Human Rights Campaign President Calls for Rejection of “the Little Piece of Paper” of the Founders

We have been discussing Democratic leaders and activists who have been calling for revolutionary change and a rejection of the foundation of the American constitutional system. The latest is Human Rights Campaign president Kelley Robinson, who spoke at the National Democratic Convention. In an earlier speech, Robinson rejected what she referred to as the Founders’ “little piece of paper” and called for the reimagining of our constitutional system.

The voices calling for radical change have been growing for years, including among law professors and legal commentators.

Viewers now get a steady diet of figures like MSNBC commentator Elie Mystal who called the U.S. Constitution “trash” and argued that we should simply just dump it.

In a New York Times column, “The Constitution Is Broken and Should Not Be Reclaimed,” law professors Ryan D. Doerfler of Harvard and Samuel Moyn of Yale called for the Constitution to be “radically altered” to “reclaim America from constitutionalism.”

Georgetown University Law School Professor Rosa Brooks went on MSNBC’s “The ReidOut” to lash out at Americans becoming “slaves” to the U.S. Constitution and that the Constitution itself is now the problem for the country.

I was recently called for a response to Robinson’s call. Yet, it is not clear if Robinson is speaking about the Declaration of Independence or the Constitution as that “little piece of paper.” However, she insists that “[i]n this moment, we’ve got to reimagine it with people that look and love like us at the center.”

Robinson added:

“And I think for us right now is about reimagining freedom and this American story in a way that is more revolutionary than what our Founders actually put down on that little piece of paper, but instead is the type of democracy that is by and for all of the people in this country. That’s the opportunity that we have.”

Her comments did include positive views of the progress made under the current system:

“The story of America is the story of progress towards freedom. In just a few generations, my family went from being enslaved in Mississippi to the first free Black family in Muscatine, Iowa, to preparing to elect President Kamala Harris. Progress is happening my friends!”

As someone who has supported LGBT rights for over four decades, I have nothing but admiration for those who fight for equal rights for everyone to be able to live their lives according to their own values and associations.

However, a radical “reimagining” of our constitutional system is a popular and growing call on the left. It is often left vague in terms of what such a reimagination would entail, but suggests structural, not just policy, changes.

It is that “little piece of paper” that has secured the equal rights for members of this community.

Assuming that the “little piece of paper” is a reference to the Madisonian constitution, it is a “type of democracy” that has proven the oldest and most successful constitutional system in the history of the world. It has survived precisely because it was designed for the most pluralistic nation in the world. It allows for tremendous social and political changes but does so within a framework that protects individual rights.

Before we start “reimagining” our way out of the most stable constitutional system in history, we may want to consider how the alternatives have been faring around the world.

It is that “little piece of paper” that introduced a revolutionary concept of governance that permits a nation of rivaling factions and values to govern as one. That does not mean that we do not have deep and at times bitter divisions. However, we are joined in a common article of faith in the Constitution.

While he spoke more about democracy in general, Churchill’s famous comment could as easily refer to the Madisonian system: it may be “the worst form of Government except for all those other forms that have been tried from time to time.”

(Since 2/3 congressional majority or 38 out of 50 states is required for Constitutional amendment, there is only the slimmest chance that silly political ideology will take control… but (and this is IMPERATIVE)….we must continue to VOTE for the Congressional candidates who are most/best prepared and qualified to understand and uphold the Constitution’s basic tenets. -Not by identity politics, not by radical extremism, nor by upheaval, nor calculated agenda.
    (commenter George would want to make sure that Congressional candidates have good reading and comprehension skills. He might have voted for some he now regrets.)

    The demoncrats hating on and ignoring the Constitution is a huge problem but also just part of the vast conspiracy that is mounted against all of us – as “progress” has taken us into an orwellian TOTAL GOVERNMENT INFORMATION ON ALL PEOPLE AWARENESS.

    I think they’ve thrown out more than half of the US Constitution already, of course they have their excuses, lies, spins, penumbrances and rebrandings to justify their theft of God given Rights.
    The woman in the lead piece is just spewing what most of those in power in the USA have already done, thrown it down the toilet and flushed while the bribe system stuffed their pocketbooks full.

  4. The notorious RBG once said that she did not like the U.S. Constitution because it was too imprecise and she wanted a constitution with more clauses addressing more issues. Well, politically we were descended from the British who have an unwritten constitution whose basic concepts represent the traditions of the English. We wrote ours down, outlined a system, and left it up to subsequent generations to fill in the details (which included the precious first 10 amendments – the Bill of Rights). Intellectuals must think, fortunately they cannot run rampant without strong support in the country, at least yet.

