Always Ready, Always There: Democrats Mobilize Against the National Guard Deployment

Below is my column in Fox.com on the deployment of National Guard in Los Angeles. Another round of court challenges are unfolding, but the escalation is likely to continue on both sides. While the Guard’s motto is “Always Ready, Always There!,” California Democrats do not want them between rioters and federal law enforcement.

Here is the column:

Gov. Gavin Newsom was in his element this week. After scenes of burning cars and attacks on ICE personnel, Newsom declared that this was all “an illegal act, an immoral act, an unconstitutional act.” No, he was not speaking of the attacks on law enforcement or property. He was referring to President Donald Trump’s call to deploy the National Guard to protect federal officers.

Newsom is planning to challenge the deployment as cities like Glendale are cancelling contracts to house detainees and reaffirming that local police will not assist the federal government.

Trump has the authority under Section 12406 of Title 10 of the U.S. Code to deploy the National Guard if the president is “unable with the regular forces to execute the laws of the United States.”

The Administration is saying that that is precisely what is unfolding in California, where mobs attack vehicles and trap federal personnel.

Most critics are challenging the deployment on policy grounds, arguing that it is an unnecessary escalation. However, even critics like Berkeley Law Dean Erwin have admitted that “Unfortunately, President Trump likely has the legal authority to do this.”

There is a fair debate over whether this is needed at this time, but the President is allowed to reach a different conclusion. Trump wants the violence to end now as opposed to escalating as it did in the Rodney King riots or the later riots after the George Floyd killings, causing billions in property damage and many deaths.

Courts will be asked to halt the order because it did not technically go through Newsom to formally call out the National Guard.

Section 12406 grants Trump the authority to call out the Guard and employs a mandatory term for governors, who “shall” issue the President’s order. In the memo, Trump also instructed federal officials “to coordinate with the Governors of the States and the National Guard Bureau.”

Newsom is clearly refusing to issue the orders or coordinate the deployment.

Even if such challenges are successful, Trump can clearly flood the zone with federal authority. Indeed, the obstruction could escalate the matter further, prompting Trump to consider using the Insurrection Act, which would allow troops to participate directly in civilian law enforcement.

In 1958, President Eisenhower used the Insurrection Act to deploy troops to Arkansas to enforce the Supreme Court’s orders ending racial segregation in schools.

The Trump Administration has already claimed that these riots “constitute a form of rebellion against the authority of the Government of the United States.” In support of such a claim, the Administration could cite many of the Democratic leaders now denouncing the claim.

After January 6th, liberal politicians and professors insisted that the riot was an “insurrection” and, in claiming that Trump and dozens of Republicans could be removed from ballots under the 14th Amendment.

Liberal professors insisted that Trump’s use of the word “fight”and questioning the results of an election did qualify as an insurrection. They argued that you merely need to show “an assemblage of people” who are “resisting law” and “using force or intimidation” for “a public purpose.” The involvement of inciteful language from politicians only reinforced these claims. Sound familiar?

Democrats are using this order to deflect from their own escalation of the tensions for months. From Minnesota Gov. Tim Walz calling ICE officers “Gestapo” to others calling them “fascists” and “Nazis,” Democratic leaders have been ignoring objections that they are fueling the violent and criminal responses. It did not matter. It was viewed as good politics.

While Newsom and figures like Sen. Cory Booker (D., N.J.) have called these “peaceful” protests, rocks, and Molotov cocktails have been thrown at police as vehicles were torched. Police had to use tear gas, “flash bang” grenades, and rubber bullets to quell these “peaceful” protesters.

There appears little interest in deescalation on either side. For the Trump Administration, images of rioters riding in celebration around burning cars with Mexican flags are only likely to reinforce the support of the majority of Americans for the enforcement of immigration laws.

For Democrats, they have gone “all in” on opposing ICE and these enforcement operations despite support from roughly 30 percent of the public.

Some democrats are now playing directly to the mob. A Los Angeles City Council member, Eunisses Hernandez, reportedly urged anti-law enforcement protesters to “escalate” their tactics against ICE officers:  “They know how quickly we mobilize, that’s why they’re changing tactics. Because community defense works and our resistance has slowed them down before… and if they’re escalating their tactics then so are we. When they show up, we gotta show up even stronger.”

So, L.A. officials are maintaining the sanctuary status of the city, barring the cooperation of local police, and calling on citizens to escalate their resistance after a weekend of violent attacks. Others have posted the locations of ICE facilities to allow better tracking of operations while cities like Glendale are closing facilities.

