The Three Myths of the Biden Impeachment Defense

Below is my (slightly updated) column in the New York Post on three myths being widely repeated in the Biden impeachment inquiry. These false narratives have been eagerly repeated in the media despite lacking legal or factual support. In the interest of interjecting a modicum of reality into this debate, here is why these defenses are illusory.

Here is the column:

With the formal approval of the impeachment inquiry into the conduct of President Joe Biden, the alarm and denial in Washington has reached an almost hysterical level.

Despite overwhelming evidence of a corrupt Biden family influence-peddling operation worth millions of dollars, not a single Democratic member voted for an inquiry into the allegations.

Nearly 70% of voters (and 40% of Democrats) believe Biden has acted unlawfully or unethically or both.

Yet every Democrat voted to stop any further inquiry.

Even in our blindly partisan times, that is no easy rationalization.

That’s why members are repeating three myths like a mantra on the Hill.

They’ll likely continue as the House moves to compel testimony of key parties.

When I testified at the first Biden impeachment inquiry hearing months ago, I said the threshold for an inquiry was obviously satisfied by the evidence of these massive payments and the contradictions of the president’s past claims.

Indeed, at least four articles of impeachment could be established if the House confirms critical facts.

That is the point of an inquiry: to compel not impeachment but answers. That’s why I encouraged the House to hold this formal vote.

Three myths, however, will have to be set aside.

Joe Biden did not benefit from the influence peddling

After years of suppressing this scandal, the media and even some Democrats now admit Hunter Biden and his uncles have long been involved in influence peddling.

The United States has led global efforts to criminalize and deter this common form of corruption for years.

Recent testimony from Biden associates confirmed they were selling “the Biden Brand” and Joe Biden regularly called into meetings and met with business associates.

The last line of defense has been to argue that while millions may have been sent to Biden family members in raw influence peddling, there is no evidence Joe actually benefited from the money as opposed to his children, brothers and grandchildren.

This false narrative is being repeated despite the fact courts have rejected this claim in actual criminal cases.

Not only have payments to children and other family members been viewed as benefits to a defendant, but the same is true in impeachments.

I served as lead counsel in the last judicial impeachment tried before the Senate.

My client, Judge G. Thomas Porteous, had been impeached by the House for, among other things, benefits received by his children, including gifts related to a wedding.

It’s about Hunter Biden’s addictions, not actions

Democrats are again insisting that a complex, multimillion-dollar influence-peddling operation was simply the product of Hunter being a blacked-out drug addict for years.

The argument obviously cuts both ways.

Even if Hunter was some addict thinking only about his next fix, it only highlights that these foreign figures were giving millions for access to his father, not the advice or expertise of his son.

But Hunter’s own counsel has undermined this claim by arguing in Hunter’s gun case that he had emerged from his addiction just in time to sign the allegedly false gun form.

Much of the misconduct occurred when Hunter was, by his own lawyers’ account, suddenly clear-headed and responsible.

The evidence belies claims that Hunter was not responsible for these transactions or the underlying influence peddling.

It shows a knowing, organized effort with the involvement of his uncles and, in some cases, his father.

The effort to portray Hunter as some purse-snatching junkie does not fit the evidence as he flies around the world to meet with corrupt figures and secure millions.

It’s all about Hunter’s truck

The latest myth is particularly maddening.

The House Oversight Committee released new evidence showing payments to the president out of Hunter’s business accounts.

The committee used the payments to show these business accounts were being used for personal payments and there was an intermingling of funds.

Democrats and the media immediately latched onto payments where Hunter was allegedly paying back loans to help pay for his truck.

Members told the Ways and Means Committee this was merely “a father’s love” and not anything impeachable.

It’s a cynical effort to focus on a few thousand dollars while ignoring the millions the committees detailed in months of investigation.

Democratic members make it sound like the impeachment inquiry is based on a couple alleged truck payments. It is not.

The truck payments are a handful among dozens of transfers found from these accounts to Hunter or his family members.

The point is the proceeds of influence peddling may have been used to pay back the president, who was supporting his family members.

Dollars are fungible. The money in these accounts were intermingled with personal expenses, including payments to Hunter’s father.

Once again, President Biden would be viewed as benefiting from the millions of dollars going to his family even without direct payments.

The question is his knowledge and involvement — not those benefits.

That not a single Democrat is demanding answers about this corruption is disappointing but hardly surprising.

But Biden is now facing an impeachment inquiry that will finally demand answers, not myths, on the Biden family’s influence-peddling operation.

              The two in question were participating in an election – they are essentially limited purpose public figures and they are not entitled to sue Guilliani any more than Sullivan was entitled to Sue NY Times and Martin Luther King.

              And NO You are not culpable for someone else’s fear for their lives. If the TWO had actually been murdered as a result of something said by Guilliani – He STILL could not be sued for that.

