48571119.cachedThere is a controversy in Alabama after prosecutors cut a plea agreement with an Alabama state trooper Samuel H. McHenry II, 36, who was accused of raping a woman and forcing her to perform oral sex after a bogus arrest in December 2015. For the crime, McHenry was allowed to plead to a simple misdemeanor for sexual misconduct and only six months in jail. [Warning: graphic content below]


The incident began after a woman called for help after a car accident. McHenry allegedly spotted some pill bottles and an empty nasal spray and threatened to arrest the woman. He placed her in a caged area in the back of his cruiser and drove to another area where her told her, “Fuck me or go to jail.” He allegedly pulled her pants down, raped her and afterward, forced her to perform oral sex. He then dumped her off in the parking lot of a closed store around 1:45 a.m. on Dec. 7.

What is particularly worrisome with the plea is that not only did he face charges of rape and sodomy but the dismissal of those charges (and plea to a misdemeanor) was done reportedly without the approval or consultation with the witness. Usually the victim is made part of this process.

McHenry refused to cooperate with giving a saliva sample after the incident.

In addition to giving up his certification for law enforcement, McHenry was required to pay a $500 fine and restitution for the heinous crime and was ordered not to contact the victim. That is clearly not enough for many critics who have questioned whether someone outside of law enforcement would have received such a plea bargain.

  1. Sufficiency of evidence. Is there evidence of rape besides her word and testimony? Such as: a witness, condom with his jiz in it, and or a photo of some sort from body camera or passerby.

  2. Before you guys throw the book at the prosecutor, understand that a lot of times a crappy plea deal is all they would realistically be able to get. For example maybe the witness became unavailable. That can happen for a lot of reasons that are not the government’s fault. And a sex conviction even a misdemeanor is going to mess him up for life, given the way the sex offender laws work now. Which is fine– he sounds like a horrible person and the public should at least be warned.

    Better the misdemeanor conviction than rolling the dice if there is a lack of evidence, and coming up short with an acquittal. Then he could continue to prey on people with no public brand on him.

  3. Cops regularly get away with murder, why not rape? Something is wrong when so many cops commit such crimes and get away with them. I would expect a certain number of people who see the badge and the gun as necessary for them to practice their misdeeds but there would be fewer of them seeking the badge and the gun if they were punished more harshly for using their position of authority while doing the misdeeds. Prosecutors should understand that sometimes the people need fair justice, not just the cop perp.

  8. Some of the comments here are, to put it frankly, disturbing. Allowing the police officer to plead to a misdemeanor in this case is an appalling miscarriage of Justice and sends the message that police officers can do anything thing they want and get away with it… One law for us and one law for them.
    It puts women at serious risk.

    The prosecutor’s decision to do this plea deal without consulting the victim raises all kinds of questions about which the public should be very concerned. There should be an investigation into the prosecutor’s conduct.

    Huh??? Maybe on Planet Libertarian it is a “violence free” way to make a living, but on Earth, it is a pretty unsafe occupation. Think about it. . .some chick is either getting in a car with, or taking to a motel room, a horny loser who has to pay to get laid. This, during the Tinder Age, no less! This “complex human interaction” is even potentially dangerous for the John, who may get knocked over the head and rolled for his wallet.

    One of my good friends for years is a Dominatrix, who started it in college to make extra money. She still “has sessions” with a few of her whatevers from those years. But even she had some situations that were dangerously too close for comfort. That is one reason she reduced her clientele to I think maybe 3 or 4 now. Maybe less. I haven’t talked to her in a few months.

  10. In a yearlong investigation of sexual misconduct by U.S. law enforcement, The Associated Press learned of about 1,000 officers who lost their badges in a six-year period for offenses including rape and propositioning citizens for sex while on duty.

    The figure includes only officers whose licenses have been revoked. Not all states take such action, maintain accurate records or have a statewide system to decertify officers for misconduct.

No news report mentions the woman’s profession.. But by all accounts.. Her calling for help after being in a car accident. Her profession does not seem to matter.. It is not like this cop picked the woman up on a street corner or anything. She was just in a car accident, and this seems to have simply been a crime of opportunity. It would not surprise me at all if other women had met similar fates at the hands of this particular person.

    Yes, the hooker deserves to be protected, but no, I am not as outraged as I would be if the victim weren’t a hooker. Why should I be? Am I supposed to pretend the hooker isn’t a person who will do all manner of disgusting sexual stuff with complete strangers for a few bucks?

    Sooo, some disgusting sexual stuff gets done to her without compensation, what’s the damages? Is it the $50 dollars she would have charged for a trip “Around The World?” She sure can’t claim there was any great emotional damage done to her. Heck, for a few bucks, or maybe a little dope, she would have gladly done it. She would have chased the guy down waving her purse in the air to get his attention to do it for a few bucks.

    OTOH, if the victim was a kindergarten teacher, happily engaged to her boyfriend, and somebody who goes to church every Sunday, Sunday night, and Wednesday night to Prayer Meeting, and the cop did this to her, that kind of thing could emotionally scar her for quite a few years.

    I don’t know where the silly idea came from that we aren’t supposed to notice things like this.

  14. It sounds as though there was a conflict of interest between the local Distrct Attorney’s office and local law enforcement. In such instances, the prosecution should have been handled by the state Attorney General. And I do not believe that it should matter whether or not the victim was a hooker. The cop is the one who committed the crime, not her.

    Doesn’t a hooker deserve to be protected from the violence of rape? A hooker trades with others voluntarily. As much as you might not agree with the activities of hookers and their willing clients, unless there is a John involved, it is a violence free way of making a living. Much different from the violence and theft that law enforcement utilizes on a daily basis to accomplish their normal agenda, and then we have scum like McHenry that take the violence to another level.

  17. She should sue! What a horrid, disgusting nightmare after calling for help, to get abused by someone in authority! She should sue the prosecution too!

  18. Let us talk about a fair punishment for any rapist. Forget the cop aspect. Come one, come all– cut the genitals off, stick them in his mouth, photograph him for posterity and send the photo to the victim and the mugshot section of the local newspaper. Then, some time in jail and monetary fine. As for civil suit. All he owns. Leave him his underwear. No shoes.
