The Three Myths of the Biden Impeachment Defense

Below is my (slightly updated) column in the New York Post on three myths being widely repeated in the Biden impeachment inquiry. These false narratives have been eagerly repeated in the media despite lacking legal or factual support. In the interest of interjecting a modicum of reality into this debate, here is why these defenses are illusory.

Here is the column:

With the formal approval of the impeachment inquiry into the conduct of President Joe Biden, the alarm and denial in Washington has reached an almost hysterical level.

Despite overwhelming evidence of a corrupt Biden family influence-peddling operation worth millions of dollars, not a single Democratic member voted for an inquiry into the allegations.

Nearly 70% of voters (and 40% of Democrats) believe Biden has acted unlawfully or unethically or both.

Yet every Democrat voted to stop any further inquiry.

Even in our blindly partisan times, that is no easy rationalization.

That’s why members are repeating three myths like a mantra on the Hill.

They’ll likely continue as the House moves to compel testimony of key parties.

When I testified at the first Biden impeachment inquiry hearing months ago, I said the threshold for an inquiry was obviously satisfied by the evidence of these massive payments and the contradictions of the president’s past claims.

Indeed, at least four articles of impeachment could be established if the House confirms critical facts.

That is the point of an inquiry: to compel not impeachment but answers. That’s why I encouraged the House to hold this formal vote.

Three myths, however, will have to be set aside.

Joe Biden did not benefit from the influence peddling

After years of suppressing this scandal, the media and even some Democrats now admit Hunter Biden and his uncles have long been involved in influence peddling.

The United States has led global efforts to criminalize and deter this common form of corruption for years.

Recent testimony from Biden associates confirmed they were selling “the Biden Brand” and Joe Biden regularly called into meetings and met with business associates.

The last line of defense has been to argue that while millions may have been sent to Biden family members in raw influence peddling, there is no evidence Joe actually benefited from the money as opposed to his children, brothers and grandchildren.

This false narrative is being repeated despite the fact courts have rejected this claim in actual criminal cases.

Not only have payments to children and other family members been viewed as benefits to a defendant, but the same is true in impeachments.

I served as lead counsel in the last judicial impeachment tried before the Senate.

My client, Judge G. Thomas Porteous, had been impeached by the House for, among other things, benefits received by his children, including gifts related to a wedding.

It’s about Hunter Biden’s addictions, not actions

Democrats are again insisting that a complex, multimillion-dollar influence-peddling operation was simply the product of Hunter being a blacked-out drug addict for years.

The argument obviously cuts both ways.

Even if Hunter was some addict thinking only about his next fix, it only highlights that these foreign figures were giving millions for access to his father, not the advice or expertise of his son.

But Hunter’s own counsel has undermined this claim by arguing in Hunter’s gun case that he had emerged from his addiction just in time to sign the allegedly false gun form.

Much of the misconduct occurred when Hunter was, by his own lawyers’ account, suddenly clear-headed and responsible.

The evidence belies claims that Hunter was not responsible for these transactions or the underlying influence peddling.

It shows a knowing, organized effort with the involvement of his uncles and, in some cases, his father.

The effort to portray Hunter as some purse-snatching junkie does not fit the evidence as he flies around the world to meet with corrupt figures and secure millions.

It’s all about Hunter’s truck

The latest myth is particularly maddening.

The House Oversight Committee released new evidence showing payments to the president out of Hunter’s business accounts.

The committee used the payments to show these business accounts were being used for personal payments and there was an intermingling of funds.

Democrats and the media immediately latched onto payments where Hunter was allegedly paying back loans to help pay for his truck.

Members told the Ways and Means Committee this was merely “a father’s love” and not anything impeachable.

It’s a cynical effort to focus on a few thousand dollars while ignoring the millions the committees detailed in months of investigation.

Democratic members make it sound like the impeachment inquiry is based on a couple alleged truck payments. It is not.

The truck payments are a handful among dozens of transfers found from these accounts to Hunter or his family members.

The point is the proceeds of influence peddling may have been used to pay back the president, who was supporting his family members.

Dollars are fungible. The money in these accounts were intermingled with personal expenses, including payments to Hunter’s father.

Once again, President Biden would be viewed as benefiting from the millions of dollars going to his family even without direct payments.

The question is his knowledge and involvement — not those benefits.

That not a single Democrat is demanding answers about this corruption is disappointing but hardly surprising.

But Biden is now facing an impeachment inquiry that will finally demand answers, not myths, on the Biden family’s influence-peddling operation.

