MSNBC Contributor: Biden Proved He is the “Standard Bearer” for the Founders By Vetoing the Judges Act

In an age of advocacy journalism, April Ryan has long been a standout. Ryan routinely engaged in diatribes in White House press conferences during the Trump Administration and has openly opposed all things Republican or conservative. Now, the MSNBC contributor and Grio White House correspondent has declared that President Joe Biden was a “standard-bearer for what the Founding Fathers put in place.” The reason? His much-criticized and partisan veto of The Judges Act. While even stalwart Biden allies like Delaware Sen. Chris Coons criticized the President for vetoing the badly needed, bipartisan measure to add new judges, Ryan declared it the work of a modern George Washington.

When the MSNBC host noted that The Judges Act “had bipartisan support” and was needed to relieve the overloaded courts, Ryan responded by saying that an obstructionist partisan move is precisely what the Framers would have wanted:

“It’s simple this President Joe Biden, didn’t want to give President-elect Donald Trump a chance to add more conservatism into our courts, bottom line. I mean, you have so many people talking about how everything is weighed down right now. The White House on January 20th at noon will be Republican, the House, the Senate, what? Republican and the Supreme Court leans Republican. So this president wanted to ensure checks and balances.

…He is the standard bearer for what the Founding Fathers put in place. He wants to make sure everything goes well. And think about this, even though it wasn’t a federal judgeship, think about what happened with Merrick Garland. Think about the fact that Merrick Garland never got a chance to even have interviews with some senators because they rebuffed, they did not want to have a Democrat on the U.S. Supreme Court. In some ways this is that as well, this is trying to hold the line, to make sure once again that fairness and equal play and checks and balances are in place.”

Ryan mixes rationales of avoiding adding conservative judges to retaliation for prior votes as a noble cause that harkens back to the founding.

Of course, as discussed in The Indispensable Right, some like John Adams used the Alien and Sedition Acts to arrest their political opponents, but few point to that as the gold standard for the Founders. Ironically, I have previously drawn comparisons between Biden and Adams.

Other Founders like Washington did not even support the creation of political parties, let alone endorse raw partisan moves by presidents. Indeed, Biden became the very thing that Washington wanted to avoid in saying that political partisanship:

“may now and then answer popular ends…by which cunning, ambitious, and unprincipled men will be enabled to subvert the power of the people and to usurp for themselves the reins of government…”

The move by Biden is a disgrace. Our courts are overwhelmed by dockets that leave parties without any resolution for years. In 2004, the number of cases in district court pending for more than three years was 18,280. This year, there are 81,617.

If justice delayed is justice denied, our court system is becoming a tar pit of injustice, with litigants left without verdicts or relief for years.

Every responsible and independent group in the area supported this bill as essential to supporting and maintaining our legal system. The White House did not oppose the bill until Democrats lost the election. (Some Republicans also withheld their support until after the election).

Before the election, both Democrats and Republicans supported the bill in an all-too-rare moment of bipartisanship. Biden then vetoed it because he did not want a Republican to appoint new judges (even though the new judgeships would be added over a ten-year period).

In vetoing the act, Biden once again shredded any claim to being a president who could put the public interest ahead of petty political interests. It ends his presidency on a cynical, obstructionist note.

Nevertheless, Ryan and others on the far left are applauding the act as just what they want to see in a president.

It is one thing to discard any sense of integrity or responsibility, but do us a favor: leave the Founders out of it.

  1. Jonathan: When it comes to partisanship two can play the game. Joe Biden vetoed the Judges Act for the same reason Mitch McConnell and the Republicans disgracefully refused to carry out their constitutional mandate to give “advice and consent” when Pres. Obama nominated Merrick Garland for the SC.

    You have a short memory. In March 2016 Obama nominated Garland to fill a seat on the Court due to the death of Antonin Scalia. McConnell had 9 months to hold hearings on Garland’s nomination. Yet he refused saying he wanted to hold open the spot so the next president could fill the opening. When DJT won the election he nominated conservative Neil Gorsuch and he was confirmed in record time in Jan. 2017 by McConnell and the Republican Senate.

    The same thing occurred after the death of Justice Ginsburg on 9/18/2020. Then McConnell took a very different approach. He called DJT the night of Ginsburg’s death and told DJT two things. One, McConnell said he would put out a statement saying the Senate would fill the SC vacancy before the election and; two, he told DJT to nominate Amy Comey Barrett. The rest is history. With the confirmations of both Gorsuch and Coney Barrett, McConnell secured a 6-3 conservative majority on the SC that would set the Court on a right-wing agenda for decades, e.g., taking away a woman’s reproductive rights.

