While pundits, politicians and the press have long expressed outrage over attacks on judges by former President Donald Trump, many are now attacking any judge who delays any trial of Trump before the election. Democrats have accused Judge Aileen Cannon of being politically compromised, if not conspiratorial, in her delay of the Florida trial over the mishandling of classified documents. Yet, there is ample reason for the delay that many of us anticipated in this type of case when it was filed.
For months, many of us have said that we doubt that this type of trial could be held on the rapid schedule demanded by Special Counsel Jake Smith. Smith has repeatedly sought to curtail trial review and even appellate rights of Trump to advance his schedule.
His office has made convicting Trump before the election the overriding objective of its motion — a sharp departure from past Justice Department efforts to avoid trials to influence elections.
As a criminal defense counsel, I have handled classified material cases and they are notoriously slow. Smith could have prosecuted this case in the shorter time frame if he simply charged obstruction. That would have also eliminated the glaring contrast with the handling of the Biden investigation into the current president’s retention and mishandling of classified material.
Smith decided to charge an array of document charges related to classified material. The defense must have access, review, and can appeal issues related to the classified procedures. Yet, Smith wanted both the array of document charges and a fast track to trial. The Supreme Court has agreed with Cannon that Smith’s desire to secure a conviction before the election is not the overriding consideration.
Judge Cannon is faced with recent admissions that the government mixed up files in the boxes and staged the famous photos of documents strewn over a floor with classified jackets. Most importantly, disputes over the relevant documents continues as expected in the case.
Nevertheless, leading democrats are denouncing Cannon as a partisan hack.
Sen. Sheldon Whitehouse (D-R.I.), the chair of the Senate Judiciary Committee’s subcommittee on federal courts and oversight, accused Cannon of “deliberately slow-walking the case.” Ignoring the fact that similar cases have taken much longer to go to trial, Whitehouse simply declared “it is hard for me not to reach the conclusion that this [judge] is deliberately slow-walking the case to put it into a position where should [Trump] be elected, he can order that the investigation and prosecution be terminated.”
His colleague Sen. Chris Coons (D-Del.) insisted that Cannon was “managing this case in a way that is making it highly unlikely that it will be resolved in a timely fashion.”
Coons added “Justice deferred is often justice denied.” It is a bizarre statement. Classified documents cases routinely take longer to go to trial. The alternative is to cut off the ability of the defense to fully review the documents and review objections for resolution before trial. Yet, because the defendant is Trump and these Democrats want the trial to influence the election, such defense protections are now evidence of judicial bias.
They, of course, ignore that Cannon has ruled repeatedly against major Trump motions in the case.
Sen. Peter Welch (D-Vt.), a member of the Judiciary Committee, said Cannon’s “at it again, doing everything she can to delay.”
Sen. Richard Blumenthal (D-Conn.), offered the most telling line. He said “I question whether this judge understands the magnitude or the legal import of this trial.”
Indeed, it is the timing as much as the charges that makes this so important to the Justice Department and the Democrats. Smith has crafted this case to impact the election and the failure of the court to support that effort is apparently grounds for recusal.
Blumenthal called for such a motion before the window is lost before the election: “It’s a classic dilemma for justice that a particular judicial officer may be conducting a trial that could be better done by somebody else.”
Despite the statement of his colleague Coons, this is a case where justice delayed is justice.
They are panicking. By the time the former President comes through this disgraceful and shameful misuse of legal warfare, he will likely have spent more time in a courtroom than a seasoned attorney. Exaggerating a bit.
They are scared. When he is President again, he will not forget their “hospitality” and “kind” treatment they have shown him over the past four years. They will receive only the funding required by law and will find no favorable treatment otherwise.
Either way, the next four years will be interesting times. I do not put it past the radical hard left to employ slash and burn on their way down.

The haste of Jack Smith, the Biden DOJ et al in trying these cases is in itself proof that they are politically motivated and is ample reason to delay all these trials until after the election.
Prof. Dershowitz, who is often a voice of reason, pointed out that the Stormy Daniels case would likely be successfully appealed even if it were to result in a conviction. There is only one response that comes to mind: “No sh– Sherlock!”
The demons know that perfectly well. They don’t care. What happens after the election is completely irrelevant. They don’t care if angels come down from the sky and fly Trump around the Statue of Liberty on a celestial ticker tape parade – as long as it happens on November 6 or later.
Their hatred of Trump is not really hatred of Trump – it’s that Trump is a little tiny piece of grit gumming up the machine that is taking this country on a one-way path to a totalitarian slave state. If they throw him in jail for the rest of his life, or if he has an unfortunate accident when no one is looking, or if he simply lives out the rest of his life at Mar-a-Lago as an irrelevant has-been, it’s pretty much all the same to those trying to destroy America. They will have accomplished their purpose. Because after this election, it’s over. The fact that these cases are garbage (beginning with the E. Jean Carroll travesty) is irrelevant. What matters is the sound bite. The visual images of Trump in an orange jumpsuit. The headlines screaming “TRUMP FOUND GUILTY.” What matters is that Joe Average will say to Mrs. Joe Average: “Gee, Trump is worse than Biden, better vote for four more years of dumpster fire.” Except it won’t be four more years like these. The past four years will seem like Camelot compared to what awaits us if Biden “wins” another election.
Kudos to Judge Cannon, the Lord’s Cannon of Justice, blasting some constitution and some law into a process that would make any self-respecting banana republic blush.

Today’s fight for power has many people who are not leftists or Democrats supporting the “regime.” Understandably, the Democrats and Left do, but what about all the government employees who are not Democrats but follow the Left because it benefits them? How about all those on welfare or other government assistance, some of whom cannot find the USA on the world map? We cannot forget Republicans who don’t want to expose their dirty dealing. Irony of ironies. This case is premised on the notion that these documents were unsafe in the hands of Donald Trump. But they are really unsafe in the hands of the FBI and DOJ. They published photos of the documents after seizure. They leaked information from some of the documents soon after seizure. They have now mixed them up. Heaven only knows what manner of people have had access to them since seizure. Maybe Donald Trump should organize a raid to seize them back
The other issue is the deliberate prejudice to Trump’s right to a fair trial. Charges should be dismissed on this basis alone.

Strange but the more they keep Trump from campaigning, the higher his polls go. Even juries in predominantly Democrat run cities can no longer be trusted to render fair, impartial judgments in cases even remotely connected to politics. We saw that with Sussman. Just open and proud jury nullification based entirely on politics. Who believes a Natacha/Gigi, Dennis, Fishwings, Justice Holmes could possibly sit as an impartial juror in a case even barely touching on politics? They are not outliers. They fairly represent most “progressive” Democrats.

Many predicted a war if he moved the troops, yet he did so and war didn’t break out. This successful outcome, which averted a potential conflict, is a testament to Trump’s responsible decision-making.
He took clear responsibility for that action and succeeded. No credit was given but he was accused of potentially starting WW3.
Cannon is slow walking the case. She has already gotten smacked down by the appellate court twice. She has issues a number of bizarre rulings and has refused to issue opinions on even routine matters. There is also evidence that she is taking bribes.

Cannon has set June 21 for a hearing on whether Smith’s appointment and funding are lawful. Meese, Mukasey and Calabresi have argued in amicus briefs and articles that his appointment violated the appointments clause because he is in effect a principal officer but was not approved by the Senate as required. Justice Thomas asked Trump’s counsel about this in the immunity case oral argument. If Cannon rules against Smith that could end both of the Smith cases, subject to appeal.
