With the recent decision in Trump v. Slaughter affirming the right of presidents to fire members of the “independent” commissions, President Donald Trump took out the newly recognized power for a spin by removing the members of the Election Assistance Commission (EAC). He removed the commissioners over their failure to implement voter identification and security policies. The question now is how the EAC will operate as a zombie commission without active commissioners. It turns out that this is not the first time that the EAC has been devoid of living members, though critics are likely to say that the EAC has always been moribund.

The absence of active members creates an obvious power vacuum, as the Commission rules require an affirmative vote by at least three commissioners to conduct official business. Notably, the Commission has previously had no active members or a working quorum.
Until the Senate confirms new commissioners (which statutorily has meant an evenly divided partisan makeup), the EAC can continue to function even if it cannot establish new rules or policies. For example, it can continue to certify equipment and disburse grants through its Executive Director, General Counsel, Chief Operating Officer, Chief Financial Officer, and staff.
It can even hold hearings and meetings to gather new information and data.
Moreover, it is the states that continue to administer elections for the most part under our constitutional system. Congress does have concurrent jurisdiction for federal elections and this move is likely to refocus attention on the pending legislative reforms being pushed by the Trump Administration.
Given the current state of affairs in Congress and the late date of the move, this is unlikely to make material differences in the midterm elections. However, it is the first salvo from a newly invested president over such independent commissions.

But the fact that it’s almost impossible to detect illegal voting makes it very unlikely that it doesn’t happen. If you leave the bank and the vault unlocked overnight, with the alarm and all cameras turned off, and you made sure not to count how much was in the vault at the end of the day, you don’t need proof that the bank was robbed overnight. The fact that you went to such trouble to make robbing the bank undetectable is good proof that it was indeed robbed.
There’s nothing inherently bad about mail-in voting. It’s just that, our grandparents generation had to develop Electioneering Law (corrupt behavior in the vicinity of polling places on Election Day), including being able to cast your ballot in secret, and nobody pestering you about how you planned to vote, bribing you, or threatening you while standing in line.
When mail-in voting was greatly expanded in 2020 (the year of Covid), it was thought “convenient” by Dems to not pass any Anti-Electioneering Law to go with it. Why? In the 19th century it was very large, but it never went away – it has been confirmed that LBJ won his senate seat by stuffing ballot boxes with 80,000 fraudulent ballots.
When the mechanical voting machines were retired by HAVE nearly every single one was found to have teeth filed off the gears.
If that was done ONCE for one election – it then effected every subsequent election.
But procedures and check are important not just to catch fraud but to catch errors.
In Wyndham NH in 2020 a software error in DVS equipment resulted in overvotes on a significant percentage of folded ballots.
This was a KNOWN problem decades before the election – but never addresses because it only effected a small percent of folded ballots and only absentee ballots were folded until 2020.
Fortunatrely the problem did NOT flip any elections – that we know of, but a hand recount resulted in a 400 vote alteration in a seat that had been within 20 votes.
oddly this flaw was in 85% of the tabulators in NH and ONLY Needham conducted a recount to find and correct the problem.
Further though the needham DVS systems were older – they were in use in many other states.
Nor has anyone tested the newer systems from the same problems.
Prior to 2020 we did not look for problems that were only possible on absentee ballots.
I would never request an absentee ballot and mail my choice. Why? Well, we can’t trust the postal service to accept and deliver absentee ballots. There’s been several articles and photos of envelopes and similar material in a dump. You do know that all states in the US conduct secret ballot elections ?
That means once you actually have fraud it is not possible to tell what the effect on the election results were.
We have lots and lots of examples of election fraud. Even very large scale fraud – such as 315K illegally counted ballots in Fulton County in 2020.
But we do not and can not tell who those ballots were cast for.
It is nearly impossible to prove that election fraud changed the results of an election – because you can not know which ballots are fraudulent.

We need to cut a finger tip from each voter to allow DNA and fingerprint analysis to ensure they are citizens. We can also tie each vote cast to the individual voter so that someone can come and verify that the ballot matches what they wanted for candidates.

