Scottish Minister Doubles Down on Anti-Free Speech Law

There is global criticism of the new anti-free speech law in Scotland, including a dare from author J.K. Rowling to arrest her for her criticism of transgender policies. The law is so bad that even the British Prime Minister, in a country previously denounced for attacks on free speech, has demurred from supporting the Scottish law.  Now Humza Yousaf, first minister of Scotland, has doubled down in supporting the draconian law while misrepresenting its language.

Yousaf bizarrely claimed that critics have ignored that the legal threshold of “the new offences is very, very high indeed. Your behaviour has to be threatening or abusive and intended to stir up hatred.” It is almost comical in its absurdity. No, a standard based on “stirring up hatred” is not very very high. Moreover, the showing can be based on a showing that stirring up hatred was “likely” rather than “intended.”

In signature form, Yousaf reportedly then lashed out at critics like Rowling and Joe Rogan as  “right-wing actors” who have “[no] sympathy for the fact we are bringing in legislation that is clamping down on hatred.” He insisted that this is merely an extension of the fight against “disinformation.”

The critics include virtually the entirety of the free speech community. Rowling’s objections to transgender policies are rooted in her feminist principles and the concern over the erasure of the gains of women generally.

By declaring opposing views as hateful, many on the left like Yousaf seek to shutdown any debate through a chilling effect on speech. Many do not want to face the cancel campaign or abuse directed against Rowling, who has the means and the following to weather this storm.

The Scottish law is a disgrace to the nation, which once distinguished itself in the Scottish Enlightenment as a haven for free thought.

  1. OT – an article in Politico, published on its website yesterday afternoon, discussed tactics being used by the DNC to undermine RFK’s campaign. These tactics include the use of trolls to plant fake stories on the Internet and picketing his campaign events. The title is something like “Democratic Party Tactics against RFK Rattle His Campaign”. I’m sure there will be a protest from the MSM against this undemocratic conduct.

  3. I find Professor Turley’s essays invaluable and enlightening, including this one. He often refers to to free speech issue being worse in Europe than in the US, which for the moment, I agree with. I submit that there is only one reason for that – the fact that the current US Supreme Court majority is conservative. If and when the supreme court majority becomes liberal/progressive (like one more Biden term), the right to free speech in the US will disappear so quickly that you won’t know what hit you. We will equal or surpass Europe in censorship beginning the day that majority becomes reality. And when free speech is gone from the US, the whole world will suffer the consequences.

    For some, the cure for perceived “disinformation”— is to diss information that offends you, through censorship or criminalization.
    Interstingly, Yousaf is a Pakistani Muslim, and Islamic belief says this: “Evil speech interferes with the discovery of truth and thus violates human dignity. Therefore, restricting evil speech is justifiable on freedom of expression.”

Most, if not all, European countries have laws relating to speech, some of them quite harsh.   12. J.k. Rowling, to her credit, highlighted the chilling nature of this law. And yes, she did it from the focus of protecting the rights of women from dysphoric and fetish driven men.

    Interestingly, but not necessarily surprisingly, none of the major women’s groups supported Rowlings. They are completely on board with men defining what a woman is, their right to become a woman merely by declaring it to be so, and their right to women’s spaces and opportunities.

    Many of the news reports have highlighted how Scotland does not have a first amendment like we do. This is correct, but when it comes to gender lunacy our first amendment does not seem to be recognized. Try going on CNN, MSNBC, ABC, NBC, CBS, or before the NYT’s or WP and telling them that men cannot become women, cannot have babies, and that chest feeding isn’t the same as breast feeding. That wouldn’t go over well. While they are not government entities, the same would be true if you made those statements before any democrat politician.

    So this issue is more than about freedom of speech, it’s about placing objective reality above gender lunacy.

One would think with their history they’d recognize the parallels with what lead to WWII, but alas, we no longer teach history, anywhere.           James. the second term has its dangers, for with no ability to run for a third term, the President can pull out all the stops. Obama did that, but that tendency must be recognized before the second term. We saw Obama’s tendencies before his first presidency in his books, the people he associated with, and where he came from.             So right. This was probably clear to anyone that read Obama’s book, but I was unfortunately not one of those. The fervor was so high at the time, I don’t know if it would have mattered in meaningful terms, anyway. I recall perfectly well how people treated Sarah Palin (was not a fan of hers, I’m not a conservative, but she has not deserved what has been done to her) back then, and it has only gotten worse. Exponentially, catastrophically worse. I recall the intraoffice conversations going on around me at the time, in a blue state, that basically turned my stomach and made me embarrassed to be in the room with such cretins (the focus was entirely on their own prejudice, not the future of the country, blue or red); that was 12 years ago. And here we are now. I would love to see an example of an independently thinking, modern, blue voter. There don’t seem to be any. All these descriptive ideologies are in flux, meaning different things to different people. It is not good enough to say one’s ideology.               I was born a Democrat but voted independently. I became a Republican to support a specific individual. I then changed to independent only again to turn Republican to add my voice to the nomination of Donald Trump. I will probably remain Republican while he is in office, and then I will see. I will never be a Democrat again and likely will never vote for a Democrat candidate whether I like him or not. The Democrat Party of today is too dangerous. It must be destroyed and rebuilt so that it no longer is a party of fascist anti-speech fanatics against the voices that differ from their own while they knowingly lie.

