Yesterday, Arizona Attorney General Kris Mayes became the latest Democratic prosecutor to suggest a possible criminal charge against former President Donald Trump. Mayes suggested that Trump’s controversial statement on Liz Cheney going to war could constitute a criminal threat. It is absurd and Mayes knows that any such charge would collapse before any remotely objective trial judge.
The promise of a criminal investigation by Mayes may hold a type of thrill-kill enticement for voters, but it would constitute a major assault on free speech in criminalizing political rhetoric.
I have often criticized Trump for his rhetoric and particularly his personal attacks on opponents and critics. However, the question is not whether you like the Cheney comment but whether there would be any meaningful limits on criminalizing political speech.
Critics charged that some media outlets were accused of misrepresenting the comments by cutting off part of what Trump said.
Drudge Report ran a banner reading “TRUMP CALLS FOR CHENEY’S EXECUTION.” It then linked to the partial quotation on MSNBC and CNN:
“I don’t blame him for sticking with his daughter, but his daughter is a very dumb individual. Very dumb, she’s a radical war hawk. Let’s put her with a rifle standing there with nine barrels shooting at her, OK? Let’s see how she feels about it. You know, when the guns are trained on her face.”
However, they cut off the lines that followed. Here is the whole quote with the removed lines in bold:
“I don’t blame him for sticking with his daughter, but his daughter is a very dumb individual. Very dumb, she’s a radical war hawk. Let’s put her with a rifle standing there with nine barrels shooting at her, OK. Let’s see how she feels about it, you know, when the guns are trained on her face. You know, they’re all war hawks when they’re sitting in Washington in a nice building saying, oh, gee, we’ll, let’s send — let’s send 10,000 troops right into the mouth of the enemy.”
The quote is clearly a reference to Cheney going to war and how she would feel about it.
The usual suspects ran to X to decry a threat of violence, including Harvard Professor Laurence Tribe. Tribe previously called for Trump to be charged with the attempted murder of former Vice President Mike Pence. Even though no prosecutor has ever suggested such a charge, Tribe assured CNN that the crime was already established “without any doubt, beyond a reasonable doubt, beyond any doubt.” Tribe also previously declared that there was evidence supporting criminal charges of witness tampering, criminal election violations, Logan Act violations, extortion, espionage, attempted murder, and treason by Trump or his family.
Once again, I do not like the tenor or the name-calling. However, it is most clearly not a criminal threat.
What is most striking about Mayes’s promise is that no competent prosecutor would believe that such a political statement could constitute a crime. As I discuss in my book, “The Indispensable Right: Free Speech in an Age of Rage,” people do not like to admit it but they like the rage. It is addictive and contagious, even for prosecutors.
We have been here before with Trump. After the January 6th riot, there was an overwhelming consensus that Trump could be charged with incitement. After the riot, District of Columbia Attorney General Karl Racine was widely praised when he announced that he was considering arresting Trump, Donald Trump Jr., Rudy Giuliani, and U.S. Rep. Mo Brooks and charging them with incitement. So what happened to that prosecution? The failure of Racine to charge Trump was not due to any affection or loyalty to the former president. It was due to the paucity of direct evidence of a crime that would hold up in court. Supporters of this theory also often cut off the quote before Trump told his followers to protest “peacefully.”
Mayes will also likely drop the matter in time with no action. The important thing was to convey to Democratic voters a desire to prosecute Trump. It is now the bona fides of every Democratic prosecutor.
Even under Counterman v. Colorado, the Supreme Court ruled that criminal threats must be based on a showing of a culpable mental state. It cannot be based merely on a claim that words are objectively threatening. At a minimum, it requires the person to recklessly disregard a substantial risk that his words could be perceived as threatening. In so holding, the Court sought to offer “‘breathing space’ for protected speech.”
The need for such breathing space is even more significant in the context of a presidential campaign. For example, after his controversial garbage comment, Biden was accused of wanting to drown Trump. He has previously spoken about beating up Trump. None of that could be reasonably viewed as actual threats.
Even some figures on the left called out the media for misrepresenting the statement. The Young Turks’ Cenk Uygur wrote “Donald Trump did not call for the execution of Liz Cheney. That is a bald-faced lie.He was making a point about how she is a chickenhawk. But also, Trump shouldn’t talk about guns being ‘trained on her face,’ especially in a time where we’re worried about political violence.”
Vox correspondent Zack Beauchamp added his objections: “Folks, Trump didn’t threaten to execute Liz Cheney. He actually was calling her a chickenhawk, something liberals said about her for ages. Look at the context — Trump is talking about giving her a weapon. Typically, people put in front of firing squads aren’t armed.”
Political analyst Jonah Goldberg retracted his comments on CNN and now admits that there was no threat by Trump.
The threat from Mayes constitutes political pandering of the worst kind. Suggesting another round of lawfare just days before the election is a disservice to her office and the citizens of Arizona.

3. To cause physical injury to another person or damage to the property of another in order to promote, further or assist in the interests of or to cause, induce or solicit another person to participate in a criminal street gang, a criminal syndicate or a racketeering enterprise.
B. Threatening or intimidating pursuant to subsection A, paragraph 1 or 2 is a class 1 misdemeanor, except that it is a class 6 felony if:
1. The offense is committed in retaliation for a victim’s either reporting criminal activity or being involved in an organization, other than a law enforcement agency, that is established for the purpose of reporting or preventing criminal activity.
2. The person is a criminal street gang member.
C. Threatening or intimidating pursuant to subsection A, paragraph 3 is a class 3 felony.

