‘Where’s Jackie?”: Why the Public Needs Answers on Biden’s Alleged Incapacity

Below is a slightly expanded version of my column in U.S. News & World Report on the investigations into President Joe Biden’s mental state in his second term of office. While I do not expect any prosecution to come from these investigations, there are ample reasons why we should get answers to some of these questions as we continue to struggle with the problem of presidential incapacity.

Here is the column:

“Jackie, are you here? Where’s Jackie?”

When then-President Joe Biden asked in September 2022 if House Rep. Jackie Walorski, an Indiana Republican who had died weeks earlier in a car accident, was in a meeting, observers were shocked. Biden had not only issued a statement of condolence; he attended the ceremony to lower the flags at the White House in her honor.

As Washington Post media critic Erik Wemple noted last week, that moment should have been a wake-up call. In Washington parlance, it left no room for “plausible deniability” about whether Biden was still fit to hold the office of president. And it wasn’t just Democratic politicians who were willfully blind to Biden’s obvious deterioration.It was also the media.

That’s why the country should fully support President Donald Trump’s June 4 order for his administration to investigate Biden’s competence and answer some of these questions, including the possible abuse of an autopen to sign legislation, pardons and other documents while he was president, instead of looking for political motivations.

Similarly, the Republican-led House Oversight Committee is also investigating.

The New York Times called it part of Trump’s “campaign of retribution against his perceived enemies” and “the latest effort by President Trump to stoke conspiracy theories about his predecessor.”

There is a weird dissonance when journalists blame Biden’s White House for a coverup, but then criticize efforts to investigate that coverup. While criminal charges are unlikely to stem from the investigation, if the White House autopen, for instance, was used without Biden’s consent, that would amount to forgery, obstruction of justice, fraud or other serious crimes.

The complicity of politicians, staff and even the press in deception is nothing new in Washington. A century ago, after President Woodrow Wilson experienced a severe stroke in September 1919, his wife, Edith, and his staff covered up the severity of his condition, which made him incapable of fulfilling his duties until the end of his term and affected the race for a Democratic successor. To end such abuses, we must demand accountability and greater transparency on matters of presidential health and competence.

The 25th Amendment of the Constitution was intended to address succession issues, including the incapacity of a president, but it is very difficult to remove a president without the support of the vice president and most of the Cabinet, which means little can be done without a virtual mutiny within the White House.

That is particularly true when staff have an interest in maintaining the illusion to keep the president and themselves in power. With Biden, according to the reporting in the book “Original Sin” by journalists Jake Tapper and Alex Thompson, the staff regularly cut off the access of Cabinet secretaries to Biden, limited public events and scripted short remarks for the president to read from teleprompters.

Allegations that Biden’s staff misused the autopen are exceptionally difficult to prove, and Biden has issued a statement insisting he had full knowledge of everything that was signed.

Absent a confession of incapacity, Congress would need someone like John Dean, the White House counsel during the Nixon administration who was willing to break from the ranks and implicate his former associates. So far, there do not appear to be any Deans on the Biden staff, who are likely eager to avoid being implicated in potential improper use of the autopen or other actions that may have circumvented the president or covered up his decline.

But that doesn’t mean the Trump administration and Congress shouldn’t be trying to get to the bottom of what happened. The worst thing for the American people would be a collective shrug and a resumption of business as usual.

In Washington, it is the cover-up that is often the basis for prosecution rather than the original crime. The most likely path to success in such investigations is to get staffers to trip the wire in interviews by lying to or misleading investigators. Such false statements can be (and often are) criminally charged.

Such charges are then often used to wedge witnesses into cooperating with investigators in exchange for plea agreements. One cooperating witness can force a cascading failure for the defense as additional staff members are implicated and rush to make their own plea bargains. It is the Washington version of musical chairs: You do not want to be the last staffer without a plea to sit on.

Currently scheduled to testify before the House Oversight Committee in the coming weeks are Neera Tanden, the former director of Biden’s Domestic Policy Council; Anthony Bernal, Biden’s former assistant and senior advisor to the first lady; Ashley Williams, a former special assistant to Biden and deputy director of Oval Office operations; and Annie Tomasini, Biden’s former deputy chief of staff. Their statements might push divisions to the surface.

Biden was kept on a reduced schedule, allowing him to rally for single events. That is the difference between a major stroke and creeping cognitive decline. The 25th Amendment was designed for catastrophic medical events, not the slow slide to senility.

The result for the office can be largely the same, but the chances of detection are much lower. For now, the Biden scandal shows that very little has changed since the Wilson scandal. With a protective first lady, a lax White House physician and a cooperative staff, it is still possible to conceal the alleged incapacity of a commander in chief. That is why you might not have a “Weekend at Bernie’s“, but you can easily have a full term with Biden.

    QUESTION: Yeah. Let me follow up on a phrase you just were – weaponization ambitions. Are you saying there that the United States did not see intelligence that the supreme leader had ordered weaponization?

