Democratic Lawyer Marc Elias Raises Power to Eliminate the Virginia Government in Response to the Gerrymandering Decision

Democratic lawyer Marc Elias appears to believe that Democrats do not need to stop at simply sacking and packing the Virginia Supreme Court in response to the adverse ruling on the radical gerrymandering plan. Elias reminded Democrats that they could eliminate the entire Virginia government under the state constitution.

The demand for radical action was prompted by the Virginia justices, including one appointed by then-Democratic governor Mark Warner, who found the Democratic effort unconstitutional. It does not matter that leading Democrats, including Gov. Abigail Spanberger, also believed that the Democrats could be found in violation of the state constitution in pushing forward with the controversial effort to virtually extinguished Republican representation in the purple state.

The adverse decision has resulted in the same demands for radical institutional changes from some of the same voices pledging to pack the United States Supreme Court once they retake power, to guarantee they never lose it again.

Elias responded to the loss by invoking language from Article I of the Virginia Constitution itself:

“whenever any government shall be found inadequate or contrary to these purposes, a majority of the community hath an indubitable, inalienable, and indefeasible right to reform, alter, or abolish it, in such manner as shall be judged most conducive to the public weal.”

That is his response to a well-reasoned decision of unconstitutionality of a redistricting plan. We can scrap the entire Virginia government.

It is another example of the “by any means necessary” culture of the left today. There is no institution or value that is sacred. This is why I recently wrote about the rise of “the new Jacobins” in my book Rage and the Republic, lawyers and law professors rationalizing the trashing of the Constitution and our institutions to achieve their political goals.

Elias has long been controversial for his tactics.

It was Elias who was the general counsel to the Clinton presidential campaign when it secretly funded the infamous Steele dossier and pushed the false Alfa Bank conspiracy. (His fellow Perkins Coie partner, Michael Sussmann, was later indicted but acquitted).

Clinton campaign officials denied any involvement in the Steele Dossier. When journalists discovered after the election that the Clinton campaign hid payments for the Steele dossier as “legal fees” among the $5.6 million paid to Perkins Coie, they were reportedly stonewalled. The campaign was ultimately sanctioned by the Federal Election Commission for the subterfuge.

New York Times reporter Ken Vogel said at the time that Elias denied involvement in the anti-Trump dossier. When Vogel tried to report the story, he said, Elias “pushed back vigorously, saying ‘You (or your sources) are wrong.’” Times reporter Maggie Haberman later wrote that “Folks involved in funding this lied about it, and with sanctimony, for a year.”

Elias’s group later unsuccessfully led efforts to challenge Democratic electoral losses.

In Maryland, Elias’s team supported another abusive gerrymandering scheme that a court found not only violated Maryland law but the state constitution’s equal protection, free speech and free elections clauses. The court found that the map “subverts the will of those governed.”

One media site accused Elias and his group of “making millions off gerrymandering efforts” while publicly denouncing Republican gerrymandering.

In 2024, Elias’s legal team was also accused of pushing “to bar third-party presidential candidates — including Cornel West — from swing state ballots where they might siphon votes from the Democratic nominee [Kamala Harris].”

Likewise, the New York Times reported that Elias’s firm’s work “on behalf of a Soros-funded PAC in Texas…was opposed by a left-leaning election watchdog as undermining laws intended to limit the influence of major donors.”

His group’s work for New York redistricting was ridiculed as not only ignoring the express will of the voters and also effectively negating the votes of Republican voters.

In 2024, the Chief Judge of the Western District of Wisconsin criticized the Elias Law Group for one of its challenges. Judge James Peterson (an Obama appointee) said that the argument “simply does not make any sense.”

Now, Elias is reminding Virginians that they can respond to an opposing court decision by eliminating some or all of the Virginia state government.

It is the logic of the Jacobin. As discussed in my book, the Framers sought to prevent democracy from becoming mobocracy by rejecting more direct democratic powers. They tried to temper the passions of democracy in moments like this.

There is nothing new about these voices, like that of Elias, in fueling radical impulses. They are the same voices and arguments that have long been heard in this country. We have long rejected them and this year will celebrate the 250th anniversary of our Independence. However, as Benjamin Franklin warned us and now Elias has reminded us, we must fight to keep this Republic.

            There are those who are still old school, traditional, moderate, JFK Democrats. Bill Maher, Elon Musk, the good professor, my own sister. Even they do not agree with some of the far leftists polices and abhor some of them.
            My sister is a member of her local Democrat party chapter. Most of them are more aligned with traditional, moderate, JFK Democrat policies and reject the far leftists.
            However, some within her chapter have told her, point blank, her thinking was “wrong.” To which she took issue. She wrote the DNC and the then Biden campaign if they did not get back to their traditional Democrat roots, she would vote third party.
            For my sister, that is saying a lot.

        I would note that Virginians CAN wipe out their constitution, government and supreme court exactly as Elias claims.

