Supreme Court Issues Major Opinion on Transgender Identity and the Trump Passport Policy

In a significant win for the Trump Administration, the United States Supreme Court issued an opinion on Thursday afternoon on the Trump Administration’s requirement that passport holders use their sex assigned at birth and that such requirements do not violate equal protection guarantees. While a brief, unsigned opinion issued on the interim docket, it represents a major ruling on the constitutional protections afforded to transgender individuals.

The case began with a challenge to an executive order issued on January 20, 2025, declaring that the federal government would only “recognize two sexes, male and female.” The order instructed the State Department to “require that government-issued identification documents, including passports, visas, and Global Entry cards, accurately reflect the holder’s sex.”

The litigants alleged that the order and underlying policy were a denial of equal protection.

I previously discussed the Supreme Court’s upholding a Tennessee ban on transgender medical treatments for adolescents. One of the most notable aspects of this decision was the concurrence of Justice Amy Coney Barrett, rejecting the claim that transgender status qualifies as a group entitled to heightened scrutiny under the Constitution.

Chief Justice John Roberts wrote that “The Equal Protection Clause does not resolve these disagreements.” However, the Court stressed that “This Court has not previously held that transgender individuals are a suspect or quasisuspect class. And this case, in any event, does not raise that question because SB1 does not classify on the basis of transgender status.”

In her concurrence, Justice Amy Coney Barrett directly rejected the claim:

The Sixth Circuit held that transgender individuals do not constitute a suspect class, and it was right to do so.3 To begin, transgender status is not marked by the same sort of “‘obvious, immutable, or distinguishing characteristics’” as race or sex.

…Nor is the transgender population a “discrete group,” as our cases require.

…The boundaries of the group, in other words, are not defined by an easily ascertainable characteristic that is fixed and consistent across the group. Finally, holding that transgender people constitute a suspect class would require courts to oversee all manner of policy choices normally committed to legislative discretion.

…The conclusion that transgender individuals do not share the “obvious, immutable, or distinguishing characteristics” of “a discrete group” is enough to demonstrate that transgender status does not define a suspect class.

…The Equal Protection Clause does not demand heightened judicial scrutiny of laws that classify based on transgender status. Rational-basis review applies, which means that courts must give legislatures flexibility to make policy in this area.

While that was a concurrence with only Justice Thomas, I wrote at the time that the concurrence “likely speaks to the view of three or four other members on the Court.”

It now appears that it clearly did represent the majority’s view.

In this opinion, the Court rejects the rulings of U.S. District Judge Julia Kobick, a Biden appointee in Massachusetts, and the United States Court of Appeals for the First Circuit on the injunction of the policy. Both courts would have forced the Trump Administration to issue passports to transgender and nonbinary Americans that reflect the sex designation of their choosing.

However, the Court ruled that “Displaying passport holders’ sex at birth no more offends equal protection principles than displaying their country of birth—in both cases, the Government is merely attesting to a historical fact without subjecting anyone to differential treatment.”

In rejecting the equal protection claim, the Court added that there is no evidence that a policy requiring a passport to display the holder’s biological sex can only be the result of “a bare  . . . desire to harm a politically unpopular group.” It further found that the challengers are unlikely to prevail under the Administrative Procedure Act as “arbitrary and capricious.”

The Trump administration is thus “likely to succeed on the merits” of its defense against the challengers’ claims, the court wrote. And because Kobick’s order “enjoins enforcement of an Executive Branch policy with foreign affairs implications concerning a Government document,” the court said, the government “will ‘suffer[] a form of irreparable injury’” if the order is not paused.

That produced another fiery dissent from Justice Ketanji Brown Jackson in her dissent, which Justices Sonia Sotomayor and Elena Kagan joined. Jackson slammed her colleagues:

“The Court … fails to spill any ink considering the plaintiffs, opting instead to intervene in the Government’s favor without equitable justification, and in a manner that permits harm to be inflicted on the most vulnerable party.”

Jackson dismissed the opinion as a type of “back-of-the-napkin assessment” in a cursory opinion. She objected that, not only had the Administration not shown any irreparable harm absent emergency relief, but the challengers “have shown they will suffer concrete injuries if the Government’s Passport Policy is immediately enforced.” She concluded by claiming that “the Court’s failure to acknowledge the basic norms of equity jurisdiction is more than merely regrettable. It is an abdication of the Court’s duty to ensure that equitable standards apply equally to all litigants—to transgender people and the Government alike.”

The opinion substantially reinforced Barrett’s earlier position. While the government had the advantage of a case in an area where considerable deference is given to executive decision-making, the underlying equal protection holding is a major setback for advocates seeking to establish transgender status as protected in the same way as race or religion.

Prof. Turley — Please do not use the phrase “sex assigned at birth.” That sounds too much like the crowd that thinks it’s okay to “identify” however one pleases, rather than by the gender/sex he or she was born. The closest I would get to that phrase is to say, “sex assigned BY GOD at birth,” which is how one’s gender/sex is actually determined. After all, Someone had to make that “assignment at birth,” right?

It’s the reality deniers who say “sex assigned at BIRTH,” as though it were an arbitrary occurrence, rather than a careful decision made by God Himself, when it actually happens, but again, it’s God who does the assigning (well, duh!!).

    A STEM Professor approached me recently on campus about a trans student in his graduate level science course. He stated that last year a male student in his class was using female pronouns, dressing as a woman and identified as a woman. However, this semester the same student is taking another of his courses but is now dressing like a man, using male pronouns and identifies as a gay male. I responded, hence the lie of transgender individuals, unlike gays and lesbians. One day trans folk identify as whatever, and next day they change their minds. Homosexuals dont have that option. They either commit suicide because they cant become heterosexuals or accept their cross as people who stand athwart evolution.

