Parents Win Major Victory in California Public Schools in Gender Change Case

We have been discussing the efforts of school officials around the country to block information for parents on their children changing their gender in public schools, including a recent victory for parents in Michigan. I have long been a critic of such attacks on parental rights in our schools. Now, parents have another major victory in California from District Court Judge Roger Benitez, who offered a resounding ruling in support of the inherent rights of all parents. However, public school boards, administrators, and teachers’ unions are continuing the fight to bar parents from knowing about gender changes in their children. Nevertheless, it is a great way to end this year for everyone who values family and parental rights.

The court cuts straight to the point in the opinion:

“With these longstanding principles in mind, this case presents the following four questions about a parent’s rights to information as against a public school’s policy of secrecy when it comes to a student’s gender identification. First, do parents have a right to gender information based on the Fourteenth Amendment’s substantive due process clause? Second, do parents have a right to gender information protected by the First Amendment’s free exercise of religion clause? Third, do religious public school teachers have a right to provide gender information to parents based on the First Amendment’s free exercise clause? Fourth, do public school teachers have a right to communicate accurate gender information to parents based on the First Amendment free speech clause? In each case, this Court concludes that, as a matter of law, the answer is “yes.” Parents have a right to receive gender information and teachers have a right to provide to parents accurate information about a child’s gender identity.”

Judge Benitez relies on a quote that we have previously discussed from Troxel v. Granville (2000): “It is cardinal with us that the custody, care and nurture of the child reside first in the parents, whose primary function and freedom include preparation for obligations the state can neither supply nor hinder.” The Supreme Court has repeatedly cited such parental rights, but school officials and teachers’ unions have been unrelenting in curtailing or denying such rights.

That view was captured in the comment of Iowa school board member Rachel Wall, who said: “The purpose of a public ed is to not teach kids what the parents want. It is to teach them what society needs them to know. The client is not the parent, but the community.”

State Rep. Lee Snodgrass (D-Wis.) tweeted: “If parents want to ‘have a say’ in their child’s education, they should home school or pay for private school tuition out of their family budget.”

Parents who question unpopular policies are often treated as extremists.

Michelle Leete, vice president of training at the Virginia PTA and vice president of communications for the Fairfax County PTA, said parents would not force them to reverse their agenda: “Let them die. Don’t let these uncomfortable people deter us from our bold march forward.”

The Attorney General on behalf of the State of California says Plaintiffs’ lawsuit is “properly understood as seeking a federal constitutional exemption from the California constitutional right to privacy, as applied to gender identity in the school context.” State Defs’ Oppo to Plaintiffs’ MSJ, Dkt 256, at 9. But the Attorney General gets it upside down. Plaintiffs do not ask the State to magnanimously permit a sort of federal constitutional exemption. What Plaintiffs seek is to force the State to respect their enduring federal constitutional rights as citizens of the United States.”

  3. This nonsense will not end until public school teachers, administrators, and school boards are successfully sued into oblivion for negligence over this gender ideology issue. It will just take one jury’s award that is in excess of the amount covered by personal liability insurance, and owed personally by the defendant, to result in big changes. If teachers want to be considered “professionals” on par with physicians, attorneys, dentists, nurses and engineers, then they should be held to similar personal liability risk.

          1. Yes, snitching. Parents often expect teachers to snitch on their kids, but maybe they should focus more on their own children rather than rely on educators to do the parenting for them. There’s really no excuse for shirking parental responsibility. If their kids are failing class, that is one thing, but if kids confide in them about something personal and risk exposing them to abuse at home and at school, then it’s an entirely different thing. Teachers are not paid enough to be put in the middle of what should be a parent’s responsibility: figuring out whether their child is behaving differently or being addressed differently. The best thing to do is ask their own kid.

Teachers are not in the business of snitching or making assumptions about a student’s gender preferences. If parents want to know whether their child wants to be addressed as a different gender, they can always ask their child. Parents are in the best position to notice changes and behaviors. That would make more sense than to ask a teacher to tattle on their own students. Once it is discovered that a teacher is a snitch, students will label them as such, and they can be brutally mean, spreading gossip and rumors that effectively destroy any trust in that teacher.         A better solution would be to have teachers tell their students if they want to be addressed as different gender or use a different pronoung to talk to their parents first. What could end up happening is students will stop trusting teachers with issues that may expose them to bullying, harassment, and abuse at home. Those in high school will likely avoid talking to teachers altogether for fear of being ratted out by a teacher.

    I remember going to a city council meeting discussing the budget and a teacher got up and promulgated a requirement that 50% of all increases in the budget should go to the schools. No debate of what is needed, how much is wasted, where else money is needed or why the 50% amount.   12. The trans sickness is finally being put out to pasture. The bright light that has been focused on this movement has started to show good effects as polls show a waning of interest in these trans lifestyle choices. The judge’s decision shows reality is starting to come back. The fight needs to go on. There needs to be folllowup at the state and federal level to remove funding for these treatments. People can still get this treatment but they need to fund it themselves and not taxpayers. A treatment almost always seems reasonable when other people pay the bill yet when one must do it themselves then thought starts to re-assert itself and priorities start to shift.
    Many very mentally ill people are mis-diagnosed and thrown in the hodgepodge of a trans illness. Maybe we will re-assert that mental health is a complex issue requiring extended observation and management with rational thought and non-invasive techniques.
    We have seen the sad story of Rob Reiner and his son Nick who had, reportedly, schizophrenia, drug abuse and recent medication changes that may have precipitated the Reiner murders. This deterioration with drug changes is real and a risk in mental illness, yet many people in our society pushed body mutilation and potent drugs and hormones on to unstable personalities like it was a panacea and sadly it is not.

  13. “If parents want to ‘have a say’ in their child’s education, they should home school or pay for private school tuition out of their family budget.” — What unmitigated hubris! Too many of these teachers conflate their own misguided opinions with reality at the expense of the children they are being paid to teach.

    1. Well, it’s true. If parents are adamant about how their child should be educated it is their responsibility to ensure they get it. there are already plenty of choices with school vouchers for private schools and home schooling resources. If they don’t like the public school policies they can always go to a private school or home school. Isn’t that the whole point of the school choice movement?

      2. Whether the parents are given a voucher or private schooling is paid in full, the judge’s decision rightfully stands. Teachers have engaged in unlawful conduct. Children are raised by parents, and when the state intervenes, the negatives pile up quickly.

        GSX should learn how to stay out of other people’s lives and fix his own sordid existence.

      3. Public schools should “put their money where their mouth is”. The money that supports public schools is meant for the student, not teachers and not administrators. Taxpayer money should follow the student, whether it be a student whose parent choose for her or his child to attend a public, private, or religious school. Let’s then see how many families choose to keep their children in public school to continue to be indoctrinated in gender ideology and to “graduate” high school unable to read at grade level or be competent to do no more than middle school math. If the education establishment morons that believe that society truly believes that the authority of public school teachers and administrators trumps the authority of parents for educating their children then parents would choose to keep their children, and their money, in public schools. I suspect that public school boards, public school administrators, and public school teachers do not have the courage “to put their money where their mouth is”.

      4. X, you say there are choices such as vouchers but you ignore that the fascist little teacher/union person said that the parents should USE THEIR OWN MONEY to go to private schools. I guarantee you that the person is against vouchers.

  14. About time for parents to put one on the scoreboard. Yet, the administrative State of California has been and continues to sacrifice the children upon the grinding wheel of political power by normalizing the abhorrent.
