Minnesota Files Meritless Lawsuit to Stop Increase in Fraud Investigation and Immigration Enforcement

Yesterday, Minnesota Attorney General Keith Ellison, on behalf of the state and alongside the cities of Minneapolis and Saint Paul, filed a federal lawsuit that is most notable in the absence of any intelligible legal principle. The effort to stop the surge of federal personnel to investigate fraud and enforce immigration is breathtakingly frivolous and farcical.

Ellison has long been more advocate than attorney in his public life, even praising Antifa for instilling fear in Trump and Ellison’s political opponents.

Ellison has been actively trying to tamp down coverage of the massive fraud under his watch, including potentially billions meant to support children and impoverished families.

Recently, a tape was released in which Ellison met with Somali figures later convicted of fraud and agreed with them that they needed to support “candidates that will fight to protect our interests.”

Now, Ellison is actually trying to get a federal court to prevent the federal government from surging resources in the state to investigate and prosecute fraud. The filing is little more than a press release with a caption on it:

“The Trump Administration’s new focus on “fraud” in Minnesota is just its latest attempt to attack Democratic politicians and more aggressively and recklessly implement their immigration enforcement agenda.”

Ellison wants a federal court to prevent the assignment of federal investigators and law enforcement to the state to enforce federal law. Ironically, the state is making this argument as a matter of state rights under the Tenth Amendment (as well as a series of equally frivolous claims under the Administrative Procedure Act).

Notably, they are trying to dictate the deployment of federal personnel and resources as a federalism claim. The filing is a diatribe that vaguely alleges racial profiling and attacks on “law-abiding citizens.”

At the press conference, Saint Paul Mayor Kaohly Her declared, “Federal law enforcement’s occupation of our city is putting us all at risk.” Ellison repeated the reckless rhetoric, insisting that “this federal invasion of the Twin Cities has to stop, so today I am suing DHS to bring it to an end.”

This is a purely performative measure, using a filing to give the appearance of action to satisfy irate constituents. Hopefully, the district court will respond with clarity about the use of the federal courts for political screeds.

In the movie Billy Madison, the principal responds to an argument from the lead character by saying.

“What you’ve just said is one of the most insanely idiotic things I have ever heard. At no point in your rambling, incoherent response were you even close to anything that could be considered a rational thought. Everyone in this room is now dumber for having listened to it. I award you no points, and may God have mercy on your soul.”

The scene comes to mind in reading this meritless filing.

        anyone not a moron knows that all vaccines are NOT the same.
        The Smallpox vaccine is extremely effective and provides immunity for 70 years.
        Whooping cough only lasts about 10 years.
        The covid vaccine is 97% effective 2 weeks after the 2nd booster but has a half life of 6-9months.
        Anyone who can do math would know that alone meant it was not going to eliminate covid.

        The flu vaccinee varies from 30% effective to 70% effective depending on the year and we have no idea how long immunity lasts – because it is rare for the same flu to come back.

        There is also growing concern about vaccines like the flu vaccine – because frequent vaccinations can have a NEGATIVE impact on your immune system. That is not a big deal for a vaccine that lasts for 70 years.
        It is a big deal for a vaccine you are getting several times a year.

        We hopefully have all learned from Covid and VARS that most medical treatments have negative effects on some hopefully small percent of people. The scale of the impact and the percent of people effected varies = but my point is that no treatment, and in this case no vaccine can be presumed identically beneficial to other treatments of vaccines.

        We are ranting about measles now – the measles vaccine KILLS a few hundred children every year.
        That is one of the reasons that we discontinue the recomendation to vaccinate for a disease that is effectively eliminated from the US.
        If we get a small outbreak from tourists or illegal immigrants – we can quarantine those infected and those exposed. And if necescary we can vaccinate locally to prevent the spread. Regardless though that might result in some deaths – it will result in LESS deaths than mandatory vaccination for a disease that is no longer present in the country.

        In all cases of all vaccines factors determining whether it is recomended would be the number of people who die from the vaccine. if given universally, The likely number of people who might die in an outbreak if it is not. The durration of immunity from that vaccine. The risk profile of the vaccine and of the disease. Covid as an example never kills healthy children. In most instances they do not even know they have it and can not spread it. Conversely for the elderly the death rate was 1:3 You can give a very dangerous vaccine to people for a disease that kills one in 3. You should not give it at all to people who can not spread the disease, probably do not know they have it and do not die from it.

        Regardless the POINT is that in the real world the “SCIENCE” does not collapse to some idiotic conclusion to vaccinate everyone always for everything – which is what the left is shilling.

