Lone Star State: Perry Refuses To Stop Execution Of Mexican Citizen Despite Treaty Violation

Many people thought it was a bit odd when Governor Rick Perry indicated that he might run for President of the United States after previously suggesting that Texas may want to secede from the United States. Perry seems not only want to be the John C. Calhoun of presidential aspirants, but he has also decided to add the violation of international law and treaties as a resume booster. Over the objections of President Obama and a host of leading international figures, Perry has refused to stop the execution of of Humberto Leal Garcia — a Mexican national denied his rights under the Vienna Convention.

Texas police and prosecutors have repeatedly violated the Vienna Convention by not informing foreign citizens of their right to consult with their embassies. Leal is a convicted rapist and murderer.

Leal, 38, was killed a 16-year-old girl in San Antonio. Texas police and prosecutors never told him about the right to speak to his embassy. This violation was either a knowingly disregard of the law or an act of gross negligence. Yet, the prosecutors and police have faced no repercussions for causing this international controversy. Moreover, Perry refuses to meet his obligation to satisfy international obligations that are expressly required under a treaty.

Consular access is a vital protection for Americans traveling abroad, but Texas is about undermine that protection by refusing to address a clear violation of its own officials. Imagine the response of other countries when an American is held in places like Iran or North Korea. They are likely to invoke the Texas Rule and deny such access. Once again, the United States appears to view international obligations and law as binding on every one but ourselves. This is not an isolated case. In 2004, the United States was found to have violated the treaty in 51 cases involving Mexicans awaiting execution — many in Texas.

    Regarding Mitt Romney: It’s really difficult to know where he stands on issues. He changes his positions so often. He keeps trying to morph into the candidate that he thinks will win the Republican nomination.

    That is one disturbing, factual exposé of Mr. Perry. Maybe I am getting dyslexic in my old age—is this 2011 or 1102 CE…(I purposely used CE instead of AD to upset those Southern Baptists I hung out with in my youth, when I believed in that silly gawd-offal god/JC/Lard/holey ghost-magic.) Fortunately, college and Mr. Darwin shot holes in Mr. holey ghost and his compatriots and freed me from their ‘holey’ grasp.

    Obviously Michael you are immune to irony, just as you so self righteously are infused with blood lust. Just for your information if someone ever did that to a child of mine I would kill them myself, if able and it wouldn’t be an easy death. No brag, just the truth. The problem is just because someone is thought to be guilty doesn’t mean they are and I might well kill an innocent person. Also too, I reserve the right to act in such a manner to myself, the directly aggrieved and not to a State where far too often justice that would have made Roy Bean cringe is done.

    In Texas, however, there is much brag, much swaggering and the macho belief in the mythological “code of the west.” The problem is that Texas has a long history of trying to execute the innocent and indigent, while letting wealthy murderers go free. How many people have been released from Texas death rows in the past decade because they were wrongly convicted? In my long life I have often observed that those who like to talk tough are usually those who don’t think deeply. The toughest people I’ve met would never express themselves the way Texans do routinely and prove so by electing gutless tough talking governors, they know they’re tough and don’t have to prove it.

    Ummmmm……….he DID have a trial, and was convicted with overwhelming evidence. Show me where I implied anything that you said. That was a pretty ignorant statement. My kind of justice WAS done.     I’m with you 100% on that comment, although I don’t think I could vote Romney no matter who he picked for VP. I’m kind of interested in hearing more about this Huntsman guy though. What I saw of his running announcement didn’t sound like any Republican I had heard speak in my life time.

  7. I would never vote for Mr. Perry or Ms. Bachmann and if Romney chose either as a VP, I will not be voting–unless those progressives I heard of find a viable challenger to face Mr. Obama.

    HOUSTON – Texas executed a Mexican national Thursday over objections from President Barack Obama’s administration that the action would violate international treaty obligations and put U.S. citizens abroad at risk.

    In a case that garnered international attention, the U.S. Supreme Court rejected a last-minute stay of execution on the grounds that Humberto Leal Garcia was not told of his right to diplomatic counsel when arrested.

    Leal Garcia, 38, was pronounced dead at 7:21 p.m. ET after he was given a lethal injection at a prison in Huntsville, Texas.

    We’ve discussed secession her on occasion, voluntary and forced 🙂
    What I know about it is that it’s virtually impossible to pull off. If it weren’t there’s a list of about 15 states I’d rejoice to see do it, they’re almost all welfare states anyway, no loss to me. That’s why no state that talks about it will actually do it. Go for it.

States rights are THEY KEY to our freedoms. He and Holder are so busy suing states and worrying about international “rights’ he makes me ill.