    So, Kelley Robinson wants to reimagine the Constitution and freedom. The most notorious use of the concept recently was reimagining policing, which resulted in wholesale defunding and escalating crime and troubles and victimization in those deep blue areas in which it was tried. Seattle and Portland are now racing to undo it, and Minnesota has seen the elevation of the Governor out of the state, leaving a hope for some correction.

    Just keep reminding people of what can happen when someone’s reimagining leaves reality.

    Rosa Brooks, will be a law professor at Georgetown, but she failed “Constitution 001” since if the Constitution and the Declaration of Rights are based on the inalienable rights inherent to human beings such as “life, liberty, and the pursuit of happiness” their statement is contrary to classifying us “slaves” to the U.S. Constitution.

The civil rights movement was started by COMMUNISTS and the labor movement was heavily influenced by them. They hate the documents that founded this nation because they get in the way of their goal of world domination. Not being aware of history, it is not expected that you would know this. It’s okay.     1. The Constitution has been amended some 27 times, amidst literally THOUSANDS of attempts to do so. (Look it up.)
      Indeed, Thomas Jefferson himself proposed regular review/amendment (every 10-20 years, he suggested). (Look it up, there are several gov. sources for you to choose from, e.g. 1 USC 106, or governmental summaries of amendatory efforts.)

      While a president can neither order nor veto an amendment passed by Congress, Trump–or for that matter, any private citizen,– can propose or promote an amendment to Congress for consideration.

        Lincoln and his successors improperly, illicitly, and unconstitutionally amended the Constitution with a gun to America’s head under the dictatorship of brutal military occupation after denying not prohibited and fully constitutional secession. 

        Every act of Lincoln and every subsequent act of Lincoln must be repealed. 

        America must be repealed back to the Constitution and Bill of Rights of the Founders and Framers.

        In a society of laws, laws must be adhered to.

When a “human rights” activist believes that we would be better off without a constitution or bill of rights, and that the pathway to human rights means more governmental control, no guarantees to individual freedoms, no right to self-protection, vast programs of government censorship, no rights to income or personal property, a nation with no border controls, free healthcare and housing. Its pretty easy to see where this is going. We have a VP candidate that believes that China embodies the ideal of “human rights” because everyone has food and a place to live.

Progressives had several shots at making a constitution during the French Revolution but, as Thomas Carlyle noted, they never actually started, like precision built motors that never start or run. The temptations of arbitrary and emergency rule always got in the way. They were fortunate to end up with a Napoleon. The norm is a Lenin or Stalin.

    Our universities and institutions have been occupied by very stupid and very dangerous creatures of late. We need to pay closer attention.

    What might otherwise be considered a minor error of judgment can blow up into a big issue in a political campaign when the error evokes a candidate’s deeper flaws.

    Yesterday, the U.S. Army issued a stern rebuke to the Trump campaign over his visit on Monday to the Arlington National Cemetery, where Trump sought to score political points by marking the third anniversary of a deadly attack on U.S. troops in Afghanistan as American forces withdrew from the country. Thirteen American service members were killed in the attack at Kabul airport’s Abbey Gate.

    A video of the visit posted by the Trump campaign on TikTok shows Trump visiting grave sites, with audio of him blasting Biden’s “disaster” of the Afghanistan withdrawal.

    The Army said in its statement that participants in the ceremony “were made aware of federal laws” which “clearly prohibit political activities on cemetery grounds.” The statement also noted that an Arlington National Cemetery official “who attempted to ensure adherence” to these rules “was abruptly pushed aside.”

    Reportedly, when the cemetery official — a woman — tried to prevent Trump and his staff from entering the prohibited area, Trump’s staff verbally abused her and pushed her out of the way so Trump could enter.

    The Army statement went on to say: “It is unfortunate that the ANC employee and her professionalism has been unfairly attacked. ANC is a national shrine to the honored dead of the Armed Forces, and its dedicated staff will continue to ensure public ceremonies are conducted with the dignity and respect the nation’s fallen deserve.”

    The incident has blown up into a big issue, but not because the Trump campaign erroneously held a political event at the Arlington National Cemetery.

    It’s blown up because it’s a microcosm of Donald Trump’s moral squalor.

    Trump has repeatedly shown contempt for military heroism. He claimed that the late John McCain, who had been a prisoner of war, was “not a war hero. He was a war hero because he was captured. I like people who weren’t captured.”

    When General Mark Milley invited a wounded, wheelchair-bound soldier to sing “God Bless America” at Milley’s welcoming ceremony as Trump’s chairman of the Joint Chiefs of Staff, Trump admonished him, “Why do you bring people like that here? No one wants to see that, the wounded.”

