Below is my column in The Hill on the latest spin from the left to convince Americans to abandon core constitutional institutions and values as part of a radical agenda in the upcoming elections. Those who defend our traditions, on the 250th anniversary of our Republic, are now being accused of being “nostalgic” rather than progressive. It is a nostalgia that will take on a truly tragic element if professors, pundits and politicians are successful in this effort.

It appears that the Madisonian democracy has joined shackets and combat boots as embarrassingly outdated for many on the left. In calling for radical changes to our constitutional system, leading Democrats are now calling the lingering loyalty to our traditions as mere “nostalgia.” To be nostalgic in today’s parlance is to be a dupe of the oligarchs and an enemy to reform.
“Nostalgia” has become the new coded term for reactionaries among Democratic figures, who are trying to convince Americans to accept radical changes to our republic after 250 years.
Kamala Harris recently insisted that opposition to ideas like packing the Supreme Court is mere “nostalgia” for a system that is no longer working. “I would caution us against talking about rebuilding with any sense of nostalgia about how things work, because even before, they weren’t working so well for a lot of folks,” she said. That “nostalgia,” according to Harris, is preventing us from doing things like packing the Supreme Court with an instant liberal majority.
California Gov. Gavin Newsom (D) last week also declared that “nostalgia is not working” and, while refusing to embrace socialism, added that “capitalism as we know it doesn’t work.”
Morris Katz, a political strategist for Zohran Mamdani, spoke to CNN’s Dana Bash about looking beyond the label of democratic socialism and instead simply to accept that “our government does not work.” They are joining socialists who have long promised revolutionary changes without “introspection, nostalgia or regret.”
For the Democratic Socialist of America organization, nostalgia stands in the way of getting rid of the Senate, presidency, and the Supreme Court to fundamentally change the republic.
The effort is to condition Americans to adopt radical changes to our core institutions that professors and pundits say will guarantee Democrats never lose power again.
That is not an easy task for a people who have benefited from the oldest and most prosperous democracy for 250 years. They have to be very angry or very afraid to take such a radical course.
The Soviets understood that about the U.S. After Yuri Bezmenov, a KGB agent working in the media, defected in 1970, he revealed the four stages by which the Soviets hoped to bring about revolutionary change in the U.S. It began with undermining our institutions and values, with the help of journalists and academics.
With establishment figures lining up behind radical changes, including packing the Supreme Court, the public is hearing a constant drumbeat of how our system is broken.
Even Democratic judges are joining the chorus. Indeed, some appear to be auditioning for the slots promised by Democratic leaders to take over the court with a reliable liberal majority.
This week, the Hawaii Supreme Court issued an unhinged diatribe against the U.S. Supreme Court that abandoned any semblance of judicial restraint or decorum. It declared the majority as effectively racists, saying that “The Roberts Court sees only white.” It portrayed the court as a rogue institution that “overrides what Congress passed. It overrides what the people chose. All to serve its own ends.”
It is an opinion that would make an MS NOW host blush. But it follows a pattern on the left to get people to turn against our institutions and even against the Constitution itself.
Others are telling the public that they are being repressed by the Constitution, which must be scrapped. In a New York Times op-ed — “The Constitution Is Broken and Should Not Be Reclaimed” — law professors Ryan Doerfler of Harvard and Samuel Moyn of Yale called for the nation to “reclaim America from constitutionalism.”
In yet another New York Times editorial, Jennifer Szalai denounced “Constitution worship” and claimed that “Americans have long assumed that the Constitution could save us. A growing chorus now wonders whether we need to be saved from it.”
Berkeley Dean Erwin Chemerinsky insists that it is time to trash the Constitution in favor of “radical changes.”
These voices are seeking to remove all of the moderating elements of our system —the safety features that have produced the world’s most successful and stable republic. They are the very constitutional elements protecting us from the tyranny of the majority, protecting us from ourselves.
Without those protections, we will unleash the self-destructive forces that have been tearing apart other democratic systems since Athens. It is our constitution that spared us from that fate. As James Madison observed, “Had every Athenian citizen been a Socrates, every Athenian assembly would still have been a mob.”
Of course, history has shown that such radical proposals ultimately produce not democracy, but what the Framers called mobocracy. If we let that happen, many Americans will indeed look back at the last 250 years with a tragic sense of nostalgia.

