Italy Rediscovers National Identity in Fight With EU Court

In my forthcoming book, Rage and the Republic: The Unfinished Story of the American Revolution, I discuss the threat posed by transnational governance, particularly with regard to the European Union. Now, Italy appears to be rediscovering its national identity in a growing fight with the Strasbourg-based European Court of Justice (ECJ). The court just blocked Italy from enforcing its own immigration laws to combat the flood of undocumented persons in the country. Prime Minister Giorgia Meloni has called the ruling an attack on national sovereignty.

The case was brought by two Bangladeshi illegal migrants who were being removed from the country and sent to an asylum processing centre in Albania. The EU member states can only determine safe countries for the return of migrants if they provide evidence and allow for judicial review. It found that the relocations by Italy “do not offer sufficient protection to their entire population.”

Former International Criminal Court magistrate Cuno Tarfusser observed that, under the decision, undocumented persons would merely have to declare themselves as being LGBT or a persecuted religious minority, and their removal would easily be blocked.

Prime Minister Giorgia Meloni said:

“This is a development that should concern everyone – including the political forces that today celebrate the ruling – because it further reduces the already limited margins of autonomy for Governments and Parliaments in shaping the normative and administrative direction of the migration phenomenon. The Court’s decision weakens policies aimed at countering mass illegal immigration and defending national borders.”

I have long been a critic of the EU’s expanding efforts to project its power not just across but outside Europe. That includes threatening American companies that they must comply with EU censorship laws or face confiscatory fines.

 Articles 34 and 35 of the infamous Digital Services Act require all sites to identify, assess, and mitigate “systemic risks” posed by content, including any threats to “civic discourse”, “electoral processes,” and “public health.” It is up to the EU to define and judge such categories in terms of compliance.

The act bars speech that is viewed as “disinformation” or “incitement.” European Commission Executive Vice President Margrethe Vestager celebrated its passage by declaring that it is “not a slogan anymore, that what is illegal offline should also be seen and dealt with as illegal online. Now it is a real thing. Democracy’s back.”

Some in this country have turned to the EU to force the censorship of their fellow citizens. After Elon Musk bought Twitter and dismantled most of the company’s censorship program, many on the left went bonkers. That fury only increased when Musk released the “Twitter files,” confirming the long-denied coordination and support by the government in targeting and suppressing speech.

In response, Hillary Clinton and other Democratic figures turned to Europe and called upon them to use their Digital Services Act to force censorship against Americans. (Clinton spoke at the World Forum and lashed out at the failure to control disinformation.)

The EU immediately responded by threatening Musk with confiscatory penalties against not just his company but himself. He would have to resume massive censorship or else face ruin.

At the recent Berlin conference, the World Forum heralded the slogan “A New World Order With European Values.” It was an expression of the globalized model of governance, a move that directly challenges core principles of democracy and national sovereignty. Countries like Italy are now facing the reality of such transnational governance as European courts and legislation negate national priorities and regulations.

    Communism at its essence is global, with the global “dictatorship of the proletariat” its goal.

    Karl Marx was an invalid and an emaciated drunk who hallucinated that the “hired help,” the feckless proletariat, was best suited for the leadership of a nation, nay, the entire world.

    Of course, sane people know that leadership is rare and critical; leadership is best left to those with superior capacity and acumen.

    The natural and most highly effective ascension to positions of leadership occurs of merit in freedom, free enterprise, free industries, and free markets.

    “All men are created equal…”—After creation, all men are on their own, left to their own merit to create their own success.

    Communism is forcibly imposing, not “immigration,” but population replacement in order to facilitate the comprehensive subjugation of the entire world.

    It is just about there.

    It is long past time to wake up and face the direct and mortal enemies of freedom.

    1. It is a sad thing that the evils of socialism/communism are no longer taught in public schools and universities. It has gotten as verboten to condemn the many historically documented failures of communism as it is to point out black on white crime.

      Unless we gain control of, and disinfect, our media/education industries we will go down the same tubes as Europe is sliding down currently.

      When you consider the finer points, islam is just a militant form of communism in that your freedoms are curtailed by a top-heavy bureaucracy that decides what is good for you. One of the worst combinations for culture is a mix of communism with islam.

