More Bark Than Bite: Kaine’s War Powers Resolution is an “Imminent” Failure

We now have a glimpse of the War Powers Resolution promised by Sen. Tim Kaine (D., Va.), which is reportedly scheduled for a vote in the Senate on Tuesday. The resolution purportedly ends all combat operations against Iran … until you reach the very end where there is a hole that you could drive a combat task force through.

I respect members asserting their inherent constitutional authority. I have long criticized the lack of declarations of war as demanded by the Framers. We have not had a formal declaration of war since World War II. However, courts and Congress have long deferred to presidents in the conduct of such operations.

I represented congressional members challenging the Libyan war operation launched by President Barack Obama. Most Democratic members were entirely silent when Obama (and President Joe Biden) exercised such authority against different countries. Notably, the Libyan operation clearly sought regime change without an imminent threat to the United States. Some of those members are now the loudest condemning President Donald Trump in this operation.

This resolution shows how presidents can easily box in Congress once combat operations begin.

The resolution boldly declares “Congress hereby directs the President to terminate the use of United States Armed Forces for hostilities against the Islamic Republic of Iran or any part of its government or military.”

However, at the very end, the resolution has this line: “Nothing in this section shall be construed to prevent the United States from defending itself from imminent attack.”

As I wrote this week, the problem with such resolutions is that they are effectively meaningless in the context of full combat operations against a nation: “Kaine and others insist that hostilities were not imminent when we attacked. Even if that were true, they are now.”

In these circumstances, it would be nearly impossible to limit the war powers of the President without putting American personnel or allies at risk.  After decapitating the leadership in Iran, Iranian assets are clearly operating under prior orders in a decentralized structure. The United States is now seeking to neutralize any assets that it can find in preemptive attacks while trying further to degrade the command structure and military capacity of the Iranian government.

As I wrote earlier:

“The choice now for Democrats is either a senseless or suicidal resolution. It can either resolve to end hostilities as soon as practically possible (an objective already stated by the Administration) or it can actually seek to limit the Administration’s options amid full-fledged war.”

This is the senseless option. All threats from Iran are now “imminent,” and all attacks are arguably preemptive. So what does this actually do?

      Yesterday, the morning and evening legacy MSM (that I watch during meals) BOTH started with “breaking news” that three U.S. jets were downed by “friendly fire.” The immediate implication was clear (that somehow U.S. forces had screwed up). On both initial broadcasts (as well as several media news online) -it was not until the second or third sentence that they revealed it was Kuwaiti forces that took them down. I believe that was intentional, and plays as example for your comment.

        I was initially surprised that 3 F-15 jets went down since they are remarkably enduring in combat but it made sense that it could happen in a friendly environment when there is mistaken identity. Thankfully the pilots survived.

        I am surprised that there have not been a lot more instances like this since they are, or have been, fairly common in war. General Bradley’s “A Soldier’s Story” mentions some if I remember correctly.

        So far the exercise is going like a precision Swiss watch suggesting monumental intellectual planning by some very smart people and executed by many very smart people. I could not be more proud of our President, his administration, our military and our country.

        While Iranians celebrate around the world, even in Tehran, our media and Democrats openly predict and hope for failure, and I have exhausted my supply of contempt for them. They are well beneath it.

  13. Breaking news: Kashyip Patel fired numerous FBI investigators and analysts who were involved with Donald Trump’s criminal investigation for stealing classified documents. Those FBI employees also happen to have the most extensive knowledge and experience about Iran, counterintelligence and its capabilities. These firings happened right before Trump took his marching orders from Netanyahu to start the bombing. So, getting revenge against FBI employees for carrying out their assignments was more important than the loss of their intelligence expertise in Iran and their knowledge of counterintelligence. Priorities— Trump’s ego always comes first and always will.

      They were fired for misconduct. Agents were recently fired for conducting illegal surveilance of congressmen.
      Most FBI Agents have law degrees. They are expected not to act illegally.