Trump Declared War On Inspector Generals
In January 2025, President Trump fired 17 IGs, many from major departments including Defense, Interior, Health and Human Services, Housing and Urban Development, and Veterans Affairs. Since then, the administration has fired, forced out, or replaced additional IGs, including those for the Department of Education, Export-Import Bank, and USAID.
Many of these firings violated federal law. The Inspector General Act requires the president to provide Congress with a 30-day notice before removing an IG, along with “substantive rationale.” Neither was provided in the January firings.
Nearly 40 percent of IG positions—28 out of 72—are currently vacant, with 22 of the vacancies already lasting more than a year. The Social Security Administration spends $1.8 trillion a year, yet it has not had an IG for a year and a half. The Department of the Treasury has not had an IG for more than six years. Many IG offices are headed by acting officials who may feel that they lack authority to forcefully pursue investigations. Whether Trump’s IG firings were merited or not, the administration and Congress should work together to quickly fill vacant IG positions.

Authority no president has under the U.S. Constitution over any American without full constitutional due process.

What is needed in 2026: without punishing federal employees, Congress and the U.S. Supreme Court need a 21st Century Church Committee for security/intelligence reforms to undo the disloyalty and war crimes of Bush officials.

With all this talk about packing the Supreme Court, that the increasingly radical far-left anti-democratic Democrat Party has been demanding, I think the best thing would be a Constitutional Amendment to fix the number of SC Justices at nine. There was no fixed number originally placed in the Constitution, so it is up to Congress to determine their number, but until FDR in the 20th Century no one thought of packing the court to get around decisions you don’t like. It is time now to fix the number of Justices to avoid the destablizing consequences that would result from packing the court.
And while we are at it, it might also be time to place set lengths of terms for all the lower federal judges. Only the Supreme Court should have lifetime appointments. The terms should be long enough that no President will be selecting almost all of them, but short enough that the bad ones don’t stick around for generations.

It’s literally shocking how the billionaire oligarchs in this country can purchase op ed pieces like this–that accuse DEMOCRATS of being the ones who are dismissing Constitutional traditions as “nostalgia”. Let’s start with a Turley favorite–SCOTUS “packing”. Was it “nostalgia” for the past to expect candidates for the SCOTUS to not lie about stare decisis during confirmation hearings? That’s what Barrett, Kavanaugh and Gorsuch did. Was it mere “nostalgia” for Republicans to cut off 25 witnesses who wanted to testify about Kavanaugh’s character after Dr. Ford testified about what he did to her? Was it “nostalgia” for the past that Presidents are allowed a nomination to the Court that Mitch McConnell denied Obama allegedly due to the proximity of the election? These things happened, which is how MAGA has packed the SCOTUS with radical right wingers that the majority of Americans have a negative opinion of, and whose major rulings most of us disagree with And, Turley couldn’t call having just 9 Justices anything other than “tradition” because he knows that the Constitution contains no specific number of Judges and there have been different numbers over the years. If Americans want to add more judges to balance out the equities without waiting for the MAGA judges to die or retire, we are free to do so.
And, there is no Democrat politician who has espoused getting rid of the Senate, the presidency, or the SCOTUS. That’s Turley rhetoric. Turley’s attack piece is short on factual details and long on baseless accusations, other than trying to make the case that Democrats are “radical”. This is also part of the MAGA playbook–when Trump and Republicans are screwing up badly, attack Democrats. Turley actually tries to claim that it is DEMOCRATS who are trying to guarantee that they will not ever again lose an election. Projection is a major MAGA tactic–Trump is scared to death of losing power, and is doing everything possible to hang on because he has to– knowing that he continues to set records for low approval ratings.
Have Democrats, when there was a Democratic President in office, pushed for adding more blue districts because they KNOW that they are going to lose at least one house of Congress in the midterms? Uh, No. That was Trump and Republicans. Have Democrats attacked voting by mail because in a previous election, mail ballots favored his opponent? No, that was Trump. Have Democrats lied about non-citizens voting, pushed for a law creating as many barriers as possible for voting, including proof of citizenship for already-registered voters, based on lies? No. Has a Democrat president ever lied about hundreds of thousands of non-citizens registering to vote, when the evidence is that fewer than 100 did so between 1999 and 2023? No. That’s Trump. Has a previous Oval Office occupant ever lied about “winning” when he didn’t, refuse to attend his successor’s inauguration, and start an insurrection to try to prevent the rightful winner from taking office? Has a Democrat president ever pardoned insurrectionsts who trashed the Capitol and beat up Capitol Police? How about enriching himself from the presidency by selling worthless crypto bearing his image, tearing down the East Wing without permission to build a vanity ballroom that he lied about being paid for by donations, suckering fans to purchase the worthless crypto, accepting luxury gifts from a foreign government that purchased the worthless currency and who received sophisticated AI chips that aren’t supposed to leave the US. Have the children of a Democrat president ever gotten a multi-million dollar government contract to build robots, without having any experience in doing so? Has a Democrat president ever been convicted of 34 felonies, bragged about sexually assaulting women, and been adjudicated of sexually assaulting and defaming a woman? Is it mere “nostalgia” for us to remember a time when our President didn’t crash sporting events to steal the limelight from the athletes who earned their moment of glory, even though the stadium erupted in “boos” every time his face appeared on the jumbotron.
Americans are rightfully fed up. It’s not “nostalgia” for us to expect our president to be a person of honor, honesty and a patriot. Trump is none of these things.