    True, he said. But they tend not to gather very often, unless there’s honey to be gained.
    And they always get it, I said. Those champions of theirs do their very best to rob the rich and distribute the trivial amount they don’t keep for themselves to the general populace.

    Their victims are forced to defend themselves, I suppose, by making speeches to the people and acting wherever possible.

    And then they’re accused by the democratic leaders of plotting against the people and of being oligarchs, even if revolution is the last thing on their minds.

    Ultimately, when they realize that the populace at large is out to wrong them, not because it really wants to, but because in it ignorance it’s been misled by the lies and slanders of their opponents, then-and only then – they do in fact willy-nilly become oligarchs, It’s not that they really want to, but the drones stings inject this poison into their systems as well, to grow inside them.
    That’s undeniable.
    And the result is that the two sides turn to arraignments, lawsuits, and trial about each other’s conduct.

    And aren’t the people always given to setting up a particular individual as their special champion, who under their caring nurture grows to a prodigious size?
    Yes, they do tend to do that.

    Democrats lost voters like me when we came to admit they had become unreasonably good liars. Senator Daniel P. Moynihan, Democrat, would be disgusted at what has become of his party. Democrats can no longer surprise ex-Democrats like me in how they make Richard Nixon look amateurish in his stonewalling with Watergate. Thus it is not surprising that Democrats today, true racists, Nazis, anti-semites, and destroyers of children, families and American institutions, defend the indefensible: the Biden Manchurian presidency. To wit, the issue of bodily mutilation of children harkens back to Supreme Court Justice Oliver Holmes in ruling Buck vs. Bell, for eugenics. The WSJ published an editorial by a gay endocrinologist on the subject of Trans, children and the politicizations therein. Dems did this to children just like the Reichstag of Nazi Germany passed the Law for the Prevention of Hereditarily Diseased Offspring in 1933.

    Most ‘Transgender’ Kids Turn Out to Be Gay

    Subjecting them to medical interventions is the modern-day version of ‘conversion therapy.’

    As a medical professional who happens to be gay, I’ll be celebrating Dec. 15, the 50th anniversary of the American Psychiatric Association’s decision to remove homosexuality from its list of mental illnesses. The longstanding designation was based on prejudice, not medical research, and the revision marked the beginning of the end for so-called conversion therapy, which sought to “cure” gays and lesbians of a nonexistent malady.

    Half a century later, the medical establishment is pushing a new kind of conversion therapy under the guise of transgender identity. No one is suffering more than gay kids. In Canada, where I practice, and in the U.S., physicians provide what’s euphemistically known as “gender-affirming care” to patients as young as 8, and the leading transgender health association has opened the door to interventions at even earlier ages. Under this framework, those who feel uncomfortable with their bodies may receive a medical regimen including puberty blockers, cross-sex hormones and sex-change surgeries. These interventions typically stunt, remove or irreversibly modify a patient’s sexual development, genitals and secondary sex characteristics. Any endocrinologist or other physician who rejects this approach is alleged to be endangering the health and even the life of his patients.

    But are these patients really “transgender”? Research shows that some 80% of children with “gender dysphoria” eventually come to terms with their sex without surgical or pharmaceutical intervention. Multiple studies have found that most kids who are confused or distressed about their sex end up realizing they’re gay—nearly two-thirds in a 2021 study of boys. This makes sense: Gay kids often don’t conform to traditional sex roles. But gender ideology holds that feminine boys and masculine girls may be “born in the wrong body.”

    In this light, “gender-affirming care” looks a lot like conversion therapy. In the past, it took the form of electroshock therapy, chemical castration and even lobotomy. Now it takes the form of rendering teenagers sterile and sexually dysfunctional for life. Clinicians from the main U.K. transgender service referred to prescribing puberty blockers as “transing the gay away”—a play on the description of old-fashioned conversion-therapy as “praying the gay away.” A clinician who resigned from the U.K. service accused it of “institutional homophobia.” Clinicians at the service had a “dark joke” that “there would be no gay people left at the rate Gids”—the Gender Identity Service—“was going.”

    Consistent with conversion therapy, physicians are telling young gays and lesbians that something is wrong with them, based on a regressive view of what it is to be male or female. Also consistent with previous efforts to cure homosexuality: The resulting interventions often create lifelong medical problems, both physical and mental. Contrary to advocates’ claims, there’s no evidence that puberty blockers, cross-sex hormones, or surgeries reduce the risk of suicide.

    Children who take this road face a lifetime of pain, infertility and anguish. They deserve real mental-health care to address common underlying comorbidities, not mind- and body-altering medical interventions that try to make them into something they aren’t.