              Left wing nuts put other peoples lives at risk so many times in so many ways. There is no cause of action for this.

              This is a stupid case and a stupid decision – the Supreme court has actually ruled on a closely related issue within the past few years.

              Even if Guliani had PERSONALLY threatened these people – the threat would have to be credible, and immediate to be actionable
              Otherwise it is protected free speech.

              I doubt Gulliani is worried.

              The real question is why do we have to fight such dead bang loser cases often all the way to the supreme court because there are so many idiots trying to arbitrarily flush hundreds of years of law down the toilets.

              And both the arbitrary and the precident are relevant. Republicans have properly lost numerous defamation cases – on very close to the same facts and claims.

              The actual rule of law requires that justice is blind – not just to race or sex, or disability, or class, but also to politics and ideology.

              When the venue of a case and the ideology of the defendants matter radically to the outcome – we have the rule of man not law.

              The nation is in chaos today – even the left decries that.

              But it is Chaos that the Left has created. Because that is what you get when you can not follow the law.

      I would further note, that the court usually – and the apelate courts absolutely do not like claims of third party harm – especially speculative third party harm.

      Guilliani can be held responsible for actually defaming someone – if he did actually defame them.

      He can not be held responsible for the actual acts of third parties that he did not actually direct.
      And when you can not be held accountable for the actual acts of third parties you certainly can not be held accountable for others fear of things that have not happened.

    This week House Republicans were determined to humiliate Biden in front of the world. They not only voted for an Impeachment Inquiry, but they also cut-off Ukraine; a cornerstone of Biden’s foreign policy.

    Coincidentally these two gestures were totally encouraged by Putin’s water boy, Donald Trump. And Johnathan Turley becomes Trump’s water boy by failing to note the connection.

But in all your columns you have not pointed to one “crime” Joe Biden has committed. The repayments for the truck purchase don’t qualify.

    When you testified back in September at Comer’s first public hearing you admitted you had seen no evidence Pres. Biden had committed “high crimes and misdemeanors”–but you welcomed Comer’s investigation. Has Comer produced any evidence since then to satisfy the Constitution’s high bar for impeachment? Any evidence that Joe Biden, as VP or now as President, was directly involved in Hunter’s business activities or financial benefited from them? Nope.

    Whatever crimes Hunter may have committed he will be held accountable. His alcohol and drug addiction are no excuse. That is what the Dems on Comer’s Committee have consistently said. But whatever Hunter made from his business dealing in Ukraine or China that had nothing to do with his dad. But you make the bizarre claim that “President Biden would be viewed as benefitting from the millions of dollars going to his family without direct payments”. But isn’t that the point? Without “direct payments”, i.e., “bribes”, that Biden directly profited from his son’s business dealings, there is no evidence to implicate Joe Biden. With no evidence of “direct payments” you have no corruption.

    For months Comer has had thousands of records provided by Joe Biden–bank statements, emails, etc. Comer has all the records from the laptop. If Comer thought he had a “smoking gun” in the form of a bank statement or other record that implicated Joe Biden in his son’s business dealings, or received any direct financial benefit, don’t you think Comer would have waived it around at a press conference by now?

    After 11 months of investigation Comer has come up empty handed in trying to prove what you call a vast “influence peddling operation” by the Biden family. You and Comer have engaged in months of endless accusations, innuendo, insinuation and guilt by association. It reminds me of the tactics used by Joe McCarthy–and we know how that ended.

    But all this plays well with the MAGA crow, right-wing media and for some on this blog. And you will not give up this McCarthy-like witch hunt. I pays too well!

    3. I have followed this story for over four years, gathering data from many sources. There are mountains of reasons that this should have been thoroughly investigated by our DOJ, FBI, etc. The scandal is how these federal agencies and the news media conspire (d) in the cover up. If they did their job, this would have been hashed out years ago.

      If there is nothing to hide, they would joyfully provided every shred of evidence and all parties concerned would cooperate in every way so that they and the world can move on; they can’t and they won’t.

      There are none so blind those as those who will not see.

      1. Excellent perspective. The Democrats seem to find the impeachment inquiry unnecessary. Perhaps it would have been unnecessary if the DOJ and FBI had pursued these issues. Think for a moment about how taxpayer dollars have been squandered both by the federal government and New York State in an effort to pursue their creative legal theories in an effort to convict former President Donald Trump.

      2. The causes of the failure of the DOJ/FBI to investigate is ALSO a very legtitimate subject for the impeachment inquiry.

        Those on the left falsely claim there is not evidence. There is more than enough to prove the Ukraine bribery count.
        Is every other claim proveable beyond a reasonable doubt – probably not, but in a criminal trial it would all get in and the strength of one claim is enoguh to result in conviction on all claims.