    SECRETARY RUBIO: That’s irrelevant. I think that question being asked in the media all – that’s an irrelevant question. They have everything they need to build a weapon.

    QUESTION: No, that is the key point in U.S. intelligence assessments. You know that.

They have everything they need to build nuclear weapons. Why would you bury – why would you bury things in a mountain 300 feet under the ground?

    QUESTION: Right.

    SECRETARY RUBIO: Why would you bury – why do they have 60 percent enriched uranium? You don’t need 60 percent enriched uranium. The only countries in the world that have uranium at 60 percent are countries that have nuclear weapons —

    QUESTION: Right.

    SECRETARY RUBIO: — because they can quickly make it 90. They have all the elements. They have – why are they – why do they have a space program? Is Iran going to go to the moon? No, they’re trying to build an ICBM so they can one day put a warhead on it.

    QUESTION: No, but that’s a – that’s a question – that’s a question of intent, and you know in the intelligence assessment that it was that Iran wanted to be a threshold state and use this leverage —

    SECRETARY RUBIO: How do you know what the intelligence assessment says? How do you know what the intelligence assessment says?

    QUESTION: I’m talking about the public March assessment, and that’s why I was asking you if you know something more from March, if an order was given.

    SECRETARY RUBIO: Well, that – but that’s also an inaccurate representation of it. That’s an inaccurate representation of it. That’s not how intelligence is read. That’s not how intelligence is used. Here’s what the whole world knows. Forget about intelligence. What the IAEA knows: They are enriching uranium well beyond anything you need for a —

    QUESTION: Yes.

    SECRETARY RUBIO: — for a civil nuclear program. So why would you enrich uranium at 60 percent —

    SECRETARY RUBIO: — if you don’t intend to one day use it to take it to 90 and build a weapon?

    SECRETARY RUBIO: Why are you – why are you developing ICBMs? Why do you have 8,000 short-range missiles and 2- to 3,000 long – mid-range missiles that you continue to develop? Why do you do all these things?

    QUESTION: Understood.

    SECRETARY RUBIO: They have everything they need for a nuclear weapon.

    SECRETARY RUBIO: They have the delivery mechanisms; they have the enrichment capability; they have the highly enriched uranium that is stored.

    QUESTION: Yes. Right.

I’m not doing that here, and they were censured at the IAEA for that enrichment and for violating their nonproliferation agreements. I was simply asking if we had intelligence that there was an order to weaponize, because you said weaponization ambitions, which implies they weren’t doing it.

    SECRETARY RUBIO: Well, we have intelligence that they had everything they need to build a nuclear weapon.

      1. Brennan only uses what is handed to her without much thought. You could see it clearly when she kept returning to her original motif while Sec. Rubio battered her like a broken polo ball. I think her prime indication of stupidity was not realizing how thoroughly outmatched she was and shifting tone to make the best of it. The very best look she could have presented was to mostly agree with Rubio and give him room to develop his ideas as if she were a partner rather than a punching bag. Copy Maria Bartiromo who is smart and classy and never looks stupid. Easier said than done, I suppose.

          1. Thank you. I just watched it. Great interview. I suspect that the prince is right about the Iranian leadership playing for time and planning to return to their attack. I suspect Trump and his administration are as aware of it as the prince is and are prepared to act accordingly. For a change we have a truly great and intelligent administration.

            I initially had doubts about the Hamas ceasefire but when I saw Netanyahu so willing to go along with it I realized they know Hamas will break the deal but meanwhile they will rest, rearm, get some hostages and then finish Hamas.

            For a change I trust the judgment of our leaders.

      Secretary of State Rubio has been magnificent in this office. It is a pleasure to watch him in action. I hope one day he is President. The Democrats have nobody worthy to shine his shoes much less challenge his intelligence, courage.and decency.

    In Wilson’s day and for years afterwards that might have been true, but today it is only possible if the media joins in to help conceal the alleged incapacity. And that only works for a Democrat since most of the media parrots whatever the Democrat leadership wants them to say and they refuse to inquire about what the Democrat leadership wants covered up. It would not work for a Republican president no matter how protective the first lady, how lax the physician, or how cooperative the staff.

  7. System integration testing can only go so far. Putting complex systems, or systems of systems, into operation in battlefield conditions, is the ultimate test, and the source of extremely valuable data for the design and quality assurance teams.

    Any time there is a military operation anywhere in the world, particularly with advanced technology, I believe that is happening. Obviously that’s not the only reason, but it’s a side benefit. This applies to all sides in a war, or in a series of military engagement that falls short of war.

  8. Turley: I’m ashamed for you. Of all of the serious issues we have going on right now, you decided to use your platform to harp about Joe Biden. What’s wrong Turley–do even you realize that you’ve beaten the “Hunter Biden Scandal” to death?