          The War Powers act gives Trump 60 days before he must get authorization from Congress to continue.
          Trump does NOT have that much time, before he will significantly harm Republican prospects in 2026 and possibly 2028.

          HOWEVER, this can also go incredibly well, and that will have the opposite effect.
          Finally there are myriads of possibilities inbetween.

          All predictions regarding how quickly this ends and how well it ends, depend on factors most of us can only guess about.
          We expected the Iragis to welcome us with open arms – that did NOT happen
          Gauging how the Iranian people will respond to this is of great consequence with respect to any likely outcome.

          Defeating the Iranian Government and IRGC is well inside our power.
          Getting a better government is more difficult to predict.

          We have lessons from Iraq and Libya and ……
          But Iran is NOT iraq or Libya.

          The big loser if the straights of Hormuz remain shut for anytime period will be China.

          But what we saw in Venezuela and Iran is that the US can gain air superiority – not in says, not in hours, – but INSTANTLY – anywhere we want it. An amphibious landing across the Taiwan straight is an operation more difficult that any nation has ever done.

          War games that have China succeeding presume that China can gain air superiority due to large numbers of land based aircraft.

          So far in this war the Only US aircraft hot down were taken down by US systems in Kuwait when the Kuwaiti’s confused F15’s slowing to land for Iranian Drones.
          No Russian or Chinese system has taken out a US Aircraft of any kind yet. China can not cross the Taiwan strait without total air superiority – they will be slaughtered.
          This sends a giant message to China that they are not ready to invade Taiwan.

          Next – Atleast 3 Gulf nations have joined this – We have Arabs and Israelis fighting TOGETHER against Iran.
          That is enormous regarding peace in the mideast.

      There are also millions of people who are a part of that totalitarian regime and have a vested interest in maintaining it.

      Tousi can tell us that there are hundreds of thousands of people willing to take to the street and protest – possibly millions.

      But it is impossible to trust whether those wanting an end to the regime are a few million, 30 million or 70million.
      It is also impossible to know when US actions against the regime will be perceived as liberating to those inside or as a foreign invader.

      And this is the trickiest part of all of this.

      The US has several resolutions:

      Destroy enough of the Regime that what is left makes a deal we can live with and enforce – leaving the regime in place.
      Destroy enough of the regime – without alienating the Iranian people that the Regime collapses and something hopefully better from within takes its place.
      Destroy enough of the regime – that Iran is left a mess like Libya or Iraq, or Syria or Lebanon.

      Those are not the only options, they are just the only quick ones that can be accomplished through airpower.

      You can debate whether those reasons are sufficient.
      But those are the reasons.
      They are not secret.
      Most of the world knows them.

      We do not need you or anyone else to explain them.

          The American people are the most charitable in the world, and within this nation, American Jews are among the most active and generous donors. They also give a lot to political causes, but their giving extends to all, not just the ones that possess your mind. In fact, more Jews contribute more money to the left than to the right; think of Soros and Steyer, along with many others. Since 2020, Soros has given about $500 million dollars routed to his nonprofits and Super PACs, so it might appear smaller, but it affects almost every Democrat PAC you have heard of. When totalled, there are far more large donations to left-leaning candidates than to the right.

          Your statements on Iran indicate that you only read slogans produced by the left and lack knowledge. Iran has killed thousands of Americans and disabled many more, while much of the Obama money given to Iran went to killings and rape all over the world. That alone would normally cause America to go to war, but Obama normalized rape and murder and accepted the words “Death to America” as bedtime poetry. Trump did what he had to do, and the only thing at issue to more sophisticated people is the timing. Iran ran the largest number of state-sponsored terrorists in the world. Hezbollah and Hamas are known to most, but Iran funds terrorists all over the world, even into the Western Hemisphere, while supplying our enemies with war materials. They supplied the Russians who invaded Ukraine.