    Fifty years ago, the medical assault on homosexuals began to end. Now society has been told that accepting transgender identity is the same as accepting gays and lesbians. But it isn’t. Even well-intentioned acceptance of transgender identity disproportionately harms them. One day perhaps professional organizations like the Endocrine Society and the American Academy of Pediatrics will follow the evidence, as the APA did in 1973. Until then, gay kids will continue to suffer from an injustice that was supposed to end 50 years ago.

      The gay community has steadfastly refused to allow research or discussion of the underlying causes of homosexuality.

      I do not have the answers, but they do matter, because the answers have implications.

      If homosexuality (and/or transexualism) are genetic – then they would be very strongly regulated by natural selection.
      They might increase as life expectancy increases, but they would decrease as birth rates decline.
      The survival of the species is not merely an instinctual driver, it is also a fact of mathematics and genetics.

      Regardless, a genetic origen for homosexuality would naturally limit homosexuality -= if not entirely breed it out.

      Conversely if homosexuality is a choice, then choices can be made differently.
      If it is a product of environment – environment can be changed.

      I do not personally have a problem with homosexuality. But I do have a problem with being deliberately blind.

        John, I have told people, including gays/lesbians, that there is no “gay community” only a “gay population”. Same applies to every other group under the sun: Americans, Jews, Asians, etc. There does not exist a monolithic gay (or American, Jewish, Asian, etc.) voice, thus there is no invisible (gay?) hand that dictates or refuses research on anything. IIRC, there was a claim made by a homosexual researcher years ago who allegedly discovered the “gay gene”. It was all falsified.

        Im not going to go into explaining genetics on this forum. It is a complex topic and beyond the understanding of most physicians never mind laymen. Homosexuality is not genetic. That which is not capable of reproducing succumbs to extinction. Homosexuality comes from heterosexuals. Heterosexuals create homosexuals. IMO, homosexuality is the result of trauma. Andrew Sullivan and I had this conversation over 20 years ago at an HIV conference. He has written as such, but I dont keep up with his writings. Regardless of the origins/genesis of homosexuality, it is a cross that gays and lesbians carry, not a choice. Most gays are regular people. Some are awful people but then again same goes for every group under the sun.

  3. Jonathan: The House impeachment inquiry is an exercise in futility. There is no chance the Senate will convict Pres. Biden. Senator Chuck Grassely, who is conducting a parallel investigation, says he has seen no evidence that Biden has committed “high crimes and misdemeanors”.

    That said, let’s discuss the actual impeachment inquiry resolution that just passed in the House. It tracks the exact language in the Dem 2019 resolution in its investigation of DJT. But the just passed GOP version leaves out some important language contained in the 2019 resolution.

    For example, the GOP version excludes the words “open and transparent”. Where the 2019 resolution said there “shall” be open hearings, the GOP version substitutes “may”. That means it is at Comer’s discretion whether to hold public hearings. Also, the 2019 Dem resolution said “The Permanent Select Committee is directed to issue a report setting forth its findings”. In the House Republican version it says Comer’s Committee “may” issue a report. Small changes but significant as to whether Comer is really interested in an open and transparent investigation.

    Months ago Comer said he would welcome Hunter Biden to testify in an open session. Now Comer has changed his mind. This week Hunter stood in front of the Capitol and said he welcomed the opportunity to testify in public. Comer doesn’t like that idea. He wants Hunter to first give a deposition behind closed doors and he “may” later have Hunter testify in open session. Comer is really not interest in “transparency”. Like the deposition of Devon Archer, Comer wants to cherry-pick the deposition of Hunter to fit his false narrative.

    What is Comer afraid of? Under House rules Comer could suspend the “5 minute rule” to permit unlimited questioning of Hunter. That would permit the truth and nothing but the truth to come out. That is what Comer is afraid of! The Comer investigation is not really about actually impeaching Biden but serving the interests of DJT who thinks an ongoing investigation of the Biden family next year will muddy the waters and enhance his chances of getting re-elected. That’s really what this investigation is about.

    2. That is not what Grassley said. He specifically state that “I’m going to take the same position I’ve taken since 2019 that all I can say is there some indication of maybe some compromise with China particularly, but I have no evidence of it.”

      With respect to Sen. Grassely Prof. Turley should add Grassley’s argument to his list of myth’s.

      There is absolutely Zero doubt at this point that Hunter and James Biden were selling influence. More specifically their ability by leveraging Joe Biden in his government role at any given time to deliver through the use of public power on the demands of their clients.

