President Barack Obama continued his effort to preserve the “don’t ask, don’t tell” policy in a filing before the United States Supreme Court. A trial court had imposed an injunction to halt the discriminatory policy. The Administration could have allowed the injunction to stand pending an appeal but succeeded in getting the order reversed. Now, it is defending its intention to continue to discriminate against gays and lesbians in an appeal to the Supreme Court.
The Justice Department had secured an order from the U.S. Circuit Court of Appeals for the Ninth Circuit in San Francisco to allow it to continue to discharge service members solely because they are known to be gay or lesbian. It is also seeking to reverse a decision finding that such discrimination violates the Constitution. The Administration had the discretion not to appeal or to allow the injunction to stand. Instead it is fighting for the right to discriminate and has argued for an extreme view of military discretion in the abuse of gays and lesbians — including opposing the very right of individual service members to show that they were not personally a threat to good order and discipline. The Obama Administration has argued that the court should just accept that any and all openly gay and lesbian service members are a threat to good order and discipline — and thus a threat to our overall national security . . . And they wonder why Obama and Bush are now virtually even in the polls.

He’s the president and commander in chief of the U.S. Armed forces.

I understand the agenda of gay rights activists. I also understand that winning by breaking the rules is really no win at all.
The question here is: Did Judge Virginia Phillips correctly interpret the law? Did she adhere to binding precedent?
If the court erred (which I believe she did), the government should appeal. I don’t see how anyone can read the 2008 decision on the Ninth Circuit and not see that.

I am 100% in favor or repealing DADT, but I also recognize that the military is a quazi-society in which those who choose to participate voluntarily relinquish many of their constitutional rights.

Bombs Away: Afghan Air War Peaks With 1,000 Strikes in October
The U.S. and its allies have unleashed a massive air campaign in Afghanistan, launching missiles and bombs from the sky at a rate rarely seen since the war’s earliest days. In October alone, NATO planes fired their weapons on 1,000 separate missions, U.S. Air Force statistics provided to Danger Room show. Since Gen. David Petraeus took command of the war effort in late June, coalition aircraft have flown 2,600 attack sorties. That’s 50% more than they did during the same period in 2009. Not surprisingly, civilian casualties are on the rise, as well.

At one point I joked that Sarah Palin must be a Democratic plant, because she did more than anyone to help get Obama elected. I’m now wondering if Obama is a Republican plant!

It is time to wake up to what Obama and senior Democrats are, which is loyal toadies of the plutocracy whose first priority is to protect and advance the interests of the ruling class in opposition to those of the other 99% of Americans. These people do not care about alienating the democratic base, in fact they want to drive them away so that they are not seen as biased towards the interests of Blacks, workers and poor people and can appeal to better quality voters who currently support the Republicans. If this means that they lose elections for several cycles during the transition, that does not worry them as the Republicans are even better at advancing the plutocracy.
You have to believe that Obama is one of the most compliant puppets ever in the history of these “independent” leader-type jobs. He has absolutely no shame, whatsoever!

What is wrong with letting the Court of Appeals, and ultimately the Supreme Court, resolve the issue. instead of a single District Court, with which other District Courts have disagreed?
It is a civil rights issue that should not be delayed. Period.
