Sanctuary but Unsuitable: New Jersey Governor Comes Out Against Additional Federal Flights of Undocumented Migrants

New Jersey’s Democrat Gov. Phil Murphy is pushing back on a plan to fly undocumented immigrants to his state, suggesting that New Jersey is now effectively off-limits to planned federal flights dropping off undocumented immigrants. It was a striking reversal for a politician who campaigned for office on the pledge that New Jersey will always be a sanctuary state. In 2017, he declared “We’ll be a sanctuary – not just city – but state.” However, it was easier to become a sanctuary state than a closed state. President Joe Biden’s authority trumps that of Murphy in the expected flights.

Notably, neither Murphy nor the media are alleging that Biden is “kidnapping” or “trafficking” in immigrants as has been the case with flights and buses sent by the governors of Texas and Florida.

Instead, Murphy (like other Democratic leaders of sanctuary cities and states) are simply declaring themselves effectively closed or, in the case of New York, shipping the immigrants to other cities.

There is a key legal distinction at play in these moves. States and cities can make themselves into sanctuary areas by passing a variety of laws supplying resources and easing burdens for undocumented persons. However, these federal flights can only be blocked under federal law. Presidents have considerable leeway under immigration laws and the Supreme Court has swatted down efforts by states to even enforce existing federal law. This authority preempts state authority in the area.

Murphy’s declaration followed a Biden administration disclosure of  planned flights that include New Jersey’s Atlantic City International Airport among eleven facilities to receive undocumented persons.

Murphy said that he could not see how they could accept any such flights “in Atlantic City or frankly elsewhere in the state.”

Likewise, Republican Atlantic County Executive Dennis Levinson told Politico that “I will do my best to prevent this from happening. We can’t afford it. We’re a poor county. We’re one of the poorest counties in New Jersey. It’s not a burden I can put on our taxpayers.”

That opposition is a political rather than a legal matter short of some viable challenge under federal law. That seems highly unlikely since this is an ongoing federal programs as opposed to some new policy that might be subject to APA or other challenges. The Biden Administration could trigger even greater objections if it starts to ship these individuals to other states. In an election year, Biden may be leery of such political battles in purple states.

For the moment, the opposition of Murphy will likely have greater promise as a political rather than legal challenge.

      Turnout was 11.6% by design in 1789 – the election of the Founders, the last true American election – it has been all downhill ever since.

  4. Jonathan: Ever see a chicken running around with its head cut off? I did one time. It was a shocking experience for a 10 year old from the big city. I was visiting my grandparents who lived out in the country. My grandmother told my grandfather: “We need a chicken for dinner”. My grandfather turned to me and said: “Com’on son, let’s go get a chicken”. I thought we were going to the supermarket. Instead, my grandpa took me out back to his large chicken coop full of chickens. He grabbed a chicken, took an axe and immediately chopped off its head and threw it on the ground. It ran around spewing blood from its neck and then dropped dead. At dinner that night my grandpa handed me the plate with the stuffed chicken. “Dig in”, he said. I declined saying: “Sorry, but I’m not hungry”.

    Now I mention this childhood story because what is happening in Fulton County in DA Fani Willis’s case is very much like a bunch of chickens running around with their heads cut off. DJT’s 18 co-defendants are running around in different directions trying to flee from Fani’s axe–her sprawling RICO indictment. Each defendant has a different lawyer(s) and each wants a separate trial. They don’t want any association with the bad acts of DJT. Mark Meadows, as are others, is trying to flee to federal court. Ken Chesebro and Sidney Powell are asking for “speedy trials” under Georgia’s “rocket docket”. DJT doesn’t want a “speedy trial”. He wants to delay, delay and delay some more.

    Chesebro wants to be tried alone. He doesn’t want to sit next to Sidney Powell in the courtroom because she was the really “crazy” one in the conspiracy. So he has filed a bizarre motion to sever his trial from Sidney’s. In his filing Chesebro claims he “never physically met Sidney Powell”; “never sent an email to Ms. Powell”; “never received an email from Ms. Powell”. etc., etc. Chesebro forgets some inconvenient facts. In a RICO case ALL defendants are responsible for the illegal acts of the others. Sounds harsh? Not really. Compare Chesebro’s predicament with a typical Mafia organized criminal conspiracy. One mob boss’s lieutenants works out of New Jersey. Another works in Las Vegas. Neither knows the other. The “Godfather” likes it that way. But both are part of a criminal enterprise and both are equally responsible for the acts of the other.

    So what we are witnessing in Fulton County is chaos. Defendants are point their fingers at other defendants. The fake electors are pointing their fingers at DJT: “I was only following the orders of the boss”. That’s why I predict some co-defendants are going flip. Why be a sacrificial lamb (or chicken) for the boss who won’t even pay your legal bills? The only one enjoying this spectacle is, you guessed it, Fani Willis.

Anyone from Mexico who entered the US illegally can receive a Mexican carnet which affords them the ability to do everything a passport would do. Some may not have documentation.. Seems today everyone is being given documentation at the border.

