Anti-Israel Statements After the Massacre Trigger Free Speech Fights in Higher Education

Universities and colleges across the country have become embroiled in a debate over free speech in the aftermath of the massacre of Israelis by Hamas terrorists this week. Various student groups have expressed support for Hamas or their cause while condemning Israel. Black Lives Matter (BLM) chapters have even shown the image below of one of the terrorists who paraglided into Israel where hundreds of civilians were murdered, including babies. Harvard has been a particular flashpoint over strident statements of condemnation of Israel immediately after the attack. The support has led to at least one firm rescinding an offer to a pro-Palestinian NYU law student as well as calls for universities to cut off support for student groups condemning Israel.

The Black Lives Matter chapter in Chicago posted the image below which was seen as support for the Hamas attacks on Israeli citizens. It was quickly reposted by many on the Internet. Other BLM chapters have also denounced Israel and supported Palestine in the expanding war.

One of the cartoons stressed “This isn’t about Hamas — this is about Palestinians right to resist 75 years of Israeli settlers colonizing their native land.”

A coalition of 31 Harvard organizations, including Amnesty International, placed the blame on Israel for the attack. The groups issued a letter to the public as a “Joint Statement by Harvard Palestine Solidarity Groups on the Situation in Palestine” on Sunday.

The “situation” in Palestine also included the reported beheading of Jewish babies, raping of women, and massacring of people at a concert dedicated to efforts to find peace.

One group described the attack as “a historic win for Palestinian resistance.” The Harvard letter accused Israel of being “entirely responsible” for the attacks:

“We, the undersigned student organizations, hold the Israeli regime entirely responsible for all unfolding violence. . . The apartheid regime is the only one to blame.”

Anger over these views has led to calls for censorship on campus and the firing of students who have publicly stated support for Hamas. Winston & Strawn LLP rescinded an offer to Ryna Workman, president of the NYU Student Bar Association, due to her role in a statement that Israel bore “full responsibility” for the attacks by Hamas.

As a private business, the law firm is not bound under the First Amendment.

However, some have gone further to discuss these views as unprotected free speech and suggested that law students holding such views should be prevented from joining the bar. Clearly, these students are engaging in free speech and, with regard to state action, they would be entitled to the full protection of the First Amendment.

The use of ideological grounds to bar law students from becoming lawyers is a dangerous practice that, in my view, would violate free speech protections. Like most people, I am disgusted by the actions of Hamas and atrocities committed in this attack. However, this country remains committed to many freedoms that Hamas and other terrorist groups have opposed. It is never easy to support core rights for those who support their denial in others, including the very right of existence for others. However, that is precisely the point. We are not them.

In my view, cutting off support for these student groups at state schools would violate the First Amendment. Doing so at private universities would violate core free speech guarantees. In the meantime, many of us will continue to support Israel and the many faculty and students who have lost friends or family. This tragedy has touched many. We have been in touch with family and friends in Israel who are safe. However, some expect to be called into service in the coming days.  I have spoken to many of our students who are facing a nightmare of not knowing whether family members were killed or captured.

The BLM and other statements obviously cause greater trauma for many in our community who are grieving those killed or captured in Israel. However, we should direct our efforts at assisting those who have lost loved ones in Israel rather than censoring others.

    Since BLM inc. now has equated itself with supporting terrorism by depicting a terrorist paratrooper (not a Palestinian civilian, but instead an identifiable terrorist), it gives the message that this business supports terrorism and the beheading of children and other outrages.

    You have to wonder how many customers are going to want to give their money to such a business since it means the company might possibly use it to fund BLM and its now pro-terrorist politics.

I also fully support corporations deciding who they will and will not hire, based on that person’s public speech. I only hope that the totalitarian leftists that support baby murder by Hamas will let those of other thinking, pro-life, pro-Israel be able to express their views as well. So far these leftists have not been willing to allow other viewpoints be expressed. That is not liberal, that is totalitarian.

