This disturbing video has gone viral of a mother on a bus this week who threw her baby in order to fight another women on the bus. The question is what the criminal charge should be in such a case. There is no record of any charge at all but the video feeds offer little information of the aftermath.
There is an obvious basis for disturbing the peace and assault for both women. However, it seems clear that child abuse or endangerment could be brought in this case. It is not even clear that the woman who grabs the baby knows the mother.
What is strange is that the baby seems well dressed and cared for despite the mother’s hysterical screaming. She repeatedly positions the baby who seems oblivious to the mother’s screaming. It is unnerving to think that the baby is used to such screaming, but the baby sits calmly through the scene.
I find it difficult to contemplate returning the baby to the care of a mother who would toss the baby away to engage in a fistfight on a bus. What do you think?
Maybe some turnips as well.

You don’t get it. Give bad, get bad. Throwing a baby to fight a person cannot be called a good thing. God is equal. People that have darkness inside casting a shadow are the ones that are unequal.

Any time a parent is in a loud or physical confrontation a child is traumatized. The woman should be charged with reckless endangerment and given the court directed opportunity for parenting and anger management classes.
I think the lady was scared of being attacked while holding the baby..so she practically threw the baby out the way. She wasn’t clearly trying to hurt the baby.. she asked several times for someone to get her baby. I don’t condone fighting at least she didn’t drag the child into the fight. Stop and think people!

We are very dainty here. This behavior is very normal and ordinary among segments of American society, rather large segments.
I don’t belive there is enough to charge the woman with an assault on the child. Reckless Endangerment would be probably the closest but my 2 cents it would probably not hold up in court. She certainly could be guilty of Unlawful Transit Conduct.
Certainly there is enough to show there could be some serious parenting issues underlying. I think the bus driver should have ejected them from the bus before this got out of hand.
What a wimp! Think how much more effective it would have been to use the kid like a nun-chuck! since a lot of its weight is on the end it would carry a lot of velocity when it landed
This is really sad. How far have we fallen as human beings? What chance does this child have for a decent life? She will grow up surrounded by anger and hatred.
I agree Professor. She is a sorry excuse for a mother. She could have hurt the baby when she threw him, not to mention the wonderful example she is for the child. Disgusting.

IT is obvious child abuse and she should be in jail and lose custody. I was astounded when I saw what she did. It was not a handoff to the other person, she literally THREW the child.

Upon conviction, probation, together with a stern warning.
Subject to medical exam of the baby, and a social exam of the mother’s environment.
She also needs a lot of anger management therapy.
She seriously keeps ranting about the other woman “disrespecting her kid” while she screams F-bombs and other swear words right into her child’s ears. Just abysmal behavior.
Maybe she’s not the mother…