But it argued as well, with words parallel to Lincoln’s in that first address to the Congress, that “our idea is that Labor needs not to combat but to command Capital.”

              Seven years before he and Lincoln served together in the Congress (during each man’s sole term in the U.S. House) Horace Greeley—or “Friend Greeley,” as Lincoln referred to the editor in their correspondence—began the Tribune with a stated purpose: “to serve the republic with an honest and fearless criticism.” He succeeded, more wholly than any American editor before or after his transit of the mid-nineteenth century, in creating a newspaper that was not merely a newspaper. Greeley’s nationally circulated Tribune was, as Clarence Darrow aptly remembered it, “the political and social Bible” of every reforming, radical and Republican household. The Tribune was surely that for Lincoln, whose engagement with the paper would last the better part of a quarter century and eventually extend to wrangling with Greeley about the proper moment at which to issue the Emancipation Proclamation. Lincoln’s involvement was not just with Greeley but with his sub-editors and writers, so much so that the first Republican president appointed one of Greeley’s most radical lieutenants—the Fourier- and Proudhon-inspired socialist and longtime editor of Marx’s European correspondence, Charles Dana—as his assistant secretary of war.

              Greeley’s newspaper was the tribune of the agitation that spawned the Republican Party and its successful presidential campaign of 1860. Lincoln would say of the editor: “every one of his words seems to weigh about a ton.”

              This was as Greeley, an epic figure of American journalism, a political and social reformer who reveled in his ability not merely to report upon but to bend the arc of history, intended it.

              After learning the printer’s trade at the Northern Star in tiny Poultney, Vermont, Greeley arrived in New York in 1831, during the period when Fanny Wright and her allies were forging explicitly socialist political parties and movements in the city. Greeley came both to make his fortune—and that he did—and to steer the political progress of a young nation. William Seward, the radical Republican whose presidential ambitions were thwarted when Greeley switched his allegiance to Lincoln, celebrated the young newspaper editor as a Whitmanesque figure: “rather unmindful of social usages, yet singularly clear, original, and decided, in his political views and theories.”

              Greeley was what the British refer to as a “campaigning editor.” He started newspapers as platforms to promote ideas—for example, the Jeffersonian was established to advance Seward’s successful Whig Party challenge to conservative Democratic governor William Marcy, a hack of the highest order who preached the patronage gospel of “to the victor belong the spoils.” Two years later Greeley would edit a national newspaper, the Log Cabin, as the campaign journal of another Whig, William Henry Harrison, who would win and briefly hold the presidency.

          Between late August and mid-October, 1858, Lincoln and Douglas travelled together around the state to confront each other in seven historic debates. On August 21, before a crowd of 10,000 at Ottawa, Lincoln declared:17

          I have no purpose directly or indirectly to interfere with the institution of slavery in the states where it exists. I believe I have no lawful right to do so, and I have no inclination to do so.

          He continued:

          I have no purpose to introduce political and social equality between the white and black races. There is physical difference between the two which, in my judgment, will probably forever forbid their living together upon the footing of perfect equality, and inasmuch as it becomes a necessity that there must be a difference, I, as well as Judge Douglas, am in favor of the race to which I belong having the superior position.

          Many people accepted the rumors spread by Douglas supporters that Lincoln favored social equality of the races. Before the start of the September 18 debate at Charleston, Illinois, an elderly man approached Lincoln in a hotel and asked him if the stories were true. Recounting the encounter later before a crowd of 15,000, Lincoln declared:18

          I will say then that I am not, nor ever have been, in favor of bringing about in any way the social and political equality of the white and black races; I am not nor ever have been in favor of making voters or jurors of negroes, nor of qualifying them to hold office, nor to intermarry with white people.

          He continued:

          I will say in addition to this that there is a physical difference between the white and black races which I believe will forever forbid the two races living together on terms of social and political equality. And inasmuch as they cannot so live, while they do remain together there must be the position of superior and inferior, and I, as much as any other man, am in favor of having the superior position assigned to the white race.

  8. Jonathan: Now I thought conservatives were big on “states rights”? You seemed to think Govs. Abbott and DeSantis were perfectly within their rights in flying migrants all over the country because the migrants signed “waivers”. Never mind the waivers were signed under false pretenses by those working for DeSantis. In the most notorious case DeSantis flew 50 migrants that were promised they were going to Boston–but were, instead, flown to Martha’s Vineyard and simply dumped. DeSantis did bother to notify local officials in advance. It was a blatant political stunt without regard for the health and safety of the migrants.

    Now you think the Biden administration is correct in flying migrants to many different cities because federal immigration policy trumps state policy. No quarrel there. In a rare instance, why are you now supporting a Biden administration policy? Especially at a time when you think Biden should be impeached? I think I have a possible answer.

    Early in his administration DJT issued an EO banning immigration from seven Muslim countries. Trump’s policy of religious discrimination was contested in the the lower courts but the SC finally upheld DJT’s Muslim travel ban. You supported that decision. In the 2020 election campaign Biden promised that one of his first acts would be to rescind DJT’s EO. He did that as one of his first acts as President.

