No, the President Cannot Strip Rosie O’Donnell of Her Citizenship

President Donald Trump said on Wednesday he may strip comedian Rosie O’Donnell of her U.S. citizenship. He has made the threat previously, despite having no authority to do so. In the United States, political critics cannot be stripped of their citizenship, and pursuing such a course would be a fundamental denial of constitutional protections not only under the 14th Amendment but also under the 1st Amendment.

This week, the President stated on Truth Social that “As previously mentioned, we are giving serious thought to taking away Rosie O’Donnell’s Citizenship. She is not a Great American and is, in my opinion, incapable of being so!”

When I previously objected that such a move would be grossly unconstitutioal, supporters insisted that Trump was simply trolling opponents. However, the threat of an unconstitutional act only reinforces the narratives of O’Donnell, who has engaged in false claims and conspiracy theories on social media.

O’Donnell has trolled Trump after fleeing the country in protest to live in Ireland. Most recently, she was widely criticized for claiming that the shooter at the Minnesota Catholic church was “a white guy, Republican, MAGA person. White supremacist.” She later apologized, but added, “I assumed, like most shooters, they followed a standard MO and had standard, you know, feelings of… you know, NRA-loving kind of gun people.”

Spreading disinformation is not grounds for losing your citizenship and would create a dangerous precedent. Indeed, President Trump rightfully objected to Democrats trying to strip him from ballots in the last election. To now claim the right to strip political opponents of their actual citizenship only surrenders the high ground to his critics.

The feud between Trump and O’Donnell dates back years, predating Trump’s election as president.

However, Trump has also threatened to rescind the citizenship of former White House adviser Elon Musk and even New York City Democratic mayoral candidate Zohran Mamdani. Both Musk and Mamdani were born outside the country, but received U.S. citizenship through a legal process.

There are narrow circumstances under which a naturalized citizen can be stripped of citizenship, but those circumstances do not include their political views.

In 1967, the Supreme Court handed down Afroyim v. Rusk, declaring that U.S. citizens can only lose their citizenship by voluntarily relinquishing it, or where citizenship was gained by fraud.

Beys Afroyim was born in Poland and the U.S. government sought to strip him of citizenship after learning that he had cast a vote in an Israeli election. The Supreme Court ruled that his status remained protected under the Citizenship Clause of the Fourteenth Amendment to the Constitution.

Likewise, in Trop v. Dulles in 1958, the Court ruled that the government could not strip Albert Trop of his citizenship after he escaped from an Army stockade in Casablanca, Morocco. While he turned himself in the next day, the government argued that (since the country was engaged in a war and Trop was dishonorably discharged), it could revoke his status despite being a natural-born citizen.  

Chief Justice Earl Warren wrote that such punishment ran afoul of the Eighth Amendment and constituted  “a form of punishment more primitive than torture” since it amounts to the “total destruction of the individual’s status in organized society.”

Trump may wish to challenge Trop, but there is no indication that the Supreme Court would seriously consider such a departure from the long-standing precedent. That is even less likely where the effort is based on retaliation for political criticism of the President.

  1. I used to find Trump’s hyperbole off-putting, now that I understand the logic behind it, it mainly elicits laughter. I do not think he has any intention of following through, they know they’d lose in court. It pales in comparison to dem chicanery of the last ten years that has actually been employed if not embraced with knowledge of same (28th amendment, student loans, rogue judiciary, anyone? Let’s not even get started on covid).

    Thus far nothing this administration has done has been outside their purview, it isn’t a ‘new normal’ or ‘totalitarian’ to enforce or utilize our existing laws (unless one has no recollection of the USA prior to Obama, which many don’t at this point) but rather a return to normal, and the MSM exaggerate more in 30 seconds every day than Trump could in a lifetime.

    Rosie is not well, but she is perfectly safe, and TDS is a very real phenomena. Would love to know what the Irish people think of her behind closed doors given how much they ridicule someone like Bono.

Sending troops to California has been declared unconstitutional. His attempts at firing Fed Reserve board members have been ruled illegal and/or beyond his authority. He wants to take away birthright citizenship and revoke naturalized citizenship of their citizenship for minor violations of law as an excuse to remove legal immigrants.

      There are a lot of things Trump has done that are outside his purview because he wants to do what he admires most. The ability to do what he wants regardless of what the law says like dictators do. He’s a big fan of people like Kim Jung Un, Putin, Salvador’s president, etc. All dictators are in their own right.

      The policies he pushes are all geared for authoritarian rule like punishing people with the harshest possible penalty for minor offenses he wants to interpret as disloyal and un-American.

      His declining health and mental acuity are not helping either.

        He has expressed no such desire. Naturalization, once validly obtained, can’t ever be revoked no matter what the person does later. Green cards, however, can be revoked if the person commits any crime, no matter how minor. A green card is a courtesy, not a right, and it’s granted on condition that the recipient keeps all the laws.

        It took time to come to the realization, it was jarring initially during his first term. The abject ugliness of the left in the time since makes Trump look like Wilford Brimley selling oatmeal in the 80s, and it is crystal clear that A) Trump jokes a lot, and, B) the modern left is precisely one-thousand percent too serious and bereft of anything resembling a sense of humor or a sense of fairness. They really are spoiled children that want to take their toys home in a huff, at heart, or worse, bully everyone else, nearly universally in 2025.   5. Professor Turley is correct regarding 47’s inability to successfully strip Rosie (“The Loon”) O’Donnell of her citizenship, but he errs in characterizing Albert Trop in the SCOTUS case bearing his name as being a “natural-born citizen.”

    As both the Second Circuit and Supreme Court opinions confirm, Trop was a native-born citizen rather than a natural born citizen, at least as contemplated by the Founders. Only a natural born Citizen may serve as President.

    While this error does not affect O’Donnell (who, mercifully, has not announced a run for the presidency), the issue could surface for examination when the Supreme Court addresses the “birthright citizenship” matters now strolling through the lower courts. On the other hand, given the Court’s prior insouciance on the topic, do not bet the farm that such an examination will actually happen. With few exceptions, the Court relishes the avoidance of answers to controversial questions.

I can say with 100% assuredness that, however the Birthright Citizenship matter is finally resolved, it will NOT involve stripping persons of US Citizenship who’ve already been been granted it, even if under a situation of ambiguity later settled towards a more restrictive posture. Why do I know this? Because BOTH Trump’s E.O. and H.R. 569 — both restricting which newborns are eligible — only apply going forward. There is no retroactive impact.

      That said, the Democrat antagonists will bellow using the present tense that US Citizenship is being stripped from babies not even conceived yet. How can you take away something not yet conferred? Logic has no particular role to play in Dem sloganeering.

      1. US citizenship is not “conferred” or “granted”. It comes naturally, by right of birth. Anyone born in the USA is automatically a US citizen, with the SOLE exception of those who are born immune to US law, because their parents have diplomatic immunity, or are part of an invading army, and I think there’s also an exception for babies born on foreign-flagged ships that are transiting through US waters with no plan to land in the USA.

  14. Professor Turley is absolutely right on the law, and though I think this is mere rhetorical excess on President Trump’s part, I often wish he’d be a bit more measured in his remarks.

    I do believe, though, that the worst assaults on the acknowledgements and guarantees of the Constitution come from across the aisle. Which is why I voted Trump twice (for neither major party candidate in 2016).