In Washington, Jeffries has pledged to unmask the identities of individual ICE officers who have been covering their faces to protect themselves and their families from growing threats.

While Democrats have not succeeded in making a convincing political case for opposing immigration enforcement, they may be making a stronger case for federal deployment in increasingly hostile blue cities.

  1. Jonathan: If it wasn’t clear before it is now. Steven Miller and DJT have laid down the law. They are not just after the “criminals”. They are going after every immigrant, regardless of status. The ICE raids in LA over the weekend are targeting workers at Home Depot and at other workplaces in the city. This is what fascism looks like. And it is what the DJT regime wanted all along. It expected the Hispanic community, the largest in the country, to react to the ICE raids with protests. Now Pete Hegseth has escalated by deploying hundreds of US military to LA. This is historic, the first time US military have been used since 1963.

    So is any of this legal? To federalize a state’s National Guard the president must get the consent of the governor of the state. DJT didn’t do that. DJT simply invoked USC 10, Section 12406. But that Section only applies when there is “danger of invasion by a foreign nation” or “danger of rebellion”, neither of which exists in LA. That’s why the AG of California has just filled a lawsuit against the DJT regime.

    California is not a one-off for the DJT regime. DJT wants to send US troops in to every American city to enforce the expulsion of immigrants–the use of martial law to suppress dissent. It’s what happens in every dictatorship!

  3. I live in California, which has been a Democrat supermajority for many years. California illustrates the result of total Democrat control.

    For long years, California has invited illegal aliens, with benefits programs tailor made for them. The Democrat party claimed that it did not support open borders, yet it opposed the deportation of anyone, including those with deportation orders from the court, and even an MS-13 gang associate who was a human trafficker who beat his wife.

    CA is a sanctuary state, and its police and jails are not allowed to cooperate with ICE detainers for convicted criminals. This has attracted criminal aliens who would be deported elsewhere.

    Newsom added illegal aliens to Medical, which immediately ran out of money and requires billions more to operate for one year. Medical is needed to care for the poor among California citizens and legal residents. This illustrates that the sheer quantity of illegal immigrants is an existential crisis, not just this who commit violent crimes. There are just too many.

    ICE came to detain illegal immigrants, and were doxxed last week in California. ICE employees experienced death threats on their children.

    When protesters rioted, there was no conceivable reason why President Trump would assume Gov Newsom would quell the riot. He and LA mayor Karen Bass have actively urged on rioters, and called deportations fascist. They are fuel, not fire retardants.

    Protesters have broken up concrete planters, and chucked hunks of concrete and brick down overpasses on passing cars, especially cop cars, and at vehicles driving by. They have looted stores. Set fires, even though Pacific Palisades and Eaton are 2 cities in LA county that just burned. Worse, they set brush fires in the parts of Pacific Palisades that still has fuel to burn. They injured 6 police officers last night. My husband and I stayed up last night watching the riots. Some businesses have already closed due to the rampant shoplifting, from California’s pro-crime policies. Now the remaining have been looted again.

    The message is clear. Open the borders and let everyone in, or your cities will burn. Does this make more people support illegal immigration?

    Where I differ from many, is that I think one concession should be made. Democrats told the world federal immigration law didn’t matter. Skip the immigration process and just come on over. They created sanctuary cities to welcome them. Special benefits. Now, it’s clear that federal law actually does apply, and over 10 million people are told to leave. It is my understanding that the law states that those who get deported are banned from legally immigrating. I think Congress should pass a bill that gives a grace period until a determined date, that if you get deported, you can still apply to legally immigrate. I don’t blame illegal immigrants who were invited here. I do not believe in offering amnesty while here in the US, because it’s just an incentive to keep coming illegally. They should be made to leave, and apply to immigrate legally, as they should have done in the first place. Then they would arrive, properly vetted and health checked, at a rate the infrastructure can support.

There wasn’t a “riot”–there were a few incidents of violence in an otherwise peaceful protest triggered by Trump’s illegal raid at a Home Depot where people were arrested without any warrants. These people were there hoping to pick up a few bucks to feed their families by helping load goods or getting a day job helping out at construction sites. Because the Trump administration has proven its incompetence in meeting its deportation goals, ICE agents are being pressured to do something, anything, to get numbers up. According to “MSN”: “Lawyers in these recent cases describe how their clients were arrested during routine check-ins with ICE officials, given no opportunity to speak with an attorney or any family members and deported from the country within three days or less.” ICE also ripped a 4 year old child from the arms of her Cuban-born mother. The child was in America to receive life-saving cancer treatment. People are sick of this BS–Trump claimed he was going after criminals. None of these people are criminals.

