State Lawsuit Against Police Officer Allegedly Assaulting 15 Year Old Girl Removed To Federal Court

monique-tillman-tacoma-mall-cameraIn May of this year, we reported a disturbing allegation of an unlawful use of force against a then fifteen-year-old girl by a Tacoma Police Officer working an off-duty assignment at a large shopping mall.

Originally filed in with the Pierce County Washington Superior Court, on September 19th the case was removed to the U.S. District Court of Western Washington.

Surveillance video shows what appears to be disturbing actions by a professional police officer used against a petite fifteen year old for alleged criminal acts against her that were later dismissed. Plaintiff alleges in her tort claim that race discrimination was a factor in the incident.


 

In May of 2014, plaintiff Monique Charlene Tillman and her brother claim earlier in the day they sold clothing to earn money to buy food. Afterward they biked through the Tacoma Mall parking lot on their way home. It was during this crossing that off-duty Tacoma Police Officer Jared Williams, who was working a paid detail for the mall and not on official assignment with the police department, stopped the siblings. The event is shown in the below video.

The lawsuit claims that after being stopped by Officer Williams, accompanied by three mall security guards, Monique began arguing and tried to ride away. During this stop, the lawsuit alleges that the teenagers where told they would be banned from mall property for creating a disturbance.

As Monique started to ride away, Officer Williams yanked her from her bicycle and aggressively arrested her, finishing the incident by firing a Taser at her.

Plaintiff alleges the stop was unlawful, but your author does not have information regarding the reasonable suspicion or probable cause stated by Officer Williams who charged Monique with Assault in the Fourth Degree claiming assault on the officer. Several months later a Pierce County Juvenile Court dismissed this charge. For the purposes of discussion, we will not discuss the reasonable suspicion alleged for stopping Monique or her brother. In my opinion it is really only tangent to the use of force engaged by Officer Williams. I do not consider his actions to be justified by whatever crime Monique could be accused. I believe the force used was facially unlawful.

In the amended complaint filed in State Court, and subsequently entered into the federal court’s record, Plaintiffs allege that TPD Officer Williams, “had [not] seen Plaintiffs engage in any criminal activity prior to Defendant Knaack and Defendant Williams stopping Plaintiffs,” and further allege, “Defendant Williams allegedly responded that Plaintiffs were causing a disturbance and were being “trespassed” from the Mall because of their disruptive behavior. Plaintiff Tillman responded that she believed was being harassed because of the color of her skin.”

Plaintiff states, and the video seems to support, that Officer Williams, “tossed Plaintiff Tillman around like a child’s doll, slamming her into parked vehicles, forcefully shoving his hand and forearm into her chest, grabbing her by the hair and body slamming her into the pavement. Once Defendant Williams had flung Plaintiff Tillman to the ground, he deployed his Taser, sending painful electric shocks through Plaintiff Tillman.

Plaintiff Branch [her brother] was horrified by Defendant Williams’ brutalization of his sister and attempted to come to her aid.

When Plaintiff Branch tried to help his sister, Defendant Williams ordered Plaintiff Branch to back off and pointed his Taser at him, threatening to deploy it.

Defendant Knaack either grabbed or shoved Plaintiff Branch to the ground
after Plaintiff Branch backed away from Defendant Williams.”

Plaintiffs generally allege Unlawful use of force, negligence in preventing excessive use of force and failure to upholding constitutional rights of persons in the community, Assault and Battery, intentional or reckless infliction of emotion distress, false imprisonment, malicious prosecution, section 1983 violation–excessive use of force and deliberate indifference, and violation of the Washington Civil Rights Act.

My personal analysis of the surveillance video cited in the complaint is as follows:

