The Mark of Kaine: The Biden Administration Under Fire for Virginia Lawsuit over Non-Citizen Voter Removals

Call it the Mark of Kaine. The heated dispute between the Biden Administration and the State of Virginia just took a curious turn after Virginia lawyers released support for the effort to remove alleged noncitizens from the voting rolls ahead of the presidential election. The main witness against the Biden Administration may prove to be Sen. Tim Kaine (D., Va.) who is on the ballot this election.

The Biden Administration sued to stop the removal of 6,303 alleged noncitizens from Virginia’s voter rolls before the election, which is expected to be close in the state. It relies on the National Voter Registration Act (NVRA), or the “Motor Voter Law,” which bars “systemic” removal of voters from the rolls less than 90 days before an election.

Gov. Glenn Youngkin ordered compliance with existing laws, citing Virginia code 24.2-439, requiring the removal of  noncitizens whose names were added under false pretenses. It also cited Virginia Code 24.2-1019, requiring registrars to immediately notify their county or city prosecutor of such situations.

The NVRA has exceptions for removals within what the Justice Department calls the “quiet” period before an election, including the removal of individuals who are “ineligible to vote because of a criminal conviction or mental incapacity, or for “correction of registration records pursuant to this chapter.”

However, the state argues as a threshold matter that these are not systemic removals. The state argues that these are individual actions triggered automatically by citizens identifying themselves as noncitizens but then joining the voting rolls. It is a crime for a noncitizen to vote in the election.

The state notes that the voter is notified of the problem and allowed to correct any errors to remain on the rolls. If they do not correct the problem, they are removed from the rolls. However, they can still vote on election day with a “provisional” ballot to challenge any removal.

Virginia is not targeting any group and does not know how these voters might vote. It is responding to a notice coming from the Department of Motor Vehicle of a possible ineligibility and potential criminal act if the person actually votes, which is admittedly rare for noncitizens.

While the Justice Department insists that some of these individuals are actually citizens, the system allows for those citizens to remain on the rolls by simply correcting the DMV record.

I understand concerns over changes close to the election, but there seemed to be a host of options for the Justice Department short of this lawsuit, including working with the state to be sure that this relatively small number of voters are given ample opportunity to correct their records.

This weekend, Virginia added a new wrinkle in the litigation. The Virginia law has been on the books since 2006. The bipartisan legislation was signed into law by then Virginia Gov. Tim Kaine. It has been used without any objection for all those years.

However, it now appears that Kaine’s administration specifically asked the Justice Department to determine if the law was compliant with federal laws, including an express inquiry about the NVRA.

On December 16, 2006, the Justice Department completed its review and found no objections to the Virginia law though it added that it reserves the right to object in the future to any such laws.

Gov. Youngkin further told Fox News that past governors continued to use the law within the 90 days period without a peep of objection from the Justice Department.

These facts distinguish the Virginia case from the Alabama case where a court enjoined removal of names of suspected non-citizens.

Now, Kaine is on the ballot and there is a close election for the presidency. The Biden Administration is suddenly claiming to be “shocked, shocked” that there are alleged noncitizens being removed from the ballot.

In July, in an interview with WJLA-TV , Kaine insisted that “voting should be reserved for U.S. citizens.” When pressed recently, his campaign issued a non-statement statement that, again, insisted that “it is illegal for noncitizens to vote” while adding that “just as we want to block noncitizens from voting, we need to keep eligible voters from being purged from voting rolls, particularly just weeks from an election.”

Youngkin agrees that the state must “block noncitizens from voting” and is using the very law Kaine signed (and the Justice Department approved) for that purpose.

In the end, these votes are unlikely that to change any electoral outcomes. However, there is a broader fight building over a variety of election integrity efforts.

States have complained that the Biden Administration has harassed and sued them at every turn as they sought to require voter identification or other laws.

Florida is now suing the Biden administration for allegedly obstructing the verification of immigration records so the state can remove any non-citizens. The state alleges that the Biden Administration has simply refused to supply required verification information.

These are just a few of the over 165 election-related lawsuits filed in the days before the election by the federal and states authorities and various public interest groups.

