The image most of us had of former Trump attorney Jenna Ellis was a remarkably cheerful mugshot after her arrest in the RICO case brought by Fulton County District Attorney Fani Willis. Ellis made a very different appearance today in state court as she pleaded guilty to intentionally interfering in the election process in the state of Georgia. While the impact of earlier pleas by figures like Sidney Powell is hard to judge at this stage, this plea has more ominous implications for the former president.
Ellis offered a sobbing apology for her role in challenging the 2020 election and stated that
“as an attorney who is also a Christian, I take my responsibilities as a lawyer very seriously and I endeavor to be a person of sound moral and ethical character in all my dealings. … In the wake of the 2020 presidential election, I believed that challenging the results on behalf of President Trump should be pursued in a just and legal way. I endeavored to represent my client to the best of my ability…What I did not do, but I should, was make sure the facts that the other lawyers alleged to be true were in fact true. In the frenetic pace of attempting to raise challenges to the election in several states, including Georgia, I failed to do my due diligence.”
As with the other former Trump counsel, she will not face jail time and was charged with one charge of aiding and abetting false statements in writing.
As part of the plea deal, Ellis will have to serve five years probation and pay $5,000 in restitution to the Georgia Secretary of State within 30 days.
She will also have to complete 100 hours of community service, write an apology letter to voters in the state of Georgia and testify truthfully in future hearings regarding ongoing cases.
Ellis is the type of plea that tends to concentrate the mind. Powell pleaded to relatively minor charges involving unauthorized access to voting machines and areas. Those charges tend to be easy to prove. It is not clear if she would tie Trump to a conspiracy or racketeering.
Ellis pleaded guilty to false statements that could conceivably implicate the President if she claims that he was aware of the falsity and facilitated the crime. Moreover, Ellis recently broke with Trump. She called him a “malignant narcissist” who cannot admit mistakes — and said that she would never vote for him again.
The question is now whether Ellis will implicate Trump in this conspiracy. What is clear is that her plea will hold particular interest of Special Counsel Jack Smith in his parallel federal prosecution.

It is assumed she did the same with her grandfather for he was kindly to her later. Burroughs and her grandfather were killed but this courageous young woman, a girl actually, survived. The cloud of witchcraft passed before they got around to her judicial murder.
It turns out that they executed only the best among them, those who refused to confess and then accuse neighbors, though many survived by doing so. Oddly, Harvard College was behind much of the enthusiasm for killing witches. Now its Jews.

Edward: Lawyers have ALWAYS had the duty to investigate facts before advocating for them before a tribunal. Just because some whackadoodle “client” wants you, as a lawyer, to present what they claim to be “facts”, doesn’t change your obligation as the professional to vet the facts to the extent they can be vetted. That couldn’t apply, of course, to “he said–she said” situations, but this is different. This was a high-profile matter. Giuliani and Trump were publicly claiming widespread election fraud, even though there wasn’t, and stil isn’t, any proof of the things they claimed. The “facts” presented by Sidney Powell and Giuliani were just made up. Ellis, along with Giuliani and Sidney Powell, held themselves out to be the “elite strike force” that was going to get Trump elected, even though he lost in 2020. Asking that folks investigate possible election irregularities & (what Courts eventually ruled were) unlawful changes in election policies & protocols is not a crime but a duty for our public officials, yes?
The process of doing so publicly will of course lead to an opportunity for anyone to argue that, technically, 1 or more of the things you may have claimed during that process was or turned out to be technically false.
For example, “We have affidavits from experts, & even the State itself, claiming that more ballots were received by the State than the State sent out”. Turns out, this was also supported by the #s listed on the States official website, but that State subsequently corrected those #s and stated they made an error.
Nonetheless , technically speaking, the above statement is thus a false statement made by the persons who stated it in order seek investigation into the election. Does it matter that you relied on the State’s own bad info when you made that statement?
If you nonetheless have a heavily-funded DA intent on trying to imprison you for making that “false statement”, do you spend millions of $ and years in court trying to prove that you didn’t know the statement was false when you made it? Or do you just cop to what is basically a misdemeanor traffic ticket, pay a $5,000 fine, & eventually get to have your misdemeanor record expunged like the ticket never happened?

