There is a controversy in Alabama after prosecutors cut a plea agreement with an Alabama state trooper Samuel H. McHenry II, 36, who was accused of raping a woman and forcing her to perform oral sex after a bogus arrest in December 2015. For the crime, McHenry was allowed to plead to a simple misdemeanor for sexual misconduct and only six months in jail. [Warning: graphic content below]
The incident began after a woman called for help after a car accident. McHenry allegedly spotted some pill bottles and an empty nasal spray and threatened to arrest the woman. He placed her in a caged area in the back of his cruiser and drove to another area where her told her, “Fuck me or go to jail.” He allegedly pulled her pants down, raped her and afterward, forced her to perform oral sex. He then dumped her off in the parking lot of a closed store around 1:45 a.m. on Dec. 7.
What is particularly worrisome with the plea is that not only did he face charges of rape and sodomy but the dismissal of those charges (and plea to a misdemeanor) was done reportedly without the approval or consultation with the witness. Usually the victim is made part of this process.
McHenry refused to cooperate with giving a saliva sample after the incident.
In addition to giving up his certification for law enforcement, McHenry was required to pay a $500 fine and restitution for the heinous crime and was ordered not to contact the victim. That is clearly not enough for many critics who have questioned whether someone outside of law enforcement would have received such a plea bargain.

My point is that sometimes prostitutes are actually trafficked girls, or those girls who grew up, and felt like there was no way home for them. I was surprised to discover that some street girls are forced into it by traffickers. After a while, they are too ashamed, or hooked on drugs, or hopeless to accept help when it’s offered to them. It’s like long term kidnap victims who stop trying to escape. They begin to believe their kidnapper is all powerful and, at least for a while, are just broken.
I’ve read some true stories about parents searching and searching for their kidnapped daughters, to find them in the sex trade. I recall one dad retrieved his daughter from a crib using a bat because the cops were too slow.
I used to think sex workers were in the trade by choice, but I’ve learned a surprising number are victims. About 90% of sex workers say they want out but feel like they can’t, for a variety of reasons ranging from hopelessness, drug addiction, fear of their pimp, irresponsibility, a feeling of being tainted and unfit for anything else, or any number of reasons and level of responsibility.
It’s sad.

I don’t think sex slaves and prostitutes are the same thing at all. Most of the hookers out on the street, or on Craigslist have every ability to quit doing it, and don’t. There are many organizations to help get them out of the life if they want to.
As far as the guys and gals who traffic in women, hang the lot of them!

Although I’ve missed most of the back and forth about prostitution, I want to add that a troubling number of sex workers were trafficked as minors. Some were kidnapped, some the victims of sexual abuse at home, some were illegal aliens who paid to get smuggled across the border but were sold into brothels, some groomed by pedophile pimps…and then they are given enough drugs to get them addicted, and locked in. The Russians and Mexican cartels are quite active in sex trafficking. Sadly, cops would take these girls off the street and send them home, where they were getting raped by their relatives or family friends, which is what messed them up or drove them to the streets in the first place. I’ve read some interesting articles on new approaches to sex workers which takes into account that some may have been the victims of sex trafficking. The goal is rescue rather than punishment.
Unless she is a nymphomaniac with low standards, most women do not wake up one day and decide to start sleeping with strange men they are not attracted to for money. Some of the women on the street put themselves there from self inflicted troubles, like getting into hard drugs in the first place, while others were victims who lost all hope. The more I learned about sex trafficking here in the US, the more sympathy I have for these lost women and girls.

A Trooper should not have sex with anyone while “on duty”, even his wife. So, if the cop and this person had sex while he was on duty he should be fired, even if she consented. This pork em if ya gottem thing needs to be limited.

I never said the cop shouldn’t be punished for what he did, I simply questioned whether or not there was some unknown fact about the victim that made the plea deal worth doing. It could simply be the good old boy system, or maybe the chick had a long druggie rap sheet, or a history of solicitation, or a history of making false police reports, or had mental illnesses and was on psychotic medications.
But if she was a hooker, my sympathy level goes way down. FWIW, I watched this movie on Lifetime about the Green River Killer who killed like 50+ hookers. They spent millions of dollars and a huge task force to catch the dude. My take on it, tell the public and the hookers somebody is killing hookers, and if they ain’t got enough sense to quit hooking, the heck with them. I would assign a couple of officers to the case, but really .. . spend millions of bucks on a task force??? It ain’t like money grows on trees on the municipal level. There’s a lot better stuff that money could be spent on than trying to save idiots from the consequences of their idiocy.

@Bettykath The reason cops are more likely to get away with murder is that it’s technically part of their remit. There is no way to justify rape as part of their job, whereas ‘I thought I had a gun, and I was afraid for my life’ or ‘they would respond when I knocked on their car window’ seems to be sufficient reason to murder someone.
@Squeaky You may use someone’s profession to statistically say they are more likely to be subject to violence, death, injury etc. That however doesn’t justify deliberate harm from another party. Just because the 8 year old girl has only one parent who works two jobs to makes ends meet does not mean the priest should rape her because she’s an easy target. The moral decision in this kind of crime, if you believe in free will, is always on the one with power. Cop, gun, badge, power to make your life miserable. Priest, adult, possibly father figure.
Increased risk also argues for increased compensation or increased safety. I.e. prostitutes should have more police protection than other occupations. rsm – since prostitution is illegal, you probably cannot get worker’s comp for job related injuries. Same with drug dealers. You assume the risk. You sit between home plate and 1st base and you assume the risk of getting hit by a fly ball.

@ Darren Smith The Judges are just as bad. Being the enablers of this behavior from Police.. For example this case: A state judge dismissed the sexual assault case Wednesday against a Honolulu police officer accused of groping a teenage girl while on duty.
An Oahu grand jury indicted 35-year-old Kramer Aoki last November on a third-degree sexual assault charge, a class C felony punishable by up to five years in prison. The indictment says that on Sept. 6, Aoki, as a law enforcement officer, knowingly subjected to sexual contact a person in custody. The Judge dismissed the case on the basis of the Defense’s argument that since this was a Traffic stop. The teenage girl was not under arrest at that time, and therefore not in “Custody”
A manifest injustice. In my opinion the judge should not have accepted the plea deal.
The more I read about people accused of crimes on the internet, and the more law stuff I do in life, the more I Remember there are two sides to every story. The media only has one side: that is the side which sells advertising. So they report everything in a way that does that. It’s always outrage black and white injustice etc and never :”shades of grey”

I think it is reasonable to look at the victim sometimes. Be honest, when some drug dealing gangbanger gets killed, which is pretty often, does anybody really care? Do you even care? Does Black Lives Matter care? Does the FBI rush in to help out? Nope, we all sort of figure it comes with the territory. UNLESS, the worthless drug dealer was shot by a white cop.

Unless I missed it, did they have physical evidence of the rape? Did the victim (hopefully) come forward immediately, so they were able to get his DNA? Why did they offer such an injustice of a plea deal? Was it because she did not come forward right away, and there wasn’t enough physical evidence to go to trial? Or was this just a case of outrageous injustice?
Much too lenient.
Sufficiency of evidence would be good to know before rushing to judgment, no? But am I the only one wondering here about, um,. you know…kidnap?
