More Bark Than Bite: Kaine’s War Powers Resolution is an “Imminent” Failure

We now have a glimpse of the War Powers Resolution promised by Sen. Tim Kaine (D., Va.), which is reportedly scheduled for a vote in the Senate on Tuesday. The resolution purportedly ends all combat operations against Iran … until you reach the very end where there is a hole that you could drive a combat task force through.

I respect members asserting their inherent constitutional authority. I have long criticized the lack of declarations of war as demanded by the Framers. We have not had a formal declaration of war since World War II. However, courts and Congress have long deferred to presidents in the conduct of such operations.

I represented congressional members challenging the Libyan war operation launched by President Barack Obama. Most Democratic members were entirely silent when Obama (and President Joe Biden) exercised such authority against different countries. Notably, the Libyan operation clearly sought regime change without an imminent threat to the United States. Some of those members are now the loudest condemning President Donald Trump in this operation.

This resolution shows how presidents can easily box in Congress once combat operations begin.

The resolution boldly declares “Congress hereby directs the President to terminate the use of United States Armed Forces for hostilities against the Islamic Republic of Iran or any part of its government or military.”

However, at the very end, the resolution has this line: “Nothing in this section shall be construed to prevent the United States from defending itself from imminent attack.”

As I wrote this week, the problem with such resolutions is that they are effectively meaningless in the context of full combat operations against a nation: “Kaine and others insist that hostilities were not imminent when we attacked. Even if that were true, they are now.”

In these circumstances, it would be nearly impossible to limit the war powers of the President without putting American personnel or allies at risk.  After decapitating the leadership in Iran, Iranian assets are clearly operating under prior orders in a decentralized structure. The United States is now seeking to neutralize any assets that it can find in preemptive attacks while trying further to degrade the command structure and military capacity of the Iranian government.

As I wrote earlier:

“The choice now for Democrats is either a senseless or suicidal resolution. It can either resolve to end hostilities as soon as practically possible (an objective already stated by the Administration) or it can actually seek to limit the Administration’s options amid full-fledged war.”

This is the senseless option. All threats from Iran are now “imminent,” and all attacks are arguably preemptive. So what does this actually do?

Anyway, Trump said last June that the United States “totally obliterated” the nuclear power plant. Could that be a lie?

        The US did not obliterate a nuclear power plant.

        They were rebuilding. They were not days from a bomb. But they clearly had not abandoned building a bomb.

      The question under discussion is not what the strategic solution to the problem presented by Iran should be or have been. The question is who has the Constitutional authority to design and apply the solution. Anyone who disagrees with that should just candidly admit that they favor just outright burning that document and reverting to an authoritarian dictatorship and/or pure mob-rule democracy (not that there is any essential difference there) as our form of government.

        Someone here rants regularly about Lincoln’s constitutional overreach – and I agree.
        In many cases SCOTUS eventually reversed lincoln – but they waited until it did not matter to do so.

        There is little doubt that Lincoln exercised powers the constitution never gave the president.
        There is also no doubt we would be a completely different country if he had not.

        With respect to YOUR statement – the power to design and apply a solution rests clearly with the president.
        But the constitution requires that congress determine that the president is authorized to use that power.

  3. I don’t see the final statement in the proposed WPA as being that broad. The word imminent has a specific legal term of art meaning. The courts regularly deal with whether a person who attacked before being attacked because the person believed (s)he was in “imminent” danger. I guess the question would be whether an attack being imminent means an actual attack on American soil. If it means an attack on any outpost outside of American soil then an attack can always be deemed imminent. It is not unreasonable to expect the law to address this.

One wonders just what exactly they understand “imminent” to mean. Surely, it does not mean until it becomes too late to address. If sanctions and military operations like Midnight Hammer have not dissuaded the Iranian Regime from resuming further development and eventual use of nuclear weaponry to prosecute its agenda, what will? Imminence is not always only what will occur next. It also entails under the given circumstances what is much too likely to occur ultimately. Get it done now, Tim Kaine, before it is too late to do so.

    But that has not been true for my entire lifetime.

    Right now most of us are hoping for a quick relatively bloodless conclusion to all of this.
    We hope Iran will run out of missles soon.
    That US and Israeli forces will take out enough Iranian leadership and they will capitulates.

    If this is over quickly with little bloodshed beyond the Irainian regime, then this will prove a great Triumph for Trump.

    I hope and pray that is the case – because that is good for the world. A peaceful Iran that is not a terrorist theocracy would massively change the world.

    But I have hoped and prayed things turned out well far too many times and it has not.
    The US has an abysmal record in attempts at Regime Change.

    I hope I am wrong and that unlike nearly every US president in my lifetime Trump actually knows what he is doing here.
    There is very little doubt that Trump has a far better understanding of the various nations of the mideast than any prior US president.

    There are many things the US can without question accomplish.

