Hunter Blows Away His Own Counsel’s Sobriety Defense

There is a lot of chatter this morning about the interview of Hunter Biden with Axios before his appearance in Congress for testimony on the alleged corrupt activities of his family. The interview has powerful moments as Hunter describes his struggle with addiction and the pressure that he feels to stay sober in light of the election. However, one line stood out in the interview where Hunter confirms that he has been sober since June 1, 2019. That is notably after the date that he signed the gun form at the heart of his federal indictment.

Hunter states that his “initial sobriety date” was on May 17, 2019. That was the date of his marriage and the day before his father declared for the presidency.

The relapse is no surprise and Hunter’s struggle resonates with many in this country. His recovery is a huge personal accomplishment and the trauma for his entire family, including President Joe Biden, was obviously horrible through these years.

The admission, however, reaffirms what has long been known. Hunter’s recovery came long after he signed the form. The Firearm Transaction Record, ATF Form 4473, expressly asked if he was an unlawful user of, or addicted to, any stimulant, narcotic drug, or any other controlled substance. He answered that he was not. The date was October 12, 2018.

Previously, Hunter’s counsel Abby Lowell pushed a defense that the statement was truthful because Hunter may have been sober at that time. Lowell maintained that “at the time that he purchased this gun, I don’t think there’s evidence that that’s when he was suffering.” Lowell said that Biden had already emerged from rehabilitation when he signed the form.

That defense is further contradicted by testing on the pouch of the gun that showed a coating of cocaine.

It is becoming more and more difficult to claim a window of sobriety for the signing of the form when he is claiming that his sobriety date came over eight months later.

Hunter is now reconfirming what was obvious in his book: his addiction continued to rage until after his father announced for the presidency.

That may be why the defense is moving now to adopt some surprising arguments used by gun rights organizations and potentially challenging the gun control law that his father supports.

It would not be surprising if this interview finds its way into filings by the government as the court considers defense pre-trial motions.

          That is de facto UNQUALIFIED, not QUALIFIED immunity, and it must end. Qualified immunity is intended, in theory. to provide officials with the latitude necessary to perform their duties free of frivolous harrassment. Current practice affords almost unlimited shielding of government employees from the consequences of their actions, whether or not those actions were taken in good faith. That is a major problem in government today. If necessary, new legislation would be passed to restrict the scope of this practice to a reasonable minimum.

    Think how Dad must feel. If poor put-upon Hunter is giving any voluntary interviews, a day before his congressional testimony, I suspect he might be back on the crack right now. Quite frankly, it wouldn’t surprise me if Hunter’s legal counsel was on the sh!t too. .. the big wig Hollywood Producer pulling the strings looks like he’s been living in the Red Light district for some time as well.

    But this is all moot. Designated U.S. Attorney~Special Counsel Weiss, who has been investigating Hunter since 2018, is busy right now indicting the trusted, well-paid FBI CHS Smirnov for false allegations against Hunter (and Joe Biden) and insuring Smirnov’s iron-clad incarceration in California. Russian Intelligence is involved. .. at least until after the election.

    Why do you assume he really has recovered? Addicts are notorious for making false claims of recovery, because it is the easy way out of a conversation or situation, and many or most addicts become that in the first place because they are weak souls looking for that “easy way”. Hunter Biden seems to be even weaker and have less regard for the truth than most such persons, and has an immense sense of entitlement exacerbating those characteristics. That statement is ridiculously naive, and indicative of a huge blind spot.

Hunter’s gun violation was for possessing a Colt Cobra, a five-shot .38 caliber revolver often called a “detective special.” However, in the pictures from his laptop, Hunter is brandishing an automatic pistol that clearly is not the Colt Cobra. A trial in this case is unlikely because, in addition to Hunter’s testimony, it likely would require testimony from Hallie Biden, his deceased brother’s wife with whom he was carrying on a sexual relationship. Hallie, according to Politico, took Hunter’s gun, the Colt Cobra, and threw it in a public trash bin behind a grocery store and across from a high school. She later returned to fetch the gun but it was gone. Eventually, it was turned over to the police by an unnamed person who found it while rummaging the trash. The gun store that sold Hunter the weapon was questioned by Secret Service Agents who demanded the papers documenting the sale. The store owner refused to provide them to the agents but later turned them over to the ATF, the agency that regulates gun dealers. Obviously, even if only some of these details provable and material it would be grist for a long, embarrassing and revealing trial. Thus, a deal is inevitable but a part of that deal should be an agreement by Hunter to disclose information about the photo on his laptop in which he is brandishing an automatic pistol.

            Should be chiseled in stone. I think of California, where they are providing the homeless with new apartments. But I read somewhere that over half the homeless have drug or alcohol problems. If half the tenants are addicts, they are simply going to make life into a living hell for the other half. Somebody is getting a payoff to build them.

You know, when I was once involved in a medical malpractice suit, I was advised by my attorney to study all the records, know the medical literature that pertained to the alleged malpractice and then, before we went in for what turned out to be a 4 1/2 deposition, he told me to tell the truth, and only answer the questions asked and never give explanations, unsolicited. People love to explain and especially doctors. Obviously Mr Biden either failed to receive that advice or ignored it, probably to his detriment.
    A deposition is like a talk before a bunch of peers. If you have prepared well, then you know more then anyone in the room about the case or the subject and you should use that to your advantage, mainly by not mentioning that which you do not know or points that you do not wish to discuss. Make the opposite side’s attorneys work for their fees and the audience, if it’s a talk, should try to think and question you about points that were not clear. You can lay traps by not mentioning things in talks or depositions yet have defenses well prepared and ready to pounce if the opposition stumbles on to one of the unmentioned points.
    Lastly, family members and other relatives and close friends will lie through their teeth to protect one of their own, especially when money or a big settlement is in the possible result. Blatantly and obviously they will do this.
