The prison abolitionist movement has been gaining steam across the country with the rise of radical left candidates such as New York’s Darializa Avila Chevalier, who will soon be a member of Congress. Many have asked what will replace prisons in the post-carceral society. Seattle University law professor Dean Spade has the answer: care and accountability circles. If you are having that My Cousin Vinny moment of “you were serious about Dat?,” the answer is, yes, they are indeed very serious about that.
The abolitionist movement is the outgrowth of activists and professors who have argued for years that prisons are racist, oppressive, or simply useless.
One of the earliest abolitionists is avowed Communist and activist Angela Davis, who is ecstatic that her call for ending prisons has gone from a fringe movement to being taken seriously by academia and the media: “I feel like I’m living in a future I could never imagine … a future where people are (openly) talking about abolition.”
She has noted that the push to abolish prison stems from a growing acceptance of radical politics. She told Radcliffe Magazine, “As a matter of fact, rather than considering abolition a failure or as a nonviable strategy because of the emergence of a global prison industrial complex with its clear connections to racial capitalism, I would argue that this development was precisely the material basis for moving away from a politics of reform to a radical politics of abolition.”
Davis is correct that there has been a seismic change, particularly in higher education where departments have effectively purged conservatives, libertarians, and Republicans from the faculty ranks. Faculties now run from the left to the far left, and once-fringe theories are now more mainstream.
The latest voice is found in a recently posted clip by a Manhattan investigator of Seattle University law professor Dean Spade.
In the video, Professor Spade joined Professor Sarah Lamble of the Birkbeck University of London to discuss the end of the “carceral system” and Lamble’s book “Unsafe: The Carceral Roots of the Anti-Trans Backlash.” In the video, Spade makes the remarkable claim that “care and accountability circles work better” than prison for those who have committed rape or other sex crimes.
In fairness, there are some credible points raised by abolition advocates that have long been discussed in this area, including how incarceration does not “address root causes of harm.” However, it does remove those who are victimizing others from these communities. While there is a need to discuss ways to reduce crime in society, that does not mean that prisons do not serve this critical public safety purpose. While prison may not reform a rapist, it will punish the rapist and isolate him from society. While that removal is precisely what abolitionists object to in cutting off avenues for support and rehabilitation, it also protects victims from dangerous criminal actors.
Moreover, whatever the social and economic conditions may be in a given community, most people do not respond to those conditions by raping or harming others.
Professor Spade insists that “care and accountability circles work better than punishing people who have engaged in sexual harm to make them stop.” Yet, there is a significant leap of logic in insisting that the “incarceral context… has set up a story about safety, culturally, that’s terrible for all of us. And it’s also set up the same structures internally, that are about getting safe by getting away from people we perceive as bad.”
I have spent my career as a criminal defense attorney, but the removal of rapists is not “some story” fed to the public “about getting safe by getting away from people we perceive as bad.” It is not a mere “perception” that rapists and abusers are “bad.” These are dangerous individuals who get a thrill or fulfill a need in sexually assaulting others. In the course of those crimes, they cause lasting injury to victims, destroying their sense of security and self for years.
Turning back to the transgender movement, Spade insisted that such a reformation of society will require a “militant struggle” that brings together a broader coalition to “fight[] back.”
Many in academia have embraced Spade for these views. New York University Law School invited Spade to give the Annual Rose Sheinberg Lecture where he spoke about the talk “No Prisons, No Borders, No Cops, No State?” Spade, who is transgender, bills his work as seeking “to build queer and trans liberation based in racial and economic justice.”
Spade is not alone in “abolitionist” writings, which both the media and academia have highlighted with little comparative interest in opposing views or criticism.
CUNY Professor Ruth Wilson Gilmore, who teaches Earth and Environmental Sciences and Psychology, was given a profile in The New York Times Magazine about her work to abolish prisons entitled “Is Prison Necessary? Ruth Wilson Gilmore Might Change Your Mind.” Gilmore calls for massive increases in government-funded jobs, education, housing, and health care to produce “a productive and violence-free life.”
The New York Times exalts how she has succeeded in reframing the debate on “policing, jailing, caging and controlling of populations” and “has shaped the thinking of many geographers, as well as generations of graduate students and activists.”
The New York Times has long pushed abolition theories. In 1955, it was a column titled “Should Prisons Be Abolished?” that described a prison as the manifestation of an “anachronistic relic of medieval concepts of crime and punishment.”
In the NYU lecture, Professor Spade hits on many of the same radical concepts as Davis, lashing out at the state, capitalism, and the establishment. Spade heralds how we are at this “incendiary moment” that the professor never thought would come in seeking to abolish prisons despite the work of the “colonial government.” As a result of “big insurrectionary uprisings,” Spade says we can now end the “long history of repression” in the United States.
As part of this effort at the “delegitimization of the state,” Professor Spade emphasizes that the state exists to “extract the most from the people and the planet” and “redistribute wealth upwards.”
The abolitionist movement is central to this radical agenda and, as shown at schools like NYU and in papers like the New York Times, it is all the rage.
For some, replacing prisons with “Care and Accountability Circles” can seem reminiscent of the final scene in A Clockwork Orange when the minister apologizes to actor Malcolm McDowell while spoon-feeding him breakfast. He assures that he will be given an ample job and speaks hopefully of how “public opinion has a way of changing.”
That is precisely what abolitionists believe is happening in this “incendiary moment.” For years, students have been given a steady diet of such indoctrinating codswallop with little exposure to opposing views on their faculties. With so little diversity of viewpoints, it’s like going through college with your eyes wired open like McDowell.