    We have someone who lied to get into office by making promises he had no way of keeping (“grocery prices will drop precipitously; I’ll end the war beteween Hamas and Israel in 24 hours, even before I take office.”) He also lied about not knowing what Project 2025 was about and that it was his agenda all along—and then hires several of the drafters of it and has enacted the provisions immediately. Project 2025 had over 100 Executive Orders ready for the stooge to sign–and he didn’t even know what he was signing. He knew these lies would hook enough voters to get them to vote for him who otherwise wouldn’t. He also sold the power to paw through our confidential tax and Social Security files and allow the data to be downloaded by his largest campaign contributor, as well as the power to arbitrarily fire federal employees. That entire plan has backfired spectacularly. Most Americans do not approve, and multiple employees had to be re-hired. Then, there’s the utter failure of the “massive deportation” promise to round up all of those illegals who are dangerous criminals, only to bully poor folk looking to pick up a few bucks at the Home Depot. Trump has massively failed before Courts in challenges to his stupid moves.

    And now, to thank the rich Jews who helped him cheat his way into office, he has chosen to stick the United State’s nose into Israel’s war with Iran, after saying he would give them 2 weeks to arrive at a “deal”, even though we already had a deal that he decided to cancel. And, WHY the bombing right now? According to his niece, Dr. Mary Trump, it’s because of “TACO”–the shorthand phrase for “Trump Always Chickens Out”– coined by the Wall Street Journal to describe Trump’s flip flopping over tariffs. Trump’s mental illness-malignant narcissism–REQUIRES him to avoid embarrassment and humiliation–and THAT’s the main reason he decided to bomb Iran without even discussing this with Congress or our EU allies. Avoiding the humiliation of being criticized for using poor judgment is also the explanation for why he is lashing out against media and even blasting Republicans who are criticizing this very stupid move. Another reason is the fact that all of the bluster and bravado are hiding extreme insecurity–all bullies are insecure–but Trump is especially so because his attempts at projecting toughness are failing, his policies are failing, our economy is unstable, and our relations with our allies are failing. More and more Americans are seeing the truth about Trump–that he’s just a trust fund baby who has always tried to project an image of being a successful self-made billionaire, but who is really not much of a businessman, with dozens of failed businesses, claims to be smart, but wasn’t much of a student, someone who has the gall to salute military people but who dodged the draft and calls our military members “suckers and losers”, a television junkie who just loves to get in front of those cameras and who is really just an insecure bully.

    Trump chose for his cabinet syncopantic toadies whose main qualification is that they would do what they are told and never criticize him. So, we have Hegseth who is announcing plans for military operations on an unsecure server–twice–and copying a journalist too. And, then, there’s the huge flop of a military parade to celebrate his birthday that was poorly attended–not only that, but Trump reamed Hegseth because the military members who marched were not in lock step, and they smiled and waved at the crowd–you know–the people they are supposed to be serving and protecting. Trump was upset that they didn’t project “toughness”.

    Trump is flopping in the polls–his approval is south of 40%, and people do not support the unreasonable and unnecessary bombing of Iran. We’re all waiting for the retaliation–could be cyberattacks, could be any one of a number of deeds done by embedded supporters, could be killing of US military in various places in the world. And, WHY? That massive ego, Trump’s stupdity, his stupid policies and utter failure of leadership. So, Turley, why not write about these things?

  9. The obvious question is why the autopen is constitutional. A manual signature should be required for any document that carries any weight or force. If the argument is that POTUS is too busy to sign each and every important document, then I would argue that POTUS has no business signing such documents, since it takes much less time to sign a document than it takes to understand the nature and consequences of the document being signed.

    As an American, we do deserve to know what was happening.

    We also know that there were anomalies with the 2020 election, and now its coming out that there is more evidence to explain these anomalies.

    The Democrats do not want fair and honest elections unless of course they know that they’re going to win.

Now, we all know that spammers and phishers use VPNs, but so do a crapload of honest folks who don’t want to make it easy for their benevolent government to snoop on them. And the way that restriction is applied is ludicrous. Sites like WP (unfortunately are far from alone) pay a lot of money to subscribe to services that furnish them with lists of IP addresses that have been identified as being associated with that sort of misbehavior. The problem is timing. By the time those lists are compiled and distributed, real pro spammers and phishers have long since rotated to different IP addresses, meaning that enforcement of those rules consistently misses its target, and impacts mostly legit users. I also seem to recall (haven’t tried the process in a few months, since four or five previous attempts over about a years time all failed similarly) that there is something in the WP process that is biased toward paid subscribers with their own blogs. I have no desire to be in that class, I just wanted to post an occasiona comment here. But, thanks for playing…

      Even though some of my comments do inexplicably disappear, I do not think it is censorship. I see some evidence that WordPress in general, and/or this blog specifically, have some technical issues (bugs, if you will) that can break the connection at inopportune times during the posting process, or prevent a completed comment from being posted for some other reason. If you take time to notice, the nesting of “comments to comments” is also frequently broken, with a subsequent comment showing up in an inappropriate location.