      The question Grassely raises – one that is appropriate to an impeachment inquiry, is Did Hunter and James deliver what they were selling ?

      There are only two choices – yes and no.

      If you answer Yes, you have accepted that Joe Biden was part of a bribery scheme.
      If you answer No, then you have James and Hunter committing fraud to the tune of hundreds of millions of dollars.
      AND you have to beleive that the victims of James and Hunter’s fraud never caught on.

      The democratic impeachment inquiry was NOT Open and Transparent.
      All you are doing is pointing out that democrats LIED in 2019.

      While democrats conduct has been more egregious since. The FACT is that in every matter that you raise regarding Republican conduct since 2022, Republicans have ACTED dramatically better than democrats did prior.

      There has absolutely been some retaliation against democrats – specifically for the abuses of democrats when in power in the house.
      But that has been quite small overall.

      Further – while I want Republicans to do better – because that is in the interests of the country.
      I have ZERO Sympathy for democrats – or for YOU.

      Republicans have NOT treated democrats as good government requires.

      1. John Say: You claim the Democratic impeachment inquiry DJT in 2019 was “NOT open and transparent”. Let’s look at the facts. DJT infamous phone call to President Zelensky was on 7/25/2019. The House authorized a formal impeachment inquiry in late September. The House voted to begin public hearings on 10/31. 6 public hearings were held starting on 11/13. Twelve witnesses testified. They were all “open and transparent”. A final report was issued on 12/3. On 12/18 DJT was impeached. So it took about 4 months for the process to be completed.

        In contrast Jim Comer began his investigation of the Biden family 11 months ago. His first public hearing was not held until Sept. 28. And it was not until this week that the House voted to formalize the Biden impeachment inquiry. Devon Archer, a key witness, gave a deposition on 7/23. Has Comer announced a public hearing in which Archer could testify? Nope. Hunter Biden has offered to testify at a public hearing but Comer has refused.

        Comer has held a lot of press conferences and issued subpoenas but has not announced any more public hearings. So who is hiding the ball? Who is not being “open and transparent”? It’s Jim Comer, not the Dems back in 2019!

    4. The impeachment procedings against Biden – like both of those against Trump and like the various legal attacks on Trump are ALL entirely political. None of them have any chance – nor even intention of leading to actual justice.

      It is highly unlikely that Biden will be removed by the senate.
      I would not even bet on a senate trial.

      Will all hearings be public – absolutely not. Though far more than democrats in impeaching Trump
      Nor should they be.

      But ultimately the audience for the Biden impeachment inquiry is not the senate, but the american public.

      The impeachment inquiry will be fruitless if republicans draw conclusions without persuading voters.
      And that is done in public, not secret.

      The same is true of the Trump legal battles – and that is why democrats are losing those.

      It is likely that the evidence against Biden will grow with further inquiry.
      Regardless it will not diminish and there is already enough for most of the country to vote to impeach try and remove.

      But the real impeachment trial of Joe Biden will occur in Nov. 2024 – if he makes it that long.
      And that is the jury that House republicans are appealing to.

      The same is true of the Trump trials – and those are faring far worse.
      Unlike Biden – we have all the evidence regarding Trump. It is highly unlikely that consequential new evidence will emerge.

      We will see months of fighting over procedural issues. These are getting democrats NOWHERE.
      Like Biden’s impeachment inquiry where the senate is unlikely to sit as a jury, the prosecutors, judges, are not going to empannel a jury to judge Trump.

      The Jury is already selected – it is US – voters. Trump and Biden. That is who the house and the DOJ are playing to.

      And Biden and democrats are losing the fight.

Boston’s first non-white and female mayor got caught being a segregationist when her aid sent invitations to a Christmas party for City Council “electeds of color” (don’t you love that term) to the entire City Council by mistake. The mayor then apologized…for sending the invitations to the white members!!!! No apology for having a segregated party. She went on to say that she will be having a party for the full council too. So I guess the “electeds of color” get two parties and the whites just get one.

    One bit of irony is that across the river from Boston sits Harvard where the mayor, Michelle Wu, would NOT be considered a minority if she applied there. At Harvard Asians are white, Jews are white and Palestinians and other Arabs seem to get in by the truckload, if the marches and parades are any indication.

          Over the course of my lifetime the right has changed very little.
          The BIG changes on the right in my lifetime are the significantly diminished power of the religious right,
          the significantly diminished power of neocons,
          A slight shift to a more libertarian conservative core,
          and a significant increase in the appeal to the working class.

