House Democrats unanimously voted this week against legislation to build a new women’s history museum on the National Mall. The reason was an amendment that limited the exhibits to biological women to the exclusion of transgender figures. The museum failed 204-216 as House Democrats hoped that they could still secure a museum including transgender figures once they retake power after the midterm elections.
The amendment drafted by Rep. Mary Miller, R-Ill., states in part, “The Museum shall be dedicated to preserving, researching, and presenting the history, achievements and lived experiences of biological women in the United States.”
It further mandated that the museum would not depict “any biological male as female.”
The vote was notable after the release of the DNC “autopsy” report that flagged how transgender and identity politics contributed to the defeat in the last election.
The report specifically noted the success of Trump’s “Kamala is for they/them, President Trump is for you” ad. The report noted that “If the Vice President would not change her position — and she did not — then there was nothing which would have worked as a response.”
The fact that this was a unanimous vote among Democratic members is particularly notable and suggests that transgender issues will remain a rallying point for the Democrats.
Democratic members called the exclusion a “poison pill” amendment.
In the meantime, transgender issues continue to occupy the courts with a major decision by the Colorado Supreme Court this week that ordered Colorado’s largest provider of gender-affirming care for young people to resume medical treatments like puberty blockers and hormone therapy.
That puts Children’s Hospital Colorado in direct conflict with the Department of Health and Human Services, which has moved to block federal support for institutions providing such care.
Justice William Wood III wrote that “We conclude that the actual immediate and irreparable harm to petitioners outweighs the speculative harm CHC may face if the federal government further acts against it.”
In his dissent, Justice Brian Boatright said that this was hardly a speculative matter, but “a decision driven by the direct threat to the viability of the entire hospital.”

Why didn’t Turley mention that the original bill, H.R. 1329: The Smithsonian American Women’s History Museum Act was introduced by Representative Nicole Malliotakis (R-NY).
This idea of a museum devoted to women was the idea of Republicans.
It is quite interesting, and convenient, that Turley fails to mention this.
Obviously it does not fit the MAGA, and is a convenient way to stoke the rage that he so hypocritically condemns.

It’s bizarre that members of Congress would feel the need to expressly mandate that a women’s history museum celebrate the history of women but not men, as well as not trying to depict men as women, suggests public interest law professor John Banzhaf, who has won over 100 legal cases of discrimination on the basis of sex against both men and women (and sometimes against both).
If this type of explanatory language is required in federal statutes, then presumably there should be language in the U.S. Tax Code explaining that benefits which are restricted to persons 65 years and older – e.g., Additional Standard Deduction for Age, Enhanced Senior Deduction, Use of Form 1040-SR, etc. – should not be available to people under the age of 65, and that people 64 years of age or younger should not be depicted as persons 65 years or older, despite claims that they are over 64, feel older than 64, believe that they are over 64, and/or that they are old people trapped in the body of a young person.
Similarly, especially to prevent confusion among those who might seek to classify or otherwise depict people with a penis as women, there should be new federal legislation to make it clear that:
* The Federal Aviation Administration has jurisdiction over airplanes but not ships, and not even over ships seeking to be depicted as airplanes;
* The Federal Maritime Administration regulates ships but not airplanes, even if airplanes are claimed to be ships, are depicted as ships, or are described ships trapped in the bodies of airplanes;
* The Federal Bureau of Indian Affairs administers programs related to Native American Indians, and not to people born in India who might seek to be depicted as Indians.
But, in the absence of language clearly differentiating women from men and girls from boys, Prof Banzhaf reports that each of the following has already occurred:
■ A women’s volleyball match was described as a “sausage fest” since 5 of the players, the ones who tended to dominate the games and hit hardest, had a penis.
■ A girl’s basketball team was forced to forfeit its game after M2F 6 foot bearded “girl” on the opposing team seriously injured three of its players.
■ A man identifying as a woman, despite his beard and penis, won a women’s competition by lifting 35% more weight than the female record.
■ Transgendered [M2F] individuals with a penis but no vagina have been asked to have medical tests on their nonexistent cervices.
■Transgendered [F2M] persons with a vagina and cervix will not be offered pap smear tests by medical authorities.
■ For every transgender [M2F] volleyball player denied the right to play on an NCAA women’s team because they have a penis, there are dozens of men likewise prohibited for the same reason
