Below is a slightly expanded version of my column in U.S. News & World Report on the investigations into President Joe Biden’s mental state in his second term of office. While I do not expect any prosecution to come from these investigations, there are ample reasons why we should get answers to some of these questions as we continue to struggle with the problem of presidential incapacity.

“Jackie, are you here? Where’s Jackie?”
When then-President Joe Biden asked in September 2022 if House Rep. Jackie Walorski, an Indiana Republican who had died weeks earlier in a car accident, was in a meeting, observers were shocked. Biden had not only issued a statement of condolence; he attended the ceremony to lower the flags at the White House in her honor.
As Washington Post media critic Erik Wemple noted last week, that moment should have been a wake-up call. In Washington parlance, it left no room for “plausible deniability” about whether Biden was still fit to hold the office of president. And it wasn’t just Democratic politicians who were willfully blind to Biden’s obvious deterioration.It was also the media.
That’s why the country should fully support President Donald Trump’s June 4 order for his administration to investigate Biden’s competence and answer some of these questions, including the possible abuse of an autopen to sign legislation, pardons and other documents while he was president, instead of looking for political motivations.
Similarly, the Republican-led House Oversight Committee is also investigating.
The New York Times called it part of Trump’s “campaign of retribution against his perceived enemies” and “the latest effort by President Trump to stoke conspiracy theories about his predecessor.”
There is a weird dissonance when journalists blame Biden’s White House for a coverup, but then criticize efforts to investigate that coverup. While criminal charges are unlikely to stem from the investigation, if the White House autopen, for instance, was used without Biden’s consent, that would amount to forgery, obstruction of justice, fraud or other serious crimes.
The complicity of politicians, staff and even the press in deception is nothing new in Washington. A century ago, after President Woodrow Wilson experienced a severe stroke in September 1919, his wife, Edith, and his staff covered up the severity of his condition, which made him incapable of fulfilling his duties until the end of his term and affected the race for a Democratic successor. To end such abuses, we must demand accountability and greater transparency on matters of presidential health and competence.
The 25th Amendment of the Constitution was intended to address succession issues, including the incapacity of a president, but it is very difficult to remove a president without the support of the vice president and most of the Cabinet, which means little can be done without a virtual mutiny within the White House.
That is particularly true when staff have an interest in maintaining the illusion to keep the president and themselves in power. With Biden, according to the reporting in the book “Original Sin” by journalists Jake Tapper and Alex Thompson, the staff regularly cut off the access of Cabinet secretaries to Biden, limited public events and scripted short remarks for the president to read from teleprompters.
Allegations that Biden’s staff misused the autopen are exceptionally difficult to prove, and Biden has issued a statement insisting he had full knowledge of everything that was signed.
Absent a confession of incapacity, Congress would need someone like John Dean, the White House counsel during the Nixon administration who was willing to break from the ranks and implicate his former associates. So far, there do not appear to be any Deans on the Biden staff, who are likely eager to avoid being implicated in potential improper use of the autopen or other actions that may have circumvented the president or covered up his decline.
But that doesn’t mean the Trump administration and Congress shouldn’t be trying to get to the bottom of what happened. The worst thing for the American people would be a collective shrug and a resumption of business as usual.
In Washington, it is the cover-up that is often the basis for prosecution rather than the original crime. The most likely path to success in such investigations is to get staffers to trip the wire in interviews by lying to or misleading investigators. Such false statements can be (and often are) criminally charged.
Such charges are then often used to wedge witnesses into cooperating with investigators in exchange for plea agreements. One cooperating witness can force a cascading failure for the defense as additional staff members are implicated and rush to make their own plea bargains. It is the Washington version of musical chairs: You do not want to be the last staffer without a plea to sit on.
Currently scheduled to testify before the House Oversight Committee in the coming weeks are Neera Tanden, the former director of Biden’s Domestic Policy Council; Anthony Bernal, Biden’s former assistant and senior advisor to the first lady; Ashley Williams, a former special assistant to Biden and deputy director of Oval Office operations; and Annie Tomasini, Biden’s former deputy chief of staff. Their statements might push divisions to the surface.
Biden was kept on a reduced schedule, allowing him to rally for single events. That is the difference between a major stroke and creeping cognitive decline. The 25th Amendment was designed for catastrophic medical events, not the slow slide to senility.
The result for the office can be largely the same, but the chances of detection are much lower. For now, the Biden scandal shows that very little has changed since the Wilson scandal. With a protective first lady, a lax White House physician and a cooperative staff, it is still possible to conceal the alleged incapacity of a commander in chief. That is why you might not have a “Weekend at Bernie’s“, but you can easily have a full term with Biden.