          The latter has MOSTLY come without changing values or policies.
          It has mostly occured because the gradual rise in standard of living over my lifetime has made the working class much more successful and self sufficient and less interested in handouts than freedom.
          But there has been some GOP policy shift towards the working class.

          These are all significant changes – but they are NOT big changes.
          If anything the GOP is much more centerist than in the past.

          At the same time Democrats have moved pretty hard left pretty fast.

          After the 20th century it should be without question that socialism – even socialism light is a bad idea.
          Throughout the world over the past century socialism in all forms has FAILED.
          In its strongest forms it has failed BLOODILY.
          In its weakest, it has left nations to fall behind their peers.

          Conversely political and economic freedom have transformed positively everything in the world they have touched over the same time period.

          Yet modern democrats are not merely embracing socialism in a way that has not been seen on this scale in the US,
          but they are embracing it in fairly malignant form.

          History tells us this ends badly.

This year, Turley has posted 65 separate attacks on Joe & Hunter. JT ushered in 2023 by salivating over the prospect of “the details of one of the largest & most lucrative influence-peddling operations in history could be made public.”

    On March 19, Turley boldly proclaimed: “What is also clear is that the Bidens ran one of the most lucrative and blatant influence peddling operations in history.”

    But that bold, confident declaration quickly vanished when Turley testified under oath at the House Oversight Committee’s public hearing on September 28th. He reluctantly admitted “We simply don’t know, and we don’t even know if this was an illusion or not…whether Joe Biden had knowledge, whether he participated, whether he encouraged it.” Of course, that didn’t stop Marjorie Taylor Greene from filing articles of impeachment against Biden on his 2nd day in office. House Republicans have filed 17 articles of impeachment against Biden over the past 3 years.

    Turley insists the Biden impeachment inquiry isn’t propelled by blatant partisanship. Turley strongly opposed Trump’s second impeachment trial despite the fact that 10 House Republicans voted to impeach Trump & 7 Senate Republicans voted to convict Trump. So if House Republicans vote to impeach Biden, the American public will finally see whether or not the final vote tally is entirely propelled by blatant partisanship, right JT?

I have followed Beck and Tucker for years (free) for the same reason. Only recently did I subscribe to Beck’s BlazeTV (paid). I follow Tucker on X, which is free and only recently subscribed (paid) to his new network TCN. Like everyone else, my time is valuable. Like these 3 or hate them, I find their interviews are incredibly valuable. If JT put this blog behind a paywall, I would subscribe.

        I suppose what you’d get out of the Patel interview is largely what you’d get from his book. But to hear directly from someone that connected to the intel, naming names and how the Deep State operates, my takeaway was as important as it is to expose the entire BCF, it needs to lead to exposing the bigger syndicate controlling everything.

His young kids were being harassed in Central Park at the Strawberry Fields Memorial because their father was Glenn Beck. He lived close by, so he was there frequently.

Impeaching the guys that have created the two-tiered system of justice and getting the documentation of their corruption to the American public, before the election, is the maneuver. Impeaching the two individuals that have violated 6 congressional subpoenas a piece and committed felonies, is the maneuver. The political potshot is get Biden and what you have is, the Democrats and the Deep State coming in and saying “thank you,” we don’t want this guy to run.”

  16. I’m old enough to remember Watergate. That case – which led to the resignation of President Richard Nixon – was cracked when reporters “followed the money”. In the Biden impeachment matter the Democrats and their pals in the media are taking the position “don’t follow the money”. Don’t ask question why millions of dollars raining down on the Joe Biden’s family. I mean it’s pretty laughable. I can understand why the Democrats members of Congress are pretending their was no corruption going on, but I am perplexed – stunned – that reporters would ignore the story. Apparently Democrat reporters and editors believe that reporting the truth – that the Biden’s were engaging in pay-for-play influence peddling – would help the Republicans, so they are blacking out the story. That’s sad to see, reporters covering up corruption, but that’s what’s happening. This is why so many – including Trump supporters – refer media outlets MSNBC or CNN as the “fake” news”.

  19. I think that I can put it all in a nutshell. The IRS requires that there be documentation of loans of large amounts to family members. If it is found that no documentation is available than a gift tax of 40% must be applied. In other words, the claiming of a loan when no documentation of a loan is present for the purpose of avoiding paying taxes on the amount of payment is a Federal Crime. Both the person paying back a non existent loan and the person receiving the funds are subject to prosecution for tax evasion. It could all be settled if the Bidens would just produce a loan contract. They won’t because they can’t.