    WE can further damage the Irainian Nuclear program,
    We can destroy the Irainian missle program
    We can cut off Irainian oil to China and Cuba.
    We can cutoff Irainian munitions to Russia.

    But absent an end to the Iranian regime all of the above will eventually come back.

    Pro US Iranian protests throughout the world are meaningless – those people left Iran – they are NOT friends of the regime.
    Thus far I have not seen inside Iran any hints that the Iranian people are ready to change the Regime.
    It is possibly a bit early – and maybe we will see something as it becomes safer to come out on the streets.

    But so far there are no indications this regime is going to topple.

    One thing that is becoming obvious is that The regime of the Ayatolahs is not a personality cult
    That there are a large number of people that are part of the power structure of that regime and that decapitation was not sufficient
    to get a change of direction.

    Those in power seem to be content to endure a severe beating from the US, and claim victory by surviving.

    Toppling this regime requires millions in the streets, it requires the military to back the protestors,
    it requires dramatically disempowering the IRGC

    Iran is probably weaker than it has been in almost 50 years.

    But this regime does not appear to be failing under its own weight or that of our impressive millitary, and without some force on the ground – preferably that of the Iranian people. This regime seems likely to survive.

    When Maduro was Removed in Venezuela, Rodriguez stepped in and is cooperating with the US.
    That is not happening in Iran so far.

      Iran planned for this. They are not structured in a way that killing leadership collapses their military structure. Trump and Hegseth are just now realizing this. Iran may not be able to outright defeat the U.S. but they can certainly outlast it in the region. Trump will likely start begging allies for help but given how he has badmouthed them just recently. They may not even lend a hand at all. It’s not their fight.

        First Iran has two different means to harrass Israel and others – IRMB – between 1000-4000.
        But more importantly they have far fewer launch vehicles.
        A fixed missle launcher will be taken out immeditely after it is first used – If there are 1000 more missles for it – they are wasted.
        Mobile launchers last longer, but still are unlikely to get more that a few shorts off before they are destroyed.
        When Iran runs out of launchers they are done until they can create more
        We are with certainty targeting Missle and Missle launcher production.

        Next a signficant portion of their IRBM’s fail Between failures and intercepts less than 30% are getting through – possibly much less.

        Further IRBM’s are a really really expensive way to target any enemy While the US is spending far more on this war than Iran = we can afford it.
        Iran can not afford water for half its population.

        The US an Israel are intercepting IRBMs, they are knocking out launchers and they are destroying stockpiled missles

        There is ZERO doubt we can run Iran out of missles.

        But they also make enormous numbers of drones. These are cheaper, less reliable and much easier to intercept.
        And Iran has more of these than Missles.

        Of course Iran gets Cash by selling drones to Russia.

        This war is choking China of oil, and choking Russia of 40% of its munitions for the war with Ukraine.

        Whether we can run Iran out of Drones and missles is really rhetoricial – of course we can.
        The issue is how much damage can Iran do first.

        Based on news accounts of the numbers of missles and drones each day at different countries I doubt Iran has more than a weeks supply left.

        The big US concern is not using our entire stockpile dealing with Iran – or we might provoke China to attack Tiawan.
        That is unlikely because the recent purge of 4000 Top PLA officers leave China unable to manage any significant military operations.

        Further they are seeing in Ukraine, and Venezuella, and Iran the power of Our forces. I do not think China is attacking Taiwan.
        But that is a factor.

        Next – though Tomohawks are expensive – the use has active contracts for thousands of less capable shorter range cruise missles – in the 200K-500K each range.
        These are all airdrop or air launched but they are cheap and we are starting to manufacture them in large numbers.

        The most limited resources we have is the anti-ship missle interceptors. So far Iran does not appear to have been able to consequentially threaten the US navy.

        The F-22 has an amazing radar which it is likely we are not using at all. A significant part of modern stealth is that the weapons systems that are going to kill the enemy emit Nothing detectable.

        Bzzt Wrong. Iran is twice the size of TX – but that matters very little to F22’s and F35’s. What matters is finding and killing the launch vehicles – and they have far fewer of those. Longer distance missles likely do not have mobile launchers – they get taken out quickly.

        It took Israel 12 days to burn through their inventory last time. Most of what we are using in Iran is NOT being used in Ukraine – so the ukraine war which HAS reduced some US stockpiles has NOT reduced stopiles of critical weapons for THIS fight.

        Further we Own the skies over Iran at this time. WE can safely drop WWII Dump bombs for months.
        There cheap and we have lots.

          John, I think that might be the US radar system in Qatar. I don’t know if it was completely damaged or not, but it wasn’t an Israeli system, and it had little to do with Israeli defense. The dumpster diver has little useful information to provide.

That stops the Iranians from using massive barrages, which doesn’t permit as much overloading of defensive systems. Iran is also attacking its neighbors, which reduces the supplies. Obama and Biden bought them off thinking they, in their delusion of superiority as President, could hold them off and control the situation with cash.