Some local officials are sparring with state officials. Fourteen states do not require voter identification. Despite the opposition from the Administration and many Democratic leaders, Gallop and other polling show Americans overwhelmingly support voter identification laws. In California, the state actually made it illegal for local election officials to ask for identification from voters.

The key about the lawsuits filed close to the election is the first round is often the last round. Whoever wins these fights for injunctive relief is likely to remain the prevailing party in the final days before the election.

There is now a virtual army of lawyers deployed by both parties to secure or to protect the expected small margin of victory in the election. Indeed, lawsuits like the Virginia action constitute a type of “harassing fire” to push back on states on identification and eligibility efforts.

The Biden Administration’s move against Virginia shows how one person’s voter integrity is another’s voter suppression. Indeed, the man who signed this state law is now supporting the Administration seeking to limit its use.

Yet, the mark of Kaine on this law is an indelible reminder of how even long-standing practices are now being challenged in this hair-triggered environment. For voters, they will have to be careful when picking their line at their polling place. The longest line is likely the lawyers waiting to get inside.

    1. You are actually correct. The “quiet period” law has nothing to do with Jack Smith. It does, however, have everything to do with systemic purges of voter rolls within 90 days of a federal election.

  2. All these problems would be solved if your voter ID is your Social Security with your photograph as the only and exclusive document to vote.

    To differentiate the document of a resident from that of a citizen, they are issued with different colors, for example, residents have a green ID that says “DO NOT VOTE” and US CITIZENS have the yellow ID card.

      I’d offer that legal voters prove their eligibility and then pick their own PIN. Said PIN is the only voter ID that will be recognized during an election process, to and including absentee/provisional voting.

Only Hezbollah leadership and essential people were provided the pagers and phones. That means that the target was directly against the enemy. That innocent people are put at risk is something that always happens in war, but this puts the least number of people at risk because Hezbollah’s distribution of pagers and phones meant that the attack would be directed at terrorist leaders. Unfortunately, people in close contact with terrorists can be injured. But this attack saved thousands of Arab lives.

            The risk of war in the Middle East was due to weakness, not strength. Israel will protect its people and its borders. That means Iran must control itself, or America has to stop giving Iran money and opportunity to incite terrorism. Israel is not the problem. It stays within its legal borders. Iran doesn’t. Biden is a problem, for he creates wars and hot spots.

            The best way to stop a nuclear war is to end the atomic bomb production in Iran and stop the flow of money to them and then to terrorists. Harris’s policies are far more likely to start a war than Trump’s. That has been reasonably proven.

I don’t know of any country that thought Israel would prevail. I suspect that you have had no military training, so you may not understand the home-field advantage when the war is an existential threat to existence.

I watch their podcasts and would say they have been very spot on with their assessment of the Ukraine war and what is happening in Israel. That’s where my opinion is based and it hasn’t changed.                 Though slightly familiar with Colonel McGregor and Scott Ritter, I do not listen to them because of time and the fact that they made bizarre comments about the Middle East. On that subject, they did not sound rational and skipped over events and elements, some of which I repeatedly mention because, though those events are factual, they don’t meet their narrative’s needs. They are more accurate regarding Ukraine, which is not a black-and-white issue.

                Good people can fail miserably, such as the 51 supposedly independent IC members signing a letter that was a lie. Let’s flush out some truths, discussing what Colonel McGregor and Scott Ritter said, what the proof was and how logical such statements sound. Remember, brilliant German military men lent their expertise to exterminate the Jews. It is not just the Jews that have been murdered in such a fashion. These things happen all over the world despite the good people.

                I’ll provide one argument I heard. Israel is waging a war of extermination or something of that nature. If that is Israel’s objective, they are failing miserably, for the arab population has grown immensely.

                Are the missile attacks that are almost continuous going from Israel to Arab-occupied areas? NO! They are coming from Arab aggressors who pledged to kill their Jewish neighbors, targeting the civilian population.

                One can find some knowledgeable and well-trained people who hold bizarre beliefs. Critical thinking and discussion should enlighten both of us.

