According to The Jerusalem Post and other sites, an Israeli physics professor’s lecture at the University of Nevada (Las Vegas) was shutdown by anti-Israel protesters because campus police insisted that they had a free speech right to prevent him from speaking. It is a common claim made by anti-free speech faculty and students that is perfectly nonsensical. It is a rationalization to yield to the heckler’s veto.
Dr. Asaf Peer is a physics professor who was on campus to discuss black holes. However, he happens to be an Israeli, so his lecture became the target for anti-Israel protesters who stormed the event and began to shout him down. It is a common technique of “deplatforming” used by radical groups like Antifa.
The protesters accused him of studying and teaching on “occupied territory” and “spreading violent rhetoric” on his Facebook account.
There is no question that these students and groups have a right to protest. What they do not have a right to do is to shut down events to prevent others from hearing from a speaker.
Yet, the police intervened to end the lecture and escort Peer off campus. In other words, the protesters won.
The police were wrong on free speech and wrong on their own campus rules. Under UNLV’s Policy on Speech and Advocacy in Public Areas, the school maintains:
[Free speech] activities must not, however, unreasonably interfere with the right of the University to conduct its affairs in an orderly manner and to maintain its property, nor may they interfere with the University’s obligation to protect rights of all to teach, study, and fully exchange ideas. Physical force, the threat of force, or other coercive actions used to subject anyone to a speech of any kind is expressly forbidden.
I discuss this rationalization for shutting down free speech in my forthcoming book, The Indispensable Right: Free Speech in an Age of Rage.
It is now routine for protesters to prevent others from hearing opposing views and there are often allegations that some schools quietly allow the use of the heckler’s veto.
This has been an issue of contention with some academics who believe that free speech includes the right to silence others. Berkeley has been the focus of much concern over the use of a heckler’s veto on our campuses as violent protesters have succeeded in silencing speakers, including a speaker from the ACLU discussing free speech. Both students and some faculty have maintained the position that they have a right to silence those with whom they disagree and even student newspapers have declared opposing speech to be outside of the protections of free speech. At another University of California campus, professors actually rallied around a professor who physically assaulted pro-life advocates and tore down their display.
In the meantime, academics and deans have said that there is no free speech protection for offensive or “disingenuous” speech. CUNY Law Dean Mary Lu Bilek showed how far this trend has gone. When conservative law professor Josh Blackman was stopped from speaking about “the importance of free speech,” Bilek insisted that disrupting the speech on free speech was free speech. (Bilek later cancelled herself and resigned after she made a single analogy to acting like a “slaveholder” as a self-criticism for failing to achieve equity and reparations for black faculty and students).
A few years ago, I debated NYU Professor Jeremy Waldron who is a leading voice for speech codes. Waldron insisted that shutting down speakers through heckling is a form of free speech. I disagree. It is the antithesis of free speech and the failure of schools to protect the exercise of free speech is the antithesis of higher education. In most schools, people are not allowed to disrupt events. They are escorted out of such events and told that they can protest outside of the events since others have a right to listen to opposing views. These disruptions, however, are often planned to continually interrupt speakers until the school authorities step in to cancel the event.
UNLV has to make a choice on protecting this academic space for free discourse or yielding to the mob. The protesters can demonstrate outside of a room or a hall to express their opposition to a speaker. What they cannot do is prevent others from speaking or hearing opposing views. Those responsible for such disruptions should be suspended or, for repeat offenders, expelled.
A college degree is rapidly becoming a negative, rather than a positive, for job seekers.
The problem with analyzing the Democrat/Left, is that there are several pathologies, co-morbidities, and motives at play. Often, there is a reaction to cognitive dissonance, but with the subject being “black holes”, there is no anti-black hole movement that I am aware of. This is all about the messenger being a Jew. So, probably this is just simply hooliganism, and a desire to be loud and rowdy, without consequences. And the whole social group thing. Some people, it’s “Hey, let’s go to church Sunday night!” or like in my day. “Hey, let’s get together and play spades, or Risk!” For these ninnies, it is, “Hey, let’s go protest something!” They can be rowdies, and pick up Brownie points while doing it! For some, I think it is misdirected sexual energy, looking for an outlet. Others, like the actual, real-live Palestinians – it is just a chance to express their hate, and encourage others to do the same.
