We previously discussed the defamation case against NYU Law Professor and MSNBC legal analyst Andrew Weissmann. He is being sued by lawyer Stefan Passantino after Weissmann said that he coached former Trump White House aide Cassidy Hutchinson to “lie” to Congress. At the time, I wrote that “it is hard to see how Weissmann can avoid a trial.” U.S. District Judge Loren AliKhan apparently agrees. She just rejected Weissmann’s motion to dismiss the case.
The controversial former aide to Special Counsel Robert Mueller (and NYU law professor) is being sued after declaring that attorney Stefan Passantino (who represented Hutchinson before Congress) told her to lie.
Weissmann’s controversial commentary was not a surprise to many critics.
Many of us questioned Mueller hiring Weissmann given his reputation for stretching legal authority and perceived political bias. Weissmann reportedly congratulated acting Attorney General Sally Yates after she ordered the Justice Department not to assist President Donald Trump on his immigration ban. The Supreme Court would ultimately affirm Trump’s underlying authority, but Yates refused to allow the Justice Department to assist a sitting president in defending that authority. Weissmann gushed in an email to her, writing “I am so proud. And in awe. Thank you so much.”
As noted earlier, Weissmann seemed to respond to those criticisms by aggressively proving them true. Weissmann has only become more controversial as an MSNBC analyst. He called on Justice Department officials to refuse to assist in the investigation of abuses in the Russian collusion investigation. While opposing investigations involving Democrats, he has seemingly supported every possible charge against Trump or his associates.
What Weissmann often lacked in precedent, he made up for in hyperbole. That signature is at the heart of the current lawsuit. On September 13, 2023, Weissmann was referring to Judy Hunt and noted on Twitter (now X) that “Hunt also is Cassidy Hutchinson’s good lawyer. (Not the one who coached her to lie).”
In making this claim against Passantino, Weissmann actually triggered the “per se” defamation standard twice. These are categories that have been treated as defamatory per se. The allegation against Passantino would not only constitute criminal conduct but also unethical professional conduct. Passantino denounces the statement as an “insidious lie” and “smear.”
AliKahn noted that “At her fifth deposition, Ms. Hutchinson discussed a line of questioning from her first deposition about the January 6 incident in the Presidential limousine,” AliKhan wrote. “She explained that, during a break after facing repeated questions on the topic, she had told Mr. Passantino in private, ‘I’m f*****. I just lied.’ Mr. Passantino responded, ‘You didn’t lie. . . . They don’t know what you know, Cassidy. They don’t know that you can recall some of these things. So you [sic] saying ‘I don’t recall’ is an entirely acceptable response to this.’”
Hutchinson repeatedly confirmed that Passantino “never told me to lie,” “didn’t tell me to lie,” and “He told me not to lie.”
While Judge AliKhan on Monday tossed out the second count in the complaint as lacking foundation for the claim of financial harm, she refused to dismiss Passantino’s defamation claim and moved the case forward toward trial. That could prove embarrassing as Passantino’s team searches for evidence of malice in his emails and other communications.

I think in our case it would be impossible, the simplicity of British Colonialism is dead. This is a handful of unelected people dictating to us. We are in one hell of a pickle. I am going to be very curious to see how Texas votes this year; Austin, Houston, San Antonio are already blue, and just capturing a few of the suburbs of Dallas, which migrating Californians have, could very, very easily flip that state just due to wealth and numbers. Governor Abbott can’t do a dang thing about it. Anyone that thinks they can, ‘sit this election out’, is mental.
Several states, including Texas and Alaska (there have been at least 2 – 3 more, possibly including Oklahoma, but don’t clearly recall the identities off the top of my head), have already had serious legislation for secession introduced in their legislatures. Now, some of that is almost certainly political posturing, without real current intent to to pursue the alternative. But it gets the idea out there, in public. I doubt that Alaska could ever secede, too many residents are far too dependent on the Fedgov teat (for all of the “reality” shows attempting to show what a great place to live that State is, the reality is that most of it remains quite hostile). Texas, on the other had, is quite capable of taking action – I think it would not take too many more immigration problems, or other abuses of their rights by Fedgov to trigger that. If Texas actually voted to secede, what are “blue” areas like Houston, Austin and San Antonio going to do? They certainly would not be capable of themselves seceding from Texas. I live in one of the few “red” areas of an East Coast state, and I can tell you that secession has been discussed here more than once, but it isn’t economically feasible; there is a certain scale requirement for minimum size. The “blue” areas of Texas would need to accommodate the change, or relocate – the same choices we have here. I could see a strong possibility that the prospective secession of Texas could prompt several surrounding States to join them in some modern form of confederacy. Arizona and Colorado *might* be too far gone, but I don’t think that it is out of the question for Oklahoma, Kansas, Missouri, Arkansas, or Louisiana. Depending on how that all played out, I think there is a lower probability that the seceding States could extend contiguously as far East as Florida and South Carolina. Would large number of people be upset? Absolutely. It doesn’t get much mention in American History texts, but I’m certain there were tremendous numbers of people discomfited by the success of the American Revolution, but they either emigrated back to Britain, or adapted.

Dear Professor Turley, I noticed a comment or two on last night’s debate and thought I would weigh in as well. I had wondered what the left-wing media say about it as it was clear Gov. Walz lost with his nervousness and the wild statement about being friends with the shooters. The AOL newsfeed had an article from Newsweek trying to explain just what the Governor meant by the above referenced statement. It did not convince me. When a politician needs a pundit to explain just what he meant, it is game over him.
“Dennis” is also rushing to the defense of Gov. Walz by insulting Sen. Vance. This tactic is an old one from the Democratic playbook. “If you can’t argue on substance then attack the person, family, friends and anyone remotely associated with them. Leave no stone unturned.” Sorry “Dennis” game’s over. You shouldn’t have taken so much joy out of attacking President Trump.
Looking at Weissmann’s background, I don’t see how he could be anything other than a radical Leftist. He grew up in NYC. Attended an Ivy League prep school ironically named Ethical Culture Fieldston School. Bachelors from Princeton and JD from Columbia. Vance also has an Ivy League law degree. The difference is he wasn’t groomed to be a Leftist.
That gives me hope that a solid Christian, Conservative, K-12 education is the best armor for attending any college or university.