        But not easily, and not with a bare majority of votes in a rigged election.

        The VA Supreme court was correct – the referendum was conducted unconstitutionally.

        If VA wants to pass the new redistricting that left wing nuts want – they must do so according to the VA constitution.

        That means not adding the referendum to a primary election when 1M votes are already cast,
        it means getting the language actually neutral.

        Had VA done that – it is likely SCOVA would have blessed the partisan gerrymander.

        But as is typical of the left – you are toddlers in a grocery store demanding candy and hoping the adults will capitulate to end your tantrums.

        Turley has been one of the leading constitutional lawyers for decades – testifying REPEATEDLY FOR Democrats – but keeping his advice grounded in the constitution – not 4 yr old left wiung nut tantrums.

        Turely’s positions have changed very very little over decades.
        Though I would note he is a tiny bit more libertarian today.

        But MOST of his positions were liberal Democrat Dogma 50 years ago.

        It is democrats that have changed – not Turley.

        Trump is fixing the mess in Eastern Europe – while concurrently establishing – to the World, that Russia is NOT a superpower, and Russia is no longer a global threat that significantly impacts US interests.

        Trump has told Europe that THEY must put much more effort into working things out with Russia.

        Conversely Trump has redirected US interests towards China.

        We are neither a friend, nor adversay with China. But China is by far the most significant US interest globally
        And we see that under Trump.

The key was the “two flag” waving dressed in white (mourning, asian countries) of a long line of wavers where the US flag was on the outside and the PRC Flag inside waved in his face from both sides of the carpet making him walk into the middle.

        The message was clear and well presented for the CCP people/message. POTUS took it well – and I’m sure expected it.

        And after the Russian invasion of Ukraine when Biden first flew to Belgium(SHAPE), NO ONE WOULD MEET HIM.       Xi wants greater access to US markets. Xi NEEDS greater access to US markets.

        I would also add, Trump’s military action with Iran, that has China in a serious bind.
        Iran supplies 20% of the worlds oil. 80% of which goes to Asia, namely China. China needs that oil for their own use. There are also a number of other countries whom China provides refined products like gas, jet fuel to not just domestic consumption like Australia. This is a de-facto oil embargo against China. China needs this conflict to end. Trump has that power over them. Trump and Xi both know it.
        Regardless of the conflict outcome, it is the long term global energy landscape is changing and is going to change. THAT is what I am interested in.

        2. The conflict with Iran has very serious impact on China.
          Iran does NOT supply 20% of the worlds oil – Gulf nations do. Iran is just ONE of those.
          I would note that Oman, UAE and SA can all get oil out of the mideast without going through Hormuz – and they are doing so via pipelines bypassing the straight. Those are running at full capacity. but still only delivering about 50% of those countries capacities. And almost none from other countries like
          Qatar and Kuwait. I beleive Iraq can also bypass the gulf through pipelines – but NOT at full capacity.

          Basically bottling up the straights has reduced global oil supplies by about 10% – not 20%.

          But absolutely the big loser is China.
          China gets ALL of its oil from the gulf or from Russia – and most of that from Iran.

          The US has more oil than it needs – but global markets have driven the price up.
          China can not get the oil it needs.

          China is also an arms supplier to Iran – but MOSTLY has remained at arms length in this conflict.
          China has NOT provided Iran with new or replacement weapons in consequential amounts – and Iran is Pissed at China.

          China and Russia were also hurt by how easily Chinese and Russian Weaponry was bowled down in Iran last year, in Venezuella and in Iran this spring.

          That has a HUGE negative impact on Russian and chinese weapons sales.

          No rational person can understand why Europe is not ahead of the US in this conflict.

          The US does NOT need russian or Gulf Oil.

          There is way more than enough in the western hemisphere to meet the needs of the entire western hemisphere.

          I would further note that from the Oil Embargo in the 70’s forward – the US has MOSTLY moved slowly in thew right direction regarding energy – despite some stupidity – the US is wealthy enough to afford some mistakes.

          But Europe has screwed up by the numbers.
          Today they are MORE not less dependant on bad actors for their energy.
          They made stupid and large bets on “green” energy that proved expensive, unreliable and not very green.

          Those here on the left are completely ignorant of how far behind the US the standard of living in Europe is.
          The UK has one of the highest standards of living in Europe.
          Its median household income is egual to the WORST US state.

          Economic growth in Europe has been abysmal over the past 50 years .

          People do not grasp the disasterous effects of long term pi$$ poor growth

          There are nations with better standard of living than the US – but these are SMALL nations,
          and they do NOT have a better standard of living than Ohio or TX. They have a better standard of living than Mississippi.

          Regardless, Trump’s 2nd term is proving quite different from his first.
          Trump 45 was MOSTLY focused on the US economy through domestic economic measures.
          While Trump 45 had some significant success in negotiating peace in the mideast – a very unexpected development.

          Trump 47 has the same objective – MAGA – the interests of the american people – particularly the working class.

