Supreme Court Reverses Lower Court and Allows ICE Raids in California to Resume

The Supreme Court has again rebuffed lower courts seeking to block executive actions, from immigration to the downsizing of government. In the latest victory for the Trump Administration, the Court reversed decisions of a federal district court judge and the Ninth Circuit Court of Appeals to enjoin new ICE raids in California.

California Gov. Gavin Newsom and other Democrats proceeded to attack the Supreme Court justices as political hacks. Newsom declared on X that “@realDonaldTrump’s hand-picked SCOTUS majority just became the Grand Marshal for a parade of racial terror in LA.”

U.S. District Judge Maame E. Frimpong, a Biden appointee, in Los Angeles, had found a “mountain of evidence” that enforcement tactics were violating the Constitution. She found that ICE was racially profiling suspects in the operation. The Ninth Circuit upheld the controversial ruling.

An estimated over seventy percent of undocumented immigrants are hispanic.

The Supreme Court summarily tossed the injunction. While the order was issued without an opinion, two justices squared off on the looming issue in the case.

Justice Brett Kavanaugh wrote a concurring opinion arguing that race can be one of the factors used by ICE for the reasonable suspicion to stop a person and inquire about their immigration status: “To be clear, apparent ethnicity alone cannot furnish reasonable suspicion; under this Court’s case law regarding immigration stops, however, it can be a ‘relevant factor’ when considered along with other salient factors.”

Justice Sonia Sotomayor issued a dissent that called the raids troubling and then added “we should not have to live in a country where the Government can seize anyone who looks Latino, speaks Spanish, and appears to work a low wage job.”

Sen. Adam Schiff (D., Cal.) beat the drum of dictatorship in a posting to X: “This is blatantly illegal, yet the Supreme Court is allowing it to happen while the case proceeds. When the history of this country’s rapid descent into dictatorship is written, Republicans in Congress and the Roberts Court will have been its primary enabler.”

There was a time when the Court could disagree on the legality of a search without instantly being declared the handmaiden of tyranny. This is clearly not that time. However, the escalating rhetoric on the left is fueling the violence that is rising in cities like Portland.

As I noted this week, there is an emergence of a new Jacobin class of establishment figures and intellectuals seeking to ride the wave of rage on the left. Even a cursory review of French history shows that such enablers are rarely immune from the mob justice that accompanies the rhetoric of rage.

  2. Hispanics are not a race. They are descendents of people from the Iberian Peninsula – Spain and Portugal. Their DNA matches those people who we call White or Caucasian. They are the only group of people we give a separate classification to based on the language they speak. And we classify them by ethnicity, not race.
    I often wonder if they get to check the ethnicity box and the White box as well.

  4. I’m shocked Charlie Kirk has been Killed. This kind of violence is never acceptable. I sincerely hope they prosecute the shooter to the fullest extent of the law. He may have been controversial, and divisive to the left. But that sort of violence is never acceptable nor should be condoned. A truly despicable act.

    Race cannot be a “factor” in profiling if it can’t be a factor in college admissions.

      1. Not all arrestees are on their lists. They look for “collateral” to add to their arrest numbers. That’s where they are using racial profiling and assuming people are illegal aliens just by their looks or where they work.

        1. It’s actually an interesting question. Reasonable suspicion is usually multi-factored, and police are not required to ignore relevant factors. Also, governmental classifications by race are not always prohibited, such as during a prison race riot. However, any legislative classifications by race, while not ipso facto unconstitutional, must survive strict judicial scrutiny if challenged. I’m sure Justice Thomas is well aware of all these points. Given the posture of the case, and the lack of a majority opinion, there are any number of reasons Thomas might have agreed with the result, such as that he thought some other requirements for injunctive relief were not met besides the alleged illegality. Drawing conclusions from his silence is tenuous.

Even a person who took may have taken the gun away from the real shooter is immediately a suspect to those not aware of the situation. That’s why it’s not a good idea to immediately pull a gun out in a crowd like that. In the chaos of the crowd anyone can point out to the police that person has a gun. They will not hesitate to arrest or shoot if they see it as a threat. If they don’t have the shooter then he’s still out there.

    Glad the July 11, 2025, ORDER was linked. TY Professor. I read the entire 52 page Order. If the “facts” in the Order are true, then ICE was clearly violating numerous constitutionally protected rights, especially the 4th Amendment. The facts laid out in the Order show ICE was not following the law in making WARRANT LESS detentions and arrests. It is clear that the ICE agents were clearly stopping, detaining and arresting people based on skin color ALONE, and NOTHING else. ICE did NOT have the factors listed in Kavanaugh’s opinion in the TRO, how can you come to ANY other conclusion when ICE is arresting US Citizens, or legally admitted immigrants, because the do not have a “passport” on their person. Serious, not making that up, read the Opinion. . You have an ICE agent being shown a CA drivers license, or CA ID Card, yet the agency STILL arrests them and takes them into custody. Then claim that they need their PASSPORT, in addition to their valid and legit CA Drivers License/ID Card??? Please!!!… If any of us were INITIALLY detained for a LEGIT REASON (not based on our RACE ALONE), such a a traffic citation, and the LEO said he needed a PASSPORT in ADDITION to a Driver’s License, and then ARRESTED US when we had no passport, do you seriously think that would be legit? No, it would be a violation of the 4th Amendment. And that would be the biggest ass 4th Amendment lawsuit ICE had ever seen….     In a series of videos, he gave a rambling account of obsessions and paranoias that appeared to be troubling him with increasing intensity up to the catastrophe. Another was a belief in the gold and silver standard of currency – a favourite topic of the rightwing of American politics that is regularly propounded by the Fox News commentator Glenn Beck.

