Minnesota Files Meritless Lawsuit to Stop Increase in Fraud Investigation and Immigration Enforcement

Yesterday, Minnesota Attorney General Keith Ellison, on behalf of the state and alongside the cities of Minneapolis and Saint Paul, filed a federal lawsuit that is most notable in the absence of any intelligible legal principle. The effort to stop the surge of federal personnel to investigate fraud and enforce immigration is breathtakingly frivolous and farcical.

Ellison has long been more advocate than attorney in his public life, even praising Antifa for instilling fear in Trump and Ellison’s political opponents.

Ellison has been actively trying to tamp down coverage of the massive fraud under his watch, including potentially billions meant to support children and impoverished families.

Recently, a tape was released in which Ellison met with Somali figures later convicted of fraud and agreed with them that they needed to support “candidates that will fight to protect our interests.”

Now, Ellison is actually trying to get a federal court to prevent the federal government from surging resources in the state to investigate and prosecute fraud. The filing is little more than a press release with a caption on it:

“The Trump Administration’s new focus on “fraud” in Minnesota is just its latest attempt to attack Democratic politicians and more aggressively and recklessly implement their immigration enforcement agenda.”

Ellison wants a federal court to prevent the assignment of federal investigators and law enforcement to the state to enforce federal law. Ironically, the state is making this argument as a matter of state rights under the Tenth Amendment (as well as a series of equally frivolous claims under the Administrative Procedure Act).

Notably, they are trying to dictate the deployment of federal personnel and resources as a federalism claim. The filing is a diatribe that vaguely alleges racial profiling and attacks on “law-abiding citizens.”

At the press conference, Saint Paul Mayor Kaohly Her declared, “Federal law enforcement’s occupation of our city is putting us all at risk.” Ellison repeated the reckless rhetoric, insisting that “this federal invasion of the Twin Cities has to stop, so today I am suing DHS to bring it to an end.”

This is a purely performative measure, using a filing to give the appearance of action to satisfy irate constituents. Hopefully, the district court will respond with clarity about the use of the federal courts for political screeds.

In the movie Billy Madison, the principal responds to an argument from the lead character by saying.

“What you’ve just said is one of the most insanely idiotic things I have ever heard. At no point in your rambling, incoherent response were you even close to anything that could be considered a rational thought. Everyone in this room is now dumber for having listened to it. I award you no points, and may God have mercy on your soul.”

The scene comes to mind in reading this meritless filing.

  1. If the Federal government exposes more fraud it only shows the degree of incompetence of Democrat leadership. And, if the investigations can show links of the stolen money back to the Democrat or left leaning NGOs, just like USAID, the Federal government shuts down those NGOs, or enacts measures to stop the fraud, well, I would bet there would be a number of people/groups lose that money stream.
    Keep in mind, MSM is focusing on the Minneapolis shooting to deflect from the fraud story. Dont let them. We have all seen the videos. We know the out come. Dont listen to those who attempt to spin it with their mind reading skills, and lack of knowledge of the law.

I think, more likely, that there aren’t sufficient judges who are not prog/activist in nature, to try all of the dems who have engaged in fraud, corruption etc. This is my estimation as to why no one ever gets held accountable – once you start unraveling the corruption there is no telling where or when it will stop and we might be left with a non-functioning government, just ripe for revolution.

  6. When AG Keith Ellison decided to leave Congress and return to Minnesota politics, it didn’t seem to make sense. Afterall, he didn’t seem to fit within the Scandinavian heritage, and DC was more suited to his ambitions. But I didn’t know that through the Somalian voting block he had a lock on becoming AG and moreover, there were huge profits to reap in the autism business. It is no wonder he filed his suit of desperation, but surprising his legal arguments are so specious. Panic?

      Ridiculous as Ellison’s effort is, he will doubtless find some activist Federal judge who will lend support to it. Ellison is a smell, sloppy, pile of excrement, but the Federal courts are the critical current battleground for this country, and I don’t think we are winning there. When Trump or a Republican successor gets to make a SCOTUS nomination, imo it should be this guy (Judge James C. Ho). His analysis of the current state of the judicial branch is spot on.

      It was difficult to pick out a single quote from this opinion to highlight, because it is all pithy and apropos.

        If that statement defends those who “know politics” and are defying the democratic legislative process to act as an autocratic tyranny in the judicial process and on the streets (doxing Law Enforcement Officers so they can be personally attacked along with their families), then you are only speaking what is happening in the US today.

        Was curious which judges you were thinking about? Was it the SCOTUS Justice who leaked and doxed the “conservative” judges which lead to the assassination attempt on Kavanaugh? (We’re sure she didn’t MEAN to do that). Or the plethora of federal magistrate level judges who are creating law and then executing it? Perhaps the US Attorney General and the hierarchical power exercised through the Merrick Garland Sturmabteilung (we refer to it as the DOJ).

        These folk believe “for the good of the people” has nothing to do with democracy. They and their left wing progressive “billionaires” (by far the greatest number and value of wealth, see Forbes 400) believe they are Noblesse oblige – focus on the “we are the Noblesse” though “we” say anyone you must hate are actually the “rich”.

Homeland security seems to be there to remove illegal aliens and the DOJ is there to investigate the apparent fraud that has already resulted in numerous convictions, guilty pleas and further charges of fraud. I believe this will result in the further surging of the FBI financial crimes division about financial fraud and other crimes.
    I think the mounting numbers of illegal aliens found , fraud investigations and resistance to federal authority sort of make Minnesota a “target rich environment’” for the Federal Government at present. One only wonders when the stampede of charged felons and criminals will start beating a path to Canada, Probably led by the erstwhile governor.
    You never know about Biden judges though. They can call temporary restraining orders under the most minimal of causes especially if they have a soft spot for LEARING Centers.

    Talk about talking out both sides of the digestive system. If you have nothing to hide, the investigations won’t find anything. Presumptively suing seems a bit on the nose, doesn’t it.

  12. Ellison’s lawsuit is not only “meritless,” as noted by Professor Turley, it is frivolous. The complaint and its underlying action should be dismissed, with prejudice, by the District Court and Ellison should be sanctioned for filing it in the first place. Enough with Democrat officials’ nonsense. Full stop.

    1. When welfare fraud is being used to fund domestic and international terrorist groups, it falls under multiple jurisdictions. Just so happens DHS is the curent bogeyman. If it was the IRS and their Pinkerton-level connections doing the investigation, the IRS would be your bogeyman. If it was a Democratic Executive administration, you’d smile and say that the Republicans were complicit in the whole thing.

John: Because the federal agents receive no local or state support for their lawful activities, they have been formed into a task force arrangement that includes HSI agents, DEA agents, ATF agents, and FBI agents. As a result, virtually any and every federal law violation, including welfare fraud, can be investigated.

    4. You are misinformed Mr. Johnson. Homeland Security is in charge of immigration issues. The Department of Justice will investigate fraud allegations and prosecute if criminal activity is discovered. Two separate agencies, but dedicated to upholding the laws Congress has passed.

      I think you are confused because the state agency that has facilitated all the fraud by deliberately failing in its duty to investigate it is the DHS — the Department of Human Services. Since DHS has manifestly and deliberately failed, the federal DOJ has picked up the pieces.
