Below is my (slightly updated) column in the New York Post on three myths being widely repeated in the Biden impeachment inquiry. These false narratives have been eagerly repeated in the media despite lacking legal or factual support. In the interest of interjecting a modicum of reality into this debate, here is why these defenses are illusory.
Here is the column:
With the formal approval of the impeachment inquiry into the conduct of President Joe Biden, the alarm and denial in Washington has reached an almost hysterical level.
Despite overwhelming evidence of a corrupt Biden family influence-peddling operation worth millions of dollars, not a single Democratic member voted for an inquiry into the allegations.
Nearly 70% of voters (and 40% of Democrats) believe Biden has acted unlawfully or unethically or both.
Yet every Democrat voted to stop any further inquiry.
Even in our blindly partisan times, that is no easy rationalization.
That’s why members are repeating three myths like a mantra on the Hill.
They’ll likely continue as the House moves to compel testimony of key parties.
When I testified at the first Biden impeachment inquiry hearing months ago, I said the threshold for an inquiry was obviously satisfied by the evidence of these massive payments and the contradictions of the president’s past claims.
Indeed, at least four articles of impeachment could be established if the House confirms critical facts.
That is the point of an inquiry: to compel not impeachment but answers. That’s why I encouraged the House to hold this formal vote.
Three myths, however, will have to be set aside.
Joe Biden did not benefit from the influence peddling
After years of suppressing this scandal, the media and even some Democrats now admit Hunter Biden and his uncles have long been involved in influence peddling.
The United States has led global efforts to criminalize and deter this common form of corruption for years.
Recent testimony from Biden associates confirmed they were selling “the Biden Brand” and Joe Biden regularly called into meetings and met with business associates.
The last line of defense has been to argue that while millions may have been sent to Biden family members in raw influence peddling, there is no evidence Joe actually benefited from the money as opposed to his children, brothers and grandchildren.
This false narrative is being repeated despite the fact courts have rejected this claim in actual criminal cases.
Not only have payments to children and other family members been viewed as benefits to a defendant, but the same is true in impeachments.
I served as lead counsel in the last judicial impeachment tried before the Senate.
My client, Judge G. Thomas Porteous, had been impeached by the House for, among other things, benefits received by his children, including gifts related to a wedding.
It’s about Hunter Biden’s addictions, not actions
Democrats are again insisting that a complex, multimillion-dollar influence-peddling operation was simply the product of Hunter being a blacked-out drug addict for years.
The argument obviously cuts both ways.
Even if Hunter was some addict thinking only about his next fix, it only highlights that these foreign figures were giving millions for access to his father, not the advice or expertise of his son.
But Hunter’s own counsel has undermined this claim by arguing in Hunter’s gun case that he had emerged from his addiction just in time to sign the allegedly false gun form.
Much of the misconduct occurred when Hunter was, by his own lawyers’ account, suddenly clear-headed and responsible.
The evidence belies claims that Hunter was not responsible for these transactions or the underlying influence peddling.
It shows a knowing, organized effort with the involvement of his uncles and, in some cases, his father.
The effort to portray Hunter as some purse-snatching junkie does not fit the evidence as he flies around the world to meet with corrupt figures and secure millions.
It’s all about Hunter’s truck
The latest myth is particularly maddening.
The House Oversight Committee released new evidence showing payments to the president out of Hunter’s business accounts.
The committee used the payments to show these business accounts were being used for personal payments and there was an intermingling of funds.
Democrats and the media immediately latched onto payments where Hunter was allegedly paying back loans to help pay for his truck.
Members told the Ways and Means Committee this was merely “a father’s love” and not anything impeachable.
It’s a cynical effort to focus on a few thousand dollars while ignoring the millions the committees detailed in months of investigation.
Democratic members make it sound like the impeachment inquiry is based on a couple alleged truck payments. It is not.
The truck payments are a handful among dozens of transfers found from these accounts to Hunter or his family members.
The point is the proceeds of influence peddling may have been used to pay back the president, who was supporting his family members.
Dollars are fungible. The money in these accounts were intermingled with personal expenses, including payments to Hunter’s father.
Once again, President Biden would be viewed as benefiting from the millions of dollars going to his family even without direct payments.
The question is his knowledge and involvement — not those benefits.
That not a single Democrat is demanding answers about this corruption is disappointing but hardly surprising.
But Biden is now facing an impeachment inquiry that will finally demand answers, not myths, on the Biden family’s influence-peddling operation.

Jonathan: I’ll get to your column about the formalized impeachment inquiry in the House but first a last comment on DJT’s claim of absolute immunity from criminal prosecution in several of his criminal and civil cases. DJT is not happy that the Judge Chutkan ruled he did not have immunity over the Jan. 6 insurrection. So he appealed to the DC Court of Appeals. DJT was further upset that the Court agreed with Jack Smith for an expedited hearing schedule so there would be no delays in hearing DJT’s appeal.
So DJT’s filed a reply arguing there should be no “rush to judgment”–that the Court of Appeals should be more “deliberative”, take a lot of time to consider the issue. Delay and delay some more. That’s what DJT wants. But the Court of Appeals set an expedited briefing schedule–to start on 12/23 and be completed by 1/2/24. DJT’s lawyers have filed a reply brief opposing the compressed schedule. And this is where it gets almost comical.
In his reply brief DJT argues that Jack Smith is the “Grinch” that is trying to steal Christmas. On page 13 of their brief DJT’s lawyers actually said this:
“This proposed schedule would require attorneys and support staff to work round-the clock through the holidays,
inevitably disrupting family and travel plans. It is, as if Special Counsel [Jack Smith] ‘growled’ with his Grinch fingers
nervously drumming, ‘I must find some way to keep Christmas from coming’…”
Lawyers on this blog will recognize that DJT’s argument is not only comical, unserious and unlawyerly but also insulting to the 3-Judge panel that is going to hear the case. The DC Court of Appeals often hears expedited appeals. They can walk and chew gum at the same time. Working through holidays is not uncommon for lawyers and the Courts. I did it many times. So the claim that Jack Smith a “Grinch” is not a persuasive legal argument–and considering DJT’s track record it’s no argument at all.
In 2020 DJT and his lawyers worked round-the-clock to overturn the results of the election. On 12/18 DJT, Sidney Powell, John Eastman and others met in the West Wing to discuss steps that could be taken to change the election results. On 12/19 DJT told his followers in a post to come to DC: “It will be wild”. On Christmas eve Eastman wrote his infamous memo about how Mike Pence could stop the certification of the vote.
So it laughable that DJT’s lawyers could now argue that working through the holidays to comply with the DC Court of Appeals compressed schedule would disrupt family plans. And I would expect the comedians at SNL will have fun with that one in a coming sketch!

