Digging Out of a Mousehole: The Disney/ABC Settlement Reflects a New Reality for Media

Below is my column on Fox.com on the settlement of ABC News of the defamation case brought by President-elect Donald Trump. The settlement has enflamed many on the left as well as reportedly some at ABC News. However, ABC likely saw this as a no-win situation as it faced potentially embarrassing depositions.

Here is the column:

The late Richard J. Daley famously declared that “we as Democrats have no apologies to make to anyone.”

That doctrine seems still to be alive and well with many in the party when it comes to President-elect Donald Trump. After ABC News and its anchor George Stephanopoulos apologized to Trump this week to settle a defamation lawsuit, many Democrats were apoplectic.

Marc Elias, the controversial lawyer involved in the funding of the infamous Steele dossier by the Clinton campaign, denounced ABC News for bending a knee to Trump. He then trolled for contributions for his own organization as “unapologetically pro-democracy.”

Of course, ABC was not apologizing for advancing democracy but for alleged defamation. The network and the anchor expressed “regret” for stating that Trump was found “liable for rape” in a New York civil case. (The jury found that Trump had sexually abused and defamed E. J. Carroll). While Trump was never convicted of rape, Stephanopoulos repeated the claim ten times in his interview with Re. Nancy Mace, (R., S.C.).

What made the settlement interesting is that ABC was previously relying on the statements of the judge in the New York case, Judge Lewis Kaplan, who declared that the charge of rape was “substantially true…as many people commonly understand the word ‘rape.’”

Stephanopoulos played up his defiance of Trump with CBS’s late-night host Stephen Colbert. To the delight of Colbert, who regularly attacked Trump on his show and openly supported both Joe Biden and Kamala Harris,  Stephanopoulos proclaimed that he wouldn’t be “cowed out of doing my job because of a threat.” He added, “Trump sued me because I used the word ‘rape,’ even though a judge said that’s in fact what did happen. We filed a motion to dismiss.”

So what happened?

Well, two things and both are related to the timing of the settlement.

First, the settlement came just before ABC and Stephanopoulos were to be called for depositions, as ordered by U.S. Magistrate Judge Lisette M. Reid.
That discovery was likely to prove more embarrassing for the network than it would Trump and could have revealed internal messages on the controversy.

The danger is on full display in another courtroom where CNN has been losing critical motions in a defamation case where punitive damages could result. Anchor Jake Tapper and CNN are being sued by Navy veteran Zachary Young after falsely suggesting that he and his organization were exploiting desperate Afghan refugees. Discovery uncovered malicious and unprofessional emails from producers promising to “nail” Young and making the segment his “funeral.” Disney was not eager to put its matinee personality, Stephanopoulos, through a similar meat grinder.

Second, the settlement occurred after an election in which Trump won the trifecta of the White House, Congress, and the popular vote.

Like most media, ABC was known for its unrelenting attacks on Trump and favorable coverage toward his opponents. The network’s iconic show, The View, has become an unhinged, partisan rave session against Trump, Republicans, and the majority of American voters. The show’s hosts now regularly read retractions or corrections to blunt allegedly defamatory screeds from its hosts. It has gotten to the point that the ABC General Counsel may soon need a chair at the table.

Disney is trying to adopt a more neutral stance after years of opposition for its stances on political issues and accusations of ultra-woke products. It is still struggling to appeal to over half of the country, including the most recent controversy involving the star of its soon-to-be-released remake of Snow White.

After the election, actress Rachel Zegler declared herself “speechless” over the results. That would have been a welcomed state for Disney, but the actress then found her voice in the most polarizing way, publicly praying “May Trump supporters and Trump voters and Trump himself never know peace.” Zegler was clearly miscast in the film. It was the evil Queen that was supposed to harken “a blast of wind to fan my hate.”

On top of these controversies, ABC News was attacked by many over its handling of the Trump debate with Vice President Kamala Harris and it’s biased “fact-checking.” 

With networks like MSNBC and CNN in a ratings and revenue free fall after the election, Disney clearly wants to start fresh with the new administration. Both are facing possible sales at potentially bargain basement prices.

The media echo chamber against Trump failed spectacularly in this election. With record levels of distrust of mainstream or legacy media, the public has increasingly shifted to new media.

In the meantime, Trump has been running the table on lawfare with the dismissal of the two federal cases and a victory on presidential immunity in the Supreme Court. The Georgia prosecution is falling apart over the conduct of the prosecutors rather than that of the defendant. The New York civil case faced a highly skeptical court over the grotesque award against Trump and his corporation.