President Trump has added a new arrow in his quiver of attacks as of late, charging that a vote for “any Democrat” in the next election “is a vote for the rise of radical socialism” and that Rep. Alexandria Ocasio-Cortez (D-N.Y.) and other congresswomen of color are “a bunch of communists.” Yet the first Republican president, for whom Trump has expressed admiration, was surrounded by socialists and looked to them for counsel.
Of course, Lincoln was not a socialist, nor communist nor Marxist, just as House Speaker Nancy Pelosi (D-Calif.) and Senate Minority Leader Charles E. Schumer (D-N.Y.) aren’t. (Ocasio-Cortez and Sen. Bernie Sanders (I-Vt.) identify as “democratic socialists.”) But Lincoln and Marx — born only nine years apart — were contemporaries. They had many mutual friends, read each other’s work and, in 1865, exchanged letters.
When Lincoln served his sole term in Congress in the late 1840s, the young lawyer from Illinois became close friends with Horace Greeley, a fellow Whig who served briefly alongside him. Greeley was better known as the founder of the New York Tribune, the newspaper largely responsible for transmitting the ideals and ideas that formed the Republican Party in 1854.
And what were those ideals and ideas? They were anti-slavery, pro-worker and sometimes overtly socialist, according to John Nichols, author of the book “The ‘S’ Word: A Short History of an American Tradition … Socialism.” The New York Tribune championed the redistribution of land in the American West to the poor and the emancipation of slaves.

As for Trump identifying with Lincoln, there is to be sure something of a resemblance there but not focused on Trump himself, rather in the manner of which half the Nation has become antagonistically delusional over his persona, just as took place with Lincoln’s rise in politics. I see no threatening overtones there in the comparison, other than like most Americans who have formulated their opinions and beliefs based on 160 years of anti-Southern propaganda, determining fact from folk tales can be difficult this many generations later. As the quote has been attributed as coming from Winston Churchill, or Herman Goering, or George Orwell, never the less it is a truism; “History is written by the victors.”

However, notice who it is that is desperately erasing the Confederate monuments and renaming military bases with blasé titles no one can identify with. Not Lincoln’s party. No, it’s the party that supported slavery, supported secession, supported the KKK, supported George Wallace, supported segregation, and who erected the Confederate monuments to begin with. One hundred and sixty years later, despite it all, we once again find ourselves in a Nation divided with one half believing they have nothing in common with, nor any shared values with, the other half.
I don’t believe we can affix all of that on Trump, or Pelosi, or Karl Marx, for that matter. Sounds more to me like the original conflict between the Articles of Confederation, and the attempted compromise in drafting the Constitution for Federalist Nationalism that 235 years later is rearing it’s ugly head again.
So now who owns the park in McAllen, Texas? Is it Texas, or the Federal government? Lincoln said the Fed owned Fort Sumter. South Carolina said it was South Carolina property.

Jonathan: Last night JD Vance proved why DJT selected him as his running mate. They call JD “Shady” for a reason. Shady spent the whole debate refusing to answer direct Qs. For me the defining moment was when Tim Walz looked at Shady and asked: “Do you think Donald Trump lost the 2020 election?” Shady refused to answer that simple Q and started talking about “censorship”. I was disappointed Walz didn’t confront Shady on many of his distortions–like claiming the housing crisis is caused by illegal immigrants. In the end I doubt the VP nominee debate will matter much. Most voters have already made up their minds.
But give Shady credit. He at least showed up for the debate. Not so with DJT who has refused a second debate with Harris. Now in breaking news DJT has just backed out of the planned interview on CBS on October 7. He has now turned his back on a 50 year tradition. Harris has accepted the CBS invitation.
What does this say about DJT? He’s running scared. Remember the 2020 CBS interview with Leslie Stahl when DJT didn’t like the Qs so he got up and fled the interview. Terrible optics and probably another reason DJT lost the election. I think DJT’s campaign advisors watched that 2020 CBS interview and decided they didn’t want DJT to go through that embarrassing moment again–having to lie and trying to explain why he has no healthcare plan–just a “concept” of a plan!
So Harris will be on prime time TV on October 7 to explain all her proposals to American voters. She won’t get up and leave the interview because she doesn’t like the Qs. And where will DJT be? He will be on the sidelines shouting, carping and complaining about all the bad calls by the refs. Does this sound like someone who really wants to be president again? If he can’t handle a CBS interview how can we expect him to handle 4 more years?

I discussed this on the other day’s blog with an anonymous figure. He couldn’t provide facts to defend his position. He likely didn’t recognize that FEMA was under the executive branch and couldn’t understand that generals fighting a war (Hurricane Helene) must be front and center rather than sitting on a beach chair or politicking. Ultimately, he ran away from the discussion because he knew almost nothing, but even he, a coward, would be a better President than Kamala.

With the proper advisors, I think my own sister, a lifelong traditional Democrat, could be a better president then Harris. We are not picking from traditional Democrats like JFK or RFK but far left wing Democrats whom have highjacked their own party.
One of the things I have noted and as I have posted many articles commenting on the lack of leadership the Biden/Harris admin has not only shown but proven. Whereas Trump and Vance and other GOP have shown and proven what it takes to be leaders. Being a former Marine, I know and see the difference.
