The Supreme Court Halts Venezuelan Deportations as the Fourth Circuit Upholds Garcia Order

It has been a busy 24 hours in the courts. Early this morning, the Supreme Court blocked (for now) the deportations of any Venezuelans held in northern Texas under the Alien Enemies Act, a law only used three times before in our history. At the same time, the United States Court of Appeals for the Fourth Circuit upheld the lower court’s order in the case of Abrego Garcia.

Despite the growing counter-constitutional movement, both decisions show how the courts are functioning appropriately and expeditiously in sorting out these difficult cases. Indeed, I wanted to flag a couple of paragraphs in the Fourth Circuit case that I hope everyone will take a second to read and consider from Judge J. Harvie Wilkinson, a widely respected conservative judge.

The justices ordered the Trump administration not to remove Venezuelans being held in the Bluebonnet Detention Center “until further order of this court.”

Justices Clarence Thomas and Samuel Alito dissented from the order. However, this is merely a hold on deportations pending further review of the emergency appeal from the American Civil Liberties Union, which is challenging the use of the Alien Enemies Act of 1798.

This rarely used and highly controversial law stretches back to the Adams Administration. There are good-faith arguments on both sides of the case that the Court wants to consider. Accordingly, this is not surprising.

The Fourth Circuit also correctly upheld the lower court order in the Garcia case. I remain confused by the administration’s appeal. The Supreme Court already upheld the order requiring the Administration to facilitate Garcia’s return. I have been critical of that opinion, but it clearly recognized the authority of the district court to issue that part of the earlier order.

However,  Judge Wilkinson’s opinion contains one passage that I wanted to excerpt. It is a measured and important point that both branches need to show mutual respect in these cases. This sage advice is not coming from a critic or a liberal jurist. It is coming from someone who has been at the heart of conservative jurisprudence for decades:

“The basic differences between the branches mandate a serious effort at mutual respect. The respect that courts must accord the Executive must be reciprocated by the Executive’s respect for the courts. Too often today this has not been the case, as calls for impeachment of judges for decisions the Executive disfavors and exhortations to disregard court orders sadly illustrate.

Now the branches come too close to grinding irrevocably against one another in a conflict that promises to diminish both. This is a losing proposition all around. The Judiciary will lose much from the constant intimations of its illegitimacy, to which by dent of custom and detachment we can only sparingly reply. The Executive will lose much from a public perception of its lawlessness and all of its attendant contagions. The Executive may succeed for a time in weakening the courts, but over time history will script the tragic gap between what was and all that might have been, and law in time will sign its epitaph. It is, as we have noted, all too possible to see in this case an incipient crisis, but it may present an opportunity as well. We yet cling to the hope that it is not naïve to believe our good brethren in the Executive Branch perceive the rule of law as vital to the American ethos. This case presents their unique chance to vindicate that value and to summon the best that is within us while there is still time.

Well said, your honor.

One can disagree with the ultimate merits on legal issues. However, as I have previously written, the disagreement on those issues should not trigger demands for impeachment or other extreme measures.

  1. The irony here is that we are all looking at the “turd in the punch-bowl” and arguing about what to do. The “turd in the punch-bowl” was bequeathed to us by four years of the Biden administration that facilitated the flow of illegal aliens to enter the US willy-nilly yet the Trump administration is being criticized for its lack of due process in reversing the flow. It appears that there are some asymmetric rules being applied to illegal aliens willy-nilly entering this country and the need for scrupulous due process for the same illegal aliens to go back to their home country.

    Is he “conservative”? In a manner of speaking. Lewis Powell was a family friend of the Wilkinson’s apparently, and so Wilkinson was hired to be one of Powell’s law clerks. No objection to that per se, but it does lend itself to an accusation that his professional life, such as it is, has been way too insular.

    Has he ever represented a criminal defendant? No. Has he ever represented anyone, even the government? It appears not, he went from his clerkship into a professorship. He’s Yale, UVA Law.

    Do his credentials and “experience”, such as they are, lend themselves to a kind of credentialist snobbery? Yeah.