  3. I’m surprised at Meloni. She should know that because Italy is a member of the EU, it has lost its sovereignty if the EU thinks it needs to.
    The UN was basically created out of guilt because Wilson’s League of Nations wasn’t embraced. And then used by the Rockefeller wing to fool us into thinking that its global governance would stop war. The scam worked until it didn’t. Which is where we are now. I’m for national sovereignty. I look around and see others who tell me they do as well but don’t support Trump. That’s “the tell” to me that they are idiots. If you are for national sovereignty, Trump is your only hope.

      Do you really believe that? The EU has been progressively losing it’s grip on it’s members, with the Ukraine war being the most immediate (but not the only, or the most basic) cause. Some of it’s newer members in Eastern Europe have taken steps in what is nearly open defiance of its stated positions. The only coherence that it ever exhibited was when France and Germany had the power to dictate to the other members. Those days are gone, never to return. If it sufficiently antagonizes members such as Italy to the point that one or more of those members seeks to withdraw, what power do you think it would have to prevent it? I very much doubt that it has the will or the power to oppose such an action militarily. Opposing it economically would only exacerbate the inherent conflicts among the remaining members. My sense is that it is for all intents and purposes a sinking ship, and that it will not survive another decade in anything like its current form.

If the EU is going to be fining U.S. corporations for not censoring customers to the EU’s liking, and even fining individual U.S. citizens for merely expressing opinion online, all of it allegedly in violation of vaguely defined or undefined EU standards, then the U.S. should institute a special tariff against all of the EU to collect back those fines and reimburse the U.S. corporations and citizens, plus perhaps an administrative percentage for providing the service. This should be completely separate from any other tariff or duty and not subject to negotiation. The tariff rate would go up or down based on the dollar amount of the fines that have been assessed by the EU that have not already been collected back by the U.S. and reimbursed to those corporations or citizens.

    Second, I don’t understand why any country has to send back illegal immigrants all the way back to their home countries or some supposed ‘safe’ country. The illegals in some cases travelled half-way around the world, or at least through numerous other countries, on their way to their preferred destination. Presumably some of those countries they passed through or around or over were safe enough to stay and apply for asylum there, if they are in fact legitimate refugees (and most are not) rather than just economic migrants. Why can’t they simply be ordered to leave? Let them go back home or to any other place they passed through, as in, we don’t really care where you go just so long as you go.

If Joseph Goebbels had the EU of today, the Germans would not have just outlawed listening to foreign broadcasts applicable to their own population, they would have sued the BBC, and the American media for violations of Freedom from Speech. Which is essentially what the EU has devised here. “Freedom from Speech.”

    To wit; the right to remain safe and security in ones own held values and beliefs without having to fear or suffer harmful psychological effects arising from potential conflicts of self doubt or uncertainty, which may result from exposure to any speech containing values and beliefs which are contradictory to what one’s own held values and beliefs may be.

    Particularly useful in protecting governmental officials who’s values and beliefs are in opposition to the populace they rule over.

In the beginning, the EU said it was formed to keep Europe (and the World it interacts with) a place of Peace, a safer place where people of every European nation are treated fairly and their laws are respected, where all Europeans are equal and their rights are respected. Respect. How does DISrespecting the laws of Italy re: Illegal Migration fit into this? ..sure sounds like soros-et-al has gotten to this EU Court finally.. money talks. follow the money… Giorgia Meloni needs to be supported 100% for standing up to this tyranny.

      Is that in reference to the French immigrant problem the Swiss were having at public pools where the immigrants were sexually assaulting young girls, starting fights when confronted, the police were called sometimes two or three times in the same hour?   10. Interesting development. I did not know that the Europeans had values. The seemed to have missed the entire meaning of the enlightenment. Many wrote about the enlightenment but few ever grasped the entire scope of what it meant especially on a national government scale. At various times the UK came close but then would backslide. As imperfect as we may be, this country seemed to have grasped much more clearly the greater meaning of the enlightenment in its totality and function in a nation state even as we strive to improve ourselves. The European Union is literally an Autocratic Superstate that has no grasp of the fundamental and god given rights of individuals. They wish to constrain both your financial and political freedoms. Democracy in all it’s forms are in retreat in that superstate.

      And you’re right about Europe. England and France dated the Enlightenment, but never married. Germany dated, then married then anti-Enlightenment.

      European Values are the core to some of the newly emerging political groups or already established groups as they push back against the elites and their version of what they call European Values which amounts to censorship, the banning of any opposition, declaring democrat elections null and void if they do not like the outcome.