Guilt or innocence isn’t a simple proposition. For example, just because someone has killed someone, doesn’t necessarily mean they have committed a crime. There might be extenuating circumstances, like self-defense, insanity or other facts that mitigate guilt. When an attorney represents a client charged with murder, they raise whatever defenses they can to the prosecution’s case, they challenge evidence, try to impeach witnesses, but they can’t knowingly suborn perjury. You cannot, for example, like Giuliani, say that election equipment changed votes from Trump to Biden, or that the vote counting equipment was manipulated from outside of election offices to void votes for Trump or add votes for Biden, or that people voted several times, or that thousands of dead people voted, or that there were thousands of fake ballots that were counted, or that election officials threw out valid ballots for Trump, or that ballots for Biden were counted multiple times–not without some proof. You also cannot accuse Ruby Freeman and Shay Moss of bringing in “suitcases full of fake Biden ballots”. There never was any proof of these things. Freeman and Moss have received death threats due to these lies.
Gigi – when a lawyer can be proved to have knowingly misled s Court, the judge in that case has authority to levy sanctions. A separate suit is not filed by a prosecutor. This is not a contempt proceeding. It is a political prosecution in which the law plays no role.

Jonathan: It’s hard to underestimate the importance of Jenna Ellis’s plea deal in Fani Willis’s RICO case. Ellis was next to Rudy Giuliani in all the attempts to over the 2020 election. Like Sidney Powell, Ellis knows where all the bodies are buried. Now 4 co-conspirators, higher up in the food chain, are going to testify against DJT. And what is DJT’s response? He is throwing his co-defendants under the bus. DJT now bizarrely claims Powell was never his attorney. That contradicts everything he said back in November and December of 2020. Powell led DJT’s effort to try to overturn the election in courts around the country. DJT wanted to appoint Powell “Special Counsel” to oversee the usurpation campaign to have the military seize the voting machines. With the plea deals of Powell, Chesebro and Ellis, DJT won’t be able to use “defense of counsel” when he goes to trial. That defense just went down the drain.
What you don’t mention is what is now going to happen with the remaining defendants–including DJT? As more co-defendants continue to flip a single trial is now manageable. Now that the Powell,Chesebro trial is off the docket of Judge McAfee. That trial was due to last a bout 6 months. Now that slot has been freed up to permit a single trial of the remaining co-defendants. I would expect Fani Willis to file a motion to do just that.
If Ms. Ellis didn’t know, as she maintains, the statements were false at the time, then her plea must be grounded on a theory of “willful blindness,” that she failed to further investigate them before she transmitted or relayed them. “Willful blindness” supplies the intent needed to prove such a crime, if actual knowledge is absent. (E.g., buying a flat-screen TV for $200 from a guy on a panel truck who says Best Buy sells it for $2,000 and not taking steps to make sure it’s legit is an example of willful blindness. The buyer is guilty of receiving stolen property.) She said as much: “What I did not do, but I should (have done), was make sure the facts that the other lawyers alleged to be true were in fact true. In the frenetic pace of attempting to raise challenges to the election in several states, including Georgia, I failed to do my due diligence.” If that is so, how would she know that Trump knew or believed the statements were false? I think Prof. Turley is wrong in saying that Ellis’s plea could hurt Trump.
I’m waiting for Trump to say Ellis was never one of his lawyers as he did with Sidney Powell. That sound of people flipping in Georgia is getting louder and louder. The immediate pressure is on Guiliana and Meadows. When they flip, and agree to testify against Trump, some of you will accept any excuse and never acknowledge they actually committed the crimes they’ve admitted to.