    Unlike what Turley may describe, many people in academia do have differing opinions from Left wing mob rule. They just don’t parade them on campus and turn over tables.

      In many of these areas the left actively seeks to ensure that no meaningful effort is ever made to find any biological basis for Trans or for that matter even Homosexuality.

      Homosexuality is easier to accomodate – while we have no scientific test for being gay,
      we also have no circumstance where protecting a gay persons rights as a person without respect to sexual preference does not protect their legitimate rights.

      Conversely applying any protections to TG requires infringing on the rights of others.

      In the case of Passports the plantiffs were asking to Compel the Govenrment to speak as they wanted.
      To list them as Female or something else, rather than Male. While the government has no free speech rights – contra many on the left. Transgenderism CONSTANTLY requires compelled speech – we are required to refer to “non-binary” people by whatever label they prefer – at the moment. That is compelled speech. A trans person can demand that you call them whatever they wish. But you can not be FORCED to do so – especially by govenrment without violating the first amendment.

      I personally have no qualms with gay people or Trans people or non-binaries, and in most instances I would politely try to refer to them as they wish. Though this often creates such a complicated mess – and my memory for people is poor that I am going to get it wrong. One of the reasons that we have pronouns is to make speech less awkward not more.
      So that we do not have to remember peoples names.

      Regardless if I am dealing with a Trans person that is particular – to the best of my ability I am going to avoid pronouns entirely – and that itself is evidence of the problem. Supposed equal protection for Trans people ALWAYS involves a loss of liberty for everyone else and imposes a positive burden on everyone else.
      And that is WRONG.

      1. Might I presume to suggest a book – Sexuality and Homosexuality by Arno Karlen. It came out in 1974 (IIRC), but it was the first honest examination of homosexuality, with copious research. Apparently, it is a “normal” variation of humans, BUT – I do not think that means that it can not be encouraged, groomed, and tolerated to the point where there is an increase in that activity.

        I view it as I view autism, mental retardation, and other deformities – something that occurs, but not something that is “normal.” And certainly not something to be encouraged on a societal level. I have never met a homosexual man who wasn’t majorly screwed up in other ways, with OCD-like tendencies being very common.

        Anyway, the book is still worth reading, and can be found cheaply, used. FWIW.

Every nation that participates in global travel systems recognizes two biological sexes for the purpose of matching identity to the traveler in front of them. Other identifiers — self-perceived gender, lifestyle, or identity choices — fall outside that universal standard. A passport’s job is to confirm who a person is under objective criteria that every border agent in the world can verify, not to record how someone feels about who they are.

          Sex, gender is currently established by visual confirmation at birth. If a physician is unable to identify, parents can request DNA tests to identify. There are very few such cases.

        Those of you on the left are under the delusion that EVERYTHING is about your personal desire for self expression.

        It is likely that in the future passports will include some form of biometric identifier – at which point sex labels and even names and photos can be dispensed with. But that day is not today.

        YOU desire for self expression is not a basis to compell government to be compelled to allow you to perform that self expression as you wish.

        If you want to express yourself – do it on social media, or your personal card.

        One of the core problems here that is unique to this non-binary nonsense is that for the first time ever some group is demanding that the force of government is used to compel others to speak of or about them only in their prefered way. That is the opposite of a right – that is an infringment on the rights of others.

        Most of the western world does not care much how you identify yourself.
        Call yourself a giraffe if you wish. If your an adult hack up your body, dress as you please, live your life as you wish
        with the caveat that you can not use FORCE against others.
        You can no more compel others to call you whatever you wish than you can compel them to turn over their money.

        Now to provide some context to what you posted, there’s somewhere around 195 countries on the planet who issue passports, depending on whether you count unique situations like The Vatican who issue passports. So, while 15 countries issue tranny passports, about 180 countries DON’T.

        So to be precise, only about 8% of countries facilitate the mental illness of those suffering from Gender Dysphoria psychiatric disorders.

The LQB pantheon gets more letters all the time and more and more preferences vie for acceptance as qualifiers for membership in a protected class.

        You are free to CHOOSE to live as whatever sex you wish a CHOICE, and you even have the RIGHT to that choice.

    The precedent set by this ruling will be horrendous as other rights and privileges are attacked and cast aside not just for transgender Americans, but for LGB Americans, and other minorities. Where will it lead? Asylums for left-handed people? Where?

Here’s your “irreparable harm” scenario, Justice KBK: The US government issues a passport good for international travel, designating that the holder is female or trans female when they are in fact a male according to genetics. The passport holder then enters the foreign country (all outward appearances indicating that they are a female) and commits a serious crime; something that is happening more and more often these days here in Vietnam. But they do so as an apparent male, with a male haircut and no feminine makeup and no feminine clothes or anything else to indicate to the casual observer that they are female. Then, because they entered the country as an apparent female, they simply hide in plain sight by putting their colored hair wig and makeup and dress and false bosoms and other parts of their disguise. Then they easily exit the country, getting an exit stamp in their visa because who’s going to stop this female for what a male did? So then the government of the foreign country discovers how this person evaded detection in their country. My guess is that they will tell the ambassador that they hold them responsible for a false and deceptive identification of the US citizen in their passport. To those who say it’s terrible to imply that trans people are capable of such behavior, I would just say to look at the recent record of mass shootings in the United States, and see how many have been done by trans people
