Dis-Grace: CNN’s Nancy Grace Loses Critical Motion in Court

It appears that CNN’s Nancy Grace will have to answer for her conduct on her program. CNN and Grace have been sued for the wrongful death of Melinda Duckett, who committed suicide after Grace attacked her on the program — suggesting that she was responsible for her own child’s disappearance. Many in the bar are delighted by the lawsuit against Grace who was repeatedly charged with abuses as a prosecutor and has degraded the profession with her snarling sensationalistic program.

U.S. District Judge William Terrell Hodges rejected a motion to dismiss the lawsuit this week. Grace attacked Duckett, 21, on a show about the disappearance of her Trenton in August 2006. Grace grilled the woman about not taking a lie detector test and being vague about her whereabouts. Duckett went out and killed herself.

Grace was a disgrace as a prosecutor and, before being given her own show, was repeatedly sanctioned or reprimanded by courts for her abuses in court, click here.

Talk shows are increasingly, and legitimately, cited for negligent conduct, click here. The lawsuit against Grace remains a long shot given causation and foreseeability issues as well as obvious plaintiff’s conduct issues. What is astonishing is that CNN and Courttv continue to air this type of vicious, vigilante entertainment.

    Exactly. According to Nancy Grace, only her opinions are the “correct” ones, and they are often completely wrong. I am very glad she is no longer a prosecutor, as her past DISgraceful and unprofessional conduct in that position, in my opinion, make her unfit to practice law.

Your third world mentality has led you to this sad state of judging others by their ethnicity or religion and I think it the basis for much of the strife in your end of the world. Say what you want about Israel but it is the sole democracy in the region, and it has at least the courage of its convictions to counter the sniffling haters who would launch attacks against their women and children. If those bent on her destruction would fight like men maybe the issue wold be decided once and for all but for now her opponents are like you: vicious bigots lurking in the shadows picking fights with the defenseless and declaring moral superiority for alleged past wrongs. Cowardice is never admired and perhaps that explains the attitude of so many Americans against those in your country. Keep braying zakimar.   4. Nancy Grace is going to hire some rabid Zionist Jew like Alan Dershowitz to focus attention away from her and argue that she was exercising her First Amendment Rights. If she gets a Judge who is also a Jew, she’ll walk. This is precisely why I worry that not enough Americans are concerned about the concentration of Jews in positions of power in the USA.

    One Muslim is elected in the history of the US Congress, and it made news on every media outlet (most controlled by Jews of course). Hundreds of Jews are elected and no one dares say a word about how less than 2% of the population controls that much power.

  5. What’s the alleged tort underlying this wrongful death suit? I imagine it’s Intentional Intentional Infliction of Emotional Distress. Maybe Negligence too, in the alternative.

    With regard to the former, the Supreme Court’s Hustler case (involving a cartoon depicting Rev. Falwell having sex with his mother) held that the same 1st Amendment protections applicable to a defamation defendant, apply to Emotional Distress defendants, where the alleged emotional distress is caused by speech. Regarding the later, logically, it would seem that the same 1st Amendment protections applicable to Defamation and Emotional Distress defendants, would apply to Negligence defendants too (but that’s a guess on my part.)

    However…on the facts of THIS particular case, it may be argued that the defendant’s conduct was not prototypical 1st Amendment-protected expression, but was essentially a Grace-initiated INTERACTION – a vicious verbal assault, publicly branding the victim as a murderer. Maybe that’s a pertinent difference.

You are the only person that took it as a negative when a Jew is labeled a Jew – I conclude from that, that you are one yourself, or you must really hate them. Perhaps your argument might fall on more receptive ears if you considered the words of Edmund Burke who quite correctly observed that neither he nor anyone else for that matter, knew “the method for drawing up an indictment against a whole people.” That, it seems, would be your purpose but with dubious or non-existent results. I suggest that if Burke couldn’t do it with his intellect your efforts are less promising and are likely in vain. Why not take on the person’s actions and leave your archaic bigotry behind? Or should we just enjoy the irony of your foolishness?

  14. Upon additional research, I discovered that Nancy Grace is not obese. I admit that I made an error, was arrogant in my rush to judgment and would like to apologize for any harm that I may have caused to Ms. Grace, her family and her adoring fans by suggesting that she was obese. Again my sincerest apologies.

  15. Most if not all the people that watched Jim Jones and David Koresh “adored” them too, that doesn’t make them adorable. Secondly, it’s great to be an advocate for victims, but when you get it wrong, admit it and APOLOGIZE.

  16. Commiting suicde after being questioned by an attorney is “not a normal” reaction. Thousands of people are questioned daily that do not have this reaction ! The woman was simply scared that she was finally “being found out.”

    Nancy Grace is making America more aware of the hundreds of horrible crimes that are taking place across this country. She cares, and it shows. Give her a break! Maost people that watch her show, adore her. I know that I do. I wish her continued success. She’s terrific.

  17. Nancy Grace is one of the best things that has happened to television. She cares for the victims, and it shows. Like Mark Klass, and John Walsh, who have all been victims, Nancy cares. She is making a difference. Not only, do we the public, get to phone-in and ask questions, give opinions, so do the involved loved ones of the victims.

    Because of Nancy, people are more aware of the hidious crimes that are taking place in this country. Her information just might save your life! Like the serial rapist in New York Central Park, for instance.

    Thank God, that Nancy can be aggressive when neccessary! Look at the lies that the Anthonys’ are telling at this time, while the little girl is still missing! Nancy has a heart of gold, and she want justice, and I feel that all of America should feel blessed that we have people like her, John Walch, and Mark Klass.

  18. The students of the Duke Lacrosse Team should sue her as well. Grace spent show after show ranting about their guilt and the day they were proven to be innocent, she skips the show and has a lackey fill in for her with no apologies.

    The only thing that surprises me about the likes of Grace and Beck is that they aren’t on Fox.

  19. JT, I think CNN and CourtTV keep this kind of “vicious and vigilante entertainment” (perfectly accurate way of putting it, by the way) for one reason; RATINGS!

    Personally, I can’t stand Nancy Grace and others just like her who automatically go for the jugular in these cases. When I heard how she went after this young mother on TV and the tragic result of the mother’s suicide shortly afterward, I knew it wouldn’t be too long before she was finally sued. I hope she loses this suit and will be forced to pay heavy damages. Maybe it will be a lesson to anyone else who thinks acting like judge, jury and executioner on national TV is something to be “proud” of.