Judge says no. Trump has every legal right to appeal.
And in doing so, the case stops during that appeal.
As to Trump’s appeal.. you can get a lawyer to say almost anything.
Look at Hunter’s lawyers now trying to claim that the immunity agreement is still in place.
This after, on record in court, he told the prosecutor to ‘rip it up’.
Also the small legal fact that the judge never signed off on it.
Then his latest stunt. Snubbign a Congressional subpoena.
His lawyers signed off on this? Really?

In 2020-election-related legal news today, the jury continues their deliberations in Ruby Freeman/Shaye Moss v. Rudy Giuliani (I’m looking forward to seeing how large the damages are), and Mark Meadows’ attorneys are arguing before the 11th Circuit Court of Appeals that the Georgia charges against him should be removed to federal court.

I also threw in some government data on the superb job growth under the Biden administration. Well summarized and especially the presents that were set in previous trials and impeachments. When I was practicing as a physician. I had already discerned that there were 2-3 or more rules of law in the land. We had multiple rules imposed on us about attending dinners and going on trips that were set up by pharmaceutical manufacturers or even unsolicited gifts from these same manufacturers.
This all ended 30 or more years ago for most physicians although some stubbornly continued to go to these dinners and trips. I went only to dinners where known reputable speakers talked about new drugs but never went on a trip. Even got unsolicited crystal on occasion. We stopped all of that and the group I worked for ceased allowing all drug representatives into our buildings and actively discouraged any contact.
You might say this was the right thing to do and I would agree but the downside was that a lot of information on new drugs no longer showed up at our group and samples ceased. No samples was a hardship since it was the main way we helped poor patients with their medications because of cost. Even a drug co-pay was sometimes too much for many people. Obamacare made no real dent in those same problems.
The gist of this was we stopped and yet day after day and year after year we saw Senators, Representatives and Presidents enrich themselves doing exactly the same thing and more on a vast scale with no admonitions or impairments by law enforcement or the DOJ. The federal government pushed the rules that we had to follow but apparently those rules and their enforcement stopped as soon as you walk into D.C. or on any Federal property or maybe not even there.
Congress could cease all of this but I doubt they will. There are too many trillions of dollars that flow through D.C. to hope for any self control by Congress or nearly anyone else up there. Only a collapse or dire emergency will cause change but it has to happen or we are the proverbial TOAST.
The funny thing is that Trump played mainly by the rules in financing his empire, as attested to by many financiers, in his trial in New York. Even that is not a real trial. More like a Star Chamber. Trump tried under a law that does not allow a jury trial, and basically the judge finds him guilty before even having testimony and tries to dissolve his business. Was there ever a more classic example of “Show me the man, and I will find his crime”.

I doubt that we can eliminate the history of this indoctrination of so much of our youth at this point in any painless manner but the alternative is cultural and national destruction. The most telling pieces of evidence are the bald faced lies Joe has repeatedly told over the years about his kowledge of and involvement in his son’s enterprises. Joe’s sycophants excuse this blatant lying on the gronds that lying is not an impeachable offense “otherwise every politician would be impeached.” Joe’s lies are what is called evidence of consciousness of guilt.
People’s beliefs don’t determine facts. People used to believe that the Earth is flat. Some still do. The fact is: the House has no evidence of Biden acting unlawfully.
Will the House even vote to impeach? Doubtful, unless they come up with actual evidence of Biden breaking the law.

Does anyone really believe two thirds of the Senate will vote to impeach regardless of the overwhelming evidence? Bigger question is how many will still vote for Biden assuming he is still the nominee next November.

The votes of the swamp dwellers will become campaign issues. Couple that with endorsing Biden’s disastrous social policies will cost a lot of swamp dwellers their jobs. Joe will be forced out over the holidays after pardoning Hunter and the rest of the Biden Crime Family. KH will then pardon Joe, and Obama and the rest of the swamp will be safe.

I think you mean convict. House impeaches, Senate convicts. At this point, the impeachment inquiry and/or impeachment without conviction is a better result. Voters get the facts with which to make a decision in November without having to endure a Harris administration. What I’m looking forward to is when 2024 is also won by “Biden” in another landslide. Gotta love those free and fair elections.

Why not? What does it change? If Biden actually got convicted in the senate, which is not going to happen, we’d be stuck with Kamala and Trump might be running against Newsom or Michelle Obama or a McRib sandwich, all of which poll better than jb and who could present themselves as different from the current unmitigated disaster. Republicans have a much better chance of beating jb than pretty much any other candidate. The goal is to get as much dirt as possible in the inquiry and/or formal impeachment.
Impeachment happens in the House, not the Senate. And failing to actually impeach would show that the House Republicans cannot even convince their House majority that there’s evidence of Biden having committed high crimes or misdemeanors.