          Thank God for the entire world that Trump dismantled Iran’s nuclear and missile programs. The vast majority of the 90 million Iranians were held captive by a death cult regime. Maybe you forgot that in one day, that regime murdered 30,000 people.

          You ramble from one topic to the next because your knowledge is skin deep, and you rely on rambling slogans instead of critical thinking. Is that why you changed your name from Natasha to Gigi to Anonymous?

According to Trump, last June, he “totally and completely obliterated” Iran’s nuclear processing plant—was he lying? Was Rubio lying? Please explain how or why attacking Israel’s enemies benefits the United States. You are the one who repeats made up crap about Obama. Unlike your orange hero, Obama stood up to Israel and told them that if they attack Iran they’re on their own, and we’ll just defend ourselves if Iran comes after us—so who is the weakling? Note that Israel did NOT proceed with starting a war with Iran when Obama was in office, and probably would not have done so except for Trump’s weakness and the fact that he is beholden to wealthy Jews, Qatar, Saudi Arabia and UAE. Which President is the one who takes his marching orders from Netanyahu and Saudi Arabia? Which one accepted a luxury flying palace from Qatar and $2 B to purchase his worthless cryptocurrency, and is therefore beholden to these rivals of Iran? The numbers of protesters killed has not been determined, and MAGA keeps exaggerating it, but anyway, Trump doesn’t care about freedom of speech or the right of people to protest–proven by the tear gassing and shooting of protesters in Minnesota. He has, in the past, suggested shooting protesters in the legs. You are the one who obviously lacks critical thinking. WHY did the reason for attacking Iran keep changing? Where do you get off making up names for people with whom you disagree?

            As to Edelman, you still haven’t addressed why she would give $100 M to Trump but not to needy elderly Jewish Holocaust victims living in squalor. If she has that kind of cash to donate, it is literally immoral that she doesn’t use it to help these people.

            1. Until we bombed their nuclear sites, Iran was months away from a nuclear bomb. Afterward, it was longer. The main problem was purifying the isotope, and they were too close. But they were building missiles, well over 1,000 a month, that they could use as leverage to buy time to fully develop the bomb and a delivery system. We were cutting the deadline very close, so it wasn’t if we attack Iran. It was when, with the hope, the government would be overturned. I hear you talking about genocide, but not a peep out of you when the Ayatollah murdered 30,000 people in **one** day.

              Iran has been attacking Israel almost from the beginning of the ayatollah reign. Before the recent war, I said that a war would occur between Israel and Iran. I even said when, not by date but by incidents. I said Israel would mostly destroy Hamas and Hezbollah, and that was when Israel attacked Iran directly. That makes sense because it’s hard to fight Iran and its terrorists from three sides when Israel is so tiny 9-10 miles wide in its center. You are totally unfamiliar with Israel, but very familiar with erroneous leftist slogans.

              Iran has seized American hostages and killed thousands of them. We are known to them as the big Satan. Israel is the little Satan. The Ayatollah hates America and all its values and culture. Its mantra is Death to America (especially gays and women who wish to be the equal of men). The Persian people are good people, and mostly want peace and the Ayatollah gone. The Jews and Iranians have had good relationships with them and will have such a relationship in the future. You don’t know, but Cyrus the Great, King of Persia, passed laws allowing the Jews to build the Second Temple, 538 BCE. You also don’t know, but today is Purim, which is from March 1-3, depending on one’s location. That is the day Haman convinced the Persian King to kill all the Jews in the world.           You rnt about the straights of Hormuz – but forget that they US builts its first Navy to taken on the “barbaray pirates” who were essentially the Iran of a dfifferent era foring the world to kowtow to them to or they world block trade in their region.

          The mere threat to shut the straight of Hormuz is an act of War that our founding presidents built the US navy to stop. We invaded the nations of the coast of north africa until they stopped interfering with free trade.

          How long after Iran gets a nuke do you think it will be, before the nuclear blackmail starts ?

      2. This is all a stupid game the left and the MSM are playing because Rubio, Hegseth, Trump and Vance are not using Exactly the same words every time to describe what we are doing and why.