    On a trip to France in 2018, Trump refused to visit the Aisne-Marne American Cemetery, where more than 2,200 U.S. service members are buried. “Why should I go to that cemetery?” he asked staff members. “It’s filled with losers.”

    According to Trump’s then-chief of staff John Kelly, Trump called the Marines who died at Belleau Wood “suckers” for getting killed.

    Trump recently said that the Congressional Medal of Freedom he’d awarded to Republican donor Miriam Adelson was “much better” than the Medal of Honor because Medal of Honor recipients are “either in very bad shape because they’ve been hit so many times by bullets or they are dead.”

    It’s not only Trump’s disdain for military heroism that’s brought to mind by what happened at Arlington National Cemetery. It’s also Trump’s disdain for the law, suggesting other occasions when Trump and his henchmen have disregarded legal rules, including their attempt to reverse the outcome of the 2020 election.

    Verbally abusing and pushing the cemetery employee who was trying to enforce the law, after she notified Trump and his staff that it was illegal to stage political events at the ceremony, recalls other instances when Trump and gang have pushed people aside, using violence to try to get their way. Think January 6, 2021.

    That the employee in question is a woman brings to mind the multitude of ways Trump has employed violence against women, from grabbing their genitals to raping them to stirring up his followers to threaten them. She declined to press charges because, according to military officials, she feared retaliation by Trump supporters.

    The entire incident is also a microcosm of Trump’s utter disdain for morality, honor, and patriotism — the public virtues, the common good. The cemetery is a sacred, hallowed ground. It is considered to be a national shrine. Trump sullied it to achieve his personal goal of the moment: to get a news clip in which he could bash Biden and, indirectly, Kamala Harris.

    The incident rings the warning bells, rekindles the dark memories, revives the fears.

    What happened at Arlington National Cemetery earlier this week was much more than an erroneous photo op. It was Trump on full display.

    1. This post has a very Gigi ring to it. What you don’t seem to understand is that no one cares about this. Orange man bad isn’t gaining any traction. Haven’t you figured out yet that whatever insults, lies, moral failings, financial matters, civil and criminal charges, etc. leveled at Trump…no one cares. No one. It won’t be a “landslide defeat”. In fact, unless Harris begins to answer questions and do interviews, and at least fakes having a brain, she will be destroyed in November. No matter how much is heaped upon Trump, in doesn’t matter, he is STILL worlds better than Harris/Walz. No one had any problem with Trump, least of all democrats, until he dared to run for office and then had the audacity to win. Before then, they had no problem with his financial dealings, bankruptcies, affairs, divorces, tv shows, etc. They gladly shook his hand, posed for pics, and took his money. So again, no one cares.

      1. I would agree with that. He has no politician’s filter that I can see. Some people like that, I’m not sure it has helped him overall. His public speaking, seems to be just like he would speak to someone privately, rough, crude, and to the point. His greatest achievements have been his pragmatic style of governing (he calls it “America First”), cutting regulations and red-tape, he seems to anticipate problems very well, and that people believe (IMHO, rightly so) that he may be the only politician that is powerful enough rise above everything and fix the many problems that exist. I would have thought that he might have been a better manager of people, better at delegating, better at selecting the right people for various jobs. That would have come from a lifetime in politics, which he didn’t have. I think he probably approached the job like he would have approached a business project, but he quickly found out that the rules were a lot different.

        I would say that for a billionaire, NYC playboy, he’s led a fairly low-key lifestyle. A few marriages, a few mistresses, kids aren’t drug addicts and they still talk to him, no arrests (except this recent BS), no history of drugs or alcohol, a few bruises in business but nothing too outrageous.

Could literally anyone avail themselves–60 year olds, people in prison? According to “Forbes”, a single IVF treatment costs between $15,000 and $30,000. Also according to “Forbes” the success rate ranges from 44.5% for women under 35 to 2.9% for women over 42. More seat-of-the pants BS lies–Trump the vaudeville clown pretending to be empathetic when he is actually desperate. A pundit I saw this morning said that “IVF” stands for “I’m very frightened”–Trump knows he’s slipping in the polls.

        Trump is also trying to back-pedal on abortion, after bragging about getting Roe v. Wade overturned–something he claimed “everyone” wanted.–Another big, fat lie. The majority of Americans supported Roe v. Wade. The Project 2025 playbook calls for a national ban on abortions and IVF. A POTUS cannot individually force the government or private insurance to pay for IVF or overcome state bans on abortion, and Republicans’ Project 2025 would ban both.. He’s just lying again–saying whatever he thinks might get him vote–no long-term plan or strategy.

