Dis-Grace: CNN’s Nancy Grace Loses Critical Motion in Court

It appears that CNN’s Nancy Grace will have to answer for her conduct on her program. CNN and Grace have been sued for the wrongful death of Melinda Duckett, who committed suicide after Grace attacked her on the program — suggesting that she was responsible for her own child’s disappearance. Many in the bar are delighted by the lawsuit against Grace who was repeatedly charged with abuses as a prosecutor and has degraded the profession with her snarling sensationalistic program.

U.S. District Judge William Terrell Hodges rejected a motion to dismiss the lawsuit this week. Grace attacked Duckett, 21, on a show about the disappearance of her Trenton in August 2006. Grace grilled the woman about not taking a lie detector test and being vague about her whereabouts. Duckett went out and killed herself.

Grace was a disgrace as a prosecutor and, before being given her own show, was repeatedly sanctioned or reprimanded by courts for her abuses in court, click here.

Talk shows are increasingly, and legitimately, cited for negligent conduct, click here. The lawsuit against Grace remains a long shot given causation and foreseeability issues as well as obvious plaintiff’s conduct issues. What is astonishing is that CNN and Courttv continue to air this type of vicious, vigilante entertainment.

    Crime Slut, is that a pro se or malum prohibitim case category? Or are they 2 distinct crimes of which you complain?

    I have to turn her off. I can’t believe that she is allowed to occupy the air space on TV. It is hard to believe that she is actually an attorney. Some of the things that she has said would cause a disbarrment proceeding in the state in which I am in.

    You know you’re probably correct that Nancy suffers from some mental affliction. We once put the mentally ill in treatment, now they get shows on places like Fox and CNN. Anyone care to challenge me on this in the case of Glenn Beck?

  4. According to many experts, the change in the death penalty is not because the evidence has changed, but is a means of attempting to get a plea from Casey. The experts are still not wavering in their conclusion that a conviction of first degree murder against Casey Anthony is still highly unlikely. After reviewing the evidence in this case released to the public, I agree, based upon the evidence, extremely unlikely.

  5. Well, Nancy Grace was proven to be wrong again today on the Phil Spector case too. Spector was convicted of second degree murder, unlike the frivolous and wrongful claims by Predator Grace.

  7. It is heresay only if you do not belive what Nancy has said herself when she was interviewed. For me, I tend to believe it is fact, and a rationalization as to why Nancy violates the law so often on her show. As far as a comment of saying something to the affect of killing the kid(s), there in lies the problem with the Casey Anthony case. If the authorities have confirmed proof that Casey said or typed that in a text message, that will be the only way for the prosecution to get a murder-one verdict on that case.

    I did not know that, but isnt that as you legal eagles say hearsay? I am obviously not a lawyer but would that even matter? I have 2 children and from time to time I would like to “kill” them but never do and never would.

    The whole thing is pretty bad and I agree with Bobesq that she is a crime slut and I have watched her once and never again, personaly I cant even understand why people like her.

  12. Unfortunately that is how it sometimes works. There is a case going on in KC right now involving a missing woman, being investigated as a “death” right now, and anyone watching the facts has no doubt the husband did something to her. But absent evidence, the cops won’t even go so far as to call it a homicide investigation. The job of the courts is trier of fact. That comes with limitations. Those limitations, however, are critical to prevent vendetta entering in the guise of judgment. Because despite the facts that the husband in the KC case had just been served with divorce papers, entered into a haz-mat cleaning storehouse in the middle of the night – the night his soon to be ex-wife vanished, and has generally acted like a suspicious character it’s supposition he killed his wife absent the corpse or other sufficient tangential evidence. I know he did it. The cops know he did it. The family knows he did it. None of that obviates the need for proof being required even when the reasonable supposition is guilt. Sometimes the DA has to settle for the charge they can make with the evidence that have even if the actual crime implied is a greater offense. Nothing is perfect, but I’ll take evidence over “a feeling” any day. Because feelings are easier to fool than procedure and science.

    None of this changes the fact that Nancy Grace is a revolting human being who thrives on the suffering of others. A true parasite in every sense of the word.

  13. Not in my opinion Bron98, there doesn’t appear to be any forensic evidence that I am aware of that will conclusively obtain a conviction of murder-one. Unless, of course, there is forensic eveidence in the form of those hundreds of text messahes Casy did where she implicated her pland to harm Caylee. Without that, I whole-heartedly believe she will walk on the murder-one charge.

    I think its pretty evident from what we have seen on TV that she made a terrible mistake and then tried to cover it up. Couldnt the exposure also lead to a lighter sentence?

  15. Tina stopped by here and did some blogging on my pc. She signed under her own name, used her password and then blogged. On several sites, there was an outrage because both my sign-in name and her sign-in name came from the same IP-address. Obviously. But, uninformed people had a fit about that because they do not understand how basic computers operate, so they blasted Tina. She was concerned about it and I told her you just have to consider the source. She’s a former grad student of mine and she does an outstanding job at the Law firm too. Uneducated people can just be monotonous at times. The Caylee case is another great example of that too.

  16. I think that Nancy Grace should be arrested and placed in a prison. Someplace nice and safe where she will not be able to undermine our legal system the way she has been doing with this Anthony case. Ultraconservatives want to put flag burners in prison, what’s the difference? She didn’t burn the flag, but she does vandalize due process each and every night. She is molesting your right to due process, which she was sanctioned by the Appeals courts years before, and setting a precedent for every child who will grow up in a world where mock trials are held on TV for entertainment. She is vandalizing the jury system by attempting to taint all of society with her hyper-accusatory views, phony evidence and wild accusations. In my opinion, in virtue of the fact that phony bogus evidence has already been presented to every possible juror, you have a mistrial by definition even before the trial has begun. And, Casey Anthony should be released immediately because this is not a case that simply cannot be tried fairly under our system of Law. Guilty or not, Casey should go free, in part largely due to the un-professionalism of Nancy Grace. Good going
