Liz Cheney Under Fire for Allegedly Improper Contacts with Cassidy Hutchinson

Former J6 Committee Co-Chair and Rep. Liz Cheney has long been criticized for her role in creating a one-sided and at times erroneous record of what occurred on January 6th. That includes editing out Trump’s call for supporters to protest “peacefully,” burying evidence on Trump’s offer to supply National Guard support for that day, and highlighting a false account of Trump in his presidential limo that was directly contradicted by witnesses.

She now stands accused of unethically contacting a key represented witness to get her to change her testimony. In my view, ethical proceedings are unlikely after the disclosure of ex parte communications with former Trump aide Cassidy Hutchinson. However, the evidence seemingly contradicts public accounts of how Hutchinson decided to fire her counsel and change her testimony.

Hutchinson was represented by Stefan Passantino, who some clearly viewed as a stumbling block to getting Hutchinson to turn against Trump. Hutchinson would claim under oath that Passantino pressured her to stay “loyal” to Donald Trump and coached her responses to support Trump despite her conflicting accounts.

However, newly disclosed evidence allegedly contradicts that account, including Hutchinson telling former Trump aide (and now The View co-host) Alyssa Farah Griffin that “[Passantino’s] not against me complying.” Griffin reportedly responded “I actually agree with Stefan’s approach and think it’s accomplished everyone’s goals. I am happy to tip liz off.”

Hutchinson would later dump Passantino and testify to allegations that have been challenged as untrue. That includes the limo allegation that was repeatedly raised by Cheney and others. Hutchinson recounted the story that Trump allegedly grabbed the wheel of the vehicle after the Secret Service allegedly refused to take him to the Capitol.

Cheney and the Committee were aware that the account was directly and clearly refuted by the driver of the vehicle. However, they buried his account and highlighted that claim in its final report as being credible.

The new allegation concerns the communications leading up to that changed testimony. Rep. Barry Loudermilk, R-Ga., chairman of the House Administration oversight subcommittee has released the new evidence while alleging that Cheney used an encrypted phone app to evade defense counsel in speaking with Hutchinson.

Under Rule 4.2 of the Rules of Professional Conduct, “a lawyer shall not communicate or cause another to communicate about the subject of the representation with a person known to be represented by another lawyer in the matter, unless the lawyer has the prior consent of the lawyer representing such other person or is authorized by law or a court order to do so.”

Cheney is a D.C. licensed lawyer.

At the outset, in my view, Cheney was acting as a member of Congress in this matter. That has always been a rather grey area for lawyers who are also members of Congress. The bar has taken a broad view of the need for lawyers to adhere to these ethical standards. However, it is not clear politically or ethically if the Bar officials would be inclined to pursue Cheney, who has been lionized in Washington for her role in the investigation.

Yet, the record does indicate that Cheney was not just aware of the represented status but the policy of the House to respect the rules governing represented parties. In one message Griffin tells Hutchinson, “Her one concern was so long ad [sic] you have counsel, she can’t really ethically talk to you without him.”

That did not appear to prove a barrier. Before Passantino withdrew as counsel, Cheney communicated secretly with Hutchinson. A later message was sent to Cheney reading on June 6, “Hi, this is Cassidy Hutchinson. I’m sorry for reaching out this way, but I was hoping to have a private conversation with you (soon), if you are willing.”

Cheney responded, “I would be happy to. Let me know what time works for you.”

A few days later, Hutchinson fired Passantino, who told Just the News that “I absolutely had no knowledge at the time that Congresswoman Liz Cheney was communicating with my client behind my back – either directly, through her staff, or through cutouts.”

However, Cheney has claimed that it was Hutchinson who reached out to her and indicated that she was severing her counsel. As an investigating member of Congress, she had an institutional interest, if not a duty, to pursue witnesses.

In her memoir, Cheney said that it was Hutchinson who contacted her directly after her third interview and added “I was very sympathetic to her situation, but I did not want our committee to be advising her on what she should do next…I told Cassidy that she could consult another lawyer, and seek his or her independent advice on how best to move forward.”

