Chicago Woman Sues Ex-Boyfriend Over Posting Intimate Pictures on Porn Site

thumb_computer_assault_2In Chicago, Jessica Voth has filed a torts case against her former boyfriend Miles Marsh after he allegedly posted “intimate and personal pictures” of her on a website called exgfpics — or “exgirlfriend pictures.” The site itself appears to cater to such hostile and juvenile acts of ex-boyfriends. However, the site is not being sued and has protections under federal law.

Voth and Marsh were student together at Lake Forest College and, after they broke up on Valentine’s Day in 2006, Voth insists that she told Marsh to destroy the pictures — which she said she was reluctant to take in the first place. Marsh refused but allegedly promise to keep them private.

Voth was informed of the pictures by a friend who said that he saw them online.

The lawsuit accused Marsh of intentional infliction of emotional distress, invasion of privacy, and other charges.

Recently, a federal court ruled against Hustler Magazine in the use of nude pictures of a the deceased wife of Wrestler Chris Benoit.. That ruling, however, was based on the right to publicity rather than privacy. Privacy cases are more difficult when you voluntarily gave photos to another individual, as opposed to the recent McDonald’s case. Nevertheless, there can be an action if Marsh took the pictures under the express understanding that they would remain private.

Regardless of the law, of course, none of this changes the fact that Miles Marsh is a colossal jerk if the allegations are true. It takes someone without an ounce of humanity, intellect, or maturity to post such pictures. Perhaps such lawsuits will achieve one desired social objective: to discourage others from relationships (or worse yet, breeding) with the men who post on this site.

  15. A non-judicial method of solving this is for the woman to insist of taking full frontal pictures of the man requesting theirs. Net distribution of many of those “man shots,” might then discourage these predatory men from their desire to keep “reminders” for vicarious stimulation and just let people get back to the fun of getting it on, without the tricks. Perhaps I’m old fashioned, in fact I guess I am, but if you need the tricks and the fantasy to spice up your sex life, you should examine just how good it is.

    I’m having to fall into the discretion is the better part of damage control philosophy. If you are free spirited enough to not give a damn what anyone thinks, ok, then more power to you. If it’s a financial transaction like pornography, ok, knock yourself out (if that’s your thing). But in a relationship? Yeah, things can always go bad and it was my experience that there is no area of law where you’ll see two people more willing to go out of their way to screw with each other than a divorce action. A divorce is just a break up writ large. If someone is willing to flee the jurisdiction with the children, doing as much calculated damage to a “betraying partner” with dirty pictures is a baby step in the possibilities for us to revert to when pain devolves people into mean poo flinging monkeys. But if you’re not willing or able to take the heat compromising photos could cause you personally and/or professionally, why take the risk? And one should give it some forethought. You may not be embarrassed today, but do you really want to explain to the grandchildren what grandma and grandpa are doing with their little person friend and a modified weed eater? I think not.

    A consensual relationship can turn sour anytime, and sometimes it is hard to predict the ex’s reactions, so personally I like to play it safe from the get-go.

    I can say that this man, (ok mouse) is a prime candidate to run a bank, ponzi scheme, Exxon, congress.

  20. I always wonder at people who let themselves be photographed in compromsing positions voluntarily. Those could be just an accidental or malicious click away to the world.