    My concern 10 years ago was that he wrote an article that equated “wrongful acquittals” and “wrongful convictions”, which I think is absolutely appalling in a judge. A judge’s job is to avoid the latter like the plague, and strictly speaking the former isn’t a judge’s concern at all.

    Not to mention that in 2014 a federal judge taking the position that habeas petitions shouldn’t be granted was so swinging-after-the-bell as to be cringe. Federal habeas in non-death penalty cases had long since disappeared, although it was and remains robustly – and quite incoherently – available in death penalty cases (how can it be that constitutional justifications for habeas relief are entirely absent, unless the death penalty is involved, when suddenly they are so abundant that relief is granted 50% of the time?).

    So, the point is that when the cameras aren’t rolling Judge Wilkinson doesn’t appear to have the same tender solicitude for “due process” as when the cameras are rolling.

    This whole kerfuffle over “Kilmar” is, like almost everything else the media does with Trump, a manufactured controversy.

    And the truth is Judge Wilkinson doesn’t care about the fate of any member of the rabble unless and until the other members of the chattering classes are already onboard, as they are with Kilmar.

  3. Jonathan: I wholeheartedly agree–“Well said, your honor”. Judge Wilkinson’s short 7-page opinion should be read by all Americans–lawyers and non-lawyers alike, not only because of its brevity but because Wilkinson is one of the most respected conservative judges in the mold of former federal judge Michael Luttig.

    Wilkinson points out that the DJT regime’s refusal to comply with the ruling of SCOTUS that Abrego Garcia must be returned from that hell hole in El Salvador is an existential threat to the rule of law. The judge said “The Executive will lose much from a public perception of its lawlessness and all of its attendant contagions”. Polls show that “public perception” is already against the DJT regime’s unlawful actions. Most Americans believe that immigrants are entitled to due process rights before they can be deported. The DJT regime denied those rights to Abrego Garcia by snatching him from his car and putting him in the notorious prison in El Salvador.

    But I dissent from your view on the Alien Enemies Act of 1798 that there are “good-faith arguments on both sides” of the issue as to whether DJT can use the AEA as justification to deport immigrants. The AEA only permits a president to deport immigrants in time of war. We are not at war with Venezuela or any other country. The DJT regime’s use of the AEA is an unlawful attempt to abuse wartime authority to justify what is basically a mass kidnapping campaign.

  4. Abraham Lincoln defied the Supreme Court. How? He told Justice Taney that he would throw him in prison if he did not go along with Lincolns cessation of Habeas Corpus. Taney also held the South had every right to secede. Today Lincoln is considered a great hero. There are times when POTUS has to act to save the Nation. If the Courts continue to block deportations it will lose its credibility which is already tattered. With an idiot Justice that can’t define what a woman is, do you think the public will have much more patience?

    1. The SCOTUS needs to address ALL of the nationwide injunctions by US District Judges once and for all. Not this drip drip oon each individual judicial overreaching by District Judges! Chuck Schumer admitted, no he bragged that before Biden left office the Democrat Senate placed over 300 PROGRESSIVE (AKA Socialist, Marxist Judges in the lower Districts across the nation. They were given their primary assignments of blocking ALL of President Trump’s agenda. SCOTUS needs to put them in Constitutional check! These District judges were not created under the Constitution. They were created by Congress, who needs to get themselves in gear to get legislation passed to also define the jurisdiction of the US District Judges, since they don’t seem to understand their jurisdiction pertains only District wide. Between SCOTUS and Congress they should be able to get that done at least. This is ridiculous.

  5. Well Well, Turley ran into the wall that was invevitably coming. He can no longer ignore the Trump administration’s lawless governing once the Supreme Court chimes in.

    While Turley still not criticizing the Trump administration head on he’s still trying to both-sides the argument. Clearly that’s not the case. The administration is arguing from bad faith. It has lied and obfuscated to the courts multiple times and even after the Supreme court in a 9-0 ruling told Trump the lower court’s ruling was correct and they were orderd to facilitate his return.