    Now you call Biden’s veto “a disgrace”. What about the disgraceful acts of McConnell by refusing to hold confirmation hearings on Garland’s nomination or ramming through the Coney Barrett nomination in the last months of the DJT administration? To use your own words, McConnell showed no “sense of integrity or responsibility”!

    1. The senate has no constitutional duty to consider a nomination just because the president made it. It is free to consent to a nomination, to oppose it, or to ignore it, as it wishes. And it is entitled to do so for political reasons, since it is a political body.

      As McConnell correctly said at the time, the senate had never before, in a presidential election year, approved a supreme court nomination by a president of the opposite party, and it wasn’t about to start such a precedent on his watch.

      Four years later the situation was very different, because the nomination was made by a president of the same party as the senate majority, so it exercised its clear right to consent to the nomination. It didn’t have to, but it chose to, as was its right.

    Especially this: “The bill has not been hastily drawn up, but is the product of years of study, analysis, and congressional review.”

    This: “District court filings have grown by 30 percent since 1990, when the last comprehensive judgeship bill was enacted. Meanwhile, since 1991, the overall number of authorized district court judgeships increased by only four percent. This has contributed to significant delays in the resolution of cases
    and serious access to justice concerns.”

    And this: “In some of our country’s most inundated district courts, the time between filing and disposition for a civil case is *four or five years*, compared to 20 years ago when the time was less than 22 months.” (emphasis added)

But that analysis was at odds with the assessment of their parent agency, the Defense Intelligence Agency, and wasn’t incorporated in the report presented to Biden.

    The DIA Inspector General’s office opened an inquiry in the spring into whether the scientists’ assessment was mishandled or suppressed, people familiar with the matter said. A spokesman for the agency declined to comment on whether this inquiry was continuing, had been completed and what it might have included.

        Trump can do that on his own. He can spend emergency funds by declaring an emergency at the border.

        2). Carry out the largest deportation operation in american history
        Again purely executive action.

        3). End inflation, and make america affordable again
        Some of that will happen automatically just by increasing real growth. Deregulation which Trump can do quickly on his own is a big first step.
        The next major factor is government spending. Trump will likely try to refuse to spend money – and that will go to SCOTUS which I will bet backs him.
        But even if it does not, it can pass through reconcilliation.

        4). Make america the dominant energy producer in the world, by far!
        Again executive action.

        5). STOP OUTSOURCING, AND TURN THE UNITED STATES INTO A MANUFACTURING SUPERPOWER
        Primarily executive action.

        6). large tax cuts for workers, and no tax on tips!
        That requires congress. It requires a fillibuster proof majority if it is to be permanent.
        But 10 year changes to the tax code are not subject to fillibuster.

        7). Defend our constitution, our bill of rights, and our fundamental freedoms, including freedom of speech, freedom of religion, and the right to keep and bear arms
        again executive action mostly.

        8). Prevent world war three, restore peace in europe and in the middle east, and build a great iron dome missile defense shield over our entire country — all made in america
        Again executive action mostly.

        9). End the weaponization of government against the american people
        Again executive action mostly

        10). Stop the migrant crime epidemic, demolish the foreign drug cartels, crush gang violence, and lock up violent offenders
        again executive action mostly

        11). Rebuild our cities, including washington dc, making them safe, clean, and beautiful again.
        I am not sure what this means. I suspect it means moving Biden Green New Deal spending to actual infrastructure.
        That can be done through reconciliation.

        12). Strengthen and modernize our military, making it, without question, the strongest and most powerful in the world
        Much of that is executive action – but spending changes require congress. That is going to be an interesting area.
        Numerous democrats have strongly suggested they would back DOGE if there were cuts to defense.
        There is enormous waste in defense spending. so it will be interesting to see what both parties agree to.
        Trump is a proponent of a strong military, his is NOT a proponent of funding the military industrial complex.

        13). Keep the U.S. dollar as the world’s reserve currency
        That is foreign policy.

        14). Fight for and protect social security and medicare with no cuts, including no changes to the retirement age
        Do you think democtrats are going to oppose this.

        15). Cancel the electric vehicle mandate and cut costly and burdensome regulations.
        Large parts of this can be done through executive action.
        But it is likely Trump can get green energy spending cuts through congress.

        16). Cut federal funding for any school pushing critical race theory, radical gender ideology, and other inappropriate racial, sexual, or political content on our children
        Again executive action.

        17). Keep men out of women’s sports.
        Alot can be done through executive action. But permanent action requires congress.

        18). Deport pro-hamas radicals and make our college campuses safe and patriotic again
        again executive action.

