Below is my column in The Hill on a victory this week for citizen journalists in the Supreme Court. The most interesting aspect of the case may not be the legal reasoning but the implications of the rise of new media in this country.

This week, there was a little-noticed order out of the Supreme Court that decided a narrow legal question with much great implications for journalism. The justices tossed a decision of the United States Court of Appeals for the Fifth Circuit that barred a lawsuit by Priscilla Villarreal. Known online as La Gordiloca (loosely translated as “the fat, crazy lady”), Villareal is part of a growing number of new media journalists.
At a time when the public is rejecting legacy or mainstream media, the case is the latest reminder of a rising force of citizen journalists.
Technically, the court instructed the lower courts to review the case in light of the recent decision in Gonzalez v. Trevino. That decision relaxed the standards for citizens suing over retaliatory arrests. Villareal was not just a citizen but a citizen journalist who claimed to be performing the same newsgathering functions as conventional journalists.
Villarreal had alleged that she was arrested for seeking and obtaining nonpublic information from police as a journalist — the identity of a person who had killed himself — and publishing it on Facebook. The Fifth Circuit ruled that the police could claim immunity from the lawsuit she brought, and the justices just set that decision aside.
As I discuss in my book, “The Indispensable Right, journalism is in free fall in the U.S. as citizens reject the establishment media as biased and unreliable. For years, journalism schools have taught students that they have to abandon objectivity and neutrality for advocacy.
Advocacy journalism is now the norm. Former New York Times writer (and now Howard University journalism professor) Nikole Hannah-Jones has declared that “all journalism is activism.” Emilio Garcia-Ruiz, editor-in-chief at the San Francisco Chronicle, similarly announced that “Objectivity has got to go.”
After a series of interviews with more than 75 media leaders, Leonard Downie Jr., former Washington Post executive editor, explained that objectivity is viewed as a trap and reporters “feel it negates many of their own identities, life experiences and cultural contexts, keeping them from pursuing truth in their work.”
The response of the public has been to look elsewhere for news. Indeed, the mantra “Let’s Go Brandon!” was embraced by millions as a criticism of the media as much as it was a criticism of President Biden.
Recently, the new Washington Post publisher and CEO William Lewis was brought into the paper to stop a collapsing readership and revenue. He told the staff, “Let’s not sugarcoat it…We are losing large amounts of money. Your audience has halved in recent years. People are not reading your stuff. Right? I can’t sugarcoat it anymore.”
They are, however, reading “the stuff” of figures like La Gordiloca, who is described as “a tattooed one-woman mobile newsroom who, until the coronavirus lockdown, often broadcast live while driving her car.” Her following on Facebook is now larger than her local newspaper. The New York Times described how La Gordiloca “reflects how many people on the border now prefer to get their news.” The paper admitted that she is is a “swearing muckraker who is upending border journalism.”
New media journalists are more H.L. Mencken or sometimes even Hunter S. Thompson but they are viewed as more authentic and independent. Millions of Americans now get their news from social media and blogs. Various traditional media outlets have either closed or are fighting for their existence. What they are not doing is seriously questioning their course in adopting advocacy journalism.
Journalism has become a ship of fools who increasingly write for each other rather than the dwindling numbers of actual readers. And they have written off half of the country with their plunge into advocacy journalism. As a consequence, many have come to view mainstream media as a de facto state media.
Today, over half of U.S. adults (54 percent) say they get news from social media. Only 27 percent now rely on TV as their first choice with only 6 percent preferring radio and only 5 percent preferring print.
The recent polling figures from Gallup show how much harm this generation of editors and reporters has done to the field. Trust in the media is at an all-time low, continuing a consistent decline. Only 31 percent express a “great deal” or “fair amount” of confidence in the media. Adults with no trust at all in the media is greater at 36 percent.
In the 1970s, trust in the media ranged from 68 percent to 72 percent.
In some ways, the U.S. has come full circle. At the start of the Republic, citizens rejected establishment sources of news in favor of citizen journalists and pamphleteers like Thomas Paine. They are doing so again.
Ironically, Villareal’s victory will benefit mainstream reporters. The police used an obscure law that makes it a criminal offense to solicit nonpublic information if the person is seeking to “benefit” from the information. The police simply alleged that Villareal was seeking to benefit by getting a larger audience on Facebook. She argued that she is a different type of journalist. Facebook is her media.
The original panel decision of the Fifth Circuit viewed Villareal’s prosecution as the criminalization of journalism, with Judge James C. Ho writing, “If that is not an obvious violation of the Constitution, it’s hard to imagine what would be.” (The panel decision was then reversed in a re-hearing by the full court).
The Fifth Circuit will now have to reconsider its analysis. That is more likely than the media reconsidering its take on modern journalism. But if they do not, then they will be looking at the future in the face of La Gordiloca.
Editors and journalists continue to saw vigorously at the branch upon which they sit. The question is whether, if they fall and no one is left to hear, will it make a sound?