We have previously discussed Passantino’s defamation lawsuit against MSNBC legal analyst and former Mueller aide Andrew Weissmann.

Once again, I am doubtful that this would rise to a formal Bar ethics investigation. However, the evidence shows the communications leading to Hutchinson’s firing of her counsel and changing of her testimony, including accounts later challenged by critics.

Hutchinson, Griffin, and Cheney have been reportedly campaigning together this month in support of Vice President Kamala Harris.

In the end, there are ethical concerns raised by these communications. Cheney should have worked through new counsel and proposing alternative counsel raises additional concerns given the interest of Cheney in having the witness “flip” against Trump. She could have waited for new counsel to communicate with her and the Committee.

Alternatively, Hutchinson could have fired her counsel and formally contacted the Committee as an unrepresented party. The ethical rules are designed to avoid this type of murky representational posture. Nevertheless, I am doubtful that this will result in any ethical proceedings against Cheney.

    First, it’s pretty clear from the record that when Hutchinson found out her attorney, Stefan Passantino, was being paid for by DJT to influence her testimony, she reached out to Cheney. It was not the other way around. Cheney told Hutchinson she should probably seek independent legal advice. After Hutchinson fired Passantino and obtained another attorney that is when Cheney and the Committee began further interviews that ultimately led to Hutchinson’s bombshell public testimony. Nothing Cheny did violated Rule 4.2. You even admit this in your column. So why do you keep pushing a non-issue?

    Second, what is really bizarre is that you start your column by falsely accusing the J.6 Committee of “burying evidence of Trump’s offer to supply National Guard support for that day”. FACT CHECK: That claim is FALSE. Former acting Defense Secretary Chris Miller and Joint Chiefs Mark Milley testified before the Committee that they never received any request to deploy either the military, the National Guard or any other law enforcement to prepare for Jan. 6. Even Keith Kellog, Pence’s former national security advisor, testified that DJT never asked for any law enforcement response.

    Despite all the evidence to the contrary you are still peddling DJT’s lies–all in an effort to re-write the history of Jan. 6. You are stuck on DJT’s call for his supporters on Jan. 6 to act “peacefully”. You omit the part where he tells his supporters to “fight like hell or you won’t have a country any more!”. Revisionist history is not your strong suit!

In fact one of the WELL DOCUMENTED REASONS that Hutchinson flipped – if you can call hearsay tall tales that are entirely irrelevant to anything “flipping”, was because she was desparately contacting Team Trump and the RNC looking for dinancial help with her legal expenses and she was advised that they could not help as it was a conflict of interests and advised her to start a “go fund me”

      Which BTW was a very appropriate recomendation – because Anyone can contribute through a “go fund me” without violating conflict of interest rules, because the recipient is insulated from those allegedly trying to influence them.

      So NO Trump was NOT contributing to Hutchinson or anyone else’s legal defense.

      And in fact that is part of the purpose of democrat lawfare – is to bankrupt those they go after or get them to flip to reduce legal costs.
      They did this with Gen. Flynn.

      John Eastman has had multi-million dollar legal costs – he receives donations to cover his legal expenses, and he has won every single effort at Democratic lawfare against him – and is building the evidentiary and legal record for others. Eastman actually won against Lawfare in California – that is more impressive than Trump winning in NYS.

      With respect to Cheney violating the rules – it is actually Turley’s efforts to defend her that fail.
      If Cheney was NOT a lawyer – but still chairing (or just sitting on, or just house staff) on a committee conducting an investigation, she should NOT be contacting a represented witness without going through their lawyer.

      The rule in question applies to lawyers, but even more so to judges, ALJ’s or those conducting an investigation.

      The institutional interests Turley tries to raise are resolved by subpeona’s and/or offers of immunity for testimony.