I am a libertarian who thinks that imprisonment should be restricted to violent crime. However, that does not equate to eliminating prisons. In fact, I would advocate that those actually convicted of a violent crime be sentenced to a minimum of 5 years, with the first 3 years mandatory (no parole). Any subsequent conviction for violent crime should be punishable by a life sentence, with no opportunity for release before age ~75. Non-violent crimes can be effectively punished with fines and/or mandatory and obligated work that is heavily taxed to pay compensation to victims (leaving the perp with a minimum subsistence wage).
So you would agree that all white collar crimes (insurance fraud, embezzlement, Ponzi schemes, wire fraud, counterfeiting, identity theft) should result in no jail/prison time)

Let’s face it, the current correctional system is not working. Recidivism is a major problem as are the children of inmates abandoned to the streets or the failing welfare system causing a “revolving door” syndrome back into the prisons.
We also know that children raised by at least one natural parent has a greater chance of succeeding in life.
Can we not start with that premise and find a way to break that cycle?
First, separate violent criminals from the non-violent population. They are not the same type of criminal and treating them the same has not worked this far.
We also have millions of square feet of unused government buildings sucking up millions of dollars in maintenance costs.
What if we start with a smaller population? Non-violent women with dependent children?
My idea in a nutshell.
Let’s take one of these buildings in an urban area and convert it, not into “prison”, but a family reconciliation center.
House the women in the upper floors.
Open a childcare and after-school care center, in the lower levels.
Have the women work in the centers, caring for their own children in the daytime.
Develop the center floors into a recreational area where the immediate family and the women can spend time watching TV, hanging out together.
This will help maintain the family structure, keep the kids off the streets and provide the women with the hope of returning to a normal life after rehabilitation.

With prisons one has a system that was historically riddled with abuses. That’s the nature of prisons and hard to bypass. So the optics will always be negative with regards to prisons.

Getting rid of income taxes and paying for govenrment entirely through sales taxes is an excellent idea.
FURTHER – sales taxes impact everyone – which gives everyone a reason to hold government accountable for spending.

While government requires SOME agency to collect taxes and enforce tax laws – Most of the IRS is just wasteful spending.
You do not need the IRS if you do not have an income tax.

So yes the IRS can be eliminated many ways – ways that are BENEFICIAL.

The average drug addict requires five rehab stays to achieve success–at ending a self-harming behavior. That’s the best that modern methods can do with people motivated to change. Our prisons are filled with offenders whose criminal behaviors have directly harmed, not themselves, but others. The only way to have any chance at persuading them to stop is to provide them motivation, by making their behavioral impulses overwhelmingly painful to them. That is not rehabilitation, nor more than is it rehabilitation that keeps a child from touching a flame for the second time.
Learning is a reward-based ability, and when the reward for civilized, lawful conduct proves insufficient for a person, the best society can do is try to make it sufficient, or permanently disqualify that unteachable person from society.

I got a haircut today with my country rural barber, a Mensa member, who always has a full shop when I visit. I’m have a Ph.D. in a hard physical science and live in an urban environment. Nevertheless, I have two full-sized vaults full of guns of all types. (And a third vault filled with factory ammunition of corresponding calibers. Although I also reload many of my spent shotgun and handgun hulls & cartridge cases in order to save money.)
While my particular passion is trap shooting, a 12-gauge shotgun sport, I have all manner of rifles (semi-automatic and otherwise) and handguns for every purpose: from target shooting to concealed-carry. (And yes, I reluctantly have a permit.)

What I haven’t seen either in JTs post or in the comments is any real description of what a ‘care and accountability circle’ is. So I tried looking it up and from what I’ve read, it’s portrayed as a way to better re-integrate a prisoner into society. It depends on the offender being a willing and cooperative participant, and also relies on quite a few (unpaid?) volunteers to help out. As the ‘accountability’ of last resort is sending the offender back to prison, they obviously can’t be complete replacements for prison itself. This might help reduce prison populations a bit for the truly repentant, but not for hardened criminals. Anyone who believes these Circles are going to fully do away with prisons is full of …. dangerously unrealistic optimism.

If I remember correctly, it was proved in the 1980’s that building NEW prisons was the key to reducing the rise of lawlessness in sixties and seventies.
It’s clear that the conservative solution is to imprison the lower 20% of the economic strata. Of course that means that they will get government supplied room, board, and medical care – the exact things that are decried as socialist.
So much crime would be avoided if, instead of providing those things to the same 20% within the overpriced prison system, they were provided to those who are impoverished.
But if they don’t end up in prison, an indication that they fit your stated demographic, how would we know who to give that money too?
Impoverished is always relative and you have no guardrails on giving away my money.
There are people who are in and out of jails as a way of life, similar to how homeless survive as takers. They found something that ‘works’ for them just enough to ‘settle’. We really don’t want them wandering around out here in an environment that it’s hard for them to exist in. That’s your average ‘recidivist’.

Well, No one has commented upon how a no prison society would intersect with a 2nd amendment society. I would suspect that since prison is no longer a viable means of enforcing the law and I suppose execution also would be off the board, then there would likely be a great deal of street justice enforced almost immediately. Likely it then would slowly decline as the perceived miscreants are dealt with by other means than law enforcement.
The problem with it is children may be present as we’ve recently seen Norman Bates aka Lindsay Clancy.
Maybe public flogging?
Cheaper, no chance at 10 years in crime school, and if sufficiently painful and humiliating, perhaps more of a deterrent.
I would like to see Congress pass a bill designating the congressional districts of supporters as the location for prototype programs. They would be evenly distributed throughout the country and overseen by advocates.