What scares me, is that a lot of folks in the Muslim part, aren’t afraid to die – Blacks are, to a lot larger degree. Watch videos of 3 or 4 of them doing a home invasion, or robbing a store, and when the first shot gets fired at them, all you see are white sneakers skedaddling out of there in a hurry. The same with the soy boy whites. They do this because nothing much happens to them. I do not think that you are going to see that when the Palestinians get really cranked off. I think they will stand and fight, and take as many with them as they can. I hope they are not contagious on the Left.
The protest was very pro-black holes because that’s where they are trying to send free speech.
The dumbing down is successful.
The indoctrination complete.
It’s go time for the 21st Century Hitler Youth, the Komsomol, Young Pioneers, and Little Octobrists.
A big thank you goes out to the members of the teachers unions for donating their time and efforts to “the cause.”
And a bigger thank you goes out to all the parents for donating the lives of their children.
We couldn’t have done it without you.
– Rogue Gov.
@Dawn
I wish you were wrong, but you aren’t. The fact remains that these kids show up to college already defunct, and that, much as I agree with you, is not the college’s fault. Unless we want to talk about modern parenting, I don’t know what the conversation is about. And it’s gonna bite us. This starts at home, and it is just as bad in ‘conservative’ families; there is no such thing as parenting anymore. It has lead to everything else, as we’ve had a couple of decades of it at this point. In not too much time there will be no one left to teach parents how to parent.
Liked, and I mostly agree with you, but colleges do exacerbate the problems significantly.
It isn’t the teachers unions. It’s politicians and corporate “leaders” twisting education to suit their ends. They succeeded in turning too many (though not all) schools into some sort of factory model back in the early 1900s and they are doing it again to achieve their 4th Industrial Revolution.
Someone above had a great point, the cops (authorities) never remove a liberal/Democrat, they always remove the heckler. Only conservatives get shouted down, removed, denied access or not even be invited and yet they leftist fascists (that’s right, leftist fascists) just love using their storm troopers to shut down opposition.
One fun side effect is watching dimwits like AOC, who is on record as saying “protests are meant to make people uncomfortable” being made uncomfortable in a movie theater as her beta man watches uselessly.
The anti-Israel pro-Hamas “protestors” are just Antifa, climate morons and BLM goons finding a new and hot topic. These useful idiots are paid by Soros types, supported by the CCP (notice they never protest Chinese coal plants or in front of any Chinese embassy) and egged on by Marxist professors that want the west to fail.
“It’s the [communist party], stupid!”
– James Carville
The anti-Israel pro-Hamas “protestors” are just Antifa, climate morons and BLM goons finding a new and hot topic.
TRUE
Jonathan, the problem with your expansive definition of free speech rights is that it is accommodating to militant tactics of
intimidating speakers using mob tactics.
I argue that there are ample rights of free expression without bending to tolerate these 3 purposes:
1. intentional deceit
2. intimidation / drowning out
3. urging illegal activity
I implore you to consider the needs of the polity for orderly, respectful dialog. Stop defending militant tactics that offend common norms.
@pbinCA
You aren’t defending diddly squat except your own personal notions, that is the antithesis of the ‘greater good’ in a diverse society comprised of individuals with individual needs; that you can’t see that is all we need to know. Leftists do not believe in human beings, or human lives. Take your brainwashed behind to China, Russia, or even Canada, end get your boosheet hands off of our freedom. Pbbt.
@pbinCA
PS – what you do not seem to understand is that there is no such thing as ‘expansive interpretation’ of free speech. There is NO interpretation of free speech in our Constitutional Republic. Free speech is *free friggin’ speech*, you toad. If you are too stupid and ill-equipped to combat ‘bad ‘ speech with more and better speech, that is really the reality of your own inadequacy and quite possibly, the weakness of your arguments. This is why so may say dems can’t win elections on facts or the natural proclivities of the constituency; they have to cheat, and steal. You are not devaluing that proposition with your idiot comments, and you are in the wrong place to pick that particular fight. And again, I am an independent voter, not a generational lib like Jonathan Turley, nor a conservative, who will never vote dem again, when in the past, I most certainly did. And you do not deserve to know my family history or all of the good things we participated in over the decades. Modern dems are a plague, and you pb in CA, are the thing that legitimizes that notion. My dad was born in LA 90 years ago, I know all about it, and you can pretty much bite me and everyone else here that thinks you are a tool. and you are. Your personal opinions do not constitute law or its arbitration.