    The tone of Loughner’s rantings is almost exclusively conservative and anti-government, with echoes of the populist campaigning of the Tea Party movement. “Don’t trust the government listener!” he said in one video, accusing Washington of mind control and brainwashing.

    The US constitution, the bible of the Tea Parties, features heavily, as does the suggestion that the federal government is acting against the text. “You don’t have to accept the federalist laws. Read the United States of America constitution to apprehend all of the current treasonous laws.”

    There is also a strong streak of implicit violence in the postings.

    He linked to his favourite video, America: Your Last Memory in a Terrorist Country, which shows a ghostly figure burning the US flag in the desert to a heavy metal song that repeatedly chants “Let the bodies hit the floor!”

    He referred to people calling him a terrorist and wrote “a terrorist is a person who employs terror or terrorism, especially as a political weapon.”

    Until 4 October, Loughner was a student at Pima community college in Tucson, but he was suspended after a number of inappropriate acts.

    The college said he had five contacts with the campus police for having disrupted classrooms and the library. In a YouTube video posted on 29 September, Loughner accused the college of fraud and of being illegal under the US constitution.

    After Loughner quit the college, the institution made clear that, if he wished to return, he would have to undergo a mental health check to ensure that his presence did not “present a danger to himself or others”.

    Fellow students at Pima told local newspapers that he had displayed troubled behaviour. He was reported to be isolated and withdrawn and used to laugh out loud in the poetry class in a way that made others feel uneasy.

    “He disrupted class frequently with nonsensical outbursts,” Lynda Sorenson, who shared his mathematics class last year, told the Arizona Daily Star.

    He lived with his parents on the northwest side of Tucson, a few miles away from the shooting scene. His difficulties began relatively early, with one incident recorded by police of a drug violation while he was at high school. He tried to enlist in the US military in Tucson but was turned away for unspecified reasons.

    Arizona prides itself on its loose gun laws but there is still shock that a man with such a prolonged history of erratic and disturbing outbursts was able to legally acquire the gun he used in his rampage. The shootings were carried out with a Glock 19 semiautomatic, with a magazine of 30 bullets.

Also there is the spine and spinal cord. All it takes is millimeters to make a difference.             2. Yes the shell casing of a .223 or 5.56 is much larger, usually meaning a loud bang, far more pronounced than a .22 long rifle. Could be a .22 magnum. Reportedly they think the most likely distance of the shot was 200 yards. Probably more than a .22. .22 usually used at shorter range. I would suspect at 5.56.

More misleading BS from Turley—all the SCOTUS did was pause the lower court injunction preventing ICE from racially profiling people who speak Spanish, who might appear to be hispanic, or who work at low-wage jobs. There was NO ruling on the merits–which is to be fully briefed. This is NOT any “victory” for the Trump administration–dissolving a preliminary injunction, without any explanation, based on a nonexistent “emergency” is purely driven by politics. This ruling is outrageous because 50 years ago, the SCOTUS outlawed racial profiling by police. All of this is, of course, a diversion away from the 130 + court losses the Trump administration has racked up so far since Trump cheated his way into office, including Courts blocking Trump from trying to fire members of the FTC and Federal Reserve. Turley speaks of “rage on the left”–people SHOULD BE outraged when the SCOTUS, the majority of whom lied to get on the bench, reverses cases that have stood for decades. Racial profiling is WRONG and unconstitutional. But, that’s not the message Turley is paid to promote.

      1. Old Man: Turley said that the lower court was REVERSED–it was NOT. The SCOTUS merely paused the injunction granted by the lower court. The merits still need to be fully briefed and ruled on. BUT, up to now, racial profiling has been unconstitutional for the past 50 years. AND, there was NO “emergency”, so this case did not belong on the “emergency” or “shadow” docket, which is increasingly misused to avoid the merits of cases.

      A friend of mine, former SWAT commander, retired LEO, sent me a video. Based off what has been reported and the video, long range shot, the shooter was aiming for the head but misjudged the drop or did not compensate for the downward angle. Regardless, based off the shot placement, the amount of blood loss, that could be fatal.

            Correction, based off the reporting of the building from which the shot was taken and where Kirk was speaking, found a map of UVU campus, crossed referenced with Google Maps, taking some guess work with the scale/distance, looks like a short range shot, the downward angle was likely why the POI was low, in the neck, vs the head.
            My friend needs more info at to the height to angle to make a more detailed analysis.

Mexico’s statistics on skin color: Instead of a racial census, the government has recently published data based on observable physical traits like skin color. A 2017 study found that 49% of the population could be considered “light-skinned. Your racist classification doesn’t hold water. You should have looked it up before you flapped your lip.

      Depends on the situation and circumstances. Did ICE SEE them cross the border, with their own eyes? Arrest them and deport them. No problemo… I know one thing is certain, I AM NOT going to detain, let alone arrest anyone with no other supporting facts, just for being Asian.

    Law enforcement needs reasonable suspicion.
    Reasonable suspicion can be reached by a combination of factors – many of which are either legal conduct or attributes.

    The number of grandma’s of swedish descent engaged in islamic terrorism is nil. We reasonably conclude searching grandma’s depends for bombs is a waste of time and an embarrasment.

    Being hispanic in LA does not make you an illegal alien, but it is far more likely than if you are polish.

    We look for those who violate the law among the groups they are most likely to belong to

    We do not look for mass shooters among the hispanic community.
    We are seeing an increasing trend of mass shooters who are white and Trans.

    The standard for a stop is NOT proof beyond a reasonable doubt – it is reasonable suspicion.

    1. Reasonable suspicion is a ridiculously low bar. It makes it very easy to violate 4th amendment rights just by using “reasonable suspicion”. It’s almost like a nice loophole to violete youre 4th amendment rights.