          But the means are far far bigger.

          I would have bet heavily against Trump’s actions in Venezuella – Trump 47 refused to go to war with Iran over shooting down a US Drone.
          Trump 47 appears to be ridding the world of the last vestiges of radical socialism and international bad actors.

          The long term outcome in Venezuella has yet to be determined – but it is inarguable that Venezuella is no longer acting hostile to US interests.

          While little attention is being paid to Cuba – there is very little doubt it will collapse likely in the next year.

          Russia is diminished further with each passing month.

          There is zero doubt Iran does NOT come out of this with a fraction of the global political power they had before.

          In the long run – both China and Russia are collapsing.

          But the objective of current diplomacy with Xi is to get China to back away from being the most fascist modern nation, to returning to the more capitalist regime that existed from Mao’s death through to Xi’s rise.

          I do not know if that is possible – I am not sure about China’s survival – even if it does change radically.

          But Trump has been moving aggressively on foreign policy since the startt of this term,
          While STILL doing everything he did in the first time.

          The left talks of Project 2025 – but people should read Agenda 47 – it is only oine page and Trump is working HARD on pretty much EVERYTHING on that agenda.

          This is a far more confident Trump than Trump 47

          Further Trump 45 operated out of the White House – besieged by Republicans and democrats alike.

          Trump 47 owns the republican party.
          And he has the entire administration not just the WH advancing that Agenda 47.

          Trump is in theory a lame duck – he can not run again.
          But this is NOT a lame duck presidency.
          This is the most aggressive effort I have seen from any president in my lifetime to deliver on an agenda.

          We are barely 1 yr in to Trump 47 and he has still accomplished more than in his first term.

          Yes the long term global energy landscape is changing – but alot of that was predictable – Trump or not. Trump has merely accelerated it.

          I think we are moving towards a period of long term US prosperity.

          But Equally important – we are also moving towards long term global propsperity for those that get on board.

          The question in front of us TODAY is whether Xi and China get on board.

          There are many many many things going on at once and they are all somewhat chaotically moving towards a better world.

          Despite – possibly because of the current conflict – we are headed towards peace in the mideast like we have never seen in my lifetime.

          What is going on in Argentina with Milei is incredible – but not just for Argentina.

          South american socialism is on the back foot – and that portends great prosperity for South America.

          As noted – Xi and China can get on board or they can be left behind – they get to choose.

          Trump built an excellent relationship with the rest of Asia in his first term.

          The question right now is whether China wants to be part of that – or whether it wants to go the way of the USSR and fight another Cold War against the US – in an era where the world is grasping that socialism does not work.

          Europe is a mess – but there are lots of good signs for a better european future.

        European leaders when Obama and Biden were president share the same values as Obama and Biden. There was little conflict.

        Biden in particular was NOT respected personally – he NEVER was much of a politician, more of a two bit grifter.

        One of the worst things about the Biden Family Grift was that it was low rent and stupid.
        The Clintons made a fortune from the Clinton Foundation – and though there was some obvious pay for play, they did NOT make the same Sen. Menedez type of open grift that the Bidens engaged in.

        Joe Biden could have made millions as a politician without the Open and obvious corruption that the biden family engaged in.
        But he was too stupid to do so.

        Absolutely nations who are benefiting from Trump 47 policies are rewarding the Trump family.
        But those same policies are benefiting the american working class.

        Regardless, Biden was viewed as impotent, corrupt and senile by much of the world.

        The US under Biden did NOT lead the world. We just walked 100 yrds behind the rest of the world.

        Trump is at odds with other world leaders on some issues.

        Trump is a leader and he is well respected.
        That does not mean he is liked or that other world leaders share his views.
        But they are following anyway – they have little choice.

        The question regarding the focus on China through the rest of the year is:

        Is Xi and China going to continue to be at loggerheads with the US,
        A strategy that is likely to further weaken china,
        or are they getting on board.

        Trump has made it clear that China is the US greatest adversary – since 2016.

        He is also making it clear – it does not have to be that way.
        That china can work with the US and prosper.

        I do not want to pretend to know what choice Xi will make.
        Xi and china have had a very rough year.
        Xi and China are the weakest they have been in a long time.
        But Trump is going out of his way to flatter Xi and China.

        The question is will that help Xi see the right future for China ?
        Xi has been wrong ALOT over the past decade.

        We will have to see if he is ready to change course.

    Under Article One of the U.S. Constitution, Congress (controlled by Republicans) has the authority “to enforce the U.S. Constitution” at the local, state and federal levels.

    So if a local, state or federal government is violating constitutional rights, Congress has a duty to intervene to correct that unconstitutional system or practice.

    Congress could enact constitutional voting districts not favoring any one party or any one group. That would reverse the damage done by states like Texas.

        Jeanne Ives, a former Illinois state legislator, with representation by the Public Interest Legal Foundation, is challenging the law as of this week.
        This same foundation is also challenging California’s congressional map.