James, why do you pepper your arguments with insults? I’m not a Dem. Did you stereotype me because I live in CA? I’m a conservative-leaning independent. Yeah, we’re a minority here.
It’s impossible to have a productive debate with your lame, accusatory, oppo-branding style. It’s the same tactic leftists use when they run out of merit-based argument. You write just like a leftist….not interested in discussing ideas if there’s the slightest deviation from your pre-existing viewpoint. When Turley started this site, it was mostly lawyers making comments — people skilled with words and debating ideas. It’s really gone downhill.
people skilled with words and debating ideas. It’s really gone downhill.
I have always seen you as an example of the deterioration of dialogue in the public square. No, I’m not a “skilled” attorney ala Lawrence Tribe, Joe Patrice and Elie Mystal. Thankfully I had enough brains to pursue medicine, scientific research and making medicine accessible to those on the margins of society
James described you accurately
“No, I’m not a “skilled” attorney ala Lawrence Tribe, Joe Patrice and Elie Mystal.”
Ouch! Where is Shakespeare when you need him with a:
“But Lawrence is an honorable man.”
O judgment! thou art fled to brutish beasts,
And men have lost their reason.
Marc Anthony was eloquent in Shakespeare’s Julius Cesar but i’m partial to Leonidas retort about professions and soldiers. It has much application to our national situation/demise today
pbinCA – does it matter if you are a democrat ?
What matters is that you are WRONG.
It has taken us centuries to resolve the limits to free speech. We have done so through experience.
Your arguments shred more than 2 centuries of free speech legal history. Worse they return to arguments that are both wrong and did not work.
It does not matter if you are right or left.
Many here on the right embrace their own versions of the weaponized politics of the left – more so the more egregious those on the left get. That does not make the argumnets of those on the right any better in that regard than the left.
Regardless, left and right we are free to TALK about treason by our oponents, about coups and insurrections, and big lies.
What we are not free to do is to buy actual FORCE behind those words.
You can chant “lock her up” all you want. When you act to do so. you damn well better be dead spot on compliant with the actual law.
In our words we are frree to be wrong. to lie to engage in decept/
It is not pur freedom to speak that is limited – it is our actions.
“I’m a conservative-leaning independent.”
PbinCA, you are a conservative-leaning independent who believes in eliminating free speech, which is protected by the First Amendment. You have also expressed disdain for the Second Amendment. We can find a few other amendments that are not to your liking.
What is it that makes you conservative-leaning?
Brilliant, comrade, simply brilliant!

What the —- would “Crazy Abe” Lincoln have ever done while traversing this once-free country expounding and exhorting before legions of milquetoast fools and parasites that,
“SECESSION IS PROHIBITED BECAUSE SECESSION IS NOT PROHIBITED.”
Oh, and, “That’s All, Folks!”

1 & 2, depends on who decides. deceit and lies are often in the eye of the beholder. All politicians would be locked up.
3, is codified and can be prosecuted.
Argue whatever you want.
We have spend centuries working out free speach.
The legitimacy of speech is not determined by YOUR subjective guess as to someone else’s purpose.
“intentional deceit” is protected speech.
“intimidation / drowning out” – is protected speech. The use of force or advocating for the use of force is NOT.
” urging illegal activity” -s protected speech. Inciting violence is not – and that has specific elements, it must be clear, and immediate.
At this point I don’t think it’s too extreme to say we need to even metaphorically shut down our current universities, fire everyone, and start over from scratch, or at the least create legitimately viable alternatives; it is time for the Ivy Leagues and all that follow to die, there is no value or enlightenment there, let alone education. That goes for a good number of our institutions. If you are still sending your kids to these idiot factories, I do not know what to tell you; the mentality of the students is a reflection of the mentality of the instructors and administrators. If you are paying, this is precisely what you are getting. Literally, full stop. Not a great value proposition given the absurd tuition rates of the 21st century. Think hard and think long about this. It isn’t ‘education’, and no one with a magic wand is going to tap your kid and magically make them smart, competent, kind, or skilled adults that create value in the world simply because you spent a sh*tload of money and pressured them. Experience and wisdom are not transactional; competence, salience, even savvy – these do not come with a receipt.