      You say you live in California–then you ought to know that California agriculture DEPENDS on migrant labor. California is the largest agriculture producer in the United States and agriculture is one of California’s most-important industries. The California economy, which is the 4th largest in the world, would fail without migrant labor, upon which it has depended for decades. So, yes, migrants are welcomed in California–and for valid reasons. And, whether you want to admit it or not–you benefit from their being there.

    The activation of the Marines is intended to provide Task Force 51 with adequate numbers of forces to provide continuous coverage of the area in support of the lead federal agency.

    Task Force 51 is U.S. Army North’s Contingency Command Post, which provides a rapidly deployable capability to partner with civil authorities and DoD entities in response to a Homeland Defense and Homeland Security Operations. It is commanded by Maj. Gen. Scott M. Sherman.

    Task Force 51 is comprised of approximately 2,100 National Guard soldiers in a Title 10 status and 700 active-duty Marines. Task Force 51 forces have been trained in de-escalation, crowd control, and standing rules for the use of force.

  16. Turley is nothing if not predictable. He conveniently leaves out little critical details about Trump’s alleged “authority” to call out the Guard and failed to cite the text of the statute. Here is the statute:

    (1) the United States, or any of the Commonwealths or possessions, is invaded or is in danger of invasion by a foreign nation;
    (2) there is a rebellion or danger of a rebellion against the authority of the Government of the United States; or
    (3) the President is unable with the regular forces to execute the laws of the United States;
    the President may call into Federal service members and units of the National Guard of any State in such numbers as he considers necessary to repel the invasion, suppress the rebellion, or execute those laws. Orders for these purposes shall be issued through the governors of the States or, in the case of the District of Columbia, through the commanding general of the National Guard of the District of Columbia.

    None of the foregoing applies, and Turley, as usual, omits discussion of how or why it could apply. We do not have an invasion or danger of an invasion. There isn’t any rebellion or danger of rebellion against the Government, and the fat one is not unable with regular forces to execute the laws of the United States. He just wants to exercise the power he cheated to get because he is a pathetic narcissistic sociopath.

    Trump deliberately incited these protests as a pretext to call up the National Guard and Marines–something he mused about doing the first time he was stinking up the Oval Office, when cooler heads prevailed and prevented him. The LA Police and LA County Sheriff’s Department are more than capable of containing any protests that got out of hand–and, considering the large number of protesters, the incidents of violence and property damage were relatively minimal. Trump sent ICE agent thugs to a Home Depot–they could not have had warrants because they had no way of knowing who might be at Home Depot looking for day work. It is THIS that sparked the protests.

    And, contrary to the arguments Turley is trying to make to defend January 6th–that WAS an insurrection because Trump called for a “rebellion against the authority of the Government of the United States”–the Congress–which had convened to accept Biden’s victory. And, also contrary to Turley’s deliberately misleading argument, California HAS cooperated in LAWFUl ICE arrests–10,000 of them to date. ICE agents have, in other situations, been without any uniform, without any badge, and just grabbed up people, refusing to identify themselves.

      Peacefully demanding the congress act differently is a first amendment right.

That MAY be done under conditions in which the defendant and/or their lawyers face criminal sanctions if they make public the name of officers prior to trial.
      While the NORM is for uniformed officers wearing badges that identify them to make arrests, that is a NORM not a requirement of the law.
      NORMALLY officers making an arrest are uniformed because an ordinary person is less likely to obstruct and more likely to be convicted for obstructing a uniformed police officer. But plain clothes officers can make arrests, They are required to identfy as police at the time of arrest – because you are not resisting or obstructing law enforcement until they identify as law enforcement.

      I find it weird that the party of masks is pissing over ICE for masking.

      I would note that even many of the NG forces are masking.

      Left Wing nuts are known for VIOLENCE. They will dox officers and threaten them and their families, they threaten supreme sourt justices.

        Turmp’s order is illegal. “Shall” means only when the governor requests it. Newsome didn’t request the national guard. Trump’s bypassing of the governor is not legal in this situation and it will likely be struck as in illegal order by Trump. The rioting is not an invation or rebellion either. It seems Trump does not have a legal leg to stand on despite Professor Turley’s weak argument trying to support Trump’s decision.

When “peaceful protestors” torch private cars, smash police vehicle windows and toss rocks and concrete at law enforcement in response to efforts to enforce laws — enacted, by the way, in a bipartisan past — and all the while waving Mexican flags in the “City of Angels” as local police are told to “stand down,” one is tempted to ask: might this not be a good time for The Big One?
