Georgia Judge Rules Against Democrats Blocking Republicans on Board of Elections

Democrats in Georgia have lost their effort to block two Republican commissioners from sitting on Fulton County’s Board of Elections because of their political views. What is most striking about this effort was not just the raw partisanship but the utter lack of legal authority of Democrats to refuse to recognize the duly selected GOP members.

For months, the board has blocked two Republican nominees: Jason Frazier and Julie Adams. Fulton County Commissioner Marvin Arrington declared that “I think the Republican party ought to take a look at their people and not nominate people that are on the far right and nominate people that are in the center.”

While self-proclaimed defenders of democracy often seem to have no qualms about curtailing democratic choices from ballot cleansing to jurisdiction flight, this is particularly raw and outrageous. There is no law supporting this action and the state law is clear on the need to seat the GOP commissioners.

Under the state law, two members are appointed by the Democratic party, two are appointed by the Republican party, and a chairperson is selected by the Fulton Commissioners.

On Monday, Fulton County Superior Court Senior Judge David Emerson crushed the claims by the majority that they possessed a veto over GOP commissioners despite the law saying that the commissioners “shall” be seated. It is difficult to see how any competent lawyer would support this legal claim.

Emerson stated the obvious that the Fulton County Commission did “not have the discretion to disapprove an otherwise qualified nominee.” The court points out that higher courts have repeatedly rejected the argument of the Board that “shall” does not mean “shall.” Instead, they claimed that it is merely “directive” and allows them to choose who the other party will sit on the board.

The frivolous character of the Board position is captured in this line:  “The court also notes that the appointment statute contains no provision to support the respondents’ position that it should have the power to veto any given nominee and force the county chairperson to submit other nominees.”

The two challenged commissioners have been denounced as far-right or “election deniers” by Democrats. In other words, the commissioners are claiming that they can bar members based on their political views to force the GOP to select commissioners that they consider acceptable. Commissioner Mo Ivory insisted in the board’s meeting that “It’s not possible to work with folks trying to sow discord and chaos”

Judge Emerson had enough, writing that “the lack of these appointments harms the election process and deprives the nominating party of representation on the BOE.”

    As for illegal immigrants it’s not about the vote. It’s about the 2030 census. The Constitution requires a census if “all persons”. It does not care if these persons are legal, illegal, citizens or not citizens, voters or not voters, just that they are persons
    The number of people determine how House of Representatives and therefore electoral votes are apportioned..
    Stick a couple million illegals in California, a couple more in Illinois, a couple more in New York a couple more in Oregon and maybe Washington State to be counted in the census. Their increased population would result in them receiving more congressional seats, taken of course from Red States. This would give them permanent control of the House of Representatives as well as the Electoral College forever. That’s the Democrats long game and that is why they are fighting so ferociously to feed and shelter these people until at least 2030.
    We better start looking in a way to make sure that they cannot be counted in the census, and we better ought to start looking at that soon OR we need to be deporting these people by truck load and trailer load as soon as possible so they’re not around in 2030.

It is only explanation for the Biden open border policy despite the near term political damage to the Dem party it caused. The administration should focus deportation efforts on the blue states where most of the of illegals wound up to counter the attempt at trying to creat a one party country.

  10. It was certainly improper for the Arrington to attempt to block these GOP commissioners. However, this article hardly provides a reasonable background of the issue.

    He conveniently leaves out that Julie Adams, one of the GOP commissioners in question, filed a lawsuit seeking a declaration that her duties as an election board member were “discretionary.” She does not believe she must vote to certify results by the deadline set in law. A Georgia appeals court clarified that county election officials must vote to certify results according to deadlines set in law.

    Contrast this with the way that the GOP is handling the redistricting situation in TX. Anyone, who disapproves of TX Democratic legislators believing their vote duties are “discretionary” should not be supporting folks like Adams.

That being said, I personally feel Julie Adams should have the right to challenge election results if she think it isn’t transparent and question its integrity. After all, we had seen what numerous courts did back in 2020 and their denying of plaintiffs’ challenges by claiming that they have no legal standing to challenge the results of the election or election rules being change extra-legislatively because either A) the election hadn’t begun yet, B) the election is still on-going, or C) the election is over and the plaintiffs were too late to challenge the election results.

      However, after reading this article from Fox 5 Atlanta (Fulton County election board member appeals order saying she must certify results), I agree with the judge, the same Robert McBurney who ruled in favor of the republicans in the Fulton County Election Board case, that Ms. Adams must comply with Georgia’s state law and certified an election results. So if Ms. Adams want the ability to challenge an election result, the onus is on the Georgia Legislature to change the law.

    6. Anonymous – before Democrats threw the border open, farmers used H2A temporary visas for agricultural workers. They could then sponsor ag workers to get permanent resident visas via an EB-3.

      The only reason why so many agricultural workers today are illegal, is because the border was opened a bit at a time by Democrats, until the absolute deluge of 10 million under Biden’s tenure.

      As the border became less secure, entire industries shifted to cheap illegal labor. Citizens and legal residents are expensive to employ. They are entitled to minimum wage, work comp, and all the benefits voters demand. Illegals often work for cash under the table, for which they pay no taxes, and they enjoy no benefits like work comp, unemployment, and so on…or at least they didn’t, until Biden gave them Taxpayer Identification Numbers.

      Illegal aliens are a 2nd class of worker. Employers don’t follow the law, and utilize them to undercut competitors. Many rungs on the ladder of success are closed to them.

      When I was a teenager, landscaping companies were all owned by citizens or legal residents, or sometimes high school students raising money. Farms hired temporary migrant workers, local youth, and often their own children and relatives.

      Today, virtually all of them in CA run illegal immigrant crews. It’s how they undercut the legitimate businesses who hired legal residents and citizens, paid them a decent wage, and carried all the required benefits.

      After all these years of porous, and then wide open borders, of course returning to the days when a second class of worker, the illegal alien, is not available will be difficult. Farmers will once again rely on the ag visas. It will be a process.

      Democrats have used the same arguments in favor of illegal immigrants that they used in support of slavery…essentially, “Who would pick the cotton?” The country survived ending the Peculiar Institution. No one today thinks agriculture will dissolve without slaves. If we stay the course, keep voting in Republicans for a few more terms, so illegal immigration is virtually impossible and all immigration goes through legal channels, then soon, no one will think agriculture cannot survive without illegal immigrants.

      The Democrat Party does not consider the potential of illegal immigrants. They view them as cheap farm workers, janitors, and other unskilled labor, who will remain unskilled. An underclass to be exploited.