    So what is at play here? I suspect you hope that, if DJT is the GOP nominee next year, he will be re-elected. And one of his first acts will be to reimpose his Muslim travel ban which you favor. And then you can argue that a under Section 212(f) of the INA a president has such authority. Why? Because federal policy always trumps state policy. So as strange as it might seem I think that is why you are suddenly supporting a Biden administration immigration policy. And that’s why I think Congress needs to amend Section 212(f) to prevent any future president from using immigration laws to discriminate against immigrants based on religion.

    Sanctuary from what? Why are all these poor, desperate people, in the “millions”, flocking to the southern border? That’s the problem that needs be addressed, first and foremost .. . and I suspect the answer(s) involve powerful, far reaching geopolitical struggles going back decades.     I suspect few of these people are making such a dangerous and arduous journey to live the American dream in the ‘land of opportunity’. Most likely, many are running for their lives.

    It is estimated, e.g., more than 20 million people have been displaced in Ukraine since VP Biden gave them 6 hours to fire the chief prosecutor investigating Burisma/Hunter Biden in 2014. More than half of Ukraine’s total population.

      There is a TED Talk where they address the issue and makes a compelling argument by improving the economies in Central and South American countries, people would not only remain in their home countries but fare better rather than trying to start over in America.

In fact at the last few Democrat presidential debates the liberals on the stage argued to give MEDICARE to anyone that arrives here one hour ago. Medicare, that benefit that citizens work 40-45 years to receive as well as counting the minutes until they reach 65, will be going to all illegals before long. We already give everyone free medical care nd if you don’t believe me go to any emergency room at any time of day. We give food assistance, we give phones, we give shelter, we have NYC arguing to give all illegals work visas, licenses and the right to vote in state and local elections. We even had NYC and Mayor Adams setting up giant living facilities that actually had video gaming devices set up for the incoming people. If I want a video device I have to go buy it.

        You cannot have an open border when you are giving people free stuff. But liberals know this and that is why the border is open. They said they wanted to fundamentally change America and they have succeeded.

          I will use my family as an example of the differences between today and when my great grand parents came to this country.
          They came with only their cloths on their back and what they could carry. But they also came with legal papers of immigration. While in transit to Chicago, my grandmother was born in a box car outside of KS city. Really.
          Back then, there were no benefits. They were expected to make it on their own. Taking a hand out from anyone or the government? No! They had too much pride to do so. They worked hard. They saved their money. They paid their taxes. While they assimilated into American culture and society, they still had pride in their home country and culture. But they were thankful for the opportunity America gave them.
          Despite my grandmother only having a 6th grade education her and my grandfather attained the American dream of home ownership.

          Contrast that to what the leftist have promoted with freebies, no wonder millions want to come here. No risk, freebies for all. And under the Biden admin, unless you do something really bad, what is the worse that happens? Get deported only to return a few months later?

    But then then those border states turned the tables and called on them to walk the walk, not just talk the talk.
    Now the Biden admin is facing a crisis of their own making. How to deal with it?
    Recently residents in Chicago, not only Blacks but Hispanics were protesting the aid being given to thousands of migrants, with some calling for the city to take care of Americans first.
    Something similar happened in NYC and Stanten Island, that got violent between the protesters and counter-protesters.
    61% of Americans are living paycheck to paycheck, that is up from 59%. Americans are feeling the effects of Bidenflation and are getting angry seeing them get passed over for illegal immigrants.

    1. While I share your angst, there is a positive aspect to the emigration wave. The majority of these people want to work as opposed to a large number of the younger generation who do not see this as important. They have or want to have families who can live and prosper in a secure environment. This “should” have positive downstream consequences for the country. It won’t be recognized for twenty to thirty years as it did in the mid 1800s and the worst aspects of assimilation will occur. Of course, the presence of the modern welfare state can retard the progression but should not stop it. I remain hopeful. I also am furious at the current administration’s lack of responsibility in establishing, implementing and maintaining a secure and organized system of border control.

A ‘come one come all’ immigration policy is bad for both the immigrant and the citizenry. All of the immigrants can’t be absorbed into the labor force at once, and even if they could, we would only want those who came in legally and who have been vetted. The others must wait in line–is that good for them? If the do-gooders insist on accepting all migrants, should southern TX, AZ, NM, and CA be solely responsible for the financial, educational, security, etc. of migrants? If they’re not vetted, do you want them in your community? Until you have a family of unvetted immigrants living in your spare bedroom, you’re just a virtue signalling tribe member.

If a Republican wins the WH and/or they take the Senate and the House we will see the economy come back, we will end inflation, we will do more drilling for oil and gas, we will lower crime by actually putting bad guys in prison and not release the few that commit crime after crime, we will close the border and we will get students to pay back the loans THEY TOOK OUT, but we will never remove the 15 million illegals that will enter our country under Biden.