  6. I pretty much agree with all of what Karen S has to say.
    I know some people want to make it racial but I disagree with that aspect. Most of peoples of the region in the Levantine are a real mix of races and ethnicities. Like the United States, there is a variety of races and groups in Israel whether they be primarily of European origin or non European. But that is also true of Muslims. I don’t feel it’s white vs color at all.
    I think the actions of Hamas are abhorrent and just remind me of the horrors of the holocaust and the murder of over 6 million jews as well as millions of others whether Romani, Slavs, “feeble minded”, or just inconvenient. This is not new. The Grand Mufti of Jerusalem (spiritual leader of Muslims in the holy land in the era) spent all of world war 2 in Berlin aiding and abetting Hitler’s war against the Jews.
    Also the UN Commission divided Palestine after world war 2 into a jewish state and a Muslim state. The Jews accepted the findings and the Muslim areas rejected it. This was voted on by the General Assembly of the UN, not the Security Council. The vote and major push for the jewish state was by the USSR, although the Balfour Declaration by the UK had also made this British policy.
    Israel was then attacked by Lebanon, Syria, Transjordan, Iraq, and Egypt. Also the Arab leadership had called for all muslims and Arabs to leave although many Jews in Israel asked them to stay. Haifa was nearly completely evacuated of muslims as well as other parts of Israel. They became stateless persons and unfortunately many of the Arab / Muslim countries around them refused to assimilate them and they have subsisted in refugee camps for 70+ years
    In spite of all of that the Harvard Students have the right to say what they said, as does the Squad, and BLM. I would simply take their names and not hire them, EVER.

      Islam and Palestine are late to the Middle East. Judaism predates them both by a wide swath of time. They have no claim to anything that Jews or Christians touched beforehand.

          It is important to recognize that the above are interpretations of Mohammad’s hadiths (sayings) but not all Muslims take them literally. If your starting point is WW2 and you want to look backward, you will find that the original plan was for the Jews to get all the areas, including Jordan.     During the pitch of BLM fever, when allegiance oaths to BLM were required in the workplace, many schools, and even social media hobby groups, I argued with Democrats that BLM was antisemitic, completely racist, and was hurting black communities. I didn’t convince a single person.

    Here we are, a few years later. Police defunded. Murder rate increased. Crime in general skyrocketing. Stores closing due to the crime, leaving communities without grocery stores or pharmacies within walking distance. Black businesses destroyed. Joblessness increasing in black communities. BLM leaders enriched, with expensive houses in white neighborhoods, and nothing to show for all that money. BLM endorsing terrorists raping and murdering Jews.

    Democrats will never take responsibility for consequences like an increased murder rate, or apologize for how they treated critics of BLM, or supporters of the thin blue line.

The failure to place the Hamas actions in historical context continues to prevent parties who could, and should bring about a just settlement between Israelis and Palestinians from even beginning such conversations. Hamas action bears comparison with slave revolts in the antebellum south, and the uprising in the Warsaw ghetto. Gaza is essentially a bantustan, as brutal as any created by South Africa. To call this a war is to make a very sad joke. Israel has, since its foundation, always had the overwhelming advantage in firepower, and has traditionally exacted a toll of 50 Palestinian lives (lives of people attempting to retain their homes and property from expropriation) for any Israeli killed, and will certainly do they same this time, since they are indiscriminately bombing Gaza, a tiny, densely populated enclave, whose borders Israel completely controls, and has closed.

    But for the exploitation of cheap Palestinian labor, Israel, I’m certain would have no qualms about a genocidal assault on Gaza, to finish the issue once and for all, since the current outpouring of support from the US and its allies, and the indifference of Arab states which the US has brought into alliance makes it clearer than ever to the authoritarian Netanyahu government (which has recently moved to erase the traditional ability of the Supreme Court to balance the legislature’s extremism in the absence of a constitution) that there would be no repercussions.

    The psyche of the Jewish people includes the trauma of the Holocaust. An entire people has horror in its history, not only of global persecution but of the Nazis killing and raping as many Jews as they could. Holocaust museums have mountains of children’s shoes, left from the gas chamber. You enter the museum and are just overwhelmed by all the little shoes. Little feet that never grew because hatred killed children. Jewish people are raised with personal stories, of ancestors lost, and the few who survived, traumatized.

    Hamas was the Nazis, come from horror stories of the past to hunt them, like the worst nightmare possible. Just like Nazi Germany, they witnessed people in US and Europe, gathering together to support Hamas’ murdering and raping Jews.

    What are we going to do about the Nazi supporters here in the US who demonstrate for Hamas?     Left Wing Democrats do not believe the Jews, of Judaism, have the right to their homeland of Judea, or the rest of Israel, which was legally created after decades of planning and treaties. Most countries on the planet were created by force. The strongest people took, and held, land. Israel was created through legal means, after the dissolution of the Ottoman Empire, which fought on the losing side of WWI. The Ottoman Empire lost the land, and Israel was created. BLM has continued its history of supporting Hamas. The Democrat Socialists of America staged support demonstrations for Hamas. The Left want way past the moral equivalence argument, that terrorists killing helpless women and babies was the same as the IDF killing mass murdering terrorists, and claimed that the Jews deserved what they got.