  • The video begins with Monique and her brother riding through the parking lot, followed by Officer Williams and the security guards.
  • 00:17 Personal contact is made with Monique who is upon her bicycle. She begins talking and directing his attention ahead with hand gestures probably indicating her destination as she passes through the parking lot.
  • 00:48 Officer Williams pulls a notebook from his shirt pocket, Most likely to begin writing information about the incident or Monique’s name.
  • 00:56 Monique leans forward, appearing to ride away. She has her right foot on the ground and her hands probably on the handlebars.
  • 00:57 Officer Williams, using both hands while still holding the notepad grasps her left arm and pulls her toward him. If Williams did not allow Monique to leave simply stepping forward and holding her back with a hand or grabbing the handlebar I am certain would have been sufficient to stop her from leaving. Preventing Monique from leaving an investigation would be lawful, provided in this case a minimal amount of force is used.
  • 00:58 Officer Williams pulls Monique from the bike quickly while attempting to put Monique to the ground using a Straight Arm Bar Takedown. Monique does not fall to the ground and stands. I believe pulling Monique from the bicycle in this manner is unnecessary and a reasonable action would be to have her dismount the bicycle and remain standing, or even ordering her to sit on the pavement. She was not given any opportunity to do so. An Arm Bar Takedown can cause minor injuries to a person upon striking pavement as it is common for the target of the takedown to suddenly fall to the ground. Used properly the takedown can be mitigated by holding the arm and setting the person down but this is not always successful. But, again, I do not believe it was necessary.
  • 00:59 Monique turns in a manner consistent with being spun around by Williams who is trying to restrain her. The two then go off camera. One of the security guards holds back her brother briefly.
  • 01:08 Monique is held to the black SUV, restrained by a palm to her chest. Monique appears to be holding onto Officer Williams’ left forearm.
  • 01:24 Officer Williams attempts to put Monique’s right arm behind her back to cuff her but this does not happen. Instead, Williams spins her around and walks her to the from of the vehicle where he again pushes her into the SUV, probably in another attempt to handcuff her.
  • 01:29 After another unsuccessful attempt to put Monique onto the ground, and she stands, Officer Williams grabs her by the back of the head using a hair-hold while using a wrist clench.
  • 01:32 Officer Williams strongly yanks Monique, by the hair, to the sidewalk. Given the hardness of the ground, the physical size of Monique compared with Officer Williams, his strength, and training, and the fact that this incident was a minor violation at best, lesser means should have been employed. Officers are permitted by state law and common law to exercise reasonable force to overcome resistance, which defendants are likely to argue. However reasonableness is by both forms of law mandated.
  • 01:38 Williams straddles Monique and draws a Taser.
  • 01:40 Officer Williams shoots Monique with the darts of his Taser as evidenced by her clenching and the reflection of a wire in the video. He then holds his Taser while standing above her. In my view there was no reason to deploy a Taser against Monique given that she was on the ground and could have been cuffed with little difficulty. In fact, she was where Williams wanted her to be given that he used Straight Arm Bar Takedowns before. He was already standing above her and unless she displayed a weapon, which there is no evidence this occurred, the Taser use was excessive.
  • 01:53 One of the security guards comes forward and handcuffs Monique while Williams stands over her, holding the Taser. She remains on the sidewalk at least until the video ends.

While the complaint alleges that race was a factor in defendant’s alleged assault against the plaintiffs, I personally believe this is likely the least provable fact and no evidence to support this claim was proffered by Plaintiffs in the amended complaint other than mentioning that the “color of her skin” elicited the unlawful actions by Defendants. If however it is so proven, it would not only satisfy the Section 1983 race/color elements but greatly increase, obviously, the damages.

I do however feel this case has strong merit; sufficient enough to warrant a settlement offer by Defendants.

And, as I have mentioned repeatedly in the past, this is yet another shining example of how such small things can mushroom into a protracted controversy that is very costly to officers choosing to clamp down when it is not necessary. Those in authority need to understand that simply looking the other way on stuff that does not matter is often the best course of action. It is not worth it to anyone.

  1. Working off Darren’s description of the event alone, she was resisting arrest. She would be in juvie in Arizona.

    1. She might deserve to be in juvie. Who knows what her ‘rap sheet’ looks like. But, Paul, with your 150+IQ, tell us if it would still be OK to slam her around like that? If your answer is yes, then the next step is just shooting her because the officer thought she might have a gun, hidden somewhere. Of course you might just take refuge in your typical contrarian for contrarian’s sake refuge, but give it a try.

      These two videos illustrate diametrically opposed attitudes of the responsibilities of being a cop. In the one, perhaps because there were so many other cops and firemen there along with citizens or perhaps better training, the out of control brat was treated with kid gloves. In the other an out of control cop erupted on a teenager for what could only be at its worst, disrespect. In one incident the cops should be commended. In the other the cop should be fired.

      Those who can’t differentiate between the two are part of the problem, the extremes, those that contribute to the chaos and mayhem.