        To him “America First” means that it has to appear that America has the advantage in every situation–hence, the tariffs, because, according to Trump, China is “ripping us off”. Trump doesn’t understand the basics of tariffs, which is that the increased cost is paid for by the consumer in the form of higher prices. He also doesn’t understand that because in America we pay a living wage, we cannot compete with China for the cost of producing many of the consumer goods we purchase. Then, there’s the reciprocal tariffs–the Chinese imposed them on American agricultural products, and we taxpayers had to bail out the agriculture industry. According to “EWG”:

        There’s nothing “pragmatic” about Trump at all. You make the blanket claim that “cutting regulations and red tape” are good things. Environmental and consumer protections are GOOD things that most Americans support. We WANT clean air and water. We DON”T want climate change to get worse. We DON”T want banks and big companies ripping us off.

        You speak of Trump “fixing our problems”–he is the CAUSE of many of our problems. We are still recovering from the economic disaster he caused with his tariffs and mishandling of COVID. He lied about the seriousness because is lacks any kind of pragmatic approach to anything–COVID made him look bad, so he lies about the seriousness of it. The result was unnecessary deaths and infections and a pandemic in which America fared far worse that other developed countries. Under Biden, manufacturing is returning to America, he has gotten us back to work, back to school and got restaurants and businesses open again. He mended relations with our allies and NATO is stronger than ever.

        You say Trump led a “low-key” lifestyle? Where have you been? He has always been an attention hog–flashy, braggadocious, attention-seeking. He is a malignant narcissist. You say “a few brises in busnesses” How about these colossal flops–Trump University $25 M fraud payout, Trump Casinos–2 of them went bankrupt, Trump Steaks, Trump Golf Products, Trump the Game, Trump Vodka, Go-Trump Mortgages, Trump Airlines, Trump Ice, Trump Magazine, Trump Tower Tampa, Trump So Ho Hotel, Trump World Fair at Trump Plaza, Trump Baku Hotel, Trump International Hotel & Tower Dubai, Trump Tower Palm Beach, Trump Cologne, Trump Foundation–dissolved due to fraud.

        Trump was handed a healthy economy that he nearly destroyed. His plans for more tariffs and the dismantling of our government according to Project 2025 would take decades to fix. America can’t survive another Trump presidency.

        Then, there’s the criminal indictments, the criminal convictions and the fact that he started an insurrection that left one of his supporters dead, the Capitol desecrated by his delusional fans, Capitol Police beaten, with 5 of them dying, all due to his Big Lie–the product of his big ego. There is no defending his sitting by for over 3 hours while this melee enfolded, refusing to call off the faithful until it became clear that Pence could not be persuaded to leave the Capitol until he accepted the certified votes. He continues to lie about losing in 2020. He has insulted our military members and heroes, like John McCain, and used the hallowed grounds of Arlington National Cemetery for political purposes. He stole classified documents.

        How on eath you could see Trump as anything other than a massively flawed person totally unfit to be the POTUS is stunning. You have to ignore a massive amount of evidence of his incompetency, desperation and arrogance to praise this creature.

  17. Guess the likes of this snowflake (no longer an age specific term) don’t realize that ‘little piece of paper’ is what permits them to be an insufferable pile of grievances in the first place. This is more ignorance, entitlement, and narcissism on display. Hardly a surprise, but to be taken more seriously than many will acknowledge. Push back, and do it every day. Even were we a pure democracy: the majority don’t want this, just a privileged few, and it has become transparent as ****.

    Perhaps THAT is what the dems meant by transparency; they aren’t even attempting to hide their motives anymore. This is basically an emotional infant stating they don’t want to share the world with grownups, those that disagree, or he accountable to anything or anyone. IOW – one big, safe echo chamber of a space, the fed can replace mom and dad in their adult lives. That is always where all of this was heading with the mentality in question.

  18. What they really want is to throw out the Bill of Rights. If they could just get rid of those pesky 1-10 Amendments, then they could rule however they want. Our genius founding father’s understood that even though times change, people do not. One nice thing about the US, no one requires you to live here. If these people hate the little piece of paper perhaps they should move someplace else where they would be happy.

  19. As I have stated more than a few times here on the good professor’s blog, I am not white. The idea that the Constitution needs to be “reimagined” with preference to any one particular color of their skin, their hair style, the color of their eyes, or even the shape of their butt is not only stupid but dangerous. And who the heck thinks I have to “love” anyone? What kind of warm and fuzzy nonsense is that? I got family members I am not too fond of.

      I’ve been re-listening to a bit of early Steely Dan (“Can’t Buy a Thrill” album in this case) lately. I’m sort of surprised how appropriate some of the lyrics are to our present condition.

  20. Thanks for this column, professor. I was wondering if we’d get around to speaking about this abysmally ignorant statement. The U.S. founding documents are part of that arc of history that progressives love to invoke but understand not at all.