      This is even more disturbing because Cheney acted unethically, to secure Hutchinson’s hearsay testimony to actions that has been contradicted under oath by direct witnesses, and that even it True would be entirely meaningless.
      Trump promised his supporters at the elipse that he would be going to the capitol. Seeking to actually go there would be consistent with those remarks. It also likely would have brought an instant end to any violence. At the same time Secret Service had no oportunity to sufficiently secure the capitol for a visit by the president. There is absolutely ZERO possibility that they would have allowed Trump to go to the capitol on J6, and if necescary would have physically manhandled him elsewhere had he tried. That is unique to the current president – SS can NOT override the wishes of any other protectee. But they are by law bound to keep the president of the United States safe whether he likes that or not.

      As too Cheney – frankly I find the democrats reliance on her Delicious. The Cheney’s have been both a powerful and embarrassing force with respect to the Republican part for Decades. I think many many many conservatives are ecstatic that they are now a millstone arround Democrats necks.

      YOU are completely Wrong and vastly uninformed.
      Your claims regarding the testimoney of Miller andMilley are not only false but contradicted by written communications from Miller to the Sargent at Arms for the House – it is even part of the official House sargent of Arms timeline for J6.
      And all of the above were known since late January 2021.

      More recently however mnmountains of further EVIDENCE has been made availble – Much of it from the J6 committee records that they encrytped and destroyed in violation of house rules. But some of it from the DoD inquiry into J6 and some from a soon to be releases IG report.

      Regardless, There is ZERO doubt that Trump ORDERED the NG to be available on J6 immediately on the request of the house sargent of arms. Which is the absolute most that the President is able to do. The President has ZERO authority over the capitol grounds and can not order the military or anyone to do anything at the capitol without the consent of the leaders of Congress – which Trump did not have.

      Trump ORDERED the DC NG to be available on J6. That ORDER was conveyed to Sec Def, it was LOGGED By Sec Def, it was transmitted to JCS, and logged by JCS. That ORDER was then conveyed down the chain of commend to Gen. Walker heading the DC NG. All of this occured and is documented as well as testified to under oath by many many people. All of this occured days BEFORE J6.
      Not only is it well Documented that Trump ORDERED the NG to be available on Pelosi’s request, but that he WANTED the NG to be there BEFORE the event to protect his people from Pelosi’s CP that Trump did not trust to start something.

      Not only do we KNOW beyond any doubt that Trump ORDERED the NG to be made available on Request, But we KNOW they were fully prepared and ready sitting in a BUS at the DC Armory at 7am on J6 and sat they waitin for the order to deploy until 5PM.

      Every single tiny little bit of this is now FULLY documented.

      We have Testimony of various members of DoD – military and Civilian documenting Pelosi’s direct and illegal contact with them prior to J6.
      Her attempts to direct them – also illegal. He rejecting the NG because of the “optics”, We have Sargent at Arms Sund begging for the DC NG repeatedly starting about 11am J6 and more insentently and desparately through the day. We have Sund’s plea finally being accepted arround 2pm, We have the request being Transmitted to DoD and we have it going down parts of the chain of command in minutes – until it STOPPED, with an Army Maj. General who sat on in for a further 2hrs while he put together an unnecescary “op plan” – the DC NG has been to the capital many times for many reasons, Walker had put together an OP Plan days before based on prior deployments. Regardless this Gen. NEVER put together an OP Plan and after delaying for 2 hrs finally relayed the order to Walker.

      Again EVERY step of the process is incredibly well documented.
      None of this should be surprising – the Military documents, and preserves ALL ORDERS AND COMMUNICATIONS.

      I would further note that not only is an ORDER from Trump recorded at DoD several days before, but for absolutely ANY military action of any kind there MUST be a chain of orders that Starts with the President. That is how the military works. Absolutely nothing can be done by the military without an ORDER from the president. Does the President ORDER the military to replace a defective toilet at the Pentagon ? No.
      But that toilet ca not be replaced without an ORDER from the president directing the military to maintain their fascilities.
      Again Every single thing EVER done by the US military has Orders that can be traced back to the president – if not then the action is ILLEGAL.

      It has ALWAYS been absurd to claim that Trump did not order the DC NG to the capitol, and absurd that he did not do so days ahead of time.

