Milwaukee Man Charged With Felony In Spitting Incident

MJS Milwaukee_officer_spit.jpgWe often look at police controversies in cases of abuse or other violations by officers. We occasionally have opportunities however to witness what officers face in their daily jobs as well as officers who saw admirable restraint. This is one such case. Most of us would respond more aggressively to Mr. Larry A. Green Jr., 28, spitting in our mouths. Police officers often have to show restraint that exceeds the personal discipline of most people. The video is below.

The officers do not taser Green or throw him to the ground. They calmly cuff and arrest him.

Green reportedly went to complain about a family problem but when the officer asks if he can help him, he inexplicably spits in his face and mouth.

He is now charge with a felon of throwing or discharging a bodily fluid at a public safety worker. Whatever family problem he came to report will have to wait. The offense can come with a 3 1/2 years prison stint.

Since the videotape is available and he has admitted to the act, what do you think is the appropriate sentence (assuming he is found competent)?

  1. Of course the real loonies are the ones that want to shoot the suspect or give him 30 years….

  2. A very good comment by Darren. I’ll take him off my looney list. Spinelli stays on!

  3. I would roll with a 20-year sentence. Nobody but nobody screws in my state. I don’t know where you little cretins come from, but I’m glad you aren’t here with your feeble ideas. Milwaukee is an embarrassment to the state, it does not represent greater Wisconsin, and many won’t even recognize it other than that the Brewers play there. Make it 30.

Business as usual in Milwaukee after Detroit bankruptcy. My son works as a trades person, a Millwright, he makes a great living in Milwaukee, gets more than full time and just bought his first home as a young single guy, he is doing well, as is Milwaukee. I know several MPS teachers who are incredibly devoted to their jobs. They bring in school supplies, mittens, hats and the like from their own funds. They are on Facebook often getting their friends to donate to science projects and extra cirricular activities for their students. They hardly treat them like “criminals” as someonei said. It’s so easy for some uniformed folks to spout nonsense, but the reality is often different.

  5. i think Waldo@4:35 has a point.

it looks like he wanted to be arrested. after spitting he just stands around and waits for the officers to come out and arrest him.

maybe his family problem was that he was about to be homeless during the winter.

now he’s got “three hots and a cot” for the next three and a half years.

  6. I think there are two things that are not being recognized here

    1) The 3 1/2 years mentioned is the maximum potential sentence not what this defendant received.

    2) The method used to arrest this man is not out of the ordinary. In fact it is the way the vast majority of suspects are arrested. Most people do not resist and are just let themselves be cuffed up. When they do resist most of the time it is usually in the form of squirming to pulling away. It doesn’t too much force to put these suspects under control. Then there are the aggravated ones that take a lot of force to take down, use weapons against the officers or pose a very high risk due to the nature of the crime or the situation. But these happen the least common of all of them but they make the most interest from the public for various reasons and get the attention.

As for the spitting. The biggest worry to the officer or anyone is blood borne pathogens, especially Hep-C and diseases. I don’t have a problem with this being a felony. I don’t know what this suspect’s offender score is but I don’t have a problem with a judge sentencing him accordingly. It is not a fun thing to go through seven months of Hep-C screenings to see if you got it if the suspect was positive for it and his bled or spit into your eyes or mouth. The worry is there the entire time.

  7. David, Year in and out Milwaukee is the most racially segregated city in the US. As my comment stated, it is a failed city that has been run by one party for decades. It’s school system is a disgrace. So are their MLB and NBA teams!

  9. Now go ahead and google how the MPD is “getting better because the old guard are retiring”. I did not say the MPD, as all big city PDs, is perfect and doesn’t have serious issues by any stretch of the imagination.

  10. Yeah, Nick. I just did a google search on “racism milwaukee police department” and there were only 289,000 hits. Who do you think you’re fooling?

  11. No one needs to rely upon me about the sordid history of the Milwaukee Police Dept., it is well documented. Again, I don’t know your brother. I’m sure he was a good cop. I do know police depts. throughout the upper Midwest QUITE WELL. And, cops wannabe PI’s. I’ve helped probably 8 or so leave police work and become PI’s, I hired 4 of them!! So, there’s that.