Even Democratic politicians like Sen. John Fetterman (D., Pa.) now feel comfortable admitting publicly that the New York hush money prosecution was “bullsh*t.”

For many politicians and pundits, the election seemed to flip the magnetic poles of the country. We now have ABC News giving millions to the Trump Presidential Library as democratic donors move toward a boycott of the Biden President Library.

With networks like MSNBC and CNN struggling for their very existence, ABC is intent on having a chair when the music stops. While the ABC settlement may not be an admission of guilt, it is a recognition of the reality after this historic election.

    This framing needs to be retired. All you can say is that the jury voted to hold Trump liable.

    In today's world, you can NOT take for granted that the jurors were interested in objective truth, or that they returned a fair verdict based on the law, facts, and evidence. All you have to do is see the many people willing to go on social media to rationalize the premeditated, cold blooded, execution of a man shot in the back while peacefully walking down the street a few days ago.

    So no. I don't agree that the jury necessarily "found" that Trump sexually abused Carroll. That implies they considered the evidence, facts and law and returned a fair and impartial verdict. I do not believe that happened. The jury voted to hold Trump liable. I wish they were equivalent statements. But they are not.

      True but it was my impression the jury found Trump guilty of abuse for lashing out (or suggesting she was crazy?) in his response to allegations, not that he had ever actually physically abused her at the time of the alleged incident. This with zero evidence the event ever took place at all. (Similar in my mind to cries of obstruction for a crime never committed.) The jury found Trump liable for what is essentially free speech and fairly applied analysis, in one's own defense, particularly so since there appeared not one iota of truth to, or anything to substantiate, her allegations. And then this crazy judge had the gall to retry and convict Trump in one fell swoop in stating that, yes, Trump was found to have raped E. Carroll. This is not justice in America. And it's not kangaroo court or just a clown show either, what it is is political persecution. And every last one of these political blow boys and blow toys should be charged with civils rights violations.

      Turley, much respect, but he often appears focused on keeping the peace. There can be no peace until all of these rabid morally bankrupt dogs actively destroying the American Way are driven entirely from American politics. It's either that or we as a nation of last refuge will not survive.

  2. ABC took a similar approach to what Turley’s employer decided: they opted to settle rather than go to trial, where embarrassing and damaging information could be revealed. However, ABC’s settlement amount is nowhere near Fox News’ massive $787 million settlement for knowingly defaming Dominion. It’s also important to note that Smartmatic’s ongoing defamation case is still pending, and Turley has been notably quiet about it. Newsmax has already settled with Smartmatic, but depositions are still outstanding for Fox News in the Smartmatic lawsuit.

    The question remains: Will Fox News settle for a similar amount, or will they choose to go to trial? I expect Turley will keep us updated on the Smartmatic defamation case against Fox News for supporting Trump’s false claims of voter fraud.

      3. Olly, Fox News, Fox….News. He’s also employed by Fox News as a legal contributor. An individual contributor is a paid employee who also has a contract. Turley often mentions that he is a regular contributor to Fox News and often goes on camera to offer his legal opinions whenever Fox News wants an “expert” legal opinion on a Fox News narrative or segment. It’s not a full-time gig, I’m sure, but nevertheless, he’s still legally an employee.

Concerned about the potential harm to their brand, they opted for a settlement. Legal experts noted that everyone was expecting the trial and its implications.   6. I loved the column today. The fact that it was dripping with sarcasm made it even better and juicier. Even I know (as a non lawyer) that discovery can be a knife right through your case. Having been the target of medical malpractice cases (as many doctors are these days) I came to know the ends and outs of discovery very well.
    It can alter your research when you are preparing for a case by learning to leave as few footprints as possible for the other side to track.
    The other thing I have noted about these Trump cases in New York and elsewhere is that they are the legal equivalent of a free for all compared to court cases in my area of the country. The E.J. Carroll Case, the Stormy Daniels NDA case and the Business case with it’s 1/2 billion dollar fine are such obvious sham cases and trials that you have difficulty believing that legitimate courts (so to speak) in NYC continue to allow them to proceed. It is an embarrassment to the state and NYC and would push me to leave the state immediately since it’s obvious the the City and State has no interest in protecting all it’s citizens.

  8. I believe she received $84 MM. I’m not a Trump fan but I have a hard time believing the case. It smells like the false allegations against Brett Kavanaugh. Any high profile male could be treated in the same way in New York. I would avoid it.