Credibility is gone.
Why talk to the press when there’s a good chance that they will intentionally misrepresent facts or while presenting facts imply something that is false.
When questioned, accused wife beater Turley denies the charges. Denies that he beats her daily and twice on Sunday.
I’m sure Turley could give you a better example, but lets go with this one.

But others will see thru this ruse.
While its impossible to be 100% objective with no added bias, there are journalists that attempt to do so.

DJT has a political “hit” list and Adam Schiff is at the top of the list–a sitting member of Congress!
DJT is a criminal, a con man, a fraudster and a persistent liar. DJT favorably compares himself to Al Capone. If Kamala Harris were guilty of just one-tenth the crimes of DJT, she would have been disqualified from being on the Democratic ticket for President. But the DJT faithful think a “convicted felon” is exactly the right person to be president again. Hard to figure. But then rational thinking is not the strong suit of the MAGA crowd!

Trump is so far beyond anything Kamala Harris has to offer it’s a no brainer. Was Trump a dictator or Hitler like in his first term? After 8 years of character assassination and two real assassination attempts Trump is still the best candidate hands down. What scares the hell out of me is that after watching the train wreck of the last four years and seeing Kamala Harris’s performance as VP, she is even a candidate.

The truth is that he’s a broke convicted criminal who steals from a fake charitable foundation, who constantly lies, sexually assaults women, falsifies loan applications and business records, who has taken bankruptcy 6 times because he’s a lousy businessman and who stole classified documents, started an insurrection because he was desperate to keep power he cheated to get and desperate to avoid going to prison. Trump drove his companies into the ground 6 times and can no longer secure credit from American banks. His tariff-based economic plan is about as dumb as it gets. But, keep telling yourself he’s a genius.
Trump is also promising to take away the FCC licenses of ABC, CBS and other mainstream media. Note that Turley, who claims to be the maven of freedom of speech, has zilch to say about that. If you MAGAs don’t understand what the problem is with a presidential candidate trying to intimidate media because he doesn’t like their reporting, you shouldn’t be allowed to vote.
And CBS has issued a statement about the editing of Harris’s interview— there were no substantive changes made — they just streamlined what she said to fit into a promo—and they released a full transcript of the interview, but Turley and MAGA media pretend that CBS has done something unethical— which is not true.
Every one of the items you have thrown up are exactly why Americans are voting for him. You are blind to your own hypocrisy.

Cuba Can’t Keep the Lights On
In the socialist and healthcare paradise that is Cuba, the regime can’t keep the lights on. Another failure of the electricity grid struck Saturday evening and continued into Sunday, blacking out much of the island including the capital of Havana.
The country has been enduring weeks of periodic blackouts that can last for 10 to 20 hours at a time, as the Communist government struggles to provide even basic services. The regime blames deteriorating equipment, fuel shortages and rising electricity demand. It also blames the U.S. trade embargo, as it always does for every ill on the island.
But nothing stops Cuba from importing the parts it needs from the rest of the world. The real problem is a regime that can’t make much of anything work except exporting its people. Russia and Venezuela have reduced fuel sales to the island, which can’t pay its bills. Shortages of food and medicine are rampant.
Cuba’s dictatorship is a human tragedy and its people deserve much better. But they won’t get it as long as Communists run the place and enrich themselves at the expense of the people they impoverish.

Sens. Joni Ernst (R., Iowa) and Gary Peters (D., Mich.) are behind the ultimatum. Under their Telework Transparency Act, each federal agency would have to lay out its work-from-home policy and count how many people come into the office. That would give Congress the data it needs to crack down on laggards. The Senate Homeland Security Committee approved the bill by a 12-2 vote last month.
Congressional action is overdue since nearly every agency has let mass absence linger. Not one of the 24 largest agencies used even half of its office space during a three-month period last year, according to the Office of Personnel Management. The Social Security Administration was essentially a ghost town, with 7% of space occupied.

Yet the Biden Administration has stonewalled attempts to learn the scale of the problem. The nonprofit watchdog Open the Books requested location data for federal workers under the Freedom of Information Act. The Administration returned a document with 281,000 redactions, making it impossible to know how many workers even claim they’re still in the capital.