        19). Secure our elections, including same day voting, voter identification, paper ballots, and proof of citizenship
        This requires congress. But MOST of it is wildly popular.

        20). Unite our country by bringing it to new and record levels of success
        Executive leadership.

        You can disagree with elements of agenda 47 – but very few of them depend on congress.
        And even fewer require getting past a fillbuster.

    2. Can this vetoed bill not be repackaged and resubmitted when the next Congress convenes in January?

      Of course. Biden’s legacy and Democrats in general are DOA once the next Congress convenes

    3. So many people are saying, “no, it can’t be resubmitted, because Republicans don’t have a filibuster-proof majority”. This is an extension of Operation Demoralize, and it is pure BS. It passed the House and the Senate this time without a filibuster, didn’t it? When Republicans didn’t have any majority at all? If Democrats don’t want to pass it, why did they vote for it this time? It’s a bipartisan bill that already passed the House and Senate! Why would it be filibustered? Democrats are already looking at the next election. They see their “brand” is in the toilet, other than on MSNBC. And they know that if they don’t at least pretend to play along for a while, America is going to pull the handle and flush. You won’t see any ‘resistance’ for at least a year, while they try to chip away at Trump’s popularity.

  4. That’s not what checks and balances means. Obviously, it is not a requirement for Congress to have a majority political party different than the White House. I very much doubt April Ryan has opposed a Democrat majority Congress with a Democrat White House, as lacking checks and balances, such as when Barrack Obama took office in 2009.

    Conservative judges enforce the law. Out of control illegal immigration, state and local governments refusing to cooperate with federal immigration enforcement, and out of control crime was in part responsible for the Red Wave last November.

We left Richmond, VA precisely because of the increase in violent crime, police would no longer respond to our calls to 911 to report crime across our street in the city park, we heard gun shots regularly, police sirens blared daily, and the last straw was finding a stray bullet on our back deck. I was beyond pissed. There wasn’t enough ammo to provide us safety in Richmond. My annual Christmas letter this year to family and friends spoke about how we can look outside our windows and see beauty, neighbors wait in the driveway to chit/chat, and peace permeates our lives (meaning lack of fear of criminal violence and angst). Moving was our only “out” and we have come to celebrate our decision daily. Now I worry less about having enough ammo to fight the bad guys. Moving likely increased our life expectancy by minimum of 10-20 years!

          Avoid cities run by Democrats. It’s a matter of life or death

          I agree with you that crime statistics can create a false impression. When a DA refuses to prosecute theft, then not only does shoplifting increase, but stores stop reporting it, and simply file claims with insurance.

          It’s insurance claims in California that paint the most accurate picture of shoplifting damages.

            You are right about looking at insurance claims.

            Walmart. Target, Lowe’s, Home Depot and all the pharmacies that have anything of value locked away. There are at least three security guards per Walmart and Target. Thieves know they can get away with crime and seem unafraid of police and the security guards. Several large chain stores have closed up shop. These aren’t petty thefts, many are organized crime. The leader texts their people what to boost and the pawns go shopping for specific items. The bounty is sold as “legitimate” deals on social media.

            I learned yesterday, from someone in the know, that a number of the street beggars “homeless” at intersections are not there for a handout. They are dealing dope.

            There are long waits for specialty health care providers. Finding a PCP is nearly impossible! Why? One, providers do not want to come here. Two, the system is overwhelmed. Why would that be? We now have over twenty thousand known illegals who have Medicaid cards and they are tapping into the resources available for the citizens.

            The list goes on. The rent has gone up 30+% since COVID. Where else can 10+ million people go? Especially if they are subsidized by the federal government. I think our governor and mayor like it because the federal taxpayers money is being doled out to the illegals and is going into the local economy, an irrational and unsustainable idea.

            This the state where I was born and where I have family. However, we have been considering relocating in the near future if things do not improve.

When a chain store closes due to theft, then at least the employees have unemployment benefits. When a small business owner closes due to repeated thefts, they’ve lost everything. One of our friends owns a local store, and he had to ultimately put bars on the front, because he’d suffered so many shoplifting and blatant robberies. His insurance keeps going up, and his out of pocket costs to keep replacing the glass windows and door, door hardware, and now the bars, are appalling.

        Supreme Court precedent is not the same as legislation, and a good thing, too, or else we’d still have the Dred Scott decision.

        Although Dred Scott was reversed by Constitutional Amendment, at times, the Supreme Court itself has decided against prior precedent.

      5. Judges are an integral part of the criminal and civil justice system, which itself is critical to ensuring the law is followed, with consequences. Biased judges refuse to impartially apply the law.