        At this time there is no proof – and no direct evidence of obstriction of justice by Joe Biden at DOJ/FBI/IRS.

        But there is an extremely damning circumstantial case.
        And further inquiry could turn that into proof beyond a reasonable doubt.

        I have little respect fot he FBI and DOJ and even the IRS

        But there is absolutely no rational explanation for the bad handling of all these investigations
        and we are far past incompetence and well into obstruction.

      You can pretend that every single element of a crime has not been proven if you wish – but there is plenty of evidence of crimes.

      Bribery and soliciting bribes is a crime.

      Both James and Hunter Biden as well as their chronies promised their clients that for sufficient money they could leverage the power of the US govenrment to deliver their requests.

      That is CLEAR bribery and solicitation to bribery.

      You can claim if you wish that Hunter, James and company were LYING to their clients. You can claim they were committing fraud as well.
      But you can not claim that what they were offering in return for money was legal.

      Turley and some have fixated on the failure of DOJ to prosecute FARA violations – because that implicates Joe.

      But the FARA violations are low hanging fruit. None of the Biden Family complied with the requirements of FARA.
      Not even if their actions were otherwise legal.

      That said I think FARA is unconstitutional. But that does not change the fact that the conduct it attempts to constrain is corrupt and illegal.

      Hunter James and family were not being paid merely for lobbying.
      They were paid for the promise of DELIVERING the power of the US government to accomplish the goals of their clients.

      Try being honest with yourself.

      If I offer to arrange a murder for you in return for money. I am guilty of conspiracy to commit murder.
      I am guilty even if no murder is ever committed, no hitman is ever hired.

      The Biden family is INARGUABLY guilty of conspiracy to public corruption and bribery.

      The only not proven beyond any doubt at all element is did they DELIVER. That is the part that implicates Joe Biden.

      There is ZERO doubt that Joe Biden was involved in their business dealings – that ALONE makes him guilty of the conspiracy to commit public corruption.

      Rod Blogovitch was convicted of trying to sell Obama’s senate seat. Blogovitch did not actually sell that Senate seat. He was caught before he could do so. the Crime of public corruption does Not require completion.

      Whether you like it or not – we are way beyond “was there a crime”. We are also way beyond was Joe involved.

      At this time we are investigating the scale and scope of the crime.

      The slightly open questions are not are the Biden’s – including Joe guilty of corruptly selling public office.
      Nor are they was Joe involved. We are well past those.

      The outstanding (slightly) issue is DID THEY DELIVER ? and How Much did Joe Personally Benefit.

      There are also lots of niggling “little” crimes like tax evasion that are commonplace with all criminal enterprises.

      Hunter has massive tax problems because his businesses have no legitimate deliverable and therefore no legitimate expenses.

      While Businesses generally can not expense hookers and drugs. Some of Hunter’s egregious lifestyle would be a legitimate business expense – if Hunter was in a legitimate business. Like AL Capone Hunter’s tax problems stem from more than negligently failing to pay taxes.
      They are rooted in the fact that it is difficult to impossible to pay taxes on criminal profits without essentially confessing to a crime.

      With respect to “did they deliver” – a wide variety fo foreign sources do not pay millions of dollars over many years with nothing in return.

      The lawyer who paid Hunter’s tax bill – will get something in return.
      Those who bought Hunter’s art will get something in return – and not likely Hunter’s art.

      Burisma got something in return for the millions they gave to Hunter. And they were explicit about what they wanted in return.
      They wanted the investigation ended, they wanted Shokin fired.

      You and the left have reveled in the past in the claim that Shokin was corrupt.

      But there is a problem – there is no evidence that he was. Unlike the Biden’s there are not millions – or even hundreds of unexplained dollars flowing to him. There are not multiple opulent Dachas on the Black Sea. Shokin is quietly retired on a public servants pension and no more.

      The fraudulent claims that Shokin was corrupt – claims originated with Sorros affiliated NGO’s and with Biden managed FBI task forces are part of the deliverables to Burisma. Paint the prosecutor as a crook, and then you can more convincingly leverage public office to get him fired.

      Regardless – Shokin WAS fired – PROOF of delivery. One example of completed bribery involving Joe.

      The next issue is Was Joe Paid. It is beyond desputew that Hunters and Joes finances were intermingled. It is also beyond despute that Hunters Business finances and his and the rest of his families personal finances were intermingled. That alone is sufficient proof of personal benefit.

      But it gets worse – there is now nearly 400,000 in “loan repyments” going to Joe Biden.
      Pretty expensive Truck. I am not aware that Hunter bought a fleet of Semis with money borrowed from Joe.
      Is there a james and hunter Trucking in the dozens of shell companies ?

      Regardless the “loan repayments” were made from shell companies. More intermingling of business and personal funds.