When one targets the enemy based on who has the pager in their possession, that threatens innocents the least. The only people given pagers with limited lethality were significant terrorists.

                We see intelligent people fall into traps all the time. I do not doubt their intelligence, but some of their comments about the Middle East are so far out that one has to question them and see if they have believable and logical answers.

        It fails the test of being a serious claim when you consider that Israel has already demonstrated that they can not only wipe out Iran’s Hamas and Hezbollah terrorist groups with Biden/Harris trying to protect those terrorists to appease Obama and Michiganistan, take down practically every missile and drone Israel launches at them…

        … and while doing all of that, Israel has demonstrated that they can kill any terrorist they want inside Iran, in his bed – and drop missiles near Iran’s nuclear facility as a warning while Iran is unable to stop them doing either.

        Finally – Issues involving Ukraine ARE in Russia national interests. Issues involving Iran are not.

        Iran is driving the conflicts throughout the mideast. While they are exploiting issues surrounding Israel, this is about power for Iran.
        They were funding the fighting in Yemen against Saudi’s.

        Iran is a destabilizing force in the mideast. Biden droped the constraints that were holding them back – now the entire Mideast is suffering.

        While I have concerns about pushing Russia into a nuclear war – if that happens it will be in Ukraine, not Iran.

    3. Oldman, what you say isn’t surprising since Biden tried to deny weapons to Israel in another earlier war. Israel has learned it cannot depend on its allies or the Western world as it couldn’t rely on the Western world to save the Jews from the Holocaust.

      They couldn’t depend on Britain to maintain the homeland promised after WW1, so Jewish leaders settled for the smaller portion, creating a two-state solution, Trans Jordan and the Jewish homeland. The British and League of Nations yielded to the pressure of the Muslim Arabs, so Jewish leaders settled for a tiny portion of the land partly broken up. Again, the boundaries were refused by the Muslim Arabs, so a way to settlement was created. War would break out for a limited time, and the boundaries would be drawn based on who controlled the land. Was that good enough for the West? No. The British gave the military fortifications to the Arabs along with the weapons, believing that would end the ‘Jewish problem’ ( ~3,000 years of anti-Semitism). Israel ended up with a small portion of the mandate but larger than what they were willing to settle for before the war with the Arab states that had massive militaries and an air force that Israel did not have.

      Did the war stop after the League of Nations and other countries recognized Israel as a sovereign nation? No. Israel had more wars, and Intifadas leveled against it, and Israel won. When at the steps of Damascus and Cairo, Israel was forced by the US to leave without an end of the war or Arab recognition that Israel was a sovereign state.

      In the war with Lebanon War, Israel settled the war with Hezbollah based on the guarantee that the UN would station troops in Southern Lebanon to prevent Hezbollah from reoccupying the land (~7 miles deep to the Litany River. This land was part of the Kingdom of Israel, which consisted of Asher and others. Did the UN keep its promise? Did the Western world? No. That is why there is war today.

      The West, including the US, have not lived up to their promises, and the UN had their offices as cover for Hamas terrorists and even had many of the UN personnel take part in Oct 7 and hold onto hostages.

    During the process of being registered by Virginia, all applicants are specifically asked if they are a United States citizen. They are warned during the process of answering that question that making a false statement about whether they are a citizen is a felony, punishable under both Virginia and federal law After they had registered and had been identified as being illegally registered to vote, Virginia has provided these double felon Illegal Aliens with a process to give themselves amnesty from their crime of illegally registering to vote. These Illegal Aliens who registered to vote have been notified they have been identified as being Illegal Aliens and have been allowed to correct any errors to remain on the rolls. That same process is open to anyone receiving these letters who believes they are a qualified US Citizen entitled to be registered.

    These Illegal Alien Guest Democrat Voters for whom both Biden and Border Czar Harris are accessories both before and after the fact are not registered voters in Virginia by accident. By this stage, after first affirming they are US citizens, and then refusing the opportunity to have themselves removed from being illegally registered to vote they are deliberate felons. The Biden/Harris “quiet period” does not apply to that.