        Before Roe v Wade was overturned, every nomination of Supreme Court justices was fraught with angst, protests, and at times violence, from the Left’s desire to pretend abortion prior to viability was a Constitutional Right. They sought to legislate from the bench, as long as it was Democrat justices doing so.

        A fair judge would rule on the merits of the case, regardless of personal feelings.

        Democrat INCUMBENTS won in the senate by razor thin margins in states Trump won.
        The house is close, but even that is heading red. The 2024 house election had several states judicially jury mandered.
        It is likely those democrat favoring maps will be tossed by SCOTUS.
        It took CA an extra month of counting the vote to steal an additonal 4 house seats or the GOP would have been +4 in the house.

        3 of the 4 democrat incumbents that survived – did so by campaigning as Trump cooperative.

        The Census bureau is saying that current demographic trends will shift 9 seats/ec votes from red states to blue states.
        FL and TX are gaining 7 seats/votes. It is only 2024. If the trend continues that will be 20 seats by 2030.

        The next Senate election has more republcan incumbents,. but AGAIN it is the democrats that are in vulnerable seats.

        Just as OH and FL and TX are no longer Swing states, PA, MI, WI, and NV are growing increasingly red.

        For the first time since 1928 Republicans have more registered voters nationwide than Democrats.

        Most importantly – Democrats through absolutely everything that had at Trump and LOST.

        That is very important. It means those tactics WILL NOT work in the future.

        The attacks on Gaetz and hegsoth have fizzled.

        And did I mentioned that Trump has GAINED votes in jut about every minortity demographic except highly educated white women ?

        Next – either you have to admit that you cheated in 2020, or you have to accept that 10+ million voters that voted democrat in 2020, either did not vote or voted for Trump in 2024.

        How are you getting those votes back ? Absent Bideneaque failure on the part of republicans – your not.

        Biden changed the rules for reporting crime to FBI and several thousand police units stopped reporting. The FBI exterlopates when that happens – and they did so badly.
        They ultimately revised the numbers – Crime went up.

        Regardless the NCVS – national crime victim survey which is much more accurate. has reported increasing crime through Biden’s administration.

        Nor should this surprise.

        Oddly Crime is actually down in many Read regions – becaue police are fleeing Defund police cities where they could end up in jail if a black drug addict dies while being arrested

        Hence crime in cities and their immediate suburbs is up, while rural and red suburb crime is down.

    The States assembled as the Senate do not need the Presidents approval to establish the executive and judicial departments! What does it mean to “ordain and establish”? That means that the States as the Union assembled in the Senate determine every aspect of the executive and judicial departments, including appointing the civil officers and judges, and the president has absolutely no say in the matter, as president only nominates when vacancies occur, and there are no vacancies when the departments are established. And when vacancies do occur, the president must nominate the number of persons with the required qualifications as determined by the States as the Union assembled in the Senate as part of their advice as rules for their proceedings to determine the persons to be appointed.

    If you geniuses spent more time actually studying the Constitution of the United States instead of trying to interpret it to your advantage, we wouldn’t have all these problems of malfeasance and dysfunction in our government!

    By the way, the States as they are assembled in the Senate determine what constitutes “Good Behavior” and enforces that Standard!

      First of all, the senate is NOT “the states assembled”. It is a legislative chamber whose members are ELECTED by the people of the states, but is completely independent of the states. No state can tell its senators how to vote. Nor can a state recall its senators if it’s unhappy with their votes.

      Second, NONE of the powers you claim belong to the senate. They belong to the CONGRESS, which consists of TWO chambers. And every decision of the congress must be presented to the president for his approval. It doesn’t matter what kind of thing it is, if it requires a vote in both houses, then it needs the president’s approval, or a veto override.

      Third, Congress (with the president’s approval) creates offices, but it does NOT fill them. Filling them belongs to the president, with the senate’s consent. And yes, that includes the initial appointment to a new office. Congress NEVER gets to make its own appointments, and certainly the senate doesn’t.

          The California Air Quality Resource Board (CARB), has banned the sale of gas powered cars by 2035, and has effectively banned the sale of RVs in 2025, because RV manufacturers cannot meet the Advanced Clean Trucks Act requirements that a percentage of vehicles produced be electric. There are no electric RVs. RV manufacturers don’t want to create electric RVs that can only drive a couple hours before requiring hours of charging.

          Democrats often tout California as the “Gold Standard”, and seek to emulate it. Democrats in state and local governments can do a great deal of damage, while conservatives might have no idea what they’re doing.