Donald Trump has done more to undermine our institutions than any other single force since WWII. And that’s exactly ‘why’ the socialists are gaining so much traction: ‘Because Trump has already destroyed so much’. Trump is the most effective weapon Russia ever deployed.
Our governing system is not working at pace. It is lagging decades behind in keeping the law up-to-date with changing technology. I’ll give examples:
Birthright citizenship: European democracies all replaced this archaic system with Citizenship Inheritance 30-40 years ago, and are benefitting from the change. America cannot keep up.
National Secure ID. New Zealand knows who are its citizens using fraud-proof database tech, for deciding voting, benefits and immigration enforcement. The US doesn’t know who are and who aren’t US Citizens, yet the technology to do so existed here before anywhere else.
Foreign cybercrime. Countries where connected-computer use is a regulated privilege (China, Russia) have very little cybercrime waged from outside actors. The US population (individual and businesses) are being attacked daily from abroad (ransomware, phishing, ID theft, credit theft), and government has done almost nothing to stop it.
Our system is too accommodating of small groups of energized activists, and not responsive to majority opinion.
This has to change if we are to remain a superpower.
Interesting that you bring up New Zealand as a country that has a database of citizens, and that it is used to determine who is allowed to vote.
This is not quite true, because New Zealand allows foreign immigrants with a residence visa to vote. There are 2 classes of residence visa. There is a permanent residence visa similar to the US green card, and there is Resident Visa which is granted to foreigners who have a work skill in short supply in the country. All these immigrants are effectively treated as citizens in terms of the right to vote.
There are over 500,000 such visa holders in New Zealand, which is around 10% of the population.
New Zealand takes the view that if you live in the country permanently, contribute to the country and pay taxes , then you should have the right to vote in elections for the government that taxes you. We take the rather quaint view that taxation without representation is not acceptable. You may be familiar with that concept.
Now tell us about the immigrants in New Zealand illegally and how many immigrants are on their Social Welfare system. While at it, give us a number for the immigrants allowed in to their country with serious criminal records. We’ll wait…
Apparently you do not understand that New Zealand is a very small island nation that is 2,000 km from our nearest neighbour, Australia.
It is to all intents and purposes impossible to gain entry to the country illegally. There are only 2 airports that receive flights from foreign countries other than Australia. There is no other way to enter the country. There are no borders to sneak across. Everyone entering New Zealand is screened. It might be theoretically possible to enter by small boat, but to do so would require leaving from Australia unless you are an extremely skilled mariner capable of traversing the Pacific Ocean. And if someone is already illegally present in Australia, there would be no incentive to try to illegally enter New Zealand and risk being detected. If you are an illegal in Australia, it would make no sense to expose yourself to the risk of traveling to New Zealand. And Australians are not considered foreigners. Australia and New Zealand have an agreement that their citizens are automatically given permanent residence in each other’s country, and citizenship after 2 years. For the purposes of immigration and citizenship New Zealand and Australia are effectively the same country.
People who apply for immigrant visas must provide police reports from all countries that they have resided in. It is almost impossible for anyone with a criminal record to become an immigrant to New Zealand.
A few thousand people each year enter on visitor visas and try to overstay their visa, but we know exactly who they are, and often where they are. New Zealand is a very small country. It is very easy to find illegal overstayers and remove them in fairly short order.
In 2008 as Oblamo came to power, I researched immigration to New Zealand. As I recall, it required a minimum of $500,000 in wealth and a viable means of gainful employment. We then realized what a bunch of Wokeblokes they were and weathered the storm.
Those are the special visas available to very wealthy immigrants, known as the Active Investor Plus Visa and the Business Investor Work Visa. Many prominent Americans have used this visa to get residence and citizenship.
