On MSNBC’s “All In,” House Minority Leader Hakeem Jeffries (D-NY) doubled down on his pledge of legal retaliation against Trump officials and associates if Democrats retake power. He noted that Trump “sycophants” in the Department of Justice do not have immunity and will be pursued. The statement comes after the indictment of Letitia James for mortgage fraud. The statement suggests that the country could be in store for waves of purge politics in which parties fire or prosecute officials from the prior administration.

On the program, Jeffries was asked about his prior threats of tit-for-tat actions against Trump supporters or enablers.

They will be held accountable. What do you mean by that?”
Jeffries responded that
“there are so many different corrupt sycophants within the Trump administration, including, but not limited to within the Department of Justice. Now, these people don’t have immunity. And the reality is the statute of limitations is five years, and there will be accountability with the next administration, if not before, when Democrats take back control of the House of Representatives.”
In the meantime, James is claiming victim status in the indictment despite being lawfare’s happiest warrior, who ran on a pledge to nail Trump if elected (without bothering to specify what that crime or offense might be). James is declaring, “I am fearless.” She is also shameless.

That’s quite an understatement. Professor Turley’s “criticism” of Trump constitutes a bit of mealy-mouthed barely-there concerns. Trump wasn’t chastising the DOJ. He was demanding and ordering their prosecution. The Truth Social post was not supposed to be public.
Eric Siebert resigned. He and his team did not find sufficient evidence of a crime in either case. Then there’s the problem of Halligan. She was illegally appointed to be the prosecutor for both cases. Both Comey and James indictments are worthless because the prosecutor has no authority to be in that position.
Both cases will be dismissed before any trial takes place. I’m surprised Professor Turley didn’t bring up the “Biden judge”excuse this time.

It’s not “political retribution” to indict Comey or Letitia James if there’s real evidence of crimes. For those who were once targeted by their abuse of power, it feels less like payback and more like long-delayed justice. The “no one is above the law” mantra is often wielded by those in power—until they lose power and suddenly demand immunity. True rule of law means they finally face the same standard they once imposed on others.

I am always surprised at the negative reactions that the suggestion of eliminating qualified immunity elicits from people who otherwise seem quite reasonable. Am I the only one who doesn’t aspire to unmitigated political power, and therefore do not feel threatened by that suggestion? The only serious negative that I see in that proposal is that fewer people would aspire to political office, and, frankly, I am hard put to view that as an actual negative. Most people with any sense and intelligence seem to agree that the power and scope of the Federal government should be materially reduced (although the details are subject to much debate). So wouldn’t reducing the demand for political power arguably aid in building momentum toward such a reduction?

Someone needs to tell The Hack that Congress does not have judicial powers to prosecute putative crimes, instead Congress has impeachment powers, and I don’t think there is a statute of limitations for “high crimes and misdemeanors” that may warrant impeachment. Successful removal of an impeached official from office would require Senate confirmation by a two-thirds vote, something very unlikely. The Hack is simply threatening more of the Democrat-led obstruction that characterized the years 2016-2020. Without specific claims of committed crimes, his statement is little different from Tish James’ campaign promise to “get Trump”. Since they have proven that they can’t govern (look at the mess in Democrat-controlled cities and states), lawfare theatre is all they have to offer.

UPDATE: Just three weeks ago, SCOTUS reversed Obama Judge AliKhan’s order to reinstate FTC Commissioner Rebecca Slaughter (fired by Trump) during the pendency of her appeal.
Any action taken by the DOJ addressing crimes committed by these people will be reported as retaliation, reprisal, vengeance, retribution and in the same breath they’ll make threats of retaliation. From day one they were preparing an impeachment plan against President Trump for what, pure hate. They’re a lost cause.