So looking at the comments on this article attacking Turley, etc, my first impression was that the bombing in Iran ruffled feathers and word went out to the puppets [some of those here today] to ‘engage’. Their comments are not honest and are generally rubbish.
As for the bombing of Iran, I feel relief even though it isn’t over. I think that, by a slender margin, we didn’t leave it too late. When Hitler made his first move into the Ruhr in violation of the Versailles Treaty his generals were terrified. At that time the French were much, much stronger and Hitler told his generals to wait for a bit and then hurry in retreat if France acted. The French didn’t and Hitler grew stronger. Many Nazi tanks broke down on the way to Austria during the Anshluss. But there was no opposition. The fortresses in the Sudetenland were much stronger than the Germans realized but they were surrendered without a shot. When Nazi Germany allied with the Soviet Union attacked Poland war was unavoidable and the enemy was very strong. The war was terrible.
We could not allow Iran to get nuclear weapons before the inevitable battle. They have been very clear that they were building arsenals to destroy us and Israel. Thank God for a President who has acted before Iran was strong enough to destroy nations and Western Civilization. If he has acted soon enough. We will see.
By the way, making an atomic bomb and delivery system isn’t cheap. The billions sent to Iran by Obama and Biden didn’t buy peace; they bought the means to destroy us.
Young, your history of the development of Nazi strength is very apropos because of its important warning. I am not sure that we stopped Iran in time, for they may still have what is needed to make a bomb in due time. No, the good professor does not delete comments he may disagree with. He deletes comments that violate the civility rules. Of which you are well know for violating. Also, Franke makes overt threats to President Trump. That is why his comments get deleted.

I as as, on numerous occasions, I’ve seen comments on here referring to people as pedophiles, gay, etc, etc. Some of the stuff I’ve seen here in the past was pretty disgusting, and legally actionable.
I’m part of the so-called MAGA cult, and I’ve seen many a comment on here excoriating us, calling us fascist, HItler, etc, etc, so, without a doubt, lefties on here who believe comments are deleted based on viewpoints are making a 100% bogus argument.
I’ve wondered, on numerous occasions, does anyone moderate this forum?

The being called a fascists, Hitler, etc. has become so over done, it no longer holds relevance. It does not mean anything. Oh, look we got call Hitler . . . again.
However, when we actually look at the words and actions of either side, it looks much more like the far leftists are the wannabe fascists, authoritarians. But then again, they also change words to fit their definition of what fascist or authoritarians are. For example MAGA, or America first. They declared that is fascist speech. Reality is, the America first idea has been around for decades and I would argue to our Independence Day. Trump just happened to make it into a nifty campaign slogan that stuck. As for being called “gay” to me, that went out of meaning anything after my teen aged years.
In cases of real pedophiles or supporting the real sexual exploitation of children with pornography, or grooming, well that is some sick and twisted stuff and we need to protect children. It is the right thing to do. Unfortunately some here, if we/MAGA is for something, like only women in women’s sports, then they are against it. The upside is it appears wokeism is dead or at least dying and we are getting back to a degree of common sense, normalcy and sanity.
A few of our regular leftists have a long history of making comments that were over the top, and they got deleted. They then cry the good professor is a hypocrite, when in reality it is his blog. He gets to do with it as he pleases. They dont like it, complain but keep coming back. That is why nearly all those anony comments are not even worth reading.

Well said and I too have had a few occasions where I disagreed with the good professor. I also stated as such and then tried to express my POV with my logic or reasoning. And I never felt the need to resort to using vulgarity or personal insult to him.
I have made this comparison in the past, the blog is like the good professor’s home. I would never go into it, insult him, his wife, break the plates, kick his dog and take a big old crap on the floor. But for some reason, some people, hidden behind anonymous feel they can not only do that, but seem to take a degree of delight in doing so. The upside, it gives us insight into their mentality, which seems to be a poor and ugly one.

Would a law passed by Congress that makes it a punishable crime for those responsible for not questioning a President’s possible cognitive or physical decline under their responsibilities of the 25th amendment help in the future? This law would apply to the vice-president, cabinet members, the President’s physician, and the President’s chief of staff and the President’s legal counsel. Could such a statute be legal and enforceable without needing to amend the 25th amendment? A question of possible presidential incapacity would then warrant independent evaluation by two neurologists randomly chosen from a list of 10 previously identified neurological centers of excellence that have no immediate connection to the president.
Congress would never pass such a law because it would be immediately triggered by Trump.
Trump took a cognitive test on his first physical of his second term. 30 questions, he answered them all correctly. So, that law would not be triggered by Trump.
Biden had obvious MCI during the 2020 campaign. The pandemic provided cover for his “basement” campaign, but his campaign staff knew he was not cognitively intact. These cognitive problems progressed to full blown dementia during his Presidency. It was obvious to anyone watching Fox News, so it was most certainly obvious to Biden’s staff and to his physician. His staff covered by lying and by limiting access to Biden. His physician covered by not doing cognitive exams (if you don’t take a temperature, you can’t document a fever). But anyone who has lived or worked with a demented person knows the truth.

Dear Mr. Turley, I appreciate GEB’S comment regarding the struggle physicians have at times negotiating between “friend” and “patient”. We had a similar experience with the doctor our parents were seeing. Our dad was verbally abusive (and at times physically) toward our mother, and she would talk to the doctor about it. He would only offer feeble advice to her as he was treating our dad as well. True, by talking to him about Dad, she placed him in a very difficult position. There is no easy answer here. I am sorry for both Pres. Biden, the Physician and anyone else involved. It was very clear from the beginning of his administration that he was not well. My political side wonders if Jill wasn’t propping him up in order to keep Kamala out of the Presidency?

The problem with the 25th amendment besides written for an acute catastrophic incident and not a spiraling decline like dementia is the Country does not have the fallback of mandated reporting. If the vice president and the cabinet secretaries were mandated reporters, there would currently be many indictments for failure to report. Because there is no mandate, they and the entire staff benefited from the illusion of competence and retained their positions of power and employment while the Country was led by unelected and unaccountable bureaucrats.