As others have pointed out, you cannot know whether illegals voting have changed any particular election result because all too often the rules are such that you cannot tell how many voted or which way they voted. We do know that many illegals are in fact voting and the “rare one-offs” that are prosecuted are rare only because of how the rules are.
I think it is much more likely that is malign actors using the dead and the non-existent to alter vote counts and election results than it is that illegals themselves are doing it. In many cases, the votes of illegals are cast by someone else and not by the illegals themselves, and all too often through the use of drop boxes and mail-in ballots that help obscure the validity of the votes. And after all, such laws as Motor Voter got them on the voter rolls even if they themselves do not realize it and then someone else submits their a ballot in their name.
But none of this matters as much as having the vote of a single legal citizen nullified by an illegal vote being cast no matter how it was done. It is wrong. It is wrong no matter how many illegal votes were cast and no matter if it changed the ultimate result. The rules that permit such occurrences must be changed to prevent it. I would also agree with pbinca. In this digital world, hooking up all the means of obtaining citizenship legitimately should be connected and able to be quickly searched. I would add fingerprints at age 18 and dna testing done at birth as a backup.

But for congressional elections the ONLY thing it can’t regulate is the location of polling places for senate elections. It can regulate the polling places for House elections, but if the state legislators insist on being a55holes they can establish separate polling places for senator, and Congress can’t interfere.

No other developed nation would accept the sort of insecure electoral processes that are considered normal in many Democrat-run states and localities. Refusing to require even minimal proof of eligibility to vote is a disgrace and leads directly to fraud. This is a fundamental tenet of secure systems — that legitimate users not be impeded by the security system, while making it impossible for illegitimate users. That takes finesse.
The main problem with America SAVES is that there is no rapid, systematic and fraud-proof way to prove you’re a US Citizen. If we were smart and determined, this is something that could be reasonably achieved. But it’s not a 4 month project. Four years?…yes. It means networking all systems that record the awarding of US Citizenship: county birth records, Naturalizations, Citizenships by Derivation, overseas births to US Citizen parents, and foreign adoptions.
If we develop this capability, we’ll suddenly be able to solve other gnarly problems. We can replace birthplace citizenship with Citizenship Inheritance. That will enable us to have Foreign Exchange programs for young professionals which don’t serve as a backdoor for anchor babies — where the Exchange Workers return home after their stint in the US. We can prevent ICE from mistakenly arresting US Citizens, the proof of who is a Citizen readily on-the-spot.
Voting should never be cajoled or nudged by 1:1 pressure. Instead of trying to end mail-in voting (which is convenient in many regards), why not extend anti-electioneering law to mail-in voting? This would end GOTV, vote farming, and any individual outreach by campaigns or surrogates using voter registration lists.
Finally, we need Public Frauds Civil Torts law to deter candidates, campaigns and their media surrogates from employing deceptive infowarfare as a form of political competition. Fast Public Frauds courts would interrupt these infowarfare plays the same day they are dropped. By including media as co-respondents in these suits, we would deter amplification of falsehoods.

Anti-electioneering laws outside the limited area of actual polling places would be unconstitutional. I have a fundamental unalienable right to try to persuade you how to vote. No law can take that from me. The restrictions that states impose in and immediately outside polling places only survive strict scrutiny because the burden they impose is so limited.
Likewise laws against false campaign claims would also be unconstitutional. In general, lies are protected speech; fraud is an exception, but fraud requires that you’re ripping someone off. They have to lose money and you have to gain it.

Australia requires absolutely no ID to vote. Not even a signature, piss-poor a form of ID as that is. The only questions they ask are “What is your name? What is your address? Have you voted in this election before?” You give a name and address, assert that you have not yet voted, and they give you your ballots and cross that person off the roll.
Then when the person you impersonated shows up and also asserts he hasn’t voted, they see his name has been crossed off. If he’s satisfied and goes away, you got away with it. If he insists on voting they give him a provisional ballot, which will end up either counted or not, but in the meantime your fraudulent vote has definitely been counted so you still get away with it.