Had Trump claimed he severed ties with Powell, he could have truthfully said that. He said she had never been one of his lawyers which was an outright lie. The kind of lie he’s most familiar with.
I do feel bad for Ms. Ellis. She like many others, got caught up in the hype of an obvious con man. It is good that she is now fully aware of this fact and is ready to make amends for the assisting in the single most dangerous attempt against our democracy since the American Civil War. I do question, however, why it took so long for her to see that Trump is mentally ill. It has been obvious since at least his second year in office that he suffers from narcissistic personality disorder. He is incable of being moral or ethical unless it expressly benefits him and only him. His mind simply will not allow him to act otherwise.
The pleas by Ms. Ellis, Ms. Powell, and Mr. Chesebro and those that are yet to come, are seriously ominous for the former president. It should be noted that ALL of the indictments against Trump were brought by American citizens on very real grand juries. It should also be noted that the investigative process for uncovering these crimes was not difficult. The attempt to bring in numerous attorneys, who obviously thought they could hide under attorney-client privilege (invalid when a crime is being committed), coupled with involving dozens of lay people, gave investigators a simple route to unmasking the plot.

I ANAA, but I believe these people (Attornies) are taking a plea as they do not have the money to endure a very long drawn out process and costs thereof. They can move forward with this plea solution. Our so-called legal system today has wrought that. I would say the Federal cases will take preference to Ga case. DT will extend it out long time and will continue to fight it while in office beginning 1-20-2025. That will be to the chagrin and chappying of the Dems and RINOS. More WBs will come forward. Selah

I guess lawyers are like the rest of us. They. She base her decision on how much I am willing to sacrifice to fight this ? Right /wrong guilt or innocence have little to do with anything. The system will be unfair. Until the prosecutors have something at risk.
Turkey overshoots the runway on this one. Ellis admits to not having done her due diligence. Turley says, “Ellis pleaded guilty to false false [sic] statements that could conceivably implicate the President if she claims that he was aware of the falsity and facilitated the crime.” Where’s the intent, the knowledge that such statements were indeed false when they were made? Ellis admits now, after the fact, that what she said was false but it would be a crime only if she made those statements and at the time she made them knew they were false. She said she relied on “the facts that the other lawyers alleged to be true were in fact true.” She seems to be guilty of bad lawyering, which is not a crime. Case is a farce and should be tossed.
The intent is in the guilty plea. As for DJT, if she testifies that she shared her knowledge of the falsity, or that others did, or that DJT said something himself, well . . .. None of those sounds like a bridge too far at this point. Especially not with the host of folks out there who are not defendants (yet) and who have publicly stated that the team knew the allegations about the election were false, and that the legal theories on which to base attacks on the results were largely specious. Farcical? Checks notes. 4 of the defendants have copped pleas. Yes, we all know that the leverage and the exchange and the cost of defense all favor the prosecutor, but that doesn’t make the case farcical. 2020 was DJT’s to lose, and did he ever. It never should have been that close, but he blew it. And then he gave the Senate away by telling conservatives not to vote in the runoff. Lie bad lawyering, being dumb is also not a crime, but it’s not a quality characteristic in a candidate either.
You’re making a lot of this up, my friend. People plead guilty everyday to crimes they never committed because if they don’t they might get convicted of something more serious. It’s a quasi-legal form of coercion – charge something like RICO that carries long prison sentence, add a conspiracy charge so everyone is at least as guilty as the most guilty party, and then present an eBay bidding scheme for the peripheral defendants to cop pleas and testify against co-defendants. Millions of ordinary citizens believed there were irregularities in the 2020 election, especially in Georgia where the media seemed to focus on ballots that were improperly handled. The video of this was shown over and over again and false reports of a water main break prevented the Republican observers from being present. The events described in the charges against Ellis and the others, including Trump, occurred shoertly after the election when these assertions were widely disseminated by the media. This case is nothing short of being a modern day version of the old Georgia speed trap of years goneby.