      As noted before – they were in the Armory on the Bus waiting to go. That absolutely can not happen without orders to do so,
      And all military orders in one way or another MUST originate with the president.

      BTW – not only are you wrong about Miller and Milley – but ALL of what I stated above is documented by RECORDS, and TESTIMONY before the Cheney/Thompson J6 committee. You have not heard it before – because they gathered the testimony secretly, and only leaked what they wanted people to hear. Then they encrypted their records and deleted them all, and it has taken over 2 years to recover the deleted and encrypted records – either through Technological means or by finding copies that were not encrypted and deleted.

      No Trump is not attempting to revise J6 history – Trump is correct. Inarguably so.

      The NG can not cross a state line, and the DC NG can not do ANYTHING without a presidential order.

      Separately No Military forces can be deployed to the capitol without a request by congressional leadership. The president has absolutely no authority at all with regard to the capitol and the capitol grounds.

      The appearance of the DC NG at the Capitol would have been a curt marshal offence for anyone who ordered it without orders from a superior.

      Turley is here writing about Cheney failing to follow institutional rules. He tries to make an exception for house investigations – but not only is there no such exception – but in FACT the burden is HIGHER for those in finder of fact positions rather than those in advocate positions.

      A “Judge” contacting a represented witness directly is a far more egregious ethical violation than a prosecutor doing so.

      Time and again – you hear Trump and you immediately throw all the rules and laws and procedures and even the laws of nature out the window and presume that Trump Must of have done something evil – even if that is physically impossible.

      What has changed in nearly 4 years ? We have the testimony and the documentation of the ORDERS at EVERY step down the chain.

      Why ? Because the legality of every single thing that any officer in the military does depends on whether his actions were within he scope of his ORDERS.

      It is true of the General who ordered the Colonel to take a sector.

      The argument for Biden’s responsibility is MORE clear – Biden rarely provides any context that would mitigate his remarks.

  13. So, essentially, this is just a bunch of unverified allegations of an ethics violation that even Turley admits is sketchy. This is likely an attempt to alter the narrative through insinuations and unconfirmed allegations to sow doubt about the J6 hearings.

    There is no proof that Chaney initiated the communication. That’s alleged, but they prove Hutchinson reached out to Chaney. Turley claims this is from a second communication, but none of the evidence presented shows any communication showing Chaney first reaching out to Hutchinson. To make matters more suspect, Turley’s source is “just the news,” which is known to be heavily biased against Democrats.

    Turley is just peddling the allegations that Rep. Barry Loudermilk is putting out to undermine the results of the J6 hearings. According to Turley, there are many problems with his claims, and the first is his sloppy work tying this ethical issue, which is really a non-issue. He debunked the allegations when he admitted that the rule being used to cast a pall over Chaney does not apply to her since the ethics rules are about lawyers in court, not congressional hearings.

    I’m sure most posters here who are already jumping to conclusions and making wild assumptions won’t bother to do a little research and find out that this is essentially a nothing burger. It’s chum for the gullible and the naive.

Cheney was not acting in the capacity of a lawyer. She was acting in her capacity as committee chair. The hearings were not a court of law, and Hutchinson contacted them. Not Cheney, as alleged. Turley or Rep Barry Loudermilk do not show evidence that Cheney initiated contact with Hutchinson. That’s why they are being reported as allegations and ‘possibles.’ It’s a weak set of claims with no concrete evidence to support them. It seems to be the same BS game of allegations before evidence like the Biden impeachment inquiry often put out. We all know how that turned out.

  16. That has always been a rather grey area for lawyers who are also members of Congress. The bar has taken a broad view of the need for lawyers to adhere to these ethical standards.

    Now we’re getting somewhere. Lawyers that get sworn into Congress are subject to less or different ethical standards than what they swore to become licensed. Why? Are the bar’s standards insufficient? Or are they too ethically binding for congressional work?

    Lastly, if the conduct of a member of Congress violates the ethics rules for their license, why isn’t their license suspended or revoked? Let me guess, same ethics rules for other oathtaking professionals in Congress?
