Turley Speaks at 2024 Ohio Judicial Conference

Today I have the honor of speaking to the judges and lawyers in the 2024 Ohio Judicial conference on the Supreme Court in Columbus, Ohio.  I will be discussing the last year of cases and controversies for the Court.

The late Ruth Bader Ginsburg once said that “It’s hard not to have a big year at the Supreme Court.”

That being said, the Court is coming off one of its most historic and impactful terms in its history with rulings on gun rights, abortion, agencies, and elections. We will be exploring the opinions, statistics, and upcoming cases.

The Court is increasingly operating in a hostile political environment. The public overwhelmingly rejects calls from politicians and professors to pack the Court. However, fewer than half of Americans (47%) now express a favorable opinion of the court (51% have an unfavorable view).

That is slightly up from last year when only 43% had a favorable view. Yet, it is worth noting that members of Congress are leading these attacks but trust in Congress is at 18%. They can only envy the current trust in the Court even with the decline.

There is a generational difference in these polling numbers. About four-in-ten adults under 30 (37%) have a positive impression of the Court. The support is greater among those above the age of 50 with 54% favorable responses.

It is always great to come back to Ohio where I spent a great deal of time growing up with a mom from a small Ohio coal mining town (Yorkville).

    Professor, please urge the Supreme Court to begin doing its sworn-oath duty to “support” the “manifest tenor” of the Constitution.

The same article enumerates and provides Congress the power to regulate ONLY the Value of money, Commerce with foreign Nations, and among the several states, and with the Indian Tribes, and land and naval Forces. Additionally, the 5th Amendment right to private property was initially qualified by the Framers and is, therefore, absolute, allowing no further qualification, and allowing ONLY the owner the power to “claim and exercise” dominion over private property.

    Government exists, under the Constitution and Bill of Rights, to provide maximal freedom to individuals while government is severely limited and restricted to facilitating that maximal freedom of individuals through the provision of security and infrastructure.

    The Necessary and Proper Clause is nothing more than a perfunctory redundancy for the purposes of clarification—a reinforcement of that which was previously codified—and shall not be employed to amend and impose separate acts that do not represent but alter the letter and intent of the Founders and Framers.

  2. Hi Professor Turley, I am very glad that you are speaking in Ohio today. I would like to add one thought to the day’s discussion: The Republican candidates, Trump and Vance, did not make up the story of pets being eaten. The anti-right mainstream press keeps on saying that it is a false story, and we should believe them above all else. How can we? After all of the lies regarding Trump over the past 9 years or so, how can they expect us to believe anything said? It’s no wonder that this did happen…the people coming here illegally are so desperately poor, it does not surprise me that a pet has been taken and eaten.

  3. Jonathan: Did you see the latest news? Yesterday DJT had an event in Long Island and said he would go to Springfield, Ohio “in the next two weeks”. Do doubt to sow more chaos and division in the once peaceful town. At the rally DJT described immigrants as “animals” and “criminals” who are destroying Americans’ way of life: “We’re going to take those violent people and we’re going to ship them back to their country, and if they come back in, they’re going to pay a hell of a price!”. What “price”? One can only imagine if DJT were to have his way.

    What would DJT find if he actually goes to Springfield? A town now in turmoil because of his lies about Haitians. He will also find the Haitians in Springfield are all there legally. And they are not “animals” or “criminals”. Employers in town say they hire Haitians because they are hard workers who come to work every day on time. The only real problem in Springfield is a lack of affordable housing. Other than that Haitians don’t present a danger to public safety.

    Apparently, DJT imagines himself as Wyatt Earp. The new Marshall in town who will clean up the “mess” in Springfield by rounding up and deporting the Haitians. That might appeal to a few White racists in town but not to employers who depend on Haitians workers.

    DJT blames Springfield and immigration on Kamala–or as he refers to her as “Kamabla” Harris: “Kamala will be known as you’re invasion president”. Did DJT let something slip out? An admission that Harris might be the next President of the United States?

  4. Dear Mr. Turley “Dennis” must have missed the Springfield City Council meeting where several residents spoke up about their fears regarding the Haitian Immigrants in their city. Fears of going to the grocery store and driving in their cars are just two examples cited by these terrorized folks. I don’t know where “Dennis” lives but perhaps, he would be willing to open up his home and yard to these illegals. Let him have his family, friends and neighbors help out, too. My guess is that he would be less willing to criticize the residents of Springfield once he experiences what the residents are facing on a day-to-day basis.

Columbus is just 48 miles from Springfield where this small town is still reeling from DJT’s lies about Haitians eating the dogs and cats of neighbors. Maybe you would learn a lot if you took the time to drive over to Springfield to see what DJT’s incendiary rhetoric has caused to the inhabitants of Springfield–closed schools and the evacuation of City Hall due to bomb threats.             Comparing Cannon against Judge Merchan is laughable. The 11th Circuit has already rebuked Cannon because her rulings are crap. Merchan has been more fair and accommodating to Trump than most would like. Unlike Cannon, who has shown a higher preference for Trump because he appointed her, speaks volumes about her ‘objectivity’ as a judge.

            So, you want to compare Sotomayor’s book deal against years of unreported vacation trips, RV loans, and private jet travel? Hilarious.

            The personal hospitality exemption (loophole) still requires that all gifts be reported. It does NOT cover private jet travel or any other form of travel funded by corporations or business organizations, such as LLCs. Thomas and Alito allegedly “forgot” to report years of such gifts and “personal hospitality” events.

          (1) The old 1978 EIGA (during which time the undisclosed gifts you refer to were given) had ZERO effect on SCOTUS.
          (2) The 2023 voluntary disclosures or non-disclosures do not affect the instances you cite. I believe it is not retroactive.
          (3) To my knowledge, neither Alito nor Thomas EVER invoked an “I forgot to report it” defense or apology.
          To the contrary, Thomas expressly denied any requirement to list certain gifts.

  11. There are reasons for a fixed number of Supreme court judges and that being an odd number. There are reasons for lifetime tenure and no mandatory retirement. There are reasons for the, relative, lack of a judicial code of ethics being enforced on the court and. finally, there are ways, although intentionally difficult, to remove mistakes!
    I have not heard the left actually address these reasons other than to advocate for THEIR ideology over that of some sitting justices. If ideology is the sole measure of confidence in a court then reason has left the argument and governance has become based purely upon power and the ability to enforce.
    Is that really the world the left wants? Query the Mensheviks how that works out!