  10. Jonathan: yet again you are engaging in distractions to avoid discussing the dangers of DJT in the White House for another four years. Now he is discussing attacking Iran; more likely to start WWIII than the war he laid the groundwork for in Ukraine.

    This lawsuit shows American voters two things. First, as those of us in law would term it, this is prima facie evidence that DJT does in fact have an enemies list with many of America’s best investigative journalists at the top of it. Since leaving politics for journalism, George Stephanopoulos has been instrumental in exposing DJTs many crimes. DJT will not tolerate criticism and that put Stephanopoulos on DJT’s enemy list. The only reason Stephanopoulos agreed to settle and deleted his account on Elon Musk’s “X” was to spare his two young daughters the stigma of being pursued by DJT’s lawyers and MAGA supporters with this frivilous lawsuit.

    Second, this defamation lawsuit being allowed to proceed shows just how corrupt the Florida judicial system has become. This lawsuit would never have survived the first minute if it had been brought in the legitimate courts of New York or Washington DC. This judicial proceeding, along with another Florida court arbitrarily dismissing Special Counsel Jack Smith’s criminal indictments against Trump is all the evidence Americans need to see how DJT corrupts everything he touches, including our American justice system and equal justice for all.

    The next four years are going to be a terrible period of lawfare, as DJT uses his Attorney General and FBI Director to investigate and try to jail every politician, journalist, and protest group that stands against his corruption. And what he can’t do by using the Department of Justice, he will do with ruinous lawsuits against those on his enemies list in the third world corrupt courts of Florida. They have taken a page from the Nazi’s: if a lie is repeated often enough, it will become truth. Adam Schiff STILL believes the Russian collusion lie. What he enjoyed most of all was the spotlight it placed him in. I don’t think this payout will change any minds at ABC or any other legacy media. They are simply too entrenched in their hatred for Mr. Trump and those of us who have voted for him.

    This time Stephanopoulos did not escape. This time ABC and Stephanopoulos were so terrified of having him sit to be deposed and Trump getting access to Stephanopoulos’s emails, texts, and messages that they eagerly settled out of court by paying the $15 million.

    And they joined their fellow political whore Stormy Daniels: they both have been forced to pay Trump’s legal defenses for the defamation lawsuits.

    Gigi also likes to scream Trump is a convicted rapist in her daily screeds. If Stephanopoulos and all the lawyers defending his and ABC’s filth can go down, does Gigi believe she’s so completely insignificant that she can continue saying whatever she wants?

Carroll not have any evidence, but they changed the statute of limitations for one year just to prosecute Trump. She could not give an exact time, just a range of possible years that this took place. The dress she claimed to have worn that day and was posted on the cover of a magazine had not even been designed in that time range. She had no witnesses. She is exactly what Trump said she is, a nut case. She calls one of her pets Tit, and another Vagina. She claimed to a talk show host that many people find rape sexually exciting. And there have been other examples of her always talking about sex. If this doesn’t shout of collusion to trap Trump, I don’t know what does. Wonder how much she was paid. Logically thinking about this, Trump was always rich, well known, and as a young man not bad looking. It is doubtful he went into the store shopping to begin with, and to physically abuse someone near by in a dressing room is beyond the scope of possibilities. It wouldn’t surprise me if women threw themselves at him because of his money, and she would be a prime candidate. But there is NO PROOF ANYTHING HAPPENED! None! The Left wants to believe it, so it appears.

    1. A few more problems. Her case, and probably the NYS bill of attainder, was funded by leftist mega-donor, Reid Hoffman. Carroll was a writer and “sex-columnist” who alleged that she had been “raped” by numerous other men over the years, but none of them was named Trump. Trump was a multi-millionaire NYC playboy at the time that was dating models, if Trump attacked her in a dept store changing room, it would have been national news.

    2. they changed the statute of limitations for one year just to prosecute Trump.

      No, they didn’t. You’re in no position to criticize Carroll’s lies when you tell lies of your own.

      1. Yes, they did change that law. And you lying to say that never happened puts you right up there with Stephanopoulos.

        1. They did NOT change any law “just to prosecute Trump”. Or even to sue him. No law was ever changed with Trump in mind. Anyone who claims otherwise is a liar, and just as bad as Carroll.

  15. progressives will one thing from this settlement: always preface the statement “Trump committed rape” with “the judge said”

    The judge needs to be impeached, but it being NY, it will probably be nominated to Chief Justices of the BY supreme court.