    President Bukele said he didn’t have the authority to return him. That’s BS. He gladly returned others who were not supposed to be there before Garcia. When it was discovered that Women were on the flight and arrived in El Salvador they Bukele refused to take them in and sent them back. Garcia can be sent back and the Trump administration is obligated to bring Garcia back.

    Now tha the Supreme court will hear the case on using the AEA to deport Venezuelans it may end up directly settling the issue of what constitutes an “invasion”. But Trump being Trump is going to argue and twist any SC ruling into something else.

    Turley used a highly respected conservative judge’s words to say what he won’t say himself. He still doesn’t want to face MAGA’s wrath if he goes against Trump’s agenda. Fox News won’t have him on TV if he ever says anything to contradict the Fox News narrative.

Why does the Supreme Court ignore the most grievous offenses to our constitution? Are we to believe that the President Of the United States as no authority without a lower courts permission? Are they now suggesting that the President’s powers are contingent upon approval from lunatics that are simply attempting to obstruct the President of the U.S. from protecting the American people. Where can the American people seek Justice, when the Justice no longer rule by the constitution, and no represent’s the American people? What is Separate of Powers, Does the President actually have any powers?

    1. This is justice. Everyone needs to get due process and Trump is deporting people with no due process. Thus the court needed to put a stop to it.

      2. I am a citizen. I have rights afforded by the constitution. I pay taxes to support my country. I vote for a president. A president has as one of his duties to keep me safe. The people that Biden let in by the millions are not keeping us safe. They are also using my tax dollars for themselves. It should be the president’s call to turn these people back where they came from. Biden caused all of this and he should pay.

It would seem, in my lifetime, that more than one administration has pushed up against the judiciary in some fashion or another with more than one being at least a little critical of the judiciary. With that being said, it would appear that the Trump administration has taken this to an unprecedented level. Obviously, no American wants dangerous gangs within our nation. Or I should say no American should ever want that. Political tribalism has unfortunately lead to many believing that laws shouldn’t matter when they run contrary to one’s agenda or political belief. The president has unfortunately stated as much on X. Fortunately, our founders anticipated such and placed absolutely proper checks and balances among the three branches of government. The Trump administration has pushed hard against these boundaries to the point of giving the optics that they are or are willing to ignore the legislature and the judiciary. I use the word optics because I do not think they have crossed that line to date. It is proper, however, for both the legislative and judiciary to warn against such an action. It is particularly noteworthy that such a robust rebuke comes from such a well respected conservative judge. Our nation and the Trump administration would do well to heed such advice. Failure to do so can only lead to a non-functioning republic or worse.

She was brutally beaten to death, her face bashed to a pulp and a 6″ hole bashed in at the back of her head? She was raped while dying. There are a long list of the same types of targeted attacks by TdA and MS-13 who were indiscriminately allowed, unvetted into our country, with their intent to take over, terrorize, rape torture and murder. I would call that a foreign invasion, an incursion. TdA, MS-13 and other gangs like them are highly organized criminal terrorists. TdA is closely connected to the Venezuelan Cártel de los Soles, the Nicolas Maduro regime-sponsored, narco-terrorism enterprise based in Venezuela, and commits brutal crimes, including murders, kidnappings, extortions, and human, drug, and weapons trafficking.

      You call Alito and Thomas corrupt as the reason for their dissent. Yet if they had not, you would have said the same. There is no more indication of corruption in Alito and Thomas than there is in any of the liberal Justices. You can disagree with a Justice’s opinion/ruling, without “justifying” it by accusing them of corruption.

      Thomas reported that Alito’s wife is “in a state of panic” about losing her superyacht vacations, adding, “She’s been flying their flag upside down all week.”

      As for his own wife, Thomas said, “Ginni is mad as hell, and you don’t want to make Ginni mad. She’s already tried to overthrow one government.”

  11. Attack the problem from the other side: start publicly arresting CEO’s that have illegals employed (on-camera Perp-walks). Demand 100% compliance with E-verify. Stop all federal funding to any state providing anything but emergency medical care to illegals. Stop all welfare-type payments to the 60% of illegals recieving it. Dry up the money, and the problem goes away.