Your kids are no longer better off by gaining a degree that is the equivalent of an eighth grade education 40 years ago, somehow this is beginning to apply to even science or medical qualifications, which is scary, and the sepsis that has seeped in will guarantee they will pretty much live in your basement forever barring the possibility you are wealthy enough to set them up with a home. We are in deep doo doo when the enablers of the present are gone and these people have to somehow fend for themselves, and that day WILL come, eventually.
Really, really think about that before you vote this year, because unless you plan on dying in the next ten years, you are going tp have to live in that world until you do, along with everything else our dems have fomented since 2020. Unless you are rich to the point you are basically nigh-invulnerable, your status quo could evaporate virtually overnight. *Particularly* for those on the left who rely on big Momma/Daddy government to take care of them, as they do nothing to prepare themselves for self-sufficiency, and would be utterly lost even if they tried.
Cracks me up that people with solar panels think they somehow ‘live off the land’. Pbbt. You are a joke. Stop voting for the joke and use the brains inside your heads. You aren’t stupid, just asleep.
“KNOW THE ENEMY”

Meet children of the father land, Hitler’s youth camp for boys and girls.
Israel bad, Hamas good. What makes that so? Hamas is a terrorist organization that threatens the life of anyone who disagrees. That includes white progressives who think themselves intelligent when they are stupid. All the Gay, Lesbian, GBT… would be thrown off the roof to die no matter what their religion; blacks and Asians as well.
Hamas is a terrorist group that wishes to replace God all over the world. It doesn’t spare atheists either, as Hamas has its personal God, which is entirely different than the God of the three Western religions. Remember the slaughter of “Palestinians” by Jordon when the “Palestinians” were thrown out and massacred in huge numbers? Remember the “Palestinians” being thrown out of Egypt and Syria?
Hamas is proud of mutilating babies and women.

Finally, to the anti-Semites on the list, Hamas won’t spare your life either unless you are one of them, so stop being stupid.
For the rest, activity in northern Israel is increasing. The fighting is getting more serious, and a full-blown war will break out. Is that limited to Israel? No.
Iran is sending specialists and weapons to Hezbollah on a continuous basis through Syria. The Syrian military resources are being used to protect the caravans. But that is not all Soviet jets have entered the fray, so considering the war in Ukraine and Soviet jets being involved in northern Israel, this is demonstrating a widening of the war. Add to that the axis of Russia, China, and Iran, all strongly supporting one another (caused by Biden), militarily and economically, and one has to wonder if this can lead to a WW3. No parties want that, but when stupidity reigns at the head of government in any of those three places, mistakes can be the cause of war.
Oh Seth… Looks like you need a history lesson.
One of the Anon posters is kinda correct.
Hamas are descendants of Nazis.
That’s not to say that they are Germans, but that their leaders are associated w the Muslim Brotherhood who since the 1920’s have been at war with the Brits and Jews demanding a Caliphate of Arab Only Country. In the 20’s the Brits put Amin al-Husseini as the new Mufti of Jerusalem when the older one died.
al-Husseini led the Arab revolts during the late 20’s and 30’s… He then joined Hitler and his followers worked w the Nazis in Eastern Europe as part of the SS.
(Hitler wanted them to help quell the Muslims in Eastern Europe. So they were part of Hitlers Nazi Death cult. At the end of the war, they escaped to various Arab Muslim countries never facing trial for their participation in war crimes.
Arafat referred to al-Husseini as his ‘Uncle’. Not sure if they were really related but you can see that they were close. The PLO became the PA (Fatah and Hamas).
So yes Hamas are Nazis.
And like the Germans, they learned how to play the propaganda game and use it to their advantage.
Most of those who support Hamas are dupes who never learned their history. If you asked them if they support Hitler or Nazi Germany… most would look at you with disgust and then try to say that Israel is causing the problem. But that’s not the case.