Since Harris became the anointed of the Dem party, the media coverage of her has been 84% positive, while Trump’s media coverage has been 89% negative. During that time, what has happened to their favorability ratings according to public opinion polls? Trump has *gained* in favorability, while Harris has *lost* in favorability. This was actually highlighted in CNN recently – of all places!
So . . . could Trump be gaining because of the coverage by media actors that the public deeply distrusts? That can’t be proven, but I wouldn’t dismiss it out of hand.

As noted by an anonymous commenter below, based on its poll averaging, RCP has Trump at 312 electoral votes in the no-tossups row. As for battleground states, RCP has the following:
– Michigan: Trump +1.2
– Pennsylvania: Trump +0.8
– Wisconsin: Trump +0.2
– Arizona: Trump +1.6
– North Carolina: Trump +0.5
– Georgia: Trump +1.8
– Nevada: Trump +0.8
So in all seven of the battlegrounds Trump leads, if only by a little. But that’s statistically significant because it’s all seven, and it’s based on an average of polls, not a single poll.
Note: Harris is up in a three states that are listed in RCP’s battleground section, namely Minnesota, Virginia, and New Mexico. Likewise, Trump is up big in Ohio and Texas. However, these are generally not considered real battleground states anymore: these days the three that favor Harris are reliably blue, and the two that favor Trump are reliably red.

It’s true that all news reporting carries some bias — the most obvious being in news selection….what events register as relevant? That depends greatly on your perspective and interests.
In the current partisan deathmatch, news relevance boils down to that which makes the opposition (“them”) look bad, and makes “us” look good. These are tribalistic impulses, not even needing to be taught. That same biased information processing is what helped upright primates survive in small, cohesive groups for 200,000 years. That DNA lives on in every baby born. Biased reporting is something every human does, even if subconsciously.
A sign of bias-awareness is when a news source is willing to publish counter-narrative news…something that calls into questions or undermines one of its preceding assumptions, or goes against the conventional wisdom of its audience.
I’d say that’s how you can spot a trustworthy new source — but, the sophisticated infowarriors out there understand they have to gain trust, and so they will put out unexpected, counter-narrative pieces now and then for that effect.
The will to manipulate and deceive is part of our human condition. Our Founders understood humans to have those tendencies, and put forth a system of adversarial court proceedings — with subpoena to shatter walls of secrecy, with strict rules of evidence, and with juries as finders-of-fact — as the best way to elevate truth over falsehood.
If we could expand defamation law to include attempt to dupe the public for political effect — and confront it with rapid-due-diligence lawsuits — then here’s what I imagine would happen.
No media org wants to be sued, and publicly dressed down by a jury finding that it attempted to defraud the public.
The few who are successfully sued for Public Fraud serve as exemplars. Over time, the newsroom begins to mimic the standards of the courtroom. Assertions are held up to scrutiny (cross examination) before being published. Anonymous leaks are discounted as hearsay. The editor-in-chief (or news exec) and legal staff act as the neutral magistrate, and manage an adversarial clash of producers and writers.
But the most far reaching impact Public Frauds lawsuits on the newsroom would be giving investigative journalists a new power tool. Imagine this conversation between a reporter with a powerful entity engaged in a cover-up: “If you don’t want to answer our questions, we can sue for Public Fraud and force you into a deposition — it’s your choice.”
Investigative journalists (except where the cover-up includes an element of defamation) have never had the power of subpoena to crack open the wall of stonewalling. Public Frauds lawsuits changes the game in the interest of truth-seeking and truth-telling.
Would there be frivolous lawsuits?….of course. But copying the model of defamation lawsuits, one can predict that not every petty accusation of fraud would be entertained by a Judge. Suing costs money. What you’d hope for is that the political whoppers-of-consequence, e.g. false pretexts for going to war, cover-ups of candidate corruption, and deceptive infowarfare pushed out by government officials and their media surrogates, would be where serious casework is undertaken by the Courts.
We might at least consider whether there is are moral grounds for duping the public. And then, take a look at our legal options for investing long-term in the trustworthiness of the public square.

The speech of James Madison competes with Adam Smith’s Invisible Hand. Madison saw complete speech as the way to truth. Media knows we are more comfortable in our own echo chambers, and has built business models to cater to the chambers. Models that depend on advertiser spending preferences, profitability and happy 401(k) owners, and the revenue from data brokers’ purchase of our personal information. These things do not obey our election cycle. They are more like plate tectonics. At present two things project some hope for a better relationship between Madisonian speech and the Invisible Hand: this blog and Jonathon’s book The Indispensable Right, and Elon Musk’s efforts on X to beef up a business model where everybody gets heard. Adam Smith will hold up the speech pillar if our market demand is visible and compelling.