        They are pretending because there is more than one Why, that somehow that is a conflict, that people can not have more than one reason for doing something.

        They are also pretending that there is some conflict between “why now ?” and “why ?”

        Some of my previous posts on this have been a reflection of the fact that there is a fault line between a particularly flavor of MAGA – which I am sympathetic too, as it is more libertarian and the majority of Republicans over this.

        I personally believe actions like this need congressional approval – but history the law and SCOTUS opinions do not agree.
        I feel the same about Tariffs.
        But neither of those statements means I oppose those things, just that they should not be purely executive decisions.

        Trump is also gambling heavily on an outcome that I do not think he has as much control over as he beleives.

        I want to beleive the odds favor an acceptable outcome – but the History of US efforts like this has been abysmal.
        Success means doing far batter than any other modern president.

        Succeeding here has enormous potential knock on effects – this significantly weakens Russia and China, potentially alters the midterms (or causes a wipe out),
        has the potential to bring a lasting peace to the mideast.

        Almost all Arab countries are now actively engaged in their own self defense.
        Atleast 5 have signed on to OFFENSIVE actions against Iran – These countries are fighting against Iran and With Israel.
        I would have never beleived I would have openly seen that.

        Europe has followed slowly – Starmer has completely F#$Ked up – peobably pi$$ing everyone off – he initially failed to defend or even prepare to defend UK interests.
        But he is slowly back tracking and British military forces are moving to the region for defensive operations – UK F35s and tornados have shot down a few drones yesterday.
        And he is letting the US use Diego Garcia – NOW

        France is sending a carrier to the straights of Hormuz – that is symbolically a big deal.
        After a few stupid equivocal statements – much of Europe is slowly joining us – particularly after the Arab states have publicly sided against Iran.

        The shooting down of a couple of F15’s made it clear – that we have established TOTAL air supremacy.
        The early attacks were by F22’s and F35’s and ECM aircraft. Then F15’s – which are trucks compared to F22’s and F35’s
        Then B2’s . A few days ago the B1’s showed up. and last night I heard that B52’s are om theater.

        Each of these increases the destructive power unleashed. But each is beinging increasingly vulnerable aircraft that you do NOT risk until you have air superiority.

        Trump is now offering US guaranteed insurance for passage through the straights of Hormuz and possible US warship escorts.
        The Iranian side of the straights are littered with antiship missles, I have heard some “experts” say this is practically suicide.
        So Far Trump has shown he knows what he is doing. Regardless, if he manages to ppen the straigns of Hormuz quickly – that is a huge win.

        He is also now talking about limited use of troops – and My guess is that MIGHT be to occupy the area near the straights of Hormuz.
        We are also arming the Iranian Kurds (which likely has Turkey pi$$ed).

        Purportedly Iran is more than 1/3 of the way through its Missiles.

        Oh and Lebanon is taking on Hezbolla – that is probably the end of them.

          The nuclear ambition and missile threat of Iran are being destroyed. Iran as a state supporter of terrorism is over, likely permanently. That was our mission, and mostly a tremendous Trump success. What happens next is something that is unknown.

          Middle Eastern nations have joined together and are fighting together with Israel against Iran. It looks like the Abraham Accords will be greatly enhanced. That is also a success.

          Side successes are that this reduces the threat of a war with China over Taiwan and threats from Russia emanating from their attempts to move their borders into Ukraine. Peace is closer.

          We are moving in a unipolar direction where the US might once again become the sole superpower, which can add a layer of security that the large powers will remain peaceful with one another.

          I think to date, Trump has been extremely successful, though our leftist friends feel everything he does is wrong. They cannot look at the mess Biden made, so they feel compelled to unjustly criticize Trump.

          What comes next is open to question. The stupid game played by the left is stupid, based on ignorance, and not knowing where their voice can be appropriately used. Their playbook is yet to be written, so their word games mentioned by you above are all they have presently.
