There is a major ruling in Scotland where a court declared that it is generally unlawful to house a transgender biological male in a women’s prison. The decision follows the ruling of the top UK court that a woman is defined by her biological gender at birth. The timing is notable as we await a couple of transgender rulings from our own Supreme Court this week. The decisions also highlight the anomaly of police continuing to arrest people who object to transgender policies under the aggressive anti-free speech laws in the United Kingdom.
In her published opinion, Lady Ross declared that “in all the circumstances, the prison’s guidance is unlawful.” The decision came after a controversy involving convicted rapist Isla Bryson – formerly known as Adam Graham. Despite being convicted of raping two women in 2023, Bryson was initially sent to the Cornton Vale women’s prison.
Scotland continues to crack down on free speech through draconian laws.
The Hate Crime and Public Order (Scotland) Act 2021 illustrates how these laws create a slippery slope of speech criminalization as more and more speech is banned. We previously discussed the law when it was first introduced.
The new crime covers “stirring up hatred” relating to age, disability, religion, sexual orientation, transgender identity or being intersex. That crime covers insulting comments and anything “that a reasonable person would consider to be threatening or abusive.”
It is enough that a person is found to have likely understood that the comments would be abusive or insulting as opposed to intending to be abusive or insulting.
Figures such as J.K. Rowling have been threatened with arrest for her public position in opposition to transgender laws.
This creates a curious conflict, as courts support such views when enforcing biological limits on access to prisons and other areas.
In the United States, there is a division on the issue. Some states, like Maine, require correctional housing to match the gender identification of the inmate rather than the biological sex at birth. Faced with lawsuits and legislative inquiries, the Maine Correctional Department continues to defend its policy. Other states have barred such transgender placement.
This coming week, we are awaiting major rulings on transgender controversies in the United States.
In Little v. Hecox, the Court is considering whether laws that categorically require sports participants to compete based on their biological sex violate the Equal Protection Clause of the Fourteenth Amendment.
In West Virginia v. B.P.J., the Court is considering two questions: (1) whether Title IX prevents a state from limiting sports teams to biological sex at birth, and (2) whether such a limitation violates the Equal Protection Clause.

It’s difficult to believe that our society, along with many other supposedly “civilized” nations have abandoned “common sense” for concocted lies of mentally ill people as the basis for “truth” of any kind! With very few exceptions, it’s crystal clear at birth which sex you are & there ARE only two choices. Yes, there are babies who are born with the sex organs of both sexes, but again–the number is very few. And surgery is usually done on the child after genetic testing to determine his/her true biological sex. It’s also true that most of us do have some characteristics of the opposite sex. Again, that’s the way it’s always been. Perhaps we need to stop “playing God” & stop passing laws that cause more harm than good.

As an art historian of 50+ years, I am imagining just what this concocted memorial to an exaggerated ego will look like in 50 – 100 years. Especially after the current fad of hagiography for obama has passed and the city of Chicago is left managing this stone block when all of the funds for the library of a past and unpopular president have evaporated and the obamas have left the scene. Perhaps it can be repurposed as a mental institution treating those with gender dysphoria.

The funds for construction of presidential libraries must be raised by the former presidents.
If Obama wishes to build a monument to himself with money he raised – I am OK with that.
With respect to its appearance – I do not find it particularly unusual. Libraries typically have very little natural light to protect the books and artifacts they possess.
Regardless, you can like what it looks like or hate it. From what I can tell – plenty on the left find it offensive.
What i find more interesting is that the construction heavily favored black contractors and purportedly they have been screwed by the Obama foundation – which is way way behind on paying them.
Is this all true ? Honestly I doubt it, construction law and particularly the payment of contractors and subcontractors is extremely well developed and the process is incredibly standardized. Progress payments are made on proof of materials purchased or work completed – on all but the smallest projects there is always third party verification of purchases and progress. A portion of the contract price is held for security, and contractors are required to post bonds. All of this has well developed formal rules and most everyone in building construction knows those well and in advance of taking a contract.
The same claims were made regarding Trump – and they are nonsense.
While as I said about – building construction has massively developed law covering all details and incredibly well developed contracts – at the same time construction often involves large sums of money and can be very litigious. Which is Why the well developed law and well crafted contracts tested over decades.

As some of the UK constituencies (Scotland and NI) begin to marginally reassert themselves a bit, it appears that Starmer may be forced to resign as PM, possibly as soon as today. As pleasing as I find that prospect, it will unfortunately be only a cosmetic improvement. The vast collectivist collapse of the UK is almost certain to continue, possibly marginally delayed, but almost entirely unabated. I just hope and pray that their experience isn’t a harbinger for ours, but I fear the worst.

The real issue of the future in the UK is that there is a 3 way split on the right. While voters in the UK have shifted dramatically away from the left, they can not get behind a single vision on the right.
I am perfectly fine with that – if a fractured right ends up in power. But it is a huge problem if the first past the post system in the UK results in another labor government that reflects the will of only a tiny portion of brits.
In the US we have settled on a two party system that does not have that risk – but has other problems.

Kudos to this Scottish Court. It’s a decision for sanity. Now if they will have a court in Scotland or the UK strike down laws inhibiting free speech. Thats a more difficult goal since they have no constitution that is carved in stone to fall back on.
I also commend J. K. Rowling for the absolutely heroic stand that she has taken in fighting this transgender insanity. She has basically said to the Authorities to “Come and get Me” and yet remains free.
The transgender issue needs to return to the realm of gender dysphoria disorder with mental health counseling that is skilled and knowledgeable and not just looking for bodies to be sacrificed to the transgender surgery and puberty suppressants.
Gender dysphoria is real but hopefully we are seeing more rational approaches to its care in the US and Europe. I believe a recently enacted law in California, which blocked school staff from informing patients of transgender issues of their children, has been struck down.

On Monday the court says, in essence, “It is unlawful to put biological males in women’s prisons” – a straight‑up acknowledgment that sex matters for risk, privacy, and safety. But under Scotland’s hate‑speech rules, if you go home and say in plain language, “Good, men don’t belong in women’s prisons,” you’re the one who could get a knock on the door for “stirring up hatred.” Same underlying idea, different speaker, totally different legal posture. If these laws were really applied “equally,” they’d logically have to swallow the very judges and officials who are now required to talk biology when they fix the worst excesses of gender ideology.
Take it one step further and the picture gets even crazier. The same judge who just ruled that housing biological males in women’s prisons is unlawful could end up presiding over your case because you praised her opinion in terms activists don’t like. She uses biological sex as a premise to decide where bodies get locked up; you use the same premise to defend women’s safety and you’re in the dock for “abusive” speech. That’s not equal justice, it’s a speech caste system: the state gets to say “biological male” when it needs to protect women, while citizens are expected to mumble euphemisms or risk becoming a test case. If it’s lawful for the government to rely on sex, it has to be lawful for the governed to say “sex” out loud without fearing handcuffs.