    The Left’s position was that the Jewish women who were raped, and the beheaded babies were asking for it.

    The Jews are the indigenous people of Judea. They are not colonizers. Their Judaic religion came from Judea. They have their own culture, religion, language, and traditions, tracing to the area for thousands of years. Palestinians are Arabs indistinguishable from any other Arab. They began calling themselves Palestinians in their fight against the return of the Jewish homeland.

    The British Mandate was supposed to be a solution to the global persecution and diaspora of the Jews, who resisted converting to Islam even under threat of death. Israel is the third Jewish state in the region, while there has never been a Palestinian state. The Romans named the area Palestine, as punishment for the Jews who revolted against Roman Imperialism. It was never a country. This sparsely inhabited part of the Ottoman Empire was to be returned to the Jews to give them a safe haven. The Nazi atrocities committed against the Jews spurred Europe to complete its promise. When the Peele Commission determined that Arabs would refuse to live in a Jewish country, then they gave 90% of what was supposed to be Israel to the Arabs, in the state of Jordan and Syria. More of Israel, the West Bank, was promised to Lebanon if it would recognize Israel’s right to exist. Jordan refused, but took the West Bank anyway. Since Jordan had not agreed to the terms, the West Bank was disputed. Arabs immediately waged war on the newborn country. Israel persevered.

    Israel has regularly offered land for peace, but Hamas, the PA, Hezbolla of Lebanon, and various other terrorist organizations refused to recognize Israel’s right to exist. Hamas’ slogan is “We love death more than Jews love life.”

    The entire purpose of Hamas’ invasion was a to kill and rape as many Jews as possible. This wasn’t a soldier going rogue, punished by his military. This was a mob of rapists and murderers, spitting on raped and dead women. They raped and sodomized a woman until the seat of her pants ran with blood, and then dragged her by the hair to a vehicle packed with more rapists. They hunted down an unarmed Thai worker, mutilated him, and then beheaded him with several whacks of a blunt shovel, shouting “Allahu Akbar!” They worship a god who glorifies in rape, murder, and beheading babies, evil acts. Hamas uploaded videos of their crimes, to the cheers of homicidal antisemites around the world, including the US.

    Let’s discuss the disparity in how rape, torture, and murder is viewed by the Left, depending on the race of the victim. One of the most tragic results of slavery is that the owners raped women slaves, and could do anything they wanted to their children. The plight of Native American women sexually assaulted by white soldiers or settlers, was held up as heartbreaking sins of the past never to be forgiven. Native American activists simply brushed off the many accounts of Native Americans kidnapping and raping white victims. The whiteness of the victims, and their existence, meant they were asking for it. They brushed off the regular practice of Native Americans keeping captured Native American women from other tribes as sex slaves. The skin color of the rapists excused the acts.

    The Left saw videos of raped, and mutilated Jewish women, and felt no pity. The Jewish women, babies, unarmed men, and dead and mutilated IDF soldiers, were white, so they were “asking for it.” They refuse to accept that Jewish people are the indigenous people of Judea, because they are white. Virtue resides in melanin, and the Jews did not have enough of it.

    The same people who wore headgear fashioned to resemble women’s genitalia, going on marches because any limits at all on the gestation when unborn children can be aborted is a war on women, supported rapists of Jewish women. They were asking for it. They also support biological men in women’s showers, locker rooms, and sports teams, and blame any woman who is afraid or uncomfortable with a male, with a penis, looking at them undress, or beating them in women’s sports. The women who have spoken out against men in women’s sports have been threatened and abused. They were asking for it, because they’re white. They strayed from the Left approved thought, so they were asking for it.

    The depravity on the Left, among all those protestors claiming Jewish women were asking for it, calling for us to remove support for Israel, for Israel not to retaliate, so Hamas will be free to kill them all, is appalling. There is something wrong with a society who calls rapists freedom fighters.

    9 out of 10 Republicans have steadfast support for Israel. We don’t think the Jews deserved to be raped and murdered. We believe they should be allowed to live in peace, without constant terrorist attacks.