      1. issac – my guess, and it is a guess, is that she said something that hit a hot button with the officer. Police are held to a higher standard, however there is a limit they have to put up with. There was a failure to communicate and the officer was getting the young woman’s attention. I do not generally agree with his tactics, however I was not there and do not know what was said to aggravate the situation. Is that contrary enough for you?

        1. The point is that nothing ‘said’ should result in a cop losing it like that. France lost the world cup over a smart remark from an Italian. Zidane responded to a typical taunt physically and his replacement missed the kick. Here the cop diminished his profession and should be benched. Nothing anyone says should result in a physical assault from anybody, let alone a cop. If another person had done that to her, regardless of what she said, they would be slammed legally both publicly and privately. This cop’s bar is way to low for his profession. And no, your contrarian response is lame, not indicative of a 150+ IQ.

              Common law varies from place to place and from time to time. In this time and the place where the girl who hit the car with her bike, the police acted properly. The girl was a teenage, poorly raised, disrespectful, brat and the police treated her as such, a brat that presented no danger to anyone but herself. The way the police performed is a benchmark for proper procedure. The girl and her lack of respect exists in all cultures and times. Cops everywhere deal with this. Watch ‘West Side Story’ to see how street kids talked to cops. Growing up we were no different and the cops just laughed it off as they remembered their youth.

              The cop at the mall was simply out of control and not performing as the police should. Any other interpretation including extenuating circumstances under pseudo legal gibberish such as ‘fighting words’ and ‘common law’, leads one to believe that the person doing the interpreting probably has no where near a 150+IQ; probably not even breaking 100. Your comments deny you credibility as someone with a high IQ as well as an inventive contrarian. You really fell flat on this one. I would quit while I am no further behind if I were you. G’nite.

In one instance the kid was treated exactly as she presented herself, a mouthy little brat of no threat to anyone but herself. In the other the kid was assaulted by an out of control Nazi cop.     Also time to start doing random searches of their vehicles for throw-down weapons.

  4. Can someone tell me what the ratio is of police violating the rights of blacks vs blacks violating the rights of others? I noticed how a white supporter was beaten by 8 blacks that was on the news for 5 secs, the supporter shot in the head (no rubber bullets used), the black guy shot water he’s lawn by a black on a bike for his wallet.

    The news carried it all for about 5 seconds guess it don’t fit the narrative.

          It doesn’t matter what civilians do. Period. It is NEVER OK for the police to harass, murder, rape, assault, or otherwise abuse the public. They’ve been doing it for a hundred years in black and poor neighborhoods. The only difference now is that people have cameras so we’re starting to see the proof.

          As I said, the job is not for everyone. If you don’t have the temperament to be a GOOD police officer, go find another job. These bullies and steroid junkies give a bad name to every good cop on the line.

          And furthermore, police deaths in the line of duty are the lowest they’ve been in more than 30 years. Smoke that.

  5. One of the first places my kid and their friends went to on the ‘a little further from the neighborhood’ adventure, was the local mall. They either biked or skateboarded and ‘hung around’. The only difference here is the girl does not recognize the authority of the police and/or the security guards. In attempting to leave she is disrespecting the cop. Malls do have problems with kids cutting through and stressing out old people who are trying to maneuver their Escalades.

    However, this cop is not in control of himself and should not be a police officer. Ms From presented a video of another incident where the kid broke the law, did damage, and totally flipped out. How the police officers handled the girl who damaged the car was exemplary. The girl was a spoiled brat who, perhaps, couldn’t control herself. The police detained the freaking out brat with substantial care. One cop per arm is all that is necessary. When you weigh three times the kid, there is no need for a taser. In the mall incident, simple holding the bike would have been the appropriate first move. The immediate grabbing of the girl and tossing her around illustrates clearly that the police officer was out of control and not an appropriate person for the job. He exploded into action that was totally unnecessary. Perhaps it is working two jobs that contributes to a stress level or whatever. The bottom line is that there was no threat from the kids in both videos. In one the kid was treated as a spoiled and disrespectful brat, but with care and attention; in the other the kid was treated as a violent and dangerous criminal.

    In this society where the police are allowed to determine what is and what is not a threat and to use lethal force resulting from a ‘judgement call’ alone, there has to be some balance in the realm of common sense and self control. Police officers need more training, more scrutiny, and above all need to understand that they are there to protect and serve and if a teenager shows disrespect that doesn’t justify this sort of treatment. Juveniles have always been lipping off and disrespecting authority. This cop acted like a Nazi.