These are people like Code Pink, who volunteer to support their fellow libtarded protesters without realizing what ‘From the River to the sea…’ really means, nor that the core plank in Hamas and Hezbollah is the call for the destruction of Israel.
They also don’t get it that the Temple Mount is below the mosques and therefore had to have been there before the muslims. That the jews were there first.
There’s more, but you get the idea.
To make it worse… if you were to point out that the only people who gain from the Palestinian suffering is Hamas, they look at you like you’ve been eating bath salts and have become a raving lunatic.
So yes, you are correct in your conclusions.
Just need to add more fuel to the fire.
-G
Gumby, I think you have engaged in a bit of sarcasm as fuel when referring to my understanding of the situation. I substantially agree with everything you say, except you are looking at the past defining Hamas as Nazis, which they are, and I am looking at the future and the potential of a world war where the actual Nazis have no part. Their part in genocide ended after WW2, but the Grand Mufti’s role in genocide continues through today and into the future. But where Hamas and some others are concerned, the genocide includes anyone who disagrees. The present Hamas War is not a war against Israel; it is a war against Jews and their right to exist, along with a thought in their minds of world domination.
S. Meyer
There will be Nazis in the next war.
The ideals of Hitler fit well w the Muslim Brotherhood.
Yes, a bit of sarcasm on my part.
Reality is very scary and you need to take it with a bit of humor if you plan to survive w your sanity intact,
“Reality is very scary and you need to take it with a bit of humor”
Right now, humor isn’t satisfying. Do you realize the Russians and Israeli jets had dogfights over Syrian airspace? Do you know that heavy Russian weaponry is now on the Syrian border? At the same time, American warships are pictured not far from the area for whatever reason (since we cannot know for sure).
“. . . Hamas has its personal God, which is entirely different than the God of the three Western religions.”
I’m with you on Israel (as you know).
But I don’t understand that statement. The “three” are Christianity, Judaism, and Islam. Hamas (an Iranian proxy) is Islamic. What is the “personal God” you’re referring to?
Sam, Islam is both religious and political. The violent ones should be called Islamists, Jihadists, etc. It is difficult to know who fits in that category, for even a peaceful-appearing believer in Islam who associates with Jews and others can be a Jihadist or Islamist. I have met them.
We also have a huge Islamic population that is not Arab and cannot speak or read the Koran in Arabic unless specially taught. Hamas extremism is different than many living in Arab nations, like Lebanon, Jordan and Egypt, all of which have had to throw out Hamas (PLO, Palestinians from that area.) and killed many of them without much of a peep from the rest of the world. During Black September, when King Hussein was fighting for his life, the Israelis offered to help him militarily. Fortunately the tide turned and he didn’t require Israeli help but more peaceful arrangements followed.
We say Hamas is at war with Israel over land, but that is not true. The war is a religious war where Hamas wishes to kill all Jews, even those outside of Israel. In fact, their mindset is to rule the world, something that will never happen. Generations of children at five or possibly younger were taught to kill Jews and think of them as subhuman. Parents relish their martyred children, whose, deaths provide them a higher standard of living than others. In the meantime the leaders take pleasure in discussing the barbarism of Hamas fighters.
I think the only solution other than moving Gazans from Gaza is to do what MacArthur did in post-war Japan. They, too, were willing to die. We are now allies of the Japanese. I don’t think we can be as successful with the Gazan, but I think today it is proven that the only way to end 75 years of war is to do exactly that and hope future generations will love their children more than they hate Jews and other non-believers.
Has UNLV learned nothing from their town? UNLV needs avoid such high profile circumstances and stick to what Vegas does best in a fake world: run low profile government sanctioned rigged games.
When you are dealing with people that simply exist to play the victim card, it is best to inflict upon them the greatest amount of force to allow them their full victimhood – Sun Tzu
I recently viewed a video of AOC being heckled at a public event no one removed her but they removed the heckler. I’ve seen this on a number of occasions when a democrat is heckled they don’t remove the democrat but remove the heckler. The police at ULV indicated they couldn’t remove the hecklers because it was a public event, so they removed the invited guest. Seems kinda as backwards and inconsistent?