        It is also surprising that the very people who rant the most about corporate greed, are functioning as profit guarantors for Big Pharma.

        I have zero problems with Big Pharma trying to convince us all that we need vaccinated out the whazzo.
        If you have a company that makes vaccines- that is what you are going to say. Further even without factoring in the possibility of deceit – it is likely that the people making vaccines beleive in them and are going ot be unconsciously biased to see the benefits as greater than they are and the harms as less. That is OK in a fee market – every day we are told that changing toothpaste will change out life, get us the sexy girl, make us popular, solve all the worlds problems. Most of us know how to rationally evaluate those claims.

        The problem comes when you involve Government.
        Every business in existance would rather have to sell to govenrment that to you. There are 350 million of you and they have to persuade each one individually. If you can get a government agency to recomend or better yet MANDATE your product that is far far less sales effort and far greater sales.

        Government should not be recomending, mandating, subsidizing or really have any involvement in the sales of any product on the free market. If it does GUARANTEED there will be extremely large scale “rent seeking”

        In one case in Michigan a few years ago, the carrier, a foreign tourist, reported himself to the authorities as soon as he was diagnosed, and they were able to trace most of the people he had infected over the previous few days; it was too late to stop the outbreak, but it was contained.

Trump fired the Inspectors General in most agencies, who are the proper parties to investigate allegations of fraud, which are nothing but allegations at this point.
    These allegations came from a chronic, habitual liar who attacks anyone and everyone who refuses to knuckle under to him, and who uses the DOJ as a tool for retribution–case in point–the outrageous grand jury subpoenas served on Fed Chairman Powell because he refused Trump’s demand to drop interest rates.     Fed chairman Powell cannot be intimidated, so Drunky “Judge Jeanine” goes after him with baseless grand jury proceedings while Trump denies knowing anything about it. Chairman Powell made a monkey out of Trump when Trump confronted him with accusations of mismanagement and cost over-runs in the renovations to the Fed building–Trump’s calculation included another building which wasn’t part of the initial allocation. The cost went over because of unforeseen issues–not financial mismanagement. Trump came off looking the fool that he is–so Drunky Jeanine goes after Chairman Powell. As the MN AG said in the complaint that was filed, Trump is sore because he lost the State of Minnesota.       Perjury before congress is hard to prove. The issue must be statement of fact that is clearly false.
      Most congressional testimon is more like that of expert witnesses. You can not charge perjury because an expert witness is wrong.
      And proving an opinion is a lie is nearly impossible.

      The GJ though Powell perjured himself.

      The FED is mismanaged – all of government is mismanaged.
      That is not new.

      As to the cost – this is by far the most expensive federal building ever built.

        John, that actually isn’t true. If the DOJ refuses to prosecute someone for contempt of court, the court can hire an attorney and prosecute the subject itself. As far as I know that’s the only exception to prosecutorial discretion.

          I was over simplifying – but so are you.
          First – civil and criminal contempt are different.
          A judge can direct the Marshalls to hold a person in a cell in the courthouse if he finds them in civil contempt
          UNTIL they clear the contempt. There is no prosecution, there is not criminal record,
          But you do go to jail.
          That most typically occurs if you take the 5th, and the prosecutor offer you immunity and you still refuse to testify.
          You get out – when you clear the contempt or when the case dies.
          That occurred in the IC Starr/Clinton case in the 90’s.
          Further this ONLY applies to a person that is before the court.
          Boasberg is currently threatening something like this with Bondi and Rubio and Noem and others.
          But he is going to fail, because he does not have the means to obtain jurisdiction over them.
          That is working its way through the appeals courts.

          Criminal contempt is different and is a separation of powers issue.

          Judge Sullivan tried something akin to this in the Flynn case – though that was not a contempt issue.
          He tried to select his own prosecutor when DOJ dropped the flynn case – I beleive when the FBI 302’s surfaced and did not have any evident that flynn had lied. Flynn appealed and won, that appeal was appealed and Flynn partly lost, it was headed to SCOTUS when Trump had enough and Pardoned Flynn. So the case was not decided.

          A judge can appoint people to provide the court with reports. But that does not make them a prosecutor.

          I am not aware of a judge ever appointing there own prosecutor in a criminal case.
          I am not aware of a judge ever being able to seek an indictment on their own.
          And the bill of rights requires criminal indictments.

          If there are actual exceptions for criminal contempt – I am not ware of them.

  16. I’ll bet the litigators at DOJ are looking hard at Federal Rules of Civil Procedure 11, sanctions for substandard pleading, and 12(b)(6) Motion to Dismiss for Failure to State a Claim Upon Which Relief Can Be Granted. We’ll know soon enough.