    Unfortunately the police have to deal with those who are unreasonably critical as well as those that back them up even when they are wrong. That is why we have the courts. Hopefully this officer will lose his job and end up where he should be, a mall cop, if he is lucky, and if he passes a psychological scrutiny. He has no business being a cop. There simply have to be better prospects out there.

    I have friends whose kids are cops, friends who are cops, and have only heard how hard it is to become a cop, how discriminating the forces are, etc. Perhaps they have to discriminate more and be ever more vigilant. You don’t taser a teenage girl on the ground who you have just yanked off of her bike and slammed around for a while, against parked cars and onto the ground. Society does not need this guy protecting it.

  9. All of these incidents could have been avoided had the teen simply complied with the officer’s directions. My parents always told me to comply with the cop’s orders, even if he is being a jerk, you can file a complaint later, but at the time you are dealing with him on the street you have to cooperate. Maybe these black kids are never raised to be cooperative and respectful, or maybe being unruly and belligerent is just their nature. I really can’t imagine fighting a cop when I was 15! It would have never even entered my mind to be so bold.

As the man reached into his car to get his wallet he was shot.

      I think that motorist was giving complete compliance of the officers direction and he was shot. Or, wasn’t the incident I just described one of “these incidents”?

Get a call man with a gun, put lights and siren on and get there nice and easy. Guy has a gun drive away. Stay out of all the neighborhoods where crime is the highest. Kids going into Mall lots stealing from cars take a report.

    You cannot perform a police job when no matter what you do your wrong. Let the public see what it’s like when cops back off and give them just what they want. Let the libs in the burbs feel the pain.

          Prejudice against blacks hasn’t gone away. It just went underground after the civil rights era because it was no longer okay to tar, feather, and lynch black people and you might actually go to jail for doing it. And people were less likely to say “n******” or complain about integration, at least in public. But the anonymity of the internet [you can say nasty stuff without consequence], the election of Obama [how dare a black man become president!] and the emergence of Trump has allowed racism to come out of the shadows and emerge full blown again.

          Of course, racism is not limited to just one ethnic group, political party, etc. And it should be called out when it occurs. However, right now, the brightest light is shining on Trump and some of his supporters, and it is loathesome and ugly.

            The practice of lynching went into rapid decline after about 1893. The frequency of lynchings declined by about 2/3 between 1920 and 1935 in spite of the popularity of the 2d incarnation of the Klan in the 1920s. The last bloc lynching occurred in Georgia in 1946 and there were a scatter between 1946 and 1959, with the last occurring in Mississippi in 1959. The ‘civil rights era’ was not coincident with the demise of lynching. Lynching had disappeared earlier. Regarding blacks, it was always a Deep South phenomenon; it was rare anywhere else.

            If it helps you feel better, I suppose it is harmless enough, but the notion that BOs critics are incensed by this Uppity Negro cannot survive reading the actual critiques of his person and administration. Leftoids cannot deal with the opposition they deal with caricatures.

            While we’re at it, Obama’s connection to the domestic black population is that he married into it. There is a modest population of blacks in Honolulu. There is no ‘black community’ in Honolulu. He had no proximity to the domestic black population until he enrolled at Columbia in 1981. At a later point, he and Mooch lived in a section of Chicago proximate to the University that is just this side of a gated community. Their circle of friends among Chicago’s blacks was small – a handful of couples drawn from mulattish old-money (e.g. Eric Whittaker and Valerie Jarrett). Other than his mother-in-law, BO has scant history with rank-and-file blacks.

        2. So according to you shut your mouth and forget the rule of law and MY right to speak up. Let me know how that works out for you when you need the police and they take their sweet time getting to your wife who is being attacked in the Mall lot.

          1. Nope, I love free speech and am okay with people saying whatever they want, including racist comments. I was simply saying that racism is alive and well and more visible than ever. Just because it’s repugnant and ugly doesn’t mean I want anyone to shut up.

    Investigation of exactly what? Riding a bike while black? How and why does the author arbitrarily eliminate from discussion that the defendant, to reader’s knowledge, apparently did not witness nor hear report of any real or potential crime?

    It’s rather offensive to readers for the author to make unsubstantiated claim (“an investigation” of apparently nothing) then prohibit conversation of the claim.