              The Constitution is our anchor, and Amending the Constitution is our method of its evolution. Those who prefer SCOTUS, Congress, or the President to change the Constitution to get what they want do not politically reflect the type of people I side with. I also believe in federalism, where the states act as laboratories and adopt policies that are best for them. I can live with most laws even if I disagree with them as long as those two things are adhered to.

                What it means to be a republican or a democrat IS in a state of flux – and that is legitimate, because political parties are not defined by ideology or policy. They chose the policies they seek to advance and they choose differently over time.

                One of the reasons that Turley is being slowly red-pilled is because the meaning of liberal and democrat has shifted such that it no longer includes him.

                The democrat part of that I can understand, but conservative, and liberal have meanings independent of political party and ideology – though they are also used as labels that are divorced from their meaning.

                I am a proud liberal – I am someone who embraces individual liberty as a principle.
                In the shifting sands of word mangling the correct label for that today is libertarian.

                Conservatism is NOT an ideology, it is a recognition of the fundamental fact that most new ideas FAIL. That 9 times out of 10 the framework of the past is superior to any new ideas.
                But 9 times out of 10 is NOT 100% of the time. Conservative does NOT mean we must stay were we are, or that we must go backward. It does mean we should be skeptical of new ideas – especially those imposed by force that will be difficult to undo once imposed. It does not means we must reject new ideas solely because they are new.

                The free market means that anyone can try whatever new ideas they wish – most fail, but those who succeed reap the benefits of that success – rinse repeat. The net effect is that even though failure is far more common than success because the process can be conducted so freely and rapidly – the net result is improvement – often rapid improvement.

                Government is different – As Reagan said mans ideal is the ultimate in human freedom consistent with order.
                We can have chaos in free markets – it is self regulating there. We can not have chaos in government – in the use of force.
                The failure we are seeing today IS exactly that – the degeneration fo government into the chaotic use of force.
                That is one of the deep flaws of the modern left – they seek to destroy the entirety of the western enlightenment that produced the world that we have today, But they are entirely clueless about replacing it. Everything is Chaos.

                The “What is a Women ?” attack on the left is damning. It exposes an inherent contradiction – not just with reality – but with their ideology itself. While proclaiming that identity is subjectively determined – there ideology is still founded on the conception that their are oppressed and oppressor identities. As many people have effectively demonstrated the ideology collapses into incoherence when the oppressors identify as oppressed.

        People learn more from failure unfortunately than success.

        I am still trying to gauge what is actually going on with Generation Z. But there are many signs that the Woke generation is being followed by the most conservative generation in our history.
        No matter what the pendulum is swinging away for the woke left.

        I do expect political violence. I expect it from an increasingly desperate left as they lose power.

          John, I agree, but such considerations are a matter of degree and circumstances. I would target one RINO, maybe more, but I would try to avoid the worst consequences. In the present case, we are dealing with a presidency. Obama should never have been elected President the first time based on his history and what was known. Unfortunately, he was elected, and when running for his second term, one could see an existential threat to the nation if he won that second term. Too many people dilly-dallied and didn’t vote or voted for a third party. We got the devastating results of a fascist-style President who weaponized the bureaucracy. When through with his second term, people were willing to provide the country with his third term, Hillary Clinton, aided by those who continued to dilly-dally and again didn’t vote or voted for a third party.

          Fortunately, despite those who held your position, there was enough sanity for a Trump win. Whether Trump was the most outstanding or reasonable President didn’t matter; the country improved and moved away from the fascism Obama provided. Destroying a nation takes less time than building it up, so some seek refuge in their decision by saying Trump didn’t do enough and still refused to vote against the Obama policies when Biden ran.

          We have seen enough destruction to our nation from the left. I don’t think the damage can be repaired, but now we have a new election where the choice will be Obama’s fourth term under Biden, or we vote for Trump no matter what pains that causes us. We know Trump will move in a good direction. He is the best we have. Take note of who and what is attacked by the fascists who follow Obama-Biden. Parents of school children, religious people, free speech, medical choice etc. Look at the world! There was peace under Trump, and today, all we can see are wars widening, which can become an existential threat to humanity.

          Yet some find their peculiar interests and hurt feelings more important than survival. That is a poor choice, and it has led to war and the disintegration of nations in the past.

          You like to look at things with an indefinite time frame that can be longer than my great-grandchildren’s grandchildren’s lifetime. That is not good enough. The United States is a fluke where many random things came together to create this great country. One cannot count on it being made again in a reasonable time. You also think of the ups and downs as equal over time, but the idea of entropy enters the equation. In this case, the flow of positive energy, because it is more significant than elsewhere, is in the wrong direction, so the ups are the lesser and the downs greater. Your rigid policies lead to the downfall of great nations.