It is still likely that SOME of the gains in republican early voting are coming at the expense of republican election day voting.
But we will not get to find out the extents until election day.
It is possible that Democrats have chosen in 2024 to vote in much greater numbers on election day.
It is possible that the large increase in republican early voting has come at the expense of the normal tsumnami of republicans voting on election day.
But the more likely explanation is that the press and pollsters are missing the fact that there is a real enthusiasm gap. That despite the “vibe” that few are happily voting for Harris, and few are desparately voting against Trump.
That is certainly true of black votes – which will be critical in GA, NC, VA, PA, MI, and WI

But my “guess” is Trump wins the popular vote by atleast 2pts. That like in 2016 and 2020 the polls are off on Trump’s support – but not by the 4-7pts they have been in the past, but more like by 2-3pts.

Jonathan: I doubt there is any legal basis to charge DJT under Arizona law. His veiled rhetorical threats against Liz Cheney come close but do not appear to cross the line into a crime.
That said, DJT’s comments about Cheney reflect his proclivity for projection. He often accuses others of his own failings. DJT avoided the Vietnam draft by getting his father’s podiatrist to write a diagnosis of “bone spurs” so DJT could avoid combat in Vietnam. If there is a “chickenhawk” DJT fits the bill.
But DJT often resorts to violent rhetoric. After the interview with Tucker Carlson DJT went to a rally in Milwaukee where he complained about his mic not working: “This mic stinks. Do you want to see me knock the hell out of the people backstage”? So we can count on DJT to make direct threats of violence against others.
One thing is certain. If DJT loses again this year he will not accept the results. Just as he did on Jan 5, 2021 he will encourage his MAGA followers to “fight like hell” again. Look at what’s going on in Florida. The government is trying to censor speech promoting the abortion amendment because TV ads are being called deceptive, misinformation, and dishonest to the public. I’ve yet to see Turley write about it. But I doubt he will since it involves Republicans fighting hard to censor TV stations from airing ads they consider harmful. A federal judge already imposed an injunction against the state from punishing the TV stations. Turley is strangely silent given that he is always finding issues in strange out-of-the-way schools and isolated events.
Let’s imagine there were term limits for members in Congress and the Senate, there would be no discussion of Cheney, Pelosi, Schumer, Schiff and yes members on the right as well. Take away the opportunity for personal enrichment and maybe, just maybe the people’s work would be done.

Term limits would require a constitutional amendment, which means 38 state legislatures all agreeing to it. Not going to happen.
If such an amendment were proposed I would oppose it, because the public has the right to elect whomever it feels best represents it in any office. If that person has served the public well for 12 years or 20 years or 40, why should the public be deprived of the right to stay with what works for it? As someone who is voting for Trump, hasn’t voted for any Democrat since the mid 1970s, despises Liz Cheney types (Kinzinger et al) and who thinks that the Democrats are actually harming our country with many of them doing so intentionally, I have to say that we cannot make geopolitical decisions based on whether or not the senator or congress person would want to be in harms way. Sometimes nations have to act even if it means putting our young military folks in harms way.
The right kept us from arming ourselves in the 1930’s for fear that we would get into the war and the left has been trying to gut our military for about 50 years now. We NEED to be the strongest nation, we cannot allow China to pass us militarily or the world as we know it will cease to exist.
The Bernie’s, Warrens, AOCs, HArris’, Walzs’ and Markeys’ of the world want a weak America because they see America as evil and without redeeming value. We need to be strong and if it means that sometimes we need to get into battles it just has to be that way. Otherwise the Houthis will shut down shipping, Iran will take over the Middle East and we will be stuck saying “don’t”.

But there are causes I would put my life on the line to defend. The threshold cannot be any lower than that. If that were the standard, there’d be no fighting over pipelines, the petrodollar, or any political BS.

They’ve attempted two assassinations. That we know about. Who knows how many other assassination plans have been aborted. Trump must know they will try again. I mean, Democrats renamed themselves The Resistance to show how much they hate him. They tried impeaching him. Twice. Corrupt Democrats have tried kicking him off ballots. Corrupt Democrat judge has tried to bankrupt him. Corrupt Democrat prosecutors have tried to imprison him on bogus charges. It’s all failed.
I can’t help but compare Trump to Bennazir Bhutto, who KNEW she was likely going to be targeted for assassination. She ran anyway. Won. And was assassinated.
Like Bhutto, Trump KNOWS with fairly high certainty that if he wins they’ll kill him.

Lets wait till after Nov 5th and see if they use violence or not. They have already proven their tendencies for violence with the 2020 Summer of Love.
Its like no one remembers the riots after Trump was elected the first time.
There will be violence
S. Meyer, apparent cheating in PA, AZ, AR, and TX: Democrats posing as poll workers to close polls early in red counties; poll workers slow walking red counties; poll workers harassing MAGA supporters for their hats. VOTING MACHINES ACTUALLY SWITCHING VOTES TO HARRIS!
Voters are advising other voters to check their ballots after using the machines. I’ll check mine.
And Democrats engaging in these illegal acts all have the same looks on their faces: defiant, primeval hatred–and not one word from the DOJ.
I don’t yet know how widespread or systematic this is, but if it becomes bad enough to throw the election in doubt, there is no bottom here. Conservatives are already fed up.
Is it possible Democrats would rather see us dead? Do they really believe the military and courts would defend their rigging an election to “save democracy?” I hope that’s not the case.
Not only have the Democrats or their supporters acted criminally, but I believe they have a part in the assassination attempt, at the very least through benign neglect. Iran is a significant threat, but Trump, as President, will act against Iran and any other state-sponsored attempt to curtail his activities. I pray that the cheating is minimal because if it is, Trump will win by a landslide.

Combine that with the stupid “gotcha” question the media’s been asking R politicians over the last year:
“Will you accept the results of the presidential election?”
It’s fantastic what the Left feels one cannot know (what a woman is), and what one can know — events months into the future.