Its the path of least resistance.
You remove the group heckling, you’ll have a riot.
You remove the speaker… they aren’t going to protest and its one person.
What you need to do is to remove the hecklers. Arrest them… ticket them so you have their IDs.
If they are students… expell them for violating code of conduct rules.
Do that enough times… the problem goes away.
If they aren’t students… arrest them for trespassing.
Again the problem is that they don’t want to do their job so they take a short cut at the speaker’s expense.
. . . academics who believe that free speech includes the right to silence others.
These “academics” are blithering idiots who say nonsensical stuff like “is the juice worth the squeeze?”
If shouting someone down and preventing them from speaking constitutes free speech, then burning someone’s church and preventing them from worshipping constitutes religious freedom . . . IOW, only in opposite world.
Contra the left, the deep state, … various forms of censorship – even of so called disinformation of misinformation do nto improve society. They make it worse.
It is extremely odd given the multiple examples such as Covid that we should not understand that right now.
The entire west made extremely poor policy decisions regarding Covid that have harmed us. The major factor driving those poor policy decisions was the massive effort to censor diminishd, and discredit those that tried to point out that what we were doing was wrong, was not going to work, and was going to cause more harm than good.
This is not a covid specific anolmalie.
Contra those on the left – our society is not negatively impacted by bad influences.
We need not fear hostile foreign countries spreading disinformation – that has very little effect and almost eclusively on the far fringe.
But efforts to thwart that have significant negative effect on all of us.
We cna not know, that what we know is right – and it nearly always is not perfectly right, unless we allow those who we beleive are wrong to make their best arguments.
Making tyranny acceptable, in small doses. The libs have been screaming at lecturers, for years. The pro hamas /anti Israel mob, puts fear in the campus rentacops. They cave to the mob. Siting some ones right to stop someone else’s right to speak, is nonsense and absurd. “Anyone who can make you believe absurdities can make you commit atrocities.” Voltaire
I would of wanted to hear the discussion on his thoughts on black holes.
Really. No sarc implied.
When you debated Prof Waldron you should have brought a couple dozen loudmouths with you to interrupt him every time he tried to speak. Do a little hands on example of the professor’s position in action.
Look, we all know that what had been considered institutions of higher learning have become progressive, marxist indoctrination centers. How anyone would send their child to one of these is beyond me to begin win. Reporting about the egregious actions at these cesspools of bad ideas only reaches those of us who already understand this catastrophe in American education. The time is ripe to actually take action both politically, financially, and publicly to remove the infestations currently within the system. The bigger and more difficult problem lying before us is what to do with so many generations of misled, misguided and brainwashed young people – I don’t think there is a way to deprogram them but what to do with these barely functioning humans until they age out. They are no societally functionable, they have little ability to coexist within a civilized society and they lack, for the most part, the simplest means of curtailing their immediate and childish emotional responses. How will we be able to maintain civilization without our younger generations being competent to live within the ethos of what was America before obama and the progs f*cked it all up.
In yielding to the heckler’s veto, UNLV must have channeled Neville Chamberlain. And Chamberlain’s actions did not end that well.
Free speech ISN’T shouting people or interfering.
Free Speech “peacefully assemble”.
The former people should be ARRESTED for harassment…which isn’t FREE SPEECH!
@guy
Precisely. We have done a real number on younger generations that don’t understand anything whatsoever, let alone common decency. I can tell you from my wife’s current crop of eighth grade students: they can barely tap a phone, let alone think or perform; when they are frustrated, rather than parsing it out they resort to violence. We are headed for something very ugly if we do not reverse course *right now*. The leftist comment bombers do not seem to realize they are going to have to somehow live in the future, just like everyone else, and that the seeds of the future are unfolding NOW. The smashed windows WILL be in Harlem, or Martha’s Vineyard, or Santa Barbara. It is insanity. Pure, unadulterated insanity, like seeing you are about to drive over a cliff, and saying, ‘Meh, whatever.’.
But these kids have ben raised to simply expect their privilege as a right, or even a norm, like blue or brown eyes, and that the rest were just unlucky or beneath them. Let us not make the same mistake we made with the millennial generation, somehow expecting them to become self-realized human beings all on their own.