  12. Thank you JT. I’m not sure your fervent supporters read what the good judge said. Failure to abide by Judges rulings, and speaking ill of courts, does not bode well for this country and indeed will go down in history as a really bad idea.

        1. Yes, but the only recourse is impeachment and removal or voting in someone else. The judicial branch has no authority to substitute its judgement for the executive. The braches of government are independent and co equal. None can impose their will on the other. The President does not have to obey the courts when executing the authority and powers granted by the Constitution. The judicial branch does not have the final say on any matter outside of the judicial branch.

  13. The D.C. Circuit has temporarily halted Boasberg’s contempt order. Can anyone post the DoJ’s appeal that led to this decision? I haven’t been able to find it.

  14. This was all according to the Democrats plan. They would use the law to hinder deportation and make it nearly impossible to fix millions of illegals overwhelming America. The Courts must recognize the grave peril all this presents but clearly do not. The problem is, the Courts have deified themselves with far too many corrupt and biased Judges ready to misuse the law. I believe in the rule of law as much as anyone but there is a point where its the Courts that are lawless. If the Courts including SCOTUS keep elected officials hands tied POTUS will have massive support to defy them . Including me. The Courts failure to take into account the massive misuse of the system and whether the Biden administrations gross bad faith actions matter puts them in a dark place with Americans. Its the Courts fault for most of this after years of lawfare with Judges hostile to Conservatives and of course Trump, has already brought discredit and disrespect. Justice Roberts is a disgrace. And now we find his integrity is not as clear to us as many once thought.

Biden ushered in millions of people, with little oversight (where was our due process for stopping this invasion?). And now the courts want to adjudicate each deportation down to the most minute detail. This is the liberal playbook. Flood the playing field, knowing the courts will gum up the works.

  15. Since this one judge now has nullified our easiest route to keep American from continuing its slide into gangland, I suggest they drop the TdA’s and their cousins off in the judge’s neighborhood.

      2. The Trump Administration, operating through DOGE, has placed several thousand federal attorneys on administrative leave (including me). We’re getting full pay and benefits through the end of the fiscal year, until our pensions kick in. Younger attorneys are getting buy-outs. We could be holding due process hearings via zoom for the estimated 12-20 million illegals. Instead, I’m sitting at home, drinking coffee and reading Turley’s column. Soon, I’ll go outside and do some yard work. If each illegal got a 15-30 minute D.P. hearing, I could conclude 16-32 hearings per day. Thousands of federal attorneys, after a brief online course in immigration law, could do the same. The Trump administration should immediately deport the illegals with standing deportation orders, and then begin DP hearings for the rest, prioritizing criminals, and women who will attempt to defeat deportation by producing as many “anchor babies” as possible. Hand-wringing about activist judges isn’t going to solve the problem. But using available resources wisely could make a significant dent.

      1. #. Deporting gang members is a moral issue and involves incarceration. Releasing gangsters into any population is a moral crime because of danger.

        Due process as illegal is the process of showing a passport and visa with correct entry and exit dates. That is the process due.

        As so many lawyers and attorneys fight this , it is surprising that they aren’t also in the business of obtaining passports from.nation of origin as a matter of course. Mr. Garcia’s illegal entry in 2011 gave sufficient time to request a passport from El salvador by mail as his asylum clock ticked?

        There’s too many holes in the dam and the immigration system is burdened unreasonably. Any lawful system that is collapsed by actions including the judiciary and branches of government is treason.

        Your understanding of treason is sorely lacking.

I trust the courts will recognize the previous administration allowed an illegal invasion of our country while simultaneously war-gaming lawfare tactics to hobble the next administration’s deportation attempts; and thus, the entire operation reeks of pure treason, while all the participants have willingly committed treasonous acts against our nation.

  18. With all due respect, Judge J. Harvie Wilkinson, if OUR brethren in the unelected Judicial Branch would stick to the true concept of judicial review then a great number of these dangerous controversies could be avoided.

    1. So let the courts decide, if you don’t like the decision of a court, appeal. When the SC speaks, all sides abide by the decision.
